PLEASE TAKE NOTICE that the Zoning Board of Appeals of
the Village of North Tarrytown will hold a Public Hearing on
November 6, 1963, at 8:00 P.M. in the Municipal Building, 28 Beekman
Avenue, North Tarrytown, N.Y. , to consider the following application
for a variance from the provisions of the Zoning Ordinance of the
Village of North Tarrytown::
The application of Julius and Maria Suchy for a variance
from the provisions of Section 9 - Setback Building Lines - and
for permission to construct a one family dwelling which shall be set
back five (5) feet from the northerly side property line on property
known and designated on the tax map of the Village of North Tarrytown
as Section 17, Block 15, Lots 1 and 2 located on the westerly side of
Anderson Avenue and on the southerly side of Tappan Avenue.

A t a recent meeting of the Board, M r . Hanson of the State Department of Commerce
p o i n t e d out the necessity o f adopting subdivision controls f o r the V i l l a g e . A l t h o u g h the
Planning Board may consider such proposed r e g u l a t i o n s , they cannot be a d o p t e d o f f i c i a l l y
u n t i l t h e Board of Trustees grants to the Planning Board the s p e c i f i c powers r e q u i r e d . Then,
f o l l o w i n g the a d o p t i o n of such regulations by the Planning Board, the Board of Trustees must
a c t a g a i n , to approve the regulations, before they c a n be put i n t o e f f e c t .
In order to start the wheels t u r n i n g , we have drafted the a t t a c h e d document f o r
consideration by the Corporation Counsel and the Board of Trustees. As here presented, it
w o u l d confer upon the Planning Board the f u l l gamut of powers in c o n n e c t i o n w i t h r e v i e w
o f subdivision that are provided In V i l l a g e L a w . These i n c l u d e :
1 0 The power to review a n d approve the subdivision of new l a n d ;
2 . The poia/er to r e v i e w a n d revise previously f i l e d subdivision p l a t s , f o r land
w h i c h may be w h o l l y or p a r t i a l l y d e v e l o p e d ;
3 . The power to modify the requirements of the z o n i n g o r d i n a n c e when passing
on a p a r t i c u l a r p l a t .
This l a t t e r is a most important power not only in connection with pure subdivision a c t i v i t y ,
b u t a l s o , as we have proposed in the draft of the zoning o r d i n a n c e , in c o n n e c t i o n w i t h the
a d o p t i o n of the required Urban Renewal Plan as required by law f o r any urban renewal project
t h a t the V i l l a g e may undertake.

the control of land subdivision is an essential means of g u i d i n g the future

Tarrytown is granted the power to r e v i e w and approve new subdivisions
of land w i t h i n the V i l l a g e consistent w i t h the requirements of A r t i c l e V l - A

Be i t further RESOLVED, that the said Planning Board is a u t h o r i z e d and empowered t o
review and approve previously f i l e d subdivision plats c o v e r i n g land in the
V i l l a g e of N o r t h Tarrytown w h i c h are w h o l l y or p a r t i a l l y u n d e v e l o p e d , as

1. Present zoning ordinances, the need for revision of same, publication
cost, etc. and procedure in bringing about such a revision;.goalbringing them up to date.
Also, the adoption of Subdivision Regulations.
2. The submission of the amended contract, to be signed by Mayor Galganoa reminder that the above signed contract granting an extension be
signed, one kept, six returned.
Discussion of 3. Organization of the Planning Board, equipping members to take
official action and a grant of power for Planning Board with agreement
by trustees.
U. Recommendation-a request for funds to be allocated for Planning Board,
5. A review and compilation of all contracts of the former Planning
Boards of the Village; continuity of Program.
6. A continuing of the Planning Program(a) Neighborhood Renewal - Program for the area south of Beekman Ave.
7. Recommendation Looking to the future-budget items to be considered.
