Dear Sir:
In reference to your letter dated January 11th,
1963, a special meeting of the Planning Board was held on
February 8th, 1968 at 8 P.M. in the village board room,
at 28 Beekman Avenue, North Tarry town, New York to hear
your presentation requesting to change part of your land
in Zone R-3, single residence, to multi-family residence
and to permit an apartment building to be erected on that
site as shown on your drawings as presented.
Upon inspection of the site and drawings, and
after due deliberation.
The Planning Board will not recommend that a
remnant portion of your land be zoned from R-3 single
family residency to multi-family residency.
A change from one family residency to multi-family
residency would be spot zoning, favoring one property
owner in a R-3 one family zone.
However, this portion of land may be subdivided into
lot for one family residency as per schedule of regulations
in Section 62-8B-R-3 District and as per Subdivision
Regulations of the Village of North Tarrytown, N.Y.

                    <text>The Planning Board of North Tarrytown has considered the request by the
Board of Trustees for an opinion as tb the d e s i r a b i l i t y of an amendment
to A r t i c l e V, Section 62-14 of the Zoning Ordinance in order t o provide .
r e l i e f in connection with o f f - s t r e e t parking requirements in the commercial
Districts •
I t i s the feeling of the Planning Board that an amendment to Section 62-14
for this purpose, would be detrimental to the long range objectives of
Villa&amp;o planning.
In the revision of the Village Zoning Ordinance several years ago, the
problems of Village growth were reviewed at groat length by the Board*
It was the consensus that because of i t s physical layout tha-t the g r e a t e s t
obstacle to a continuing and profitable p;rov;th of business in the Village
would be the problem of traffio congestion*
".Vith competing shopping oenters within a few miles of the Village offering
almost unlimited parking space, i t appears l i k e l y t h a t as traffio volume
increases over the years, the convenience of ample parking f a c i l i t i e s ' a n d
less t r a f f i c congestion w i l l become increasingly important to the suocess
of our businesses*
Unless we keep pace by reducing congestion and improving parking, the Village
is bound to suffer a gradual loss of business* As the years go by, the
younger people who do not share the local l o y a l t i e s of t h i s and e a r l i e r
»eii6re.tions w i l l be less inclined to r i g h t t r a f f i o and t h e lack of parking
in order to shop in the Village. Article V, Section 62-14 i s intended to
prevent "this l o s s of business*
A second and equally important objection is the fact that
to an unpopular provision of the Zoning Ordinanoe quiokly
knowledge and often signals the f i r s t step i n the erosion
has been carefully worked out to achieve i t s objective of
future welfare of the Village*

SECTION 62-19-1
Bars, taverns, restaurants, clubs or places where
alcoholic beverages are sold for consumption on the premises.

LOCATION
No portion of the property used for a bar, tavern

restaurant, club or places where alcoholic beverages are sold
for consumption on the premises, shall lie within 250 feet in a'
straight line from any lot or parcel that is used for a public or
private school, a public library, a museum, a civic center, a
hospital, a church or other place of worship, a public park or
playground, a fire station, or another bar, tavern, restaurant,
club or place where alcoholic beverages are sold for consumption

Gentlemen:
The Planning Board of the Village of North Tarrytown
at a Special Meeting held on September 26th, 1968 at the Village
Hall at 8 P.M. upon the request of the Mayor, in reference to
a letter from law offices of Costello, Ward, TJrabasso and Shea
to the Mayor dated August 28th, 1968 to consider the request
to change the Village Zoning Ordinance to include Factory and
Manufacturing uses for the Strand Theatre Building on Beekman
Avenue to manufacture and assembly of dresses.
Upon due deliberation and discussion the Planning
Board voted and ruled unanimously that a change in Zoning should
not be made to allow a factory for the manufacture and assembly
of dresses in the C-2 General Commercial District where such
uses is not permitted as per Section 62-8B-C-2-1-2.
1. Such change would be contrary to our comprehensive
development plan which was instituted in 1964 due to the requirements of the Urban Renewal Development Contract. The comprehensive development plan took two years to formulate with the
cooperation of the New York State Department of Commerce in
studies, inspections and public hearings, and at a cost of
$24,000 of which the Village share was one-third of the cost.

2. In our comprehensive plan, provision has been
made in our "M" District "Manufacturing" where such fabrication and assembly is permitted.
3. To grant this request would be "spot zoning"
favoring one parcel or lot against the entire C-2 General
Commercial District.
4. The existing building is non-conforming and
at present occupies 95% of the plot area.
5. The existing traffic situation on Beekman Avenue
must be considered.
6. A factory has employees and there are no provisions
for off-street parking for the employees on the site.
The contention that the applicant could lease 25
parking spaces in the Van Tassel Garage is not feasible since
the Van Tassel garage was built for the use of the tenants of
the Van Tassel Apartment house. Such a transaction would not
be permanent and also would force the tenants of the Van Tassel
apartments to park in the street.
7• A factory must have an area for loading and unloading
its materials and products. No such area is available on the lot.
The contention that loading and unloading would be
done in the late night hours is not feasible since the Chevrolet
plants night shift congest Beekman Avenue from 1 A.M. to 3 A.M.
and any later loading or unloading would disturb the tenants
in that area.
