The Planning Board has reviewed your request for relief from
the strict compliance of the planning regulations as outlined in your
letter of July 2, 1979. Mtfoough the Board agrees that a simple
subdivision does not warrant strict adherence to the regulations, however,
I must point out that these measures are instituted for the protection of
the applicant, as well as the Village. I have been in contact with the
County Planning Department and they have confirmed these views.
At this time, I would invite you to submit your preliminary plat
using as a guideline Article III, paragraph 6 and Article IV, paragraph 10
as found in the Village Subdivision Regulations.

I am writing to you one more time in your capacity
as secretary of the North Tarrytown Planning Board to
demand that you make available immediately to me' as
chairman, to the other members of the Planning Board,
and to the Village Clerk for public inspection:
1. The minutes that you took of the July 14, 1977,
Planning Board meeting that I convened and over
which I presided,
2. The minutes of the illegal meeting that you
convened, apparently sometime in June, without
notification to me as chairman and without my
in fact knowing about it or being present,
and at which you discussed with Douglas D'Arpino
his desire to create a building lot on Highland
Avenue^
3. Any and all papers, letters, plans, submitted
to you by D'Arpino, including those prompting
you to call the illegal meeting.
I cannot understand why you persist in denying me
these documents and in not responding to my letters. I
expect you to make available all the documents I have
indicated not later than the close of business, Friday,
