Chairman Galgano called the meeting to order at 8:15 P.M. He then read the
Public Notice of tonight's hearing to all present. This hearing was to review an
application of Mr. Thomas Kennedy for a proposed subdivision of property owned by
George and Audrey Runtz located at the intersection of Bellwood and Farrington
Avenues in North Tarry town, N.Y.
Mr. Kennedy was asked if he would like to address the Board and explain his
possible building plans. Mr. Kennedy said should the subdivision be granted, he
would have 27,000 sq. ft. available and would like to build two one-family houses
on the aforementioned property. His purchase of said property from Mr. &amp; Mrs. Kuntz
would depend upon the Planning Board's decision.
Mr. Kennedy showed the possible building plans to Board members. It was noted
that the side and front yard setback requirements met regulations as set forth in
the Zoning Board regulations. But it was noted that the backyard showed a distance
of 18 ft. between the back of the house and the proj&amp;ety lines, where a 25 ft. distance is required. Mr. Windas said this would be an issue for the Zoning Board, as
it appeared and variance would be needed. He also noted that the Planning Board
cannot make a non-complying agreement.
Dr. Salman noted that other building plans had been redesigned to fit the 25'
backyard setback requirement.
Chairman Galgano said he felt the property could be sub-divided, and that the
Zoning Board would vote on whether or not to grant the variance.
It was then noted that the Planning Board regulations say to follow the guidelines as found in the Zoning Board code, Section 62-24, which state that the average
setback distance for the rear of a property can not be less than half the required
distance. In this case the required distance is 25 ft. thus 12% ft., half the
required distance; would be satisfied by Mr. Kennedy's plans showing 18 ft. in the
back.
Mr. Windas reconmended that the Planning Board move on to the next stage of
subdividing property.
Chairman Galgano felt that due to lack of information on rear yard setback
requirements, another public hearing would be in the Board's best interest.
A motion to move the hearing to a second state was made by Dr. Salman, seconded by Mr. Windas, and was carried by a unanimous vote.

Building Inspector Biros did note that Mr. Kennedy cannot offer a non-conforming subdivision of property.
Chairman Galgano said all parties will be informed by mail of the second stage
hearing as soon as a date is established.
Chairman Galgano told involved parties that all property owners within 200 ft.
of the property being discussed must be notified by registered mail of the request
for subdividing the Kuntz property. Article III states "the owner of any land
proposed to be sub-divided shall apply for and secure approval of such subdibision
prior to entering into any contract for the sale of any part thereof, and prior to
applying for subdivision".
Chairman Galgano said there could be no further business until such information is obtained and a second stage hearing held.
Dr. Salman then moved to
close tonight's hearing, which was seconded by Mr. Fey, and the motion was carried
by a unanimous vote. Chairman Galgano dismissed the meeting at 8:50 P.M.

Mr. Galgano opened the meeting at 8:05 and read the Public Notice
and welcomed those attending; he welcomed questions from those in
attendance.
Receipts from Post Office were presented to the Clerk by
Mr. Kennedy, builder, indicating that nineteen neighbors had
received notice of request for subdivision and had no objection
to subdivision of property in question.
Mr. Pat Shafer, 124 Hunter Avenue, requested a copy of the plans.
Mr. Louis Tonelli, 10 Farrington Avenue, asked why the Public
Hearing was being held and he was informed of the request for a
subdivision and the fact that the public deserved an opportunity
to express their views on the subdivision. Mr. Tonelli questioned
whether or not there is enough property to build on if the land
is subdivided and he was assured that there is.
Mr. Windas explained the requirements that must be met in order
to grant a subdivision.
The Board was questioned again by Mr. Shafer as to whether a
garage will be built and where it will be situated.
Mr. Galgano asked if there were any comments from those residents
looking at the map.
Mr. William Kr&amp;t»*k, 3 Farrington Avenue asked how property will
be tied into the existing sewer system and if the water pressure
was checked. Mr. Kennedy informed him the sewer would be connected
off Farrington Avenue and Mr. Biros informed him that the water
pressure is. high in this area and should not be cause for a problem.
(Mr. KjfefSrK^'advised that his water pressure is very low and
Mr. Biros advised him to have his regulator adjusted. Mr. Salman
questioned if the Village Water Dept. would do this and Mr. Biros
answered, "No". )
Mr. Shafer wished to be assured that there are no zoning violations on this subdivision and he was assured there are none.
At this time Mr. Galgano asked for comments from the Board; there
were none.
Mr. Windas moved to close the Public Hearing; motion was seconded
and all members voted in favor. Public Hearing closed at 8:30 p.m.

Work session - 8:35 p.m.
Mr. Galgano opened the work session with the request for members'
opinions on subdivision.
After a ten-minute discussion among Board members, Mr. Windas
said that as long as this subdivision meets with all requirements,
and it appears that it does, and assuming the Health Department
approves, he is in favor of granting the request for subdivision.
Mr. Galgano recommended screening along the Bellwood Avenue side
of the lot which would extend 100 ft.
All other Board members approved granting request for subdivision.
Mr. J. Ruscigno made a motion to approve subdivision; seconded by
Mr. F. Rey. Board was polled and were all in favor.
Formal resolution will be filed with the Clerk.
Mr. J. Ruscigno moved to adjourn at 9 p.m. and motion was
seconded by Mr. S. Salman.

The North Tarrytown Planning Board held a public hearing on
June 5, 1984 to approve or disapprove aDplications being sought,
one by Joaquim Pastilha of 9 Pleasant St., No. Tarrytown, and one
by Sebastian and Caroline Amenta of 395 Scarborough Road, Briarcliff Manor.
Chairman Galgano called the meeting to order at 8:00 P.M. ,
and then read the first public notice to all oresent. This
hearing was to approve or disapprove the site plan of Mr. &amp; Mrs.
Amenta for off-street parking nursuant to Section 62-29 of the
Zoning Code on their property located at 239-41 No. Broadway in
No. Tarrytown.
Chairman Galgano said the Village Attorney had recommended
tonight's hearing. He said approval could be granted provided
that the Amentas show that any water drainage from the parkways
of their property will go to the road, and not drain onto the
lot's adjacent properties,
Mr. and Mrs, Amenta assured the Board that such means had
been taken care of with the design of the lot. Sets of drawings
with plans for drainage to the street where shown to Board members.
A motion to grant approval for the off-street parking plan
was made by Mr. Ruscigno, seconded by Mr, Windas, and was unanim
ously passed.
Chairman Galgano then read the public notice to all for the
purpose to approve or disapprove Joaquim Pastilha's application
for a sub-division of property located at 41 Gordon Avenue,
No. Tarrytown.
Mr. Samuel Vieira of 40 Church Street, Tarrytown, the future
constructor of a proposed house on the property for which a subdivision is being sought, introduced himself to the Board and explained he was appearing on behalf of Mr. Pastilha.
Building Inspector Margotta noted that the proposed construction would have the proper setbacks and sidelines, and that

Mr. Pastilha was simply seeking a sub-division of property.
Mr. Windas asked what the numbers 305 and 306 on the plan
represented. Mr. Margotta replied, saying those numbers were
the pivoting property lines. Some of the lots of said property
would have to be combined to form a building lot.
Mr. Margotta explained that the zoning allows for a total of
12 feet on. the sides. Mr. Pastilha1s front property measures
20 feet, the rear is 25 feet, and the 12 feet allowed for the two
sidelines combined are allowed in the zoning code for where Mr.
Pastilha's property is located. The maximum land coverage by a
building is 35% of said land.
Mr. Windas asked if there was a severe bank in the back of
the property. Chairman Galgano said there was such a bank. Mr.
Windas then asked if the Board sees a need for any improvements
on the property before a sub-division could be granted-improvements such as excavation of the hill in the back of the property,
or drainage.
It was noted that retaining walls would be installed to help
with the drainage.
Attorney Arthur Litt said he interpreted "improvements" to
mean those of roads and/or sewers for a general area, not a
particular lot.
Building Inspector Margotta said some improvements would
have to be approved by John Biros, head of the Village's Department
of Water.
Mr. Windas asked how many parking spaces are needed for the
proposed structure. Mr. Margotta said a two-family house needs
two parking spaces, and a multi-family house needs 1.2 parking
spaces per dwelling unit.
Chairman Galgano asked if the setbacks and sidebacks, and
the 357o maximum land coverage of a lot for a house were all in
proper order. If so, he said he saw the Board as having the power
to suspend the regulations as presently found in the village code
for this case of a simple sub-division. At present, there are two
lots of Mr. Pastilha's on the village tax map, and only a portion
of one lot is being sought to be changed over to the other lot.
Mr. Windas expressed his concern that a non-conforming
building might be designed at the newly proposed property line.
It was noted that a corrugated plastic roof is planned to be
attached to the permanent wall, still leaving 5 feet to the property
line, which would be in line with regulations.
Chairman Galgano said the property with the building is nonconforming whether or not the property is sub-divided. He asked the
Board members for their thoughts.

�Mr. Windas questioned whether the sub-division rules as
such were being applied. If the Board is creating a non-conforming
situation by not having 12 feet between the two structures, how can
the sub-division ruling be applied?
Mr. Vieira explained that the final house may not end up
exactly as it appears on the map, and that the 12 feet sideline
requirement might well not be an issue. He said Mr. Pastilha is
only asking for a sub-division.
Mr. Windas said the Board must see that a lot has proper
water, sewage, street lighting, trees, electricity and telephone
wire access, and proper drainage. Even if excavation should occur
on only one lot, and retaining walls are put in, the Board must
take into consideration what impact this could have on other lots.
Mr. Litt said to the Board that a sub-division is a division
of any parcel of land for building purposes, whether or not the
construction takes place now or in the future.
Chairman Galgano asked if anyone wished to entertain a motion.
Mr. Rey asked Village attorney Brady if an uncovered walkway
affects a building?s setback and the required distance,, Mr. Brady
said such an uncovered walkx\7ay has nothing to do with the setback
of a building,
A motion to grant the sub-division of property to Mr, Pastilha
was made by Mr. Ruscigno and seconded by Mr. Dool. Mr. Rey voted
in the affirmative, but with reservations regarding the retention
wall and reinforcement so that the rear property line would preserve the adjacent properties, and that proper drainage consideration be taken into account. Mr. Windas, agreeing with Mr. Rey's
stipulations, voted in the affirmative, The vote was unanimous,
and the motion granted.
A motion to adjourn tonight's hearing was made by Mr, Ruscigno
and seconded by Mr. Windas, and unanimously carried. Chairman
Galgano declared the hearing adjourned at 8:50 P.M,

development of uses that are identical to those previously permitted, in that the action did not provide
for any change of zone, or approval of site plan;

and

WHEREAS, the property contains no structure or
area that is listed or eligible to be listed on the
Federal Register of Historic Places or designated by
the local Historic Architectural Review Board as an
historic landmark or district and the said subdivision
complies with all regional, state and local land use
plans;

�NOW, THEREFORE BE IT RESOLVED:
1.

The subdivision of the property as above

described is an unlisted action pursuant to Article
8 of the Environmental Conservation Law and Part 617
of the Rules and Regulations promulgated thereunder,
and will, in and of itself, not have a significant
effect on the environment, so that no Environmental
Impact Statement is required or need be filled
therefor.
2.

Nothing herein contained, however, shall

be deemed to indicate or suggest that subsequent
submissions for development of the property will
not requirer the preparation and filing of Environmental Impact Statements.
3.

This resolution is a Negative Declaration

for the purposes of Article 8 of.the Environmental
Conservation Law, Local Law Environmental Quality
Review Act for the Village of North Tarrytown, and
will be kept on file at the Village Hall and be

PLEASE TAKE NOTICE that the Planning Board of the Village
of North Tarrytown will hold a Public Hearing on Wednesday,
October 10, 1984, at 8:00 P.M. in the Municipal Building, 28 Beekman
Avenue, North Tarrytown, N.Y. for the purpose of approving or
disapproving the application of Vincent and Grace Buonanno and
Charles and Joan Shibetti for a subdivision of property owned by
William Jorgensen, 18 Dell Street, North Tarrytown, N.Y. also
known and designated on Village Tax Assessment Map as Section 17,
Block 1, Lots 7 &amp; 12.
All taxpayers, residents are entitled to appear and be heard

Public Hearing was called to order at 8:10 p.m. to consider the request for
a subdivision of the property at 18 Dell Street.
Joan Shibetti, 7 Mahoney Place, N. Tarrytown, N. Y., represented by
Janet Gandolfo, Attorney, was asked if there was anything she wished to say
to the Board.

are requesting this subdivision.]
Miss Gandolfo presented maps of the property in question to the members of
the Planning Board.
After a discussion on whether or not the piece of property on the north side
of Dell Street was part of the larger parcel on the south s*ide of Dell Street,
Council Walsh advised the Board he will look into the question of whether
the lots should be merged and then subdivided.
Raymond Windas said that if the property line dividing this parcel of land
in half were moved to the east by 6" it would solve the problem and there
would then be two conforming building lots.

Mr. Windas informed the Board

of the history of the division of property along Dell Street over the years.
James Galgano advised that it has been determined that these two lots
are two separate lots and we cannot merge them.

He recommended that we

allow the subdivision.
Miss Gandolfo questioned whether the Town of Mount Pleasant and the County
of Westchester treat these lots as the Village of North Tarrytown does.
Jaraes Margotta, Building Inspector, is familiar with the property in question
and approves of the subdivision.

James Galgano also has no objection to the

subdivision.
Council Walsh recommends approval of subdivision after the Building Inspector
receives a map showing the division of the lots into two conforming building

lots.

�Raymorld Windas made the motion that the Planning Board approve this
subdivision contingent upon corrected map being presented indicating
that each lot is a conforming building lot.

Frany Rey explained that he f e l t the Planning Board often seems to be
hindering rather than assisting on subdivisions.
Raymond Windas informed "the 'Board 'that he feels there should be an
amendment to the Board's regulations on subdivisions making them more
simplified.
