The Planning Board met on September 5 to consider the application of
Mr. Salvatore Donzella.

Previous to the reading of the Public Notice regarding

Mr. Donzella's application, Mr. Ponzini advised the Board that the Public Hearing
part of the E. Jacobsen application is closed, however, he noted that there is
a report at this time from the respective engineers.

Mr. M. Karamouz and

Mr. A. Paese met at Village Hall on Wednesday, September 4; they do not agree
on the matter of drainage or underground water and, therefore, we have the
authority of the Board of Trustees to expend the money to retain a third party
consulting engineer for the Village to ascertain whether or not the application
should be granted and if it would be in the best interest of all concerned.
Mr. Ponzini indicated that within two weeks we should have a report and then
be able to make a decision.

The attorneys agreed to this.

Keller and Federico

are the consulting engineers to be retained by the Village.
The Public Notice regarding Mr. Donzella1s application was read and Mr. Donzella
advised the Board that he wished to have their approval tonight on the subdivision of his property at 138 Valley Street.

He is requesting that two parcels

be made into one and he has presented plans showing new property line.

This

property was and is still nonconforming.
After the Board members reviewed Mr. Donzella"s plans, Mr. Windas made a motion
to approve this application and it was seconded by Mr. Rey.

Public hearing

was closed at 8:10.
Business meeting followed:

Mr. Donzella explained where property line will be

so the necessary maps can be drawn showing property as it is proposed in the
application.

Maps should be presented to the Planning Board, the Department

of Health, and Land Records.

Mr. Donzella pointed out that there is a steel fence

at the point where the line/to be moved.

Mr. Ponzini advised that the easement

should be shown on the plot map for the benefit of the Dept. of Health.
Mr. Ruscigno made a motion to approve the application in accordance with lines
shown on the map and subject to the final plan being submitted, showing easement.
The Board was polled and all agreed to granting this application.

The second half of the business meeting involved the Jacobsen application.
Mr. Ponzini recapped the previous meeting and the meeting the two engineers
had on September 4; he pointed out that they did not agree completely on
the issue of Jacobsen1 s application. Mr. Ponzini also pointed out that the
Mayor and Board of Trustees feel that we should have an impartial party look
at this situation and he feels that it is extremely important that our decision
be absolutely defensible if someone challenges that decision.
James Galgano said he did not think the Board of Trustees should have gotten
involved with the Planning Board and that the Planning Board should have made
a decision to allow this application; the Board of Trustees could then have
made their opinion known.
Mr. Ponzini informed the Board that when the application was presented to the
Board of Health, the covering letter was not attached explaining that no
decision was made by the Planning Board.
It is possible for Mr. Jacobsen to go to the Zoning Board and receive permission
to straighten the sewer line.
Planning Board members are in disagreement with Mr. Karamouz1 statements in
his letter.
Mr. Ponzini stated that a preliminary meeting will be set up with Keller and
Federico.
Mr. Ruscigno made a motion to adjourn and Mr. Windas seconded the motion.
Hearing and business meeting was adjourned at 8:50 p.m.

Mr. Margotta spoke first and advised the Board that he could see
nothing wrong with the request for a subdivision; all requirements
have been met.
Mr. Ruscigno said that everything looked good and that he had

Mr. John Hughes introduced himself as

Counsel for the Benzas and asked the Board to approve their
application.
Mr. John Garibaldi, 138 Harwood Avenue, spoke first and informed
the Board that after inspecting the property and plot plan he does
not feel that this subdivision will meet Village specifications
because 1) he does not feel the paper street should be included in
the total square footage of property owned by the Benzas and 2)
without the paper street parcel, the existing property is less than
20,000 square feet.

included in a cluster zoning application, the land thus burdened
may be counted in determining the number of residential units

Mr. Garibaldi pointed out that there is a requirement that each
piece of property in Philipse Manor must have a frontage of 75
feet and at present, the parcel of land with the structure
would have a frontage of only 64.59 ft. if subdivision is granted;
the

parcel

on the corner of Kelburne and Broadway would have a

frontage of 69.19 ft.

He also pointed out the danger of building

on property where ingress and egress would be off Broadway where
there has already been a death due to this type of situation.
Mr. Hughes assured Mr. Garibaldi that there are no present formal
plans to build on this property although Mr. Benza does wish to
build a driveway.

Mr. Margotta informed the Board that this must

meet specifications as to footage on each side of the proposed drive.
Mr. Rey questioned whether the Board will be creating a nonconforming piece of property by granting this subdivision.
Mr. Galgano questioned just how much property Mr. Benza has on
Kelburne Avenue and how it is measured, on the curve or straight
directly to a corner point.

He was informed that property is

Mr. Galgano opened the hearing at 8:30 p.m.
Mr. Philip Wissel, attorney representing Edwin Jacobsen, spoke to
the Board and pointed out the reasons for his client's request for a
subdivision. Mr. Jacobsen wishes to subdivide his property in order to
construct a house, however, there is a major problem in that the sewer
and storm drain lines lie where they wish to build the house and they
will have to be rerouted. New tile pipe will be used and the expense
of rerouting these pipes will be born by the Jacobsens. The addition of
a few manholes will be necessary to facilitate getting into these pipes.
It was pointed out that there should not be any possibility of increased
maintenance costs or future expense as a result of these changes to the
Village of North Tarrytown. Plans of the property were submitted indicating the routing of new pipe.
Mr. Windas questioned whether or not there is an easement on this
property and Mr. Ponzini informed him that there is but it is not recorded.
Mr. Biros said that easement lines meet the requirement as shown on the
drawing. On a question from Mr. Ponzini, he was informed that the subdivided lot would be a buildable lot. The proposed building will in no
way cover the proposed changes in utility lines; the structure would not
be over the utility lines and according to Mr. Jacobsen, the house would
not be closer to the pipes than 8*to 10'.
Mr. A. A. Litt, attorney, spoke for the residents of the neighborhood who object to granting this subdivision. He advised the Board
that they are very concerned about the health and safety of the residents
and they feel very strongly that the subdivision should not be granted
without a full study being made and an evaluation of the potential
impact on the area. Mr. Litt pointed out that in order for a subdivision to be granted, the property must be useable without damage to other
property in the area.

�-2Mr. Litt presented a letter to the Board from Mr. M. Karamouz,
an Assistant Professor at Polytechnic Institute; Mr. Karamouz has a
doctorate in Civil Engineering and is a Licensed Professional Engineer.
Mr. Karamouz was requested to observe the property in question and in
his letter he made recommendations and suggestions regarding the rerouting of the water pipes in question, (letter attached)
Mr. Litt pointed out that in Mr. Karamouz' letter it is stated
that the underground stream passes under the proposed new subdivision
near one or more of the proposed sanitary manholes which increases the
possibility of contamination and the water flow near the manholes could
cause water to get into the manhole.
Mr. Litt also stated that the residents of the area want to have
a complete study done of all ground water and the sewage system. Some
feel that the sewer is close to capacity now and that there are
problems at this time, i.e. water and sewage backup in their basements
as well as flooding. They wish to have a professional engineer make a
study of this property and assure them that it is safe to build on this
lot. Residents believe the underground stream could be contaminated
from the sewer and subdivision should not be granted until the problem
is solved.
Mr. Anthony Sarli, 33 Harwood Avenue, reminded the Board that
several weeks ago he submitted an exhibit to the Village Clerk which
referred to this application for subdivision. He also advised the Board
that several residents interested in this subdivision could not attend
this evening's meeting because they are away on vacation. Mr. Sarli
pointed out that the Village had dug in the area in April but do not
know the depth or slope of pipe at that location. He is very concerned
with the odor that may come from the pipes, plus seepage and polution,
and the possibility that there could be a rupture of pipe when new pipe
is used with old pipe. He feels that an environmental impact study
should be made before any consideration is given to this application.
Several other area residents pointed out their concerns of contamination, flooding in yards and basements and the fact that the Village
has had to pump out the line frequently;
they feel there will be
problems here in the future.

�-3Mr. Wissel said that he feels residents are justified in their
Wv concerns but should realize that Mr. Jacobsen will not do anything
that will decrease the value of their property or his. The use of
larger pipe (10" rather than 6") will be more efficient and
Mr. Jacobsen assured those concerned that he has discussed the problem
with professionals to be sure the rerouting of the pipe is done correctly.
Mr. Jacobsen has had a professional engineer discuss the problem with
Mr. Biros and has done everything reasonable to assure that the proposed
work is done correctly and he requests that his application be granted.
Mr. Marcel Goldenberg, 146 Hunter Avenue, stated that the Village
should be careful and obtain the proper decision on this problem; make
sure and have someone post a bond so that if anything goes wrong, someone will pay for it.
Mrs. Edwin Jacobsen questioned how rerouting of the sewer lines
and the use of better pipe could possibly be more damaging than what we
have now. The Jacobsens feel they are helping their neighbors so that
there will be no future problems. They are also concerned about rising
construction costs which will result with delay in granting this subdivision.
Mr. J. O'Leary, a new village resident who has been with Westchester County Department of Health for several years, suggested that
with
the Village consult/the Dept. of Health before any change is made in
the route of the sewer lines.
Mr. Wissel advised that the Dept. of Health will have to be consulted before any pipes are moved. He also advised that the Jacobsens
have retained a professional to do a study and Mr. Biros confirmed
that this is true and that it is being done properly.
When Mr. John Carroll of Hunter Avenue expressed concern that
a 10" pipe running into a 6" pipe could cause problems he was informed
by Mr. Wissel that the 10" pipe will empty into a manhole, not into a
6" pipe.
Mr. Litt said that the new pipe is not the question but the manholes are and that they have not been surveyed properly. There is
substantial risk here and he advised the Board not to subdivide too
hastily.

The question was raised that if an evaluation has been made by
experts, residents would like the assurance that it has indeed been
stl
done. They also^1^ 2ftat if new pipe is better than that which has
been there for years, will these new pipes put more strain on the old
ones, thus causing more risk?
On a motion by Frank Rey, seconded by Ray Windas,, the hearing
was closed .

BUSINESS MEETING
Mr. Windas questioned if there is any objection to putting a
house on the open lot and he was informed by Mr. Litt that no one had
any objection to a house on this lot,if it will not cause any increased
flooding or increased water problems.
In response to several questions, Mr. Biros explained how the underground stream flows from the area into Fremont Pond and he explained
further that the sanitary sewer is an 8" pipe which does not cause any
problems. He further explained that the Village does routine maintenance on the sewer system.
Mr. Margotta suggested that perhaps the elevation of some residents1
basement floors is too low thereby causing sewage backup.
On a question from Mr. Sarli, Mr. Biros explained that the bacteria
count in the water has never been tested.
Mr. A. Paese, a Licensed Professional Engineer, retained by
Mr. Edwin Jacobsen, will contact the Board of Health. The^Boara will
provide Mr. Paese with a copy of the minutes of this hearing and request
his reply to all questions before the next meeting on September 5.
It was suggested that Mr. Paese contact Mr.MJ^aramouz (333 Jay Street,
Brooklyn, N. Y. 11201) and discuss with him all aspects of this problem
and come to a resolution.
The Planning Board will consider obtaining
the opinion of a third professional engineer, if necessary, if there is a
difference of opinion between Mr. Paese and Mr. Karamouz.
Mr. Windas suggested that a copy of the plans be sent to the Dept.
of Health.
Mr. Ponzini reiterated that regardless of delay, the Board must
make the right decision.

Jackobson's property in Bellwood Ave.
An uderground stream or water course has been observed
five
feet below ground surface on the property adjacent to Mr. Sar1i's
Property
in the east. The stream appears to be flowing in the
direction of Sohn's Property at the northwest corner
of
Bellwood
and Farrington Avenues. It probably passes under the proposed new
lot arround the location of one or more of the proposed sanitary
manholes. This increases the likelihood of the contamination
of
the stream particularly in case of any backup in the sewer line.
T r. addition, the water flew arround the manholes could
cause
water
to get into the manhole and if this happens then
flooding
of sewer system will be inevitable.
In either case there could
be serious problems for the residence of the area.
I there-fore strongly recommend that the local
authorities
should
look at this entire problem in detail. It should not be
considered as amatter of simple subdivision with a 200 ft. sewer
relocation.
It may well
have harmful effects on the other
properties
in the area. A detailed environmental impact
study
should be made of the entire sewer system and the drainage in the
ares by a Licensed Professional Engineer. Only then, would it be
possible to determine
if there is any way to subdivide
this
property without danger to the heal tk and safety of others.
Furthermore proper engineering practice is clearly opposed to
locating
public
sewers and specially manholes on
private
properties. The Ten State Standards adopted by New York
State
cle.T.r ly takes this position. Inevitably, sewers and manholes on
private properties are more difficult and expensive for
the
village to maintain. Even more important is the health hazard
caused by direct exposure of the sewage through manholes in the
p-ivate arerits used by homeowners and their children.

Mr. Galgano opened the hearing at 8:00 p.m. and welcomed
anyone present who wished to address the Board.
Norman Sheer, attorney for Ellen Lehrman, presented an
affidavit of payment of taxes to date and went on to inform the
Board that there are two existing buildings on the property in
question.

One building is a 2% story, three-family dwelling with

luncheonette on the first floor, the other is a one-family dwelling.
Mr. Sheer said,
we are proposing to divide the property into two parcels so that the
one-family building will sit on one parcel and the 2% story building will sit on the other.

The property at this time is non-conform-

ing; it lacks area and setbacks.

By rearrangement the property will

be made conforming and side and rear yard areas will be in compliance with the ordinance.
Mr. Sheer asked the Board if they had any questions and
Mr. Galgano said they did not.
Motion to close hearing was made by Raymond Dool and seconded
by Ray Windas.
Business meeting followed and James Margotta looked at the
drawing and advised that he could find nothing out of order.
Frank Rey made a motion to approve subdivision application which
was seconded by Raymond Dool.

The October 10 Planning Board meeting opened at 8:10 p.m. The
purpose of this meeting was to make a decision regarding the
Jacobsen property on Harwood Avenue, corner of Bellwood Avenue.
Mr. Ponzini submitted to the Clerk a letter from Engineers and
Development Consultants Kellard &amp; Federico, dated October 7, 1985
as well as a Subdivision Map prepared by Charles Riley, Land
Surveyor, Profiles- Sanitary Sewer and Storm Drain prepared by
Charles Riley, and Utility Plan signed by Charles Riley and
utilities by A. G. Paese, N.Y.S.P.E.
Mr. Ponzini pointed out that this meeting was held to review data
and make a decision regarding the Jacobsen property and that the
Board would not open up the meeting to comments from residents.
He did ask, however, if Mr. A. Litt (attorney for residents who
object to Board granting a subdivision) wished to speak.
Mr. Litt advised that he would submit a copy of his statements to
the Clerk.
Mr. Litt advised the Board that he did not feel the
report from Kellard &amp; Federico completely covered the situation of
ground water, flooding, and pollution and he requests an engineering study to locate underground stream and study pollution. Mr.
Litt stated that his client deserves full protection. Residents
of the area do not wish to accept Mr. A. G. Paese"s word that conditions are satisfactory and that the Village should not accept
this until test data is approved.
Mr. Litt expressed his feeling
that if the Board grants approval, the Village will have to accept
the consequences and the residents will be left with the problems.
Mr. Ponzini advised that Kellard &amp; Federico were invited to this
meeting, however, were unable to make it; that they received the
complete file- including information from Mr. Paese and Mr. Karamouzto study and that they did not respond to everything. Mr. Ponzini
will get in touch with them again.
Mr. Rey mentioned that the Kellard &amp; Federico letter did not mention
undergound stream and high water in the area but feels that this cannot be checked unless construction is underway. The responsibility
lies with the Jacobsens that construction is done according to specifications. Mr. Rey also feels that the Village has responded to
everything required in this situation.
Mr. Ruscigno made a motion that the proposal is the proper solution
for relocation of the utilities in question subject to the proper
on-site inspection and testing. Mr. Rey seconded this motion. All
in favor.

�Mr. Ponzini stated that the Village Water Department can inspect
this construction as it proceeds and that the Village should
employ a professional engineer to come in and look at the construction also. It was his recommendation that in addition to
the Water Department, we should have another engineer inspect
Mr. Paese's work to be sure that it is done properly.
Mr. Litt feels this should be incorporated with the plan.
Mr. Rey made a motion that we submit a Resolution to the Board
of Trustees expressing our concerns since John Biros is retiring
and that we recommend that the Village hire a consultant;
that test data be submitted on the sewer system and that no
action be taken regarding construction until a professional
engineer checks it. Mr. Ruscigno seconded this motion and all
voted in favor.
Mr. Ponzini stated that Mr. Jacobsen must obtain County approval.
at 8:35 p.m.

Dear Mr. Ponzini:
As per your request, we have reviewed the proposed relocation
of the existing sanitary sewer and storm drain for the referenced subdivision.
Our review was based on field inspections and review of the
following documents:
1.

Planning Board minutes dated July 24, 1985.

2.

"Utility Plan" Prepared by A.G. Paese, P.E. dated last
revision August 12, 1985.

3.

"Subdivision Map prepared for Edwin Jacobsen" prepared
by Charles Riley, L.S. dated July 10, 1985.

Our comments are as follows:
1.

The proposed relocation is apparently required in order
to construct a residence on the proposed Lot B as shown
on the map entitled "Subdivision Map Prepared for Edwin
Jacobsen" dated July 10, 1985. We must assume the proposed
relocation will physically permit this construction in conformance with the Village of North Tarrytown Zoning Ordinance.

2.

The practice of placing utilities within easements on private
property is a fairly common practice in the Westchester
County area. This practice is usually due to topography as
well as economic considerations when designing a sewer system.
Evidence of such proceedures is noted in the countywide
sanitary sewer systems recently constructed under the federally
funded Pure Waters Act.

Regarding this particular situation, the concern seems
irrelevant due to the fact that the existing sanitary sewer
has existed on private property for many years and therefore,
the relocation as proposed should not adversely affect Mr.
Jacobsen's property or the abuting neighbors. The sewer as
proposed conforms to the same size piping that exists with
the present system.
3.

We have found through our past experience in the Westchester
County area that, if in fact groundwater is encountered,
it is not an uncommon occurrence.
Should high groundwater conditions exist in this area, the
Westchester County Health Department, as the reviewing and
approving agency, requires that the following procedures
be followed in order to assure that a properly functioning
sanitary sewer is constructed.
a)

The Westchester County Department of Health, as a condition of their approval, requires that during construction a licensed professional engineer must supervise the
construction to assure that proper procedures are followed
and that the construction is in accordance with the
approved plans.

b)

The Westchester County Health Department requires that
all newly constructed sanitary sewers must be tested for
exfiltration and/or infiltration in areas of high groundwater. Therefore, should groundwater be encountered,
the licensed professional engineer should verify that
the system is watertight. The licensed professional
engineer must also certify that the proposed system
meets Westchester County testing requirements. This
testing procedure will further insure a properly constructed and functioning sanitary sewer system.
We suggest that the Village of North Tarrytown not accept
the new sanitary sewer system until such time as the test
data has been submitted and found to meet the requirements of the Westchester County Health Department.

4.

Surface water flow is shown on the U.S. Geological Survey,
Tarrytown Quadrangle. The topography in this area forms a
swale from Harwood Avenue flowing north to Farrington Avenue.
It appears that this condition resulted in the storm drain
being installed through the Jacobsen property in order to
convey surface drainage from Harwood avenue north to Farrington Avenue.
The topography as indicated should alert the builder to consider the possibility of subsurface drainage to be used for
the proposed residence.

If in fact groundwater flow is found during construction,
standard construction procedures to direct groundwater flow
around the proposed residence will be required.
Due to the fact that the storm drainage system is adjacent
to the proposed residence, it would not appear to be difficult
to divert these flows.
In conclusion, through our review of the proposed relocation of
existing sanitary sewer and storm drain, we believe that the
proposal is a proper solution for relocation of both utilities.
It goes without question that the on-site inspection and testing
must be adhered to in order to assure a proper installation.

Gentlemen:
We represent a large number of residents of Philipse Manor in the
Harwood-Farrington-Hunter Avenue area, many of whom appeared at the
public hearing of this matter on July 24, 1985.
Over the years, they have had problems with the drainage and sewer
systems of the area, and they have serious concerns about the potential
impact of the Jacobsen Subdivision on these problems.
They have good reason to believe that there is an underground stream
crossing the Jacobsen property from southeast to northwest.
They have good reason to believe that this stream feeds into the open
stream between Farrington and Hunter Avenues.
They know that there has been pollution of the open stream.
They know that there has been downstream flooding.
They have personal experience with the overtaxing of the existing
sewer system.
They came to the Village with these concerns because they are residents
and taxpayers of the Village, and they feel that they and their
families are entitled to the assistance and protection of the Village
government.
They asked that the underground stream be definitely located.
They asked that the question of possible pollution from the relocated
sewer system and manholes be studied factually and in detail.

They asked that the question of overloading the down-stream sewer
line be studied and analyzed.
They want, and they feel that they are entitled to, full and complete
protection and reassurance after full investigation and field testing.
What the Village has given them is this report from Kellard and
Federico which gives them nothing.
First of all, the list of documents on which the report is based does
not even include Dr. Karamouz' report.
Second, there was no field work, no attempt to actually get any data
about anything.
There is no mention at all of the sewer overloading problem.
They talk about "groundwater" as if it were simply a question of the
water table, when actually we're speaking of a stream underground,
with a definite directional flow.
All the residents get from this report is a suggestion that, if
there's any groundwater, Mr. Paese will sign a certificate that
everything's all right. They are not satisfied to accept the certificate nor the supervision of Mr. Jacobsen's engineer. This is no
assurance at all.
Similarly, the suggestion that the Village not "accept" the work
until the test data has been approved is absurd. A new section is
being inserted into the middle of a sewer trunk line. Once it is
installed, the Village cannot avoid taking it and using it. If the
Board grants approval tonight, and if any problems ensue, either the
Village will have to bear the consequences, or else the Village will
do nothing and the residents will bear the consequences.
We repeat — this report gives my clients absolutely nothing of the
assurance and protection they asked for. They want a field investigation to determine the location, size, flow and direction of the
underground stream. They want a complete investigation of the
downstream sewer problems. They want some better protection against
pollution than a certificate by Mr. Jacobsen's engineer.
If and when anything is done here, my clients want to know what tests
are going to be made to assure their safety and property, who is
going to supervise the work, and who is going to supervise the
testing.

This approval of plans is issued under provisions of Article 17 of the
Environmental Conservation Law and 6NYCRR 652, and is issued for plans consisting of two sheets prepared by A.G. Paese,P.E.and dated Aug. 21, 1985.
The project is located in the Village of No. Tarrytown. This letter of
approval of plans and a set of the approved plans should be filed in the
appropriate office of the Village of No. Tarrytown.
By initiating construction of the project covered by this approval of plans,
the applicant accepts and agrees to abide by and conform to the following:

THAT the approval is revocable or subject to modification or change

The Planning Board meeting was opened at 8:05 p.m. on October 24 to
review the application of Tarrytown Realty Corp. for site plan
approval. The Public Notice was read by the Clerk.
Mr. Galgano informed those in attendance that although this meeting
was not intended to be an open meeting, because of high public
interest, it was decided to open the meeting tOm residents' comments.
The hearing should simply be a review of the site plan by the Board
to be certain that all restrictions are adhered to. The usual procedure is to discuss site plans with engineers only.
Mr. E. Brunner, Mr. Kahn's engineer arrived after the meeting began,
as did Counsel J. Pappalardo.
Mr. Vincent Buonanno, 132 Van Tassel Avenue, said that he appreciated
having an open meeting and requested Mr. Galgano to outline the
duties of the Planning Board so residents would know what the Board
can do. Mr. Galgano explained that the Planning Board reviews site
plans and considers any changes in the Master Plan of the Village to
be sure that what is outlined in the Village Code is adhered to by
developers.
Mr. Mario DiFelice, Gory Brook Road, requested the Board to define
just what will go into the three story building which is planned.
He was advised by Mr. Galgano that there will be an auto service
area, parts and storage area, and offices on the third floor, all of
which is in accordance with the Code. The re will be no autos or
fuel sold there.
Mrs. K. Lingardo, Pine Close, wished clarification on just who the
Tarrytown Realty Corporation is. She feels that the Corporation is
illegal because according to the State of New York, there is no
record of a corporation by this name. Mr. George Kahn assured her
that the Tarrytown Realty Corporation is a legal corporation and is
registered in the State of New York and is a tax payer in the
Village of North Tarrytown. Mr. Pappalardo said that Planning Board
records should be amended to reflect that George Kahn is owner rather
than Tarrytown Realty. Mr. Pappalardo also stated that there was a
disclosure made at the Zoning Board meeting of July 18, 1985 that
George Kahn is the principal owner of the property in question.
Mrs. Lingardo also requested an Environmental Impact statement;
Mr. Pappalardo informed her that one had been submitted to the
Zoning Board in July. (Planning Bd. does not have a copy and
Mr. Pappalardo will see that they receive one.)

�Mr. Buonanno also asked if an 8-ft. fence around the property is
legal and Mr. Margotta informed him that it should only be 6 ft.
high. Mr. Buonanno also asked if there is a right-of-way along the
north side of Gordon Avenue and if there is enough area for a
sidewalk. Mr. Brunner, Mr. Kahn's engineer, informed him that the
property line is approximately 10 ft. back from the curb and the
fence is on the property line. There will be no encroachment along
the curb area.
Mr. Pappalardo reiterated that the only reason the Planning Board
is holding a hearing tonight is because any construction of 10,000
sq. ft. or more requires site plan approval. All Code requirements
must be met; if necessary, legal action will be taken to assure that
the Code is adhered to.
Parking of employees cars, unlicensed and wrecked cars in the area,
and the number of cars parked behind the animal hospital in excess
of the number allowed, and the probability of heavy traffic on
Gordon, Rice, and New Broadway are some of the "concerns of the
Webber Park residents. Although twenty-nine parking spaces will be
provided (25 are required by Code) for customers and employees,
according to Mr. Kahn, residents aire concerned that there will be
more cars than spaces.
Mrs. Joseph Krupp, 7 Katrina Avenue, advised the Board that she has
never received any satisfaction when she complained to the police
or to the Mayor about the abuse of parking space in her area.
Mr. Buonanno said that if the deeds of the property . - question
were checked, it would show that some of the property is residential
and, therefore, cannot be used for parking. Mr. Brunner informed
him that there will be a buffer placed on property line and the
pavement in lot 298 will be removed. Mr. Margotta said that lots
297, 296, 295, and 294 are parking areas; the previous owner,
Mr. J. Albanese, received a variance to use this space for parking
and that variance remains in effect. Mr. Peirce confirmed that
this space is for parking under a continuing variance.
On a question regarding the storage of vehicles, Mr. Peirce stated
that this will not be permitted.
Mr. V. Buonanno suggested that the members of the Board walk to
the property to observe first hand the number of cars parked there.
Mr. Pappalardo pointed out that the wrecked cars will be parked
inside the new building and cars parked on the streets will be
moved into the proper spaces on the property. Mr. Brunner and
Mr. Kahn reaffirmed that there will be 16 parking spaces inside the
building and 18-20 outside which will be ample parking space.
Mr. Eugene Buonanno, Gordon Avenue, stated his concerns about the
parking problem and mentioned that he had signed an affidavit to
enforce parking and nothing had been done about it.
Mr. Kraft, New Broadway, felt that the fence is uot necessary; he
was advised that the fence is there at the prerogative of the owner

�and if unlicensed cars are parked overnight, it is illegal.

Mr. R. Dool, Webber Avenue, and member of the Board, reemphasized
the feeling of the residents that parking has been abused by the
property owner for years and that he has given no reason to believe
this abuse will cease. Several residents wished to know if the
Planning Board can enforce designated parking on employees of Tappan
Motors and they were advised that the spaces available can be used
any way the owner prefers.
Mr. Kahn insisted that when the building is completed, it will alleviate the parking problem. Mr. DiFelice
reminded the Board that there are spaces marked for employees' use on
the south side of Broadway (Rt. 9) but they do not use them.
Mr. Galgano advised that the police would have to ticket improperly
parked vehicles.
Mr. J. Ruscigno made a motion at 9:15 to adjourn the meeting;
Mr. R. Windas seconded the motion. All members.voted in favor.
BUSINESS MEETING
After some discussion the Board decided to hold off on a decision
until the following items were resolved:

portions). The submission must conform to a previously approved engineering report describing the system in
detail. The plans must be stamped with the designing engineer's seal and must be of sufficient clarity and
eligibility to permit satisfactory microfilming. Only white prints will be accepted because of the difficulty of
microfilming blue prints. There must be a blank area, at least 4 " x 7 " , in the lower right comer of each
sheet so that the approval stamp may be placed on the face of the plans.
Any deviation from the Department's standards for wastewater collection and treatment facilities must be
explained in detail.
