Minutes of the Regular Meeting of the
Zoning Board of Appeals of the Village
of North Tarrytown held at the Corporation Rooms in the Village of North
Tarrytown on the 17th day of December,
1930*.
Present:
Gerald B. Gould, Chairman
William 0. Schmidt
John K. Mullon
David Page, Jr.
John J. Lofaro, Secretary.
Mr. Gould called the meeting to order at 8;15 PM
The minutes of the regular meeting of the Board held on November 19th, 1930, were read and approved.
The absence of Building Inspector, Percy C. Minnerly was noted
and the Secretary was asked by Mr. Gould if a notice of meeting was
sent to him.

The Secretary informed him that notices of the Nov-

ember and December meetings were sent to each and every member of
this Board including the Building Inspector.

Thereupon Mr. Schmidt

moved that the Secretary be instructed to write to the Building
Inspector calling his attention to Paragraph 16 of the Rules of this
Board which reads as follows:
"The Building Inspector shall, on or before
the 10th day of each month make and file
with the clerk of the Board of Appeals and
with the chairman a written report setting
forth in detail all building permits applied
for, issued or refused together with a
,'•'• detail statement of his examinations and
other activities as Building Inspector and
any recommendations or suggestions he may
desire to submit to the Board of Appeals and
he shall attend all meetings of the Board
of -Appeals."
The said motion was duly seconded and passed.

It was suggested by Mr. Gould that some sort of a form for
the Building Inspector's monthly report to this Board he printed
to simplify the Building Inspector's work.

The matter was put

over until the next regular meeting when the Building Inspector
would be present to give the Board his views as to what he would
require in said form.
The matter of Mr. H.D. Minich was again put over until this
Board receive further communication either from the Philipse Manor
Improvement Association or Mr. Minich.
On Motion of Mr. Schmidt, duly seconded and passed, it was
resolved that the following he noted in the minutes of this
meeting*"A Notice of meeting of which the following is a copy, was
recieved by each member of the Zoning Board of Appeals.

The Board of Trustees
Dec. 10th, 1930.
Mr.
Dear Sir:
The Board of Trustees have directed me to request
you to be present at a meeting which will be held
Friday Evening, Dec. 12th, 1930, in the Corporation
Building #28 Beekman Avenue, North Tarrytown, N.Y.
At which meeting the matter of changing property
located on the corner of Broadway and Depeyster Street
from residential "B" to Business will be discussed.
Kindly arrange to be present as the Board of
Trustees would like to have an open expression from
each member of the Zoning Board of Appeals before
making a final decision in the matter.
Trusting you will be with us on said date, I remain

That pursuant to said notice each member of this Board
attended the said meeting and expressed a concurring
view with Chairman Gerald B. Gould who opposed the
proposed change from residential B to Business of that
particular property on the Northwest corner of Broadway
and Depeyster Street owned by Mrs. Catherine Ward. "

Mr. Gould called the meeting to order at 8:30 P.M.
The minutes of the regular meeting of the Board held on
October 22nd, 1930, were read and approved.
Mr. WInfield L. Morse, appearing before the Board in behalf
of the Philipse Manor Improvement Association on the matter of
the garage set back as requested by Mr. H.D. Minich, informed the
Board that Mr. Minich conferred with a committee of the association
regarding the same.

That at said conference numerous suggestions

were made and that the matter was put over until such time when
Mr. Minich is in possession of estimates of the cost of construction
of said garage either in the front or in the rear of fch&amp; premises *
It was called to the attention of the Board through the Public
Press that the Board of Trustees on December 5th, 1930, will hold
a public hearing for the purpose of taking action on changing from
residential to business that particular property located on the
Northwest corner of Depeyster Street and Broadway.

An informal

discussion followed and it was concluded that this Board has no

There being no further business to transact, meeting was
adjourned at 10:30 P.M. to meet again on December 17th, 1930.

Mr. Gould called the meeting to order at 8:15 PM.
The minutes of the regular meeting of the Board held on
September 17th, 1950, were read and approved.
A letter received from Mr. H.D. Minich under date of
September 26th, 1 950,was read and acted upon by the Board.
After a short discussion, Mr. Gould said that he would see Mr.
Minich who is now in town and suggest to him that he ( Mr. Minich)
get in touch with the Philipse Manor Improvement Association
and arrive at some sort of solution in the matter.
There being no further business before the Board, meeting
was adjourned at 9:15 PM to meet again on November 19, 1950.

The Secretary read the minutes of a regular meeting of the Board
held on July 24, 1929, and the minutes of the organization meeting held

A letter

recieved from H.D. Minich under date of September 14,

1930, was read and acted upon by the Board.

On motion of Mr. Lofaro

and seconded by M r . page it was resolved that the Secrefc&amp;ry be instructed
to answer said letter as follows:

It is clear from the rough sketches which you enclosed
that permission to carry out the plan would require a
variation in the set back building line as provided in the
Zoning Law.
We are enclosing a printed copy of the Zoning Ordinance
and call your attention to Section 12 Paragraph H4, which will
be found at the top of page 20 and which provides that any
variation in the set back can only be made upon due hearing.
The Board feels that this particular situation requires
careful study of the further development of the entire block
and is not prepared at the present time to call a public
hearing on this specific case on its own motion. "

On motfcoa of Mr. Schmidt and seconded by Mr. Mullon, the Secretary
was instructed to write to the Philips Manor Improvement Association,
Mr. Howard Beebe, Secretary, Harrington Avenue, the following letter:

may apply to parts of Hunter Avenue where unusual topographical

course, the importance of maintaining the standards
of appearance that prevail In that section.
The next regular meeting of this Board will be held
on Wednesday, October 15, 1930, and an expression of
your views will be greatly appreciated. ,f
The next matter before the Board was the question of the rights
of an owner of vacant property In a Residence A Zone to store second
hand building material on premises in such a manner as to make the
premises unsightly.

It was unanimously decided that the Board had

no jurisdiction In the matter and that the same be referred to the
Police Department on the grounds of nuisance*
On motion of Mr. Mullon and seconded by Mr. Page,!therSecretary
was instructed to write a letter to the Building Inspector, as follows:
"
We call your attention to an apparent violation
of Section 4 Paragrph 9 of the Zoning Ordinance, by
one Mr. John Sprince of 59 Howard Street, In maintaining a business and displaying a business sign in
Residence B Zone.
We wish that you take up this matter and report
to this Board at our next regular meeting on October
15th, 1930.
We also call attention to the tool house or shed
on Merlin Avenue which has been erected at that point
and maintained there for the past six months without
building construction. ff
Mr. Gould turned over to the Secretary a letter received from the
Board of Trustees under date of Amg&amp;st 15, 1929, relative to the filing
cabinet for plans for the Building Inspector and directed thet Secretary
to call the Building Inspector's attention to the fact that the Board
of Trustees authorized the purchase of said cabinet and awaits the
receipt of advice from the Building Inspector as to just what he requires*
Mr. Gould instructed the Secretary to wftfcte to the Board of Trustees
the following letter:

This will acknowledge and thank you for your
letter of September 24th*
I quite agree that the situation requires
careful study and I most certainly do not want to propose
anything that would not be an acknowledged improvement*
Of course, I feel that already I have taken into consideration the general interest, as well as my own, but I should
much prefer to have my judgment carefully checked "before
anything is done*
Tour letter however leaves me in doubt as to
how to proceed as regards the public hearing*
I infer
that a petition may be presented but I do not know whether
this would be advisable if you are already planning to take
up the question as a matter of routine*
The only difficulty is that I had in mind
beginning construction as soon as these matters oould be
straightened out and it of course has a direct bearing on
procedure and resulting bids which I should like to secure
as soon as possible*
In faot I had hoped to have these
preliminaries out of the way so that I oould complete arrangements next week*

at the Corporation Rooms in the
Village of North Tarrytown on the

Mr. Schmidt acting as temporary Chairman called the meeting to order
for the purpose of nominating and electing a permanent Chairman and
Secretary of the Board, and appointed Mr. Gould as temporary Secretary.
Mr. Schmidt ttoem stated that nominations were then in order and he nominated Mr. Gould for Chaiuman and said nomination was seconded by Mr.
Mullon.

There being no further nominations, Mr. Gould was unanimously

elected as Chairman.

Mr. Page nominated Mr. Lofaro for Sectretary and

said nomination was seconded by Mr. Mullon.

There being no further

nominations, Mr. Lofaro was unanimously elected as Secretary.
Mr. Gould, taking the Chair, outlined the work of the Board and
suggested that each member of said Board take with him copies of the
Zoning Ordinance, Building and Sanitary Codes and read the same over to
familiarize himself with the same. Mr. Gould suggested that the Board
ought to meet once a month and thereupon Mr. Schmidt moved that the Board
meet regularly on the third Wednesday of each and every month during
the ensuing term.

The motion was seconded by Mr. Page and it was

then unanimously resolved that the Board meet regularly on the third
Wednesday of each and every month during the ensuing term.
Mr. Gould instructed the Secretary to communicate with Mr. John J.

pollard, former Secretary of the Board,and obtain from him the minutes
of the previous meetings of the Board,
Mr. Schmidt turned over to Mr. Gould a letter dated August 51st,
1930, from one H.D. Minich, addressed to the Board, asking the Board its
consent to permit the building of a garage on premises owned by said Mr.
Minich on the North side of Hunter Avenue, Philips Manor, according to
plans which meet the peculiar topographical situation, that is, to build
the garage with doors flush with the bank, instead of the usual 30 feet
set back.
A telegram dated September 11, 1930, was received from said H.D.
Minich, asking for a reply to his letter of August 31st.
Mr. Gould instructed the Secretary to dispatch a night letter to
Mr. Minich as follows:

Necessary for Board of Appeals to have plot
plan showing proper location of garage and
dwelling in order to permit the Board to
consider application* Next regular meeting
September seventeenth."

and suggested that the Board consider this application at its next regular meeting on September 17, 1930.
Mr. Mullon raised the question of the rights of an owner of vacant
property in a Residence A Zone to store second hand building material
on the premises in such a manner as to make the premises unsightly*

Mr. Gould suggested that the Board should have a cabinet for its
files and a file cabinet for plans submitted to the Building inspector.
Village Clerk Quinn gave the Board permission to use the lower drawer of a
the file cabinet in the Corporation Rooms for the files and the matter
of the file Cabinet for plans, to be taken up at the next meeting.

Dear Sir:
U?his will acknowledge and thank you for your
telegram of Sept. 12 replying to mine and referring to
my previous letter.
I do not know whether the enclosed will he
satisfactory for your pusposes or not hut they will at
least serve to illustrate for all practical purposes
the arrangement that we had in mind and which I tried
to explain in my letter.
Although these sketches are rough they are
approximately accurate as to location and proportions
as I have he en over the situation carefully in person,
the problem can best be understood by visiting the
property and comparing the driveway directly across the
street - Mr. B.O.Warren's. 3The proposed garage would
be directly aosvosa the street from this driveway, but
it will be observed that the alternative of a drivewyy
on our property would result in a much deeper cut, than
was necessary in Mr .Warren's case.
I hope that the above and enclosed sketches
will be sufficient to enable action to be taken at the
next meeting to which you refer.
