Adopted at a Meeting of the Board of Trustees
September 13, 1926

�AN ORDINANCE to establish building lines adjoining public streets
and to require all buildings hereafter erected to be within such
lines; to regulate and limit the height and bulk of buildings here-; after erected, to regulate and determine the area of yards, courts
and other open spaces, to regulate and restrict the location of
trades and industries and the location of buildings designed for
specified uses; and for such purposes to divide the village into
districts, with uniform regulations * for each class of buildings
throughout any' one kind of district, - but with such regulations
differing as between districts of different kinds; so as to promote
the public nealth,' safety and welfare; with reasonable consideration, among other things, to the most desirable use for which the
." land of each district mayt be adapted, the peculiar suitability for
• particular use of any district, the conservation of property values
and the direction of building development in accordance with a
well considered plan; and also to establish regulations, restrictions, determinations and limitations. --.

SECTION 1—DISTRICTS
;s For the purposes of this Ordinance, the Village of North Tarrytown is hereby divided into four classes of districts, as follows: -•.
Residence "A" Districts

. The boundaries of these districts are hereby established as shown
on the Building Zone Map which accompanies and is hereby declared
to be a part of this Ordinance. , These district boundary lines are intended to follow lot lines as they existed at tha time of passage of
this Ordinance unless suchT district boundary lines are referenced by
dimensions on the Building Zone Map to a street line;' in case of doubt,
however, a district boundary line shall be deemed to follow the nearest thus existing lot line as determined by the Beard of Appeals according to Section 12 (e) below. No premises shay hereafter be used
and nc building or structure shall be erected, enlarged or altered except m conformity with the regulations herein specified for the district in which the premises or building is located.

ings and the accessory buildings customarily incident to it and including all open spaces thereon, and abutting on one or more s t r e e t s
16 feet or more in width. F o r any new construction, a " l o t " shall
further conform to the description filed with the Inspector of Buildings as provided below in Section 11.
The depth of a lot is the mean distance from a street line, whicn
divides the lot from a street lb" feet or more in width, to the opposite
most distant rear line of the lot measured in the mean direction of
the side lines of the lot. The width of a lot is its mean width measured at right angles to its depth.
In the case of any irregular or gore lot, the rear line shall not in
any part be deemed to be further back than a line parallel with the
street line, distant as far as possible therefrom and not less than ten
feet long, such line being entirely within the lot.
In the case of a lot abutting on two or more intersecting s t r e e t s
or two parts of the same street t h a t form an angle of less than 120
degrees with each other, any major lot line not a street line and opposite to a street line may be elected by the owner to be t h e r e a r line,
by noting such election on the plans officially filed with t h e Inspector
of Buildings as provided below in Section 11. Where such election is manifestly contrary to the established character and welfare
of the neighborhood, the Board of Appeals shall determine such r e a r
line according to Section 12 (h) below,

SECTION 3—RESIDENCE " A " DISTRICT U S E S
In any Residence "A" District no building or premises shall be
•used, or arranged or designed to be used in a n y p a r t for other than
one or more of the following specified purposes:
(1) A dwelling for one family or for one housekeeping unit only.
(2) The taking of not more than four boarders or t h e leasing of
not more than four rooms by a resident family.
(3) The office or studio nf a resident professional person, such
as a physician, surgeon or dentist, provided t h a t there is not more
than one assistant regularly employed.
(4) Municipal playgrounds or p a r k s . , .
(5) Churches and other places of w ; orship.
(6) Community center buildings providing a place of meeting or
facilities for entertainment, recreational or educational'activities es-*
tablished and controlled by and for the use of residents of the village
or the district within which the premises are located, provided, bowever, that no permit for such use shall be granted until written consent of 80 per cent, by footage, of the resident 'property owners within
the district, and within fifteen hundred feet of t h e p r e m i s e s in question if in residence district A and five hundred feet if in residence dis-

(8) A private g a r a g e on the same lot with the building to which
it is accessory and in which no business or industry is conducted except the leasing of space for not more than one non-commercial motor
vehicle, to a person n o t resident on the same lot. . No such g a r a g e
shall provide storage for more than two motor vehicles except t h a t
space for one additional motor vehicle may be provided for each 4000
square feet of a r e a , b y which the lot area exceeds 9000 square feet,
but for not more than three motor vehicles in any case. . N o t more
t h a n one commercial motor vehicle shall'be allowed in such g a r a g e
nor shall such commercial vehicle exceed one and one-half tons weight
or capacity. P r i v a t e stables shall conform to the above requirements
^ by considering one horse the equivalent of one motor vehicle. ; No
p a r t of any such g a r a g e or stable shall be used for residence purposes
except t h a t a chauffeur, coachman, stableman or gardener in the employ of the occupants of the principal building may have sleeping
:
quarters in such g a r a g e or stable.

(9) Real estate signs advertising the sale,-rental or lease of
premises, provided that any such sign be located on t h e premises in
question.

(10) Accessory uses," including'small announcement or professional signs, customarily incident to the above'permitted uses and located on the same lot with them. Except as permitted above, "accessory uses" shall not include any use customarily carried on as a business or industry, nor any driveways or walls giving access thereto,
nor any display of goods made or sold which is visible from the street,
nor any billboard or advertising sign.
SECTION ^ R E S I D E N C E "B" DISTRICT USES _
Within any residence " B " District, no building or premises shall
be used, or arranged or designed to be used in any part for other than
one or more of the uses specified above in Section 3 as permitted in
Residence " A " Districts, and in addition for: *
( 1 ) ' " A dwelling for more than one family or one housekeeping

(2) Customary home occupations carried on i s the residence of

primarily foi gam as permitted by the Board of Health.
(4) Boarding or lodging houses not primarily for transient
guests, hotels and public schools.
(5) Public buildings.
(6) Railway or public service passenger stations and r i g h t s of
way, not including switching or storage yards.
(7) Private garages as specified above in Section 3 (8) except
that in addition to space for two motor vehicles which shall be permitted on a lot of not less than 2500 square feet a r e a , space for one
additional motor vehicle shall be permitted for each 2500 square feet
of area by which the lot arc-a exceeds 2500 square feet: but space
shall not be provided for more than five motor vehicles in any case.
(8) Private schools, hospitals, not including • sanitoriums or
places for the care of contagious diseases, philanthropic or eleemosynary institutions not including correctional institutions, provided that
avery application therefore shall be first approved by the Board of
Appeals, who are hereby empowered to approve or disapprove after
written consents of 80 per cent by frontage of the owners of t h e lots
within fifteen hundred feet of the property in question, a r e filed with
the Building Inspector.
(9) Accessory uses, including small announcement signs, customarily incident to the above permitted uses and located on the same
lot with them. Except as permitted above, ''accessory u s e s " shall not
include any use customarily carried on a s a business or i n d u s t r y , nor
any driveway or walk giving access thereto, nor any display of goods
made or sold which is visible from the street, nor any billboard or
advertising sign. '
SECTION 5— B U S I N E S S DISTRICT U S E S
Within any Business District, no building or premises shall be
used, oi arranged or designed to be used in any p a r t for a n y of the
following purposes:

(a) Any use specified below in Section 6 as prohibited in Industrial Districts.
(b) Any trade, business, industry or purpose of any kind that
is noxious or offensive by reason of the emission of odor, dust, refuse
matter, wastes, smoke, g a s or noise, or t h a t is detrimental to the
comfort, peace, enjoyment, health or safety of t h e community o r t h a t
tends to become so as determined by the Board of Appeals according
to Section 12 (f) below, except t h a t railway yards, or round houses
shall be permitted in any ease.
(c) Any engine unless objectionable vibration be eliminated and
such engine be operated with an effective muffler or silencer.

(d) Assaying, other than gold or silver.
(e) Any public g a r a g e using more than seven horsepower for
driving machine tools, or conducting any such work on or within 25
feet of any street, or having any opening in the side or rear walls or
roof within 15 feet of any lot line not a street or alley line; any public stable stabling any horses within 25 feet of any street; any public garage or public stable having any entrance or exit for vehicles
within 50 feet of any Residence District or within 200 feet of any
school, playground, church hospital, public library or institution for
children under 16 years of age.

(a) Within any Industrial District, no building , or , premises
shall be used or arranged or designed to be used in any p a r t except

SECTION 7—EXISTING NON-CONFORMING

public

USES

(a) Any use existing at the time of the passage of this Ordinance may be continued, although such use does not conform with the
provisions of this Ordinance for the district in which it is located.
Such existing non-conforming use may be hereafter moved or extended throughout any p a r t s of the building which were arranged or designed for such use at the time of p a s s a g e of this Ordinance. No
building or premises containing a non-conforming use shall be enlarged or structurally altered, unless such enlarged or structurally
altered p a r t shall thereafter conform with the provisions of this Ordinance for the district involved, except a s hereinafter provided. N o
non-conforming building shall be reconstructed if destroyed over 50
per cent, of its assessed value, exclusive of foundations, by fire, water,
or the act of God. No non-conforming use if once changed to a use
permitted in the district in which it is located, shall ever be changed
back to a non-conforminguse.
(b) In specific cases, after due notice and public hearing and
subject to appropriate conditions and safeguards the Board of Appeals, hereafter created, may permit changes in or extensions to
non-conforming uses according to the provisions below in Section
12 ( h ) .
SECTION 8
In Residence " A " district no building shall exceed three stories
in height.
SECTION 9—SETBACK B U I L D I N G L I N E S
Residence A D i s t r i c t s .
(a) In Resident District A, the principal building shall be set
back within a building line 30 feet from the front street line, except
that in any district already established, where the average setback
of existing buildings within the same district, on the same side of the
street, and within 200 feet on each side of the lot in question, is less
than 30 feet, such average setback shall govern, provided howeveT.
t h a t no principal building shall be required t o set back a distance
greater than the setback of t h a t one of t h e two existing buildings on
the immediate adjoining lots, on either side, which is farthest from
the street line.
(b)

Residence B Districts
In Resident District B, the principal building shall be set

back within a building line 20 feet from the front street line, except
t h a t in any district already established, where the avrage-setback
of existing buildings within the same district, on the same side of the
street, and within 200 feet on each side of the lot in question, is less
than 20 feet, such average setback shall govern, provided however,
t h a t no principal building s h a l l b e required to set back a distance
g r e a t e r than the setback of t h a t one of the two existing buildings on
the immediate adjoining lots, on either side, which is farthest from
the street line.
Garages and Accessory Buildings
(a) Garages and other accessory buildings in Residence District
A, shall be set back a t least %5 feet from the front street line, unless
said g a r a g e or other accessory building is n t ade a p a r t of the principal
building, provided however, t h a t in caKe severe topographical conditions make such a set back impracticable, the setback may be less than
75 feet, upon specific consent of the Board of Appeals.

(b) Garages and other accessory buildings in Residence District
B, shall be* set back a t least 50 feet from the front street line, unless
said g a r a g e or other accessory building is made a p a r t of the principal
building, provided however, t h a t in case severe topographical "conditions make such a setback impracticable, the'setback may be less than
50 feet, upon specific consent of the Board of Appeals.
Building Areas
(a) In Residence.District A the combined area of the greatest
horizontal cross section of the principal building and all accessory
buildings shall not exceed 20 per cent of the area of the lot

prescribed by this Ordinance.
Rear Yards
(a) In Resid?nce District A there shall be a rear yard the full
width of every lot, at least 5 feet deep in the case of lots not more
shall be added to the required depth of the r e a r yard for each 4 feet
by which the depth of the lot exceeds 50 feet.
(b) In a business or industrial district, where it adjoins a residence district, no building shall be built within 5 feet of a back line.
Courts
In the case of all buildings in all districts, every room in which
persons live, sleep, work or congregate, shall have at least one win- "-'
dow, or ventilating sky light, opening directly either upon a street,
rear yard or side yard, or upon
(a) A court open on one side to a street, side yard or rear
yard, for the entire height of the building, provided t h a t such a court
shall be at least 6 feet in width for a two-story building, the required
width being increased by 3 feet for each additional s t o r y ; or upon
ib) A court completely enclosed, provided the width of such a
court is at least 30 per cent of the average height of the walls.
The least horizontal dimension of a court shall be considered its
width.
Courts or shafts used exclusively for lighting or ventilating bath
rooms, toilets, hallways, or stairways, are exempt from the provision*
of this section.
SECTION 10
The Board of Trustees shall appoint an Inspector of Buildings
and fix his salary. The Inspector of Buildings shall enforce this ordinance under the rules and regulations of the Board of Appeals.
SECTION 11
No work, including excavation, shall be started on any construction or alteration on any private property to cost over one hundred
dollars until a building permit therefore h a s been issued by the Building Inspector and there has been filed in duplicate with the Buildthan 50 feet deep, and in t h e case of lots deeper than 50 feet, one foot
ing Inspector and one copy returned approved by him to the Owner,
plans, drawn to scale, showing the actual dimensions of the lot to t e
built upon, the exact size, height and location of all present and proposed buildings and accessory buildings on the lot and such other information as may be necessary to determine and provide for t h e enforcement of this Ordinance.

The Building Inspector/ the Board of Appeals and t h e Board of
Trustees of the village, or either, shall have the right to enforce the
provisions of this Ordinance by injunction and for other equitable
relief.
SECTION 12—BOARD OF A P P E A L S
(a) A Board of Appeals is hereby established. Such Board
shall consist of five members to be appointed by the Village President to serve without pay. Initial appointments shall be made one
for one year, two for two years and two for three years. Succeeding
appointments shall be made for three year terms. Vacancies shall
be filled in the same manner for the unexpired portion of a term.
(b) All meetings of t h e Board of Appeals shall be public. A
quorum shall consist of three members. At least three concurring
votes shall be necessary for any decision. The Board shall keep minutes of its proceedings.
(c) The Board of Appeals shall adopt from time to time such '
rule's and regulations as it may deem necessary to carry into effec*
the provisions of this Ordinance.

i d ) The Board of Appeals shall have the power to hear and ck
cide a n y appeal from, and to review any order or decision of, the Inspector of Buildings.
(e) Where the street or lot layout actually on the ground varies
from the s t r e e t s and lot lines a s shown on the Building Zone Map, the
district designation shown on the Map shall be applied by the Board
of Appeals to the improperly mapped street on the ground, after due
notice and public hearing, in such a way as to carry out the intent and
purpose of the Ordinance and Map for t h e particular section in question.

(f) T h e Board of Appeals shall have power after public notice
and hearing to prohibit the erection, extension or alterations of any
industry or use t h a t is dangerous, harmful or obnoxious to the community as prescribed in Section 5 (b) or Section 6 (b) above or to
permit it subject to such conditions a s will safeguard the public

( g ) The Board of Appeals shall'have the power to g r a n t in undeveloped sections of the municipality temporary and conditional permits, of not more than one year's duration, for structures and uses
not permitted by this Ordinance in the districts in which they a r e to
be located, but which are necessary to the development of sections in
such districts.

(h) Where there areTpractical difficulties in the way of carrying out the strict letter of any provision of this Ordinance, or where
t h e r e is reasonable doubt as to the exact meaning of this Ordinance

or Map as applied to a specific property, and where unnecessary hardship would thereby result to an owner of the property, the Board of
Appeals shall have the power in a specific case on its own motion or
on petition and after due notice and public hearing, to vary any such
provision in harmony with the general purpose and intent of this Ordinance so that f-« public health, safety and welfare may be secured
and substanti; ;.,: .,ice done: and thus may permit, among other matters:—
(1) T'^e-extension of a non-conforming use or building upon
the lot occupied by such use or building, at the time of passage of
this Ordinance.
(2) The extension of a use or building into a contiguous, more
restricted district, but not more than 25 feet beyond the dividing line
of the two districts.
(3) Any use or building deemed by the Board to be in general
harmony with and appropriate to the uses or buildings authorized in
such district.
(4) Any variation in the height, setback building line, or yards
or courts deemed by the Board to be in general harmony with buildings and uses in a given district, and appropriate to the character of
such buildings and uses as herein authorized in such district.
SECTION 13—INTERPRETATION AND PURPOSE
In their interpretation and application, the provisions of this Ordinance shall be heid to be minimum requirements, adopted foi the
promotion of the public health, safety, comfort, convenience and general welfare. It is not intended by this Ordinance to repeal, abrogate, annul or m any way to impair or interfere with any existing
provision of law or ordinance, or with any rules, regulations or permits previously adopted or issued or which shall be adopted or issued
pursuant to law relating to the use of buildings or premises; nor is it
intended b y ' t h i s Ordinance to interfere with or abrogate or annul
any easements, covenants or other agreements between p a r t i e s ; provided, however that where this Ordinance imposes a greater restriction upon the use of buildings oi premises or upon the height of
buildings or requires larger yards, courts or other open spaces than
are imposed or required by such existing provision of law or ordinance or by such rules, regulations «ir permits or by such easements,
covenants or agreements, the provisions of this Ordinance shall control.
SECTION

14—AMENDMENTS

(a) The Village Board of Trustees may, from time to time, on
its own motion or on petition, after public notice and hearing, amend.

supplement, change or repeal the regulations and districts herein established.
(b) Whenever the owners of 50 per cent or more of the frontage in any district or part thereof between two or more intersecting
streets, shall present a petition duly signed and acknowledge to the
Village Board of Trustees, requesting an amendment,* supplement,
change or repeal of the regulations herein prescribed for such district
or such part thereof, it shall be the duty of such body to vote upon
said petition within 30 days after the filing of the same by the petitioners with the Village Clerk, and it shall require a three-quarters
vote of the Board to make such change. In case a protest against a
proposed amendment, supplement or change be presented, duly signed
and acknowledged by the owners of 20 per cent or more of the front a j e of the property proposed to be altered, or by the owners of 20
per cent of the frontage upon the street or streets immediately in the
rear thereof, or by the owners of 20 per cent of the frontage directly
opposite the property proposed to be altered, such amendment shall
not be passed except by an unanimous vote of the Village Board of
Trustees.
SECTION 15—
PENDING APPLiCATIONS FOR BUILDING PERMITS
Nothing herein con ^ined shall require any change in the plans,
construction or designated use of a building, the construction of which
shall have been started within one month of the date of passage of
this Ordinance, and the ground story framework of which,'including
the second tier of beams, shall have been completed within six months
of the date of such permit, and which entire building shall have been
completed according to such plans a s have been filed, within one year
from the date of the passage of this Ordinance.
SECTION 1 6 - ^ R T I F I C A T E OF OCCUPANCY
(a) It shall be unlawful to use or permit the use of any building
or premises or part thereof, hereafter created, erected," changed, converted or enlarged, wholly or partly, in its us or structure, until a
Certificate of Occupancy shall have been issued by the Inspector of
Buildings. Such Certificate shall show that such building or premises
or part thereof and the proposed use thereof are in conformity with
the provisions of this Ordinance. It shall be the duty of the Inspector of Buildings to issue a Certificate of Occupancy within ten days
after a request for the same shall have been, filed in his office by any
owner, after having determi»e~d that the building and the proposed
use thereof conform with all the requirements herein set forth.
(b) Under such rules and regulations as may be established by

the Inspector of Buildings, a temporary Certificate of Occupancy foi
a part of a building may be issued by him.
(c) Upon written request from the owner, the Inspector of
Buildings shall issue a Certificate of Occupancy foi any building or
premises existing at the time ot passage of this Ordinance, certifying,
after inspection, the extent and kind of use made ot the building OT
premises, including the number of employees and whether such use
conforms with the provisions of this Ordinance.

(d) Each applicant for a Certificate of Occupancy shall pay for
the same the sum of one dollar to the Village.
SECTION 17—VIOLATIONS AND PENALTIES
For any and every violation of the provisions ot this Ordinance,
the owner, agent, contractor, or other person interestefl as lessee, tenant or otherwise in any building or premises where such" violation has
been committed or shall exist, and who refuses to abate said violation
within five days after written notice has been served upon him,, either
by mail or personal service, shall for each and every violation, and ,
for each and every day that such violation continues be subject to" a
fine of twenty-five dollars and the collection thereof shall be prosecuted in the manner prescribed by law or ordinance effective in the Village of North Tarrytown.
SECTION 18—VALIDITY
The invalidity of any section or provision of this Ordinance shall

An application was submitted from the American-Czechoslovak Realty
Corp. and/or Westchester Industries, Inc. for a variance of the Zoning
Ordinance to permit the manufacture and assemble of metal products on
their premises located at 101-103 Cortland Street in the Village of
North Tarrytown.
After discussion on the question by the Board, Mr. Da11ey moved
seconded by Mr. Page, that the Village Clerk, MIBS Beatrice Reilly,
be authorized and directed to insert a Notice in The Daily News that,
a Public Hearing
on the said application will be held on October 22,

1946 at 8:00 o dock P.M. at the Village Hall, North Tarry towns N.X.
