After duly published notice, a public hearing was held before
the Zoning Board of Appeals of North Tarrytown, N.Y. on the above date.

Chairman James Friere called the hearing to order at 8 P.M.
The Clerk read the notice of hearing on application of Mr. S Mrs.
J, W. Kreuttner for a variance from Section 4.220-7-R-2 of the Zoning
' Ordinance to permit the applicants to subdivide premises located at
the southeast corner of Bellwood Avenue and Millard Avenue by reducing
the east-west depth of said premises from 200 ft. to 125 ft,, thereby;
reducing the distance of the rear lot line from the existing residence
thereon to 24.50 ft. instead of the required distance of 25 ft.
Mr. Gasparovic stateaithat the Planning Board would allow him to
re-subdivide his property provided that he obtained a variance from
the Zoning Board after he removed the rear vestibule of the existing
residence as well as the garage and driveway on the east side. The
new owner will have to build a garage and make provisions for a driveway for off-street parking, said Mr. Gasparovic.
Mr. Friere inquired of Mr. Gasparovic as to what provisions will
he make for setback requires, and was answered that he would have the
required footage.
Mr. John Gross moved, seconded by David Page that the application
of Joseph 6 Emily Kreuttner to subdivide premises located at the southeast corner of Bellwood Avenue and Millard Avenue, designated on the '
tax assess .ment map Village of North Tarrytown as Section 14, Block 18,
Lot 3 by reducing the east-west depth of said premises from 200 ft, to
125 ft., thereby reducing the distance of the rear lot line from the
existing residence thereon to 24.50 ft. instead of the required
distance of 25 ft, be and the same is hereby granted and approved,
provided that the present garage and the rear vestibule of the existing
residence be demolished and provided further that the front line set- :
back for construction of a new residence on the newly created lot be .
not less than 40 ft. so as to preserve the building line established
by adjacent residences. Carried,

Mr. Friere advised Mr. Kreuttner that these conditions be inserted
in his deed to the new owner and Mr, Kreuttner agreed to same*

Chairman Friere called the meeting to order at 8:00 P.M.
Counsel Chessari read the notice of hearing to consider an
application by Charles T. Margotta for a variance from the Zoning
Ordinance to permit said applicant to install and attach to the
building located at 332 North Broadway a wooden sign, 36" wide and 44"
high, said sign to extend 42" over the sidewalk.

Mr. Gasparovic stated that he received a call from Miss Lee,
of the

Van Tassel liquor store who voiced opposition to Mr. Margotta s sign.
Mr. Gasparovic stated that upon investigation, he informed Mr, Margotta
that the sign was in violation of the Zoning Ordinance and henceforth,
this request for a variance*
Mr. Gasparovic stated that Mr* Margotta can erect a sign which
could extend six inches from the building.
In the discussion which followed, it was stated that there might
be other requests for overhanging signs and if this request is granted,
the others would have to be also*
Pat Lupi moved, seconded by John Gross that Charles Margotta1s
request for a variance from Section 4*375, subdivisions 2-3-4 of the
Zoning Ordinance to erect an overhanging sign at his place of business
at 332 North Broadway be denied.
Carried.
Counsel Chessari read the notice of hearing to consider an application by Joseph W. Kreuttner for a variance from Section 4.220-7-R-2 to
permit applicant to subdivide premises located at the southeast corner
of Bellwood Avenue and Millard Avenue by reducing the east-West depth
of said premises from 200 ft. to 125 ft. and reducing the distance of
the rear lot line from the existing residence to 19.47, instead of
25 ft.
Mr. Gasparovic stated that the Planning Board met on August 31,
1965 to discuss Mr. Kreuttner's request for resubdivision of his
property.
The Planning Board finds that no hardship exists since
the dwelling presently located on said lot was intended to occupy the
entire lot, said Mr. Gasparovic,

�To subdivide the said lot which would create a new lot, would in
the opinion of the Planning Board, tend to downgrade the adjoining
land values and would also cause to create an existing dwelling, which
at present j is conforming to be nonconforming in regard to rear yard
setback requirements as per section 4*220 R-2-7, 25' -8" rear setback
line, Mr. Gasparovic stated that the status of the present lot is
conforming, and to change it as per Mr, Kreuttner's request would be
in violation of Section 4.120 which reads as follows:
"No building shall hereafter be erected and no existing building
shall be moved, altered, added to, or enlarged, nor shall any land or
building or portion of a building be used, designed, or arranged to be
used for any purpose unless in conformity with all of the regulations
herein specified for the district in which it is located."
In the discussion which followed, it was stat ed that the Planning
Board has denied Mr t Kreuttner's request for re-subdivision oh Section
14, Block 18v Lot 3 and a variance should not be granted*
Pat Lupi moved, seconded by John Gross that in view of the report
submitted by the Planning Board in denying Mr. Kreuttner's request for
re-subdivision, the Zoning Board of Appeals has no jurisdiction to
grant such a variance and that said request be denied. Carried.
There being no further business to come before the meeting,
John Gross moved, seconded by Pat Lupi that the same be duly adjourned,
Carried.

Chairman Friere called the meeting to order at 8:05 P.M.
The addition of a roof for an existing open porch, 2nd floor, for
a residence located at 12 Maple Street owned by Mrs. Julia Gallinger,
in Section 17, Block 10, Lot 14 was discussed at a special meeting to
determine the granting of a variance from the above section.
After due study and discussion in reference to the "Section 4.220R-4-7, Required yard and open space of the Zoning Ordinance of the
Village of North JTarrytown, N.Y.", it was determined that no hardship
existed since thej^orch existed many years in its present state. It may
be repaired, but to grant a variance so that the porch would be
enclosed would defeat the purpose and intent of the ordinance and
thereby create a precedent for other future appeals.
The request for a variance from Section 4.220-R-4-7 Zoning
Ordinance of the Village of N. Tarrytown, N.Y. would be denied.

Mr. James Friere called the meeting to order at 8 P.M.
Counsel Chessari read the first notice of hearing to consider
application of Joseph Migliarese for a variance from Section *f.220,
R-5-5 to permit the applicant to construct a four-family apartment
building on an area of 6250 square feet instead of 6500 square feet on
property located at 152 Depeyster Street and also known as Section 16,
Block 8, Lot 14 on the tax assessment map.
Mr. Gasparovic stated that the Building Department sees no objection
and recommended that the variance be granted.
Mr. David Jarema moved, seconded by Pat Lupi that Mr. Migliarese
be granted a variance from Section *f.220, R-5-5 of the Zonning Ordinance
to permit him to construct a four-family apartment building on an area

Counsel Chessari read the notice of hearing to consider an
application by Edmay 8 Lewis Realty Corp. for a variance from the
Zoning Ordinance from Section 4.356 to permit applicant to install and
maintain an ornamental wicker type board fence eight feet in night
instead of five feet at the rear of premises at 9 Barnhart Avenue and
known oh the tax assessment .map as Section 15, Block 7, Lot 6.
Mr. Gasparovic stated that he was in receipt of a telephone call
inquiring about the 8 ft. fence whichvMr. Martin had erected. Upon
investigation, Mr. Gasparovic stated that he informed Mr. Martin that
the fence was in violation of the Zoning Ordinance which calls for a 5
ft. fence. Mr. Gasparovic stated that Mr. Martin informed him that
he wanted to enclose the yard, which was being used as a beer garden, so
that it would not be objectionable to residents; however, he informed
Mr. Martin to either take the fence down or obtain a variance.
Mr. Neimark, attorney for Mr, Martin, stated that the fence was a
great improvement to the property.

owners who informed him that they had no objection to the fence.
Mr. Neimark stated that if neighbors had any objection to the

Mr. Gasparovic stated that the applicant applied for a building
permit, but was informed that a variance be obtained since the work
contemplated does not conform to the Zoning Ordinance.
Mr, Gasparovic stated that surrounding property owners have
abutting stairs and a hardship exists on the owner. The Department has
no objection to the Variance, said Mr. Gasparovic.

Mr. John Gross moved, seconded by David Page that Mrs. Elvira
Margotta be permitted to extend the upper part of the southerly store
front at 322 North Broadway, known on the Village map as Section 17,
Block 20, Lots 1-6, a distance of 8" beyond the face of the building,
which extension shall be fourteen (14) feet from the surface of the
sidewalk, and that she be also permitted to install one step, 6 1/2"
high and 12" deep and 5 feet wide, which step shall project out on to ,
the sidewalk.
Carried.
A letter was read from Mr, Irving Neimark, requesting a variance
from Section 4.356 of the Zoning Ordinance to permit an eight foot
fence, instead of the required five feet in the rear of property owned
by his clients, Edmay and Lewis Martin, 9 Barnhart Ave.
Mr. Gasparovic stated that Mr. Migliarese will be requesting a
variance for property he purchased on Depeyster Street.
Following a short discussion, two public hearings will be scheduled
for Messrs. Martin and Migliarese, as soon as the latter's request is
received.

A special meeting was held before the Zoning Board of Appeals of
the Village of North Tarrytown, N*Y. was held on the above date.

Chairman James Friere read a letter from Elvira Margotta who
requested a variance for a store front to protrude eight inches &lt;8")
beyond the face of her building at 322 North Broadway and for one step
to project out on to the sidewalk.
Following a short discussion, the Building Inspector was instructed
to contact the State authorities for approval before a public hearing
is held.
A discussion was held regarding Mr. Adelard Mallet's request for
a variance to build a five car garage to the property line on Depeyster
Street. Mr. Mallet's request is illegal in accordance with the Zoning
Ordinance.
It was stated that Mr. Mallet must comply with the Zoning Ordinance
which requires ten feet from the main building and three feet setback
on all sides for construction of a three car garage. A five car garage
is not permissible.
There is no hardship on Mr. Mallet's request.
Following a
discussion, a letter was directed to be sent to Mr. Mallet that his
variance as request cannot be granted,
Mrs. Marian Bushel's request to construct a garage to the property
line was also discussed. Her property is located on Depeyster Street.
It was stated that the garage can be replaced provided that the new
garage has a three foot setback from the side line of Mr, Mallet's
property. Since no hardship is shown as per Mrs. Bushel's request,
a letter was ordered sent to her that the Zoning Board of Appeals cannot
grant her a variance from the Zoning Ordinance.
There being no further business to come before the meeting,
the same was duly adjourned.

dwelling and since the lot was very short, he advised the Tornellos
to request a variance to construct the house within 20 fe«t of the
rear property line.
No other comment for or against the variance, John Gross moved,
seconded by David Jarema 1:hat Mr. and Mrs. Patrick Tornello be
permitted to construct a one family dwelling within twenty feet of
the rear property line, instead of the required twenty-five feet.
Carried.
An application for a variance was received from Mrs. Marian Bushel,
155 Depeyster St., to build a one car garage for storage to her property
line. Since no plans were submitted with the application, the Clerk
was instructed to notify her of same before any consideration is given
to her application.

of March, 1965, at 8:00 P.M., in the Municipal Building, 28 Beekman

LeRoy C. Brown and Frances R. Brown, his wife, for a variance from the
^oning Ordinance of the Village of North Tarrytown to permit them to
construct a one room addition at the rear of their home at m Kingsland
Road, North Tarrytown, N.Y., leaving a distance of 20 feet to the rear
lot line of their property instead of the required 25 feet.

Chairman Friere asked if there was anyone present who would like
to comment on the requested variance,
Mr. Gasparovic, Building Inspector, stated that the building
department could not issue a permit to Mr. S Mrs. Brown because the
Zoning requirement for rear line is 25 feet and the addition was
going to be built within twenty feet of the rear line.

Mr. Gasparovic stated that he suggested they request a variance
from the Zoning Board of Appeals.
No other comments for or against the variance, John Gross moved,
seconded by David Page that Mr. and Mrs. LeRoy Brown be permitted to
construct an addition to a point within twenty feet of the rear
property line, instead of the required twenty-five feet.

Mr. Seymour Robinowitz, 199 Main Street, White Plains, appeared
in behalf of Mr. Albert Dorfman, 177 East Post Road, White Plains, to
ascertain whether or not his client would be permitted to rebuilt
152-15H Depeyster Street, which was destroyed by fire. The building
at the present time is non-conforming, said Mr. Robinowitz.

�«2Mr. Gasparovic stated that he informed Mr. Dorfman that he should
first submit a set of plans to the Planning Board and if the Planning
Board does not approve of same, he should then request a variance from
the Zoning Board of Appeals.
Mr. Gasparovic explained that in accordance with the new Zoning
Ordinance, any dwelling which is destroyed by fire 50% or more, cannot
be rebuilt. 152-15H Depeyster Street was destroyed over 50%, said
Mr. Gasparovic, and having a non-conforming use, cannot be rebuilt as
a three story frame multiple dwelling structure.

Mr. Gasparovic stated that the State Inspector and himself agreed
that the building should be demolished.
The Fire Department insists that side yards on new dwellings be
enforced.
Mr. James Friere informed Messrs. Robinowitz and Dorfman that the
Board will study the matter further.
