Zoning Board of Appeals of Morth Tarrytown, N.Y. on the above date.

Chairman Friere appointed S. J. Chessari as Acting Secretary and then
declared the hearing open.
Acting Secretary Chessari read the public notice of hearing which
had been printed in the Tarrytown Daily News on December 11, 1967.
A. Gasparovic explained to the members of the Board that Mr. Donzella
had applied for a building permit for/the construction of a one family,
residence on his property at the southwest corner of Hudson Terrace and
Bedford Road, No. Tarrytown, N.Y.
Since the plot plan.submitted by Mr. Donzella for the construction
of said residence showed that the.front yard"requirements of the Zoning
Ordinance would be violated, Mr. Donzella's request for a building permit
was denied.
Mr. Gasparovic informedMr. Donzella that in order to construct said
residence, he would have to obtain approval from the Zoning Board of Appeals
of a variance of seven ;(7) feet;from the front line of his property,
thereby leaving a distance of thirteen (13). feet to the^front line of his
property instead of the required distance of twenty (20) feet. Whereupon
application for such above described variance was filed by Mr. Donzella.
Mo one appeared in opposition to Mr. Donzella's application.
After a thorough discussion analysis and review by the members of the
Board, including examination of:applicants' plot plan and other related
documents filedwith the said application, Dr. Brady moved, seconded by
David Page and unanimously carried:
Resolved: that application of Salvatore G. Donzella is approved
and variance granted in the manner above described.

Counsel Chessari read the notice of hearing to consider an
application by Andrew Avellino, owner of premises known and designated
on the tax map of the Village of North Tarrytown as Section 16, Block 5,
Lot 1, and also known by the street number 110 Beekman Avenue, for a
variance from the Zoni ng Ordinance for approval and to permit FEZ
Accessories, Inc., les see of the second floor area thereof, temporary
occupancy and use of said second floor area for the partial manufacture
of Ladies1 Millinery s ubject to the provisions, terms and conditions
required by Section 62 -40 Subdivision D-Temporary Uses-of said Zoning
Ordinance.
Mr. Gasparovic stated that^under Sec. 62-40-Subdiv. D, the
Zoning Board of Appeals can grant variance for use requested by
applicant, but for only 12 months and may, upon application, be
renewed for another 12 months only.
Following a discussion, David Page, seconded by Pat Lupi that
a variance be granted on; application"? of Andrew Avellino to permit FEZ
Accessories, Inc., temporary occupancy and use of said second floor
area for the partial manufacture of Ladies• Millinery subject to the
provisions, terms and conditions required by Section 62-40, Subdivision DTemporary Uses, on a 12 month period commencing September 1, 1967 September 1, 1968.
Carried unanimously.

Chairman Friere called the hearings to order at 8:00 P.M.
Counsel Chessari read the first notice of hearing to consider the
application of Mr. Frank Addessi for a variance to permit him to construct
and erect a closed, screened porch on the south side,of his property known
and designated as:Section 14, Block 28, Lot 8A leaving a distance of
8.64 feet from the southerly property line of said property, instead of
the required fifteen (15) feet.
Mr. Addessi explained that the purpose of the porch, which will be
on level of remainder of the house, is for his wife who is handicapped
and must use crutches to assist her in walking, to use the porch for
relaxation.
Following a short discussion, Mr. Lupi moved, seconded by Mr. Gross
that the variance be granted to Mr. Addessi to construct and erect a
closed, screened porch on the south side of his property leaving a
distance of 8.64 feet from the southerly property line of said property
instead of the required fifteen (15) feet.
Carried Unanimously.
Counsel Chessari read the second notice of hearing to consider an
application by Humble Oil S Refining Co. for a variance to permit and
allow the installation of a new 6,000 gallon gasoline storage tank on
property known and designated as Section 17, Block 12, Lot 1 leaving
a distance of twelve (12) feet from the Broadway (Route 9) line of said
property instead of the required twenty-five (25) feet and in addition,
to permit and allow the installation of a new 6,000 gallon gasoline
storage tank on said designated property leaving a distance of fifteen
(15) feet from the Hudson Terrace line of said property, instead of the
required twenty-five (25) feet.

�Mr. Barnett, Engineer of the Humble Oil 8 Refining Co., stated
that according to Section 1623 of the Fire Prevention Code, no distance
is required, and cited several communities where ty a distance of three
feet was required from the property line.
Mr. Lupi inquired as to how many tanks were on the property now
and Mr. Barnett stated that there were five tanks now and none of these
are being eliminated.
Chief Michael Apollonio inquired as to why the additional two
6,000 gallon^storage tanks. He stated that he opposed the variance
because of the bad location of the service station. Runaway trucks
from Bedford Road makes it dangerous also, said the Chief.
Following a discussion, Dr. Brady moved that the variance be
granted, seconded by Mr. Gross.

After examining and analyzing the Sketch submitted by applicant
showing an existing ten inch concrete block wall only a few feet away
from the proposed excavation for and construction of the east foundation wall of applicant's proposed residence, the Board found, as
pointed out by applicant, that to require appliaaflt to comply with the
present twenty (20) feet front line set back under the Zoning Ordinance
woujd.create many serious and severs, building problems causing undue
hardship during the course of construction as well as increasing costs
thereof considerably.
: After further discussion and deliberation by the members of this
Board, on motion by John Gross, seconded by David Page, and unanimously
carried:

Chairman Friere opened the hearing arid requested Acting^Clerk
Chessari to read the notice of public hearing.
Antonio:Iannarelli, applicant stated to the Board that he
planned to increase -the number of apartments'in the building from
five to six by splitting up the third floor from one to two apartments
and that while the present zoning ordinance would require six parking
spaces for six automobiles by creating the additional apartment, Mr.
Iannarelli requests the Board to grant him a variance to permit him
off-street parking for five parking spaces instead of the required
six parking spaces.
After examining and analyzing the survey submitted of this
property, the Board found that the maximum * square .footage of the
rear yard was 45 square feet and while the area was large enough for
four parking spaces, it was not large enough to create a fifth parking

Zoning Board of Appeals of the Village of North Tarrytown, NY., on

Mr. James Friere called the meeting to order at 8 P.M.
Clerk Fallacaro read the notice of hearing to consider an
application of Frank B. 8 Helen Zivica for a variance from the
Zoning Ordinance to permit them to construct a one family residence
on property known and designated on tax map as Section 17, Block 23,
Lots H9,50,51 £ 53 leaving a distance of eighteen (18) feet from the
front line of said property to front of northeast corner of said
proposed residence instead of the required twenty (20) feet.
Mr. Gasparovic stated that several variances were granted to.
other property owners in the area and as far as the Building Department
is concerned, he would have no objection to the variance.
Mr. Pat Lupi moved, seconded by Mr. David Page that a variance
be granted to Frank £ Helen Zivica to construct and erect a one.

from the front property line instead of 75 feet be granted. Carried.
