After duly published notice, two public hearings were held before
the Zoning Board of Appeals of the Village of North Tarrytown, N.Y. on
the above date.

Chairman Friere called the hearing to order at 8 P.M.
The Clerk read notice of hearing to consider an application by
Charles S Joan Shibetti for a variance from the Zoning Ordinance of the
Village of North Tarrytown, Section 62-8B-R-4-7 front yard requirements,
to permit construction of a one family residence on premises located on
the sou*|h side of Mahoney Place 100 ft. west of New Broadway in said
Village^ designated on the tax assessment map of said Village as
Section 17, Block 20, Lot 34- leaving a distance of ten ft. to the front
line of said property, instead of the required distance of twenty feet*
Mr. Friere asked if there was anyone present who would like to make
any comment.
Mr. Peter DeGaetano, Attorney for the Shibettis submitted proof
that registered letters were sent to property owners surrounding his
property•
Mr. Gasparovic stated that Mrs. Shibetti came before him for a
building permit and wanted to know if she could build the house with a
ten ft. setback, instead of a twenty ft. setback. The Building Dept.
could not give her a permit upon such a request without a variance,
said Mr/: Gasparovic. She was advised to make application for a variance
to the Zoning Board of Appeals.
Mr.r DeGaetano inquired that if Mr. Shibetti's
automobile is parked
in the driveway and extends beyond the front yard of his property, would
a variance be required and he was answered no.
Mr.' DeGaetano stated that the Shibettis are long time residents of
North Tarrytown.
Mr. Shibetti works in Fisher Body and is a member of
the Fire" Department, said Mr. DeGaetano and since there is a shortage of
lots in florth Tarrytown has settled on this particular lot.
Mr. Friere asked Mr, Lofaro if ther^ wa» another house on the
street and he stated Mr. Joseph Lofaro's.
Mr. Friere asked Mr. Lofaro if he had any objection to the variance.

Mr t Lofaro stated that Mr. Shibetti explained the situation to him
and he had no objection so long as his kitchen would not be blocked.
Following a discussion, the Board reserved decision until such
time as the Board reviewed the request. A meeting was scheduled for
April 29th at 6:30 P.M. at Mahoney Place for a decision.
The Clerk read the notice of hearing to consider an application by
Caleb and Susanne Curtis for a variance from the Zoning Ordinance of
North Tarrytown to permit the construction of a one family residence
on each -of the following lots on the tax assessment map of the Village
of North Tarrytown designated as Lot 2, Block IT, Section 11 having a
width of 97.11 ft. and an approximate square foot area of 10,450 ft.
and lot;16, Block IT, Section 11 having a width of 98 ft. and an
approximate square foot area of 10,450 ft. instead of as required by
S* &gt;.t' ^n :62-8B, District R-2A-5 of said Zoning Ordinance requiring a
minimum ;width of 100 ft. and a square ft. area of 15,000.
Mr* Curtis presented proof that registered letters were sent to
surrounding neighbors regarding notice of this request for a variance.
Mr* Curtis stated that an amendment was made to the Zoning Ordinance
on December 18th regarding the area of lots and width of lots in Sleepy
Hollow Manor which would pertain only to new lots. However, since the i
Court of Appeals handed down a decision which affected his lots and
since they are being sold to Mr. M. Harmon, he would like this matter ;
clarified.

Mr,' Gasparovic stated that he did not feel that a variance was
necessary; however, a case came up in Bronxville whereby the Supreme'
Court, $tate of New York, ruled that a variance must be granted to a
property owner who has a lot adjacent to his property -that property
was a conforming lot before the ordinance became into effect.
Mr,! David Bamford, President of the Sleepy Hollow Taxpayers1
Association, stated that the people in Sleepy Hollow Manor are in support
of thisramendment since it would not apply to existing lots.

The Clerk read a letter from Mr. £ Mrs. Nathans who objected to
the variance.
Following a discussion, Pat Lupi moved, seconded by David Page that
Mr. S Mj?s. Caleb Curtis be granted a variance from the Zoning Ordinance
of the Village of North Tarrytown to construct a one family residence :\
on eachfof the following lots on the tax assessment map of the Village
of North Tarrytown designated as Lot 2, Block IT y Section 11 having a»
width of 97.11 ft. and an approximate square foot area of 10,450 ft.
and lot 16, Block IT, Section 11 having a width of 98 ft. and an
approximate square foot are&lt; of 10,450 ft. instead of as required by

Counsel Chessari read the notice of hearing to consider an appla~-tio?
by Howard Kissling, as owner, and Tappan Motors as lessee, of premises hereinafter described for the following variances from the Zoning Ordinance:
1. Variance from Section 62-8B-CI, Col. 7 of schedule of regulations
thereof of said ordinance, Rear Yard Requirements, to permit said
applicants to construct a second story addition at the rear of the
building located at the northwest corner of New Broadway and Route 9 on
premises designated on the Tax Assessment Map of said Village, leaving
a distance of five feet from the rear property line of said premises
instead of the required twenty feet, and 2. variance permitting alternate
off-^ite parking space on premises designated on the Tax Assessment Map I
of s^id Village as Section 15, Blfcck 1H, Lot 17 as authorized by Section^
62-lH-B(if) of said ordinance instead of compliance to the provisions of \
Section 62-14-B(l) of said ordinance requiring on site parking space on ;
the Same lot appurtenant to applicant's business.
?Mr« Peter Blasi submitted proof that registered letters were sent
to surrounding property owners.

'Counsel Chessari read a letter directed to the Board of Trustees
from the Neighborhood Association opposing the granting of the variance.
Mrs. Mary Ward stated that there are anywhere from 10-15 cars
parked daily on New Broadway and inquired if there were going to be the
same number of cars on the street or will there be more.
Mr. Peter Blasi stated that parking is
plan which has been submitted.

Mr* Blasi stated that additional space for parking has been made
in the lot across the street and employees will be instructed to use it
if the variance is granted.
; Mr, William Patten stated that he was delegated by the Webber Park
Association at a meeting held on May 3rd and presented a petition sir ;
by residents of the Neighborhood opposing the variance*
; Mr. Friere stated that anyone can park on any street as long as
there is not a sign prohibiting parking*
Mr. Gasparovic stated that in the original parking facilities for
his building, there is provision to park on site and there if off-street
parking for 15 cars*
As far as the new plan submitted, Mr. Gasparovic
stated that they will park 7 cars and will have a loading spane.
Additional cars will be parked on Lot 17, said Mr. Gasparovic. This
would be ample room for parking if it is complied with, he said, and
aloo complies with the Zoning Ordinance.
'; Dr. Brady inquired if there was anyway that the police can see
that there should be a certain number of cars parked in the lot.
Counsel stated that the Zoning Board can restrict the number of
cars to be parked•
•Mr. Blasi stated that if the variance is granted, it would be
granted as per the plan presented. If it is violated, it will be on the
same purpose as the permit issued by the inspector, said Mr* Blasi*
The Inspector would be in a position to either file a notice of
violation or to pressure whatever remedies are available in the law or
Zoning Ordinance, said Mr. Blasi*
\ Mr. Blasi stated that he understands the Neighborhood Association
would have some questions and qualms, however, the Village passed a new
ordinance which created the setback change*
Mr* Blasi stated that Mr*
Matspn, the architect, is trying to make an improvement of the build: ^,
This•would eliminate the throwing of debris, etc*, said Mr* Blasi* If
it were a new building and we wanted to come in within five feet, then
thejfe might be cause for complaint, said Mr* Blasi* The existing
building is five feet from the line, said Mr# Blasi.

.Mr. Swaby inquired as to what is the usage now as far as the
occupancy is concerned and how many cars * are being parked in the building
and pn the parking lot there now.

Mr. Gasparovic stated that there were no requirements at the time _
because it was non-conforming* An agreement had been made with Mr*
Kissling to park 15 cars*
Mr* Swaby stated that this would not relieve the congestion on
New proadway*
Mr. Patten stated that he consulted with the Chief of Police and
was told that there was no way legally to force employees to park on
the lot.

Dr. Brady pointed out that we-were not interested in the parking,

Mr. Blasi stated that his client would instruct the employees to
park in the lot. As far as the parking plans are concerned, there are
more than enough, said Mr, Blasi. If the Trustees want to pass
regulations there is nothing we can do about it,said Mr. Blasi.
Mr. Friere stated that the variance being asked has enough spaces
sufficient for parking.
In answer to a question by Mr. Patten, Mr. Friere stated that we
as a* Board would never stop property owners from building. If the
building was not already on the property, we would not even consider
the setback. All the property owner is doing is asking for the building
to go straight up, said Mr. Friere.
; Mr. Blasi stated that Mr. Benny Ginnetti, adjacent owner, brought
out a point whereby he did not care to have the windows facing his
property. Acccv- !ing to the plans, the windows are on the north side,
however, if Mr. Ginnetti does not want them on that side, a solid wall
would be made instead, said Mr. Blasi.
It was thought that the
windows would be more attractive, said Mr* Blasi.
&lt; In summing up, Mr. Friere stated that there are enough spaces for
parking in this request for a variance and it could be stipulated in the
variance that they must park in their lot. It would be up to the
building inspector to report any violation and have a summons issued.
^Counsel Chessari stated that if the Board decides to grant the
variance, it can impose certain conditions•
It would be a must that
Mr. Kahn, as well as Mr. Kissling, would have to direct their employees
to pkrk across the street in the*other lot, said Counsel.
Mr. Friere informed the applicants that the Board will make a
decision at a future date.
\The Board reconvened in executive session and it was stated that
before a decision is made, a plan of the lot on North Broadway should be
submitted to the State Dept. of Public Works for their approval for
egress and ingress.
The Clerk was instructed to inform the applicants'
of same.

Chairman Friere called the meeting to order at 6 P»M,
! Mr. Gasparovic, Building Inspector, stated that 79 College Avenue :
is being rehabilitated so that families from the Urban Renewal Project
area may be relocated into the building. Government monies are being
used to rehabilitate the building, said Mr, Gasparovic« If the building
was non-conforming, off-street parking would not be necessary, said Mr.
Gasparovic; however, in order to conform with the Zoning Ordinance, a
variance on square footage and exempt from off-street parking was
necessary.

Present

;Counsel stated that non-profit corporation is under the FHA rules
and regulations and each member of the Board is a director.
This
request is being made by the Village in order to conform with FHA
regulations, said Counsel.
Mr. Swaby inquired as to what alternative proposals would they have
for parking. There is not enough parking, he said.
Mr. Swaby inquired if the variance is granted, would it be for this.
Corporation only or does it apply to future owners.
Counsel stated that so long as the non-profit Corporation is the
owner, it would only apply to them.
Mr. Charles Vidal, College Avenue, stated that if a wall is built, ;
there will not be any room on the 25 ft. lot for parking.

Mr. John Vlacancich, 65 College Avenue, stated that the building
should be demolished and parking available for residents.
During the meeting, it was suggested that the tenants in 79 College
Avenue utilize parking available in Margotta Courts and this would be !
recommended by the Zoning Board.
Following a discussion, Dr. Brady moved, seconded by Edward Swaby *
as follows:

That 79 College Avenue North Tarrytown, N*Y. Housing Development
Fund Co., Inc., with respect to premises known as 79 College Avenue
Section 16, Block 1H9 Lots 18-19 be granted the following variances from
the Zoning Ordinance of said Village of North Tarrytown:

minimum size of lot-required lot area 11,000 square feet,"to actual area
of said above described premises, including the existing building,
containing 5,500 square feet, instead of the required 11,000 square feei.

Off-Street Parking for Tenants, 1.2 spaces per dwelling unit so that,
after the rehabilitation of said existing building, the said above
described premises shall be totally exempt from the requirement of offstreet parking.

After duly published notice, two public hearings were held before
I) the Zoning Board of Appeals of the Village of North Tarry town, N.Y. on
the above date.

- Chairman Friere called the meeting to order at 8 P.M.

Counsel Chessari read the first notice of hearing to consider an
application for a variance by Mr. John Malandrino, dba Malandrino Delicatessen, Inc. and Malandrino Coffee Corner 8 Restaurant, premises
designated on the Tax Assessment Map as Section 16, Block 6, Lots 1 and
1A to permit applicant to extend the rear of existing buildings six (6)
feet, thereby increasing the building area an additional 150 sq. ft.
Mr. Gasparovic stated that Mr. Malandrino asked for a permit to
enlarge his area by 150 sq. ft* Legally« no permit could be obtained
until a variance is received, said Mr Gasparovic.
Mr. Friere stated that Mr. Malandrino contempates tearing down the
rear porfch,- and building a solid area.
Mr. Malandrino submitted proof that registered letters were sent to
surrounding property owners.
Mr. Page questioned the matter of fire escapes.
Mr. Gasparovic stated that he will install them directly to the
ground level.
Mr. Gasparovic stated that Mr. Malandrino will have to subno.t pl?.r&gt;s
to the State Dept. of Labor indicating exits, also.

Mr. Pat Lupi moved, seconded by Dr. Brady that John Malandrino, dba
Malandrino Delicatessen, Inc., and Malandrino Coffee Corner S Restaurant,
Incj, located at 60-62 Beekman Avenue, be granted a variance on premises
designated on the Tax Assessment Map of the Village of North Tarrytown as
Section 16, Block 6, Lots 1 and 1A, from Section 62-8B-2-8 permitting /
saicj John Malandrino to extend the rear of existing buildings six (6)
feet, thereby increasing building area thereof an additional 150 square
feet, for the purpose of erecting and constructing an addition at the
rear of said existing buildings, for enlarging the kitchen facilities in
connection with the restaurant and delicatessen businesses conducted on^the above-described premises by the said applicant. Total maximum
building area coverage of said premises, including said addition will
be increased to 64.7% of the total area of said above-described premises
instead of the required maximum 60% thereof.

James 8 Victor Albanese, dba Pickwick Post, for a variance from the
Zoning Ordinance of said Village permitting alternate off-site parking
space on premises designated on the Tax Asseasment Map of said Village .
as authorized by Section 17, Block 21, Lots 45, 46, 47, 48, 49, 50 S 51,
as authorized
by Section 62-14-BC4) of said Ordinance instead of compliance

with the provisions of Section 62-14-B(l) of said Ordinance on-site
]
parking space on the same lot appurtenant to applicants * restaurant
business.
[ Mr. James Albanese submitted proof that neighboring property owners
were; notified of his request.
,;Mr. Gasparovic stated that Messrs. Albanese had requested the
Board of Trustees to change the zoning for off-street parking. The Board
;
referred the matter to the Planning Board to ascertain whether or
not the area could be aonedfor business. Although the Planning Board
would not agree to the areafbeing changed into business, they did take
into consideration the lack of off-street parking facilities and have
recommended that a request for a variance be obtained from the Zoning
Board of Appeals for relief.
Mr. Gasparovic stated that the Messrs. Albanese, will blacktop the
area and erect a retaining wall.
They are also willing to install
lighting and screen the area as required by the Zoning Ordinance, said
Mr. Gasparovic.

Mr* Joseph Ferrone, attorney for Messrs, Albanese1, stated that the
applicants comply with all requirements as set forth in Section 62-21
of the Zoning Ordinance•
Following a short discussion, Pat Lupi moved, seconded by Edward
Swaby, that a variance be granted to Messrs. James and Victor Albanese
dba Pickwick Post, from the Zoning Ordinance of said Village permitting
alternate off-site parking space on premises designated on the Tax
Assessment Map of said Village as Section 17, Block 21, Lots 45, 46, 47 j
48,:49, 50 S 51, as authorized by Section 62-14-BC4) of said ordinance i
instead of compliance with the provisions of Section 62-14-B(l) of said;;
ordinance requiring on-site parking space on the same lot appurtenant to
applicants1 restaurant business.
This variance applies solely in connection with the use of restaurant
business. Carried.

Mr. Gasparovic stated that a letter was received from the State Dept.
of Public Works approving plans in connection with entrances for offstreet parking on Broadway for Tappan Motors.

Mr. Friere stated that a decision was held in abeyance until such
time as approval was received from the State Department of Public Works.
Following a discussion, Dr. Brady moved, seconded by David Page, that
Howard Kissling, as owner, and Tappan Motors, Inc., as Lessee, be granted
the following variances from the Zoning Ordinance of the Village of
North Tarrytown:

�1. Variance from Section 62-8B-C1, Col. 7 of Schedule of Regulations,
;
thereof of said Ordinance - rear yard requirements - to permit said
applicants to construct a second story addition at the rear of the
building located at the Northwest corner of New Broadway and Route 9
(Albany Post Road) on premises designated on the Tax Assessment Map of
said Village as Section 17, Block 20, Lots 23, 2**, 25 and 25A, leaving
a distance of five (5) feet from the rear property line of said premises,
instead of the required twenty (20) feet, and
2. Variance permitting alternate off-site parking space on premises
designated on the Tax Assessment Map of said Village as Section 15,
Block; Hf, Lot 17, as authorized by Section 62-14-BCO of said Ordinance
instead of compliance with the provisions of Section 62-14-B(l) of said
Ordinance requiring on-site parking space on the same lot appurtenant
to applicant's business. Carried.
There being no further business to come before the meeting, Edward
Swaby; moved, seconded by Dr. Brady that the same be duly adjourned.

After published notice, a public heading was held before the
Zoning Board of Appeals of the Village of North Tarrytown, N.Y. on the
above date.

Hearing declared open by Chairman Friere.
Acting Secretary Chessari read notice of hearing which had been
published in Tarrytown Daily News on November 16, 1968.
Mr. Gasparovie submitted applicant's survey and explained to the
Board the basis of applicant's application for a variance of seven (7)
feet from the northwest corner of the foundation wall to the rear yard
line of applicant's property designated on the Tax Assessment Map as
Section 17, Block 12, Lot 8A, instead of the required distance of 25 feet.
'Applicant also presented to the Board his reasons for requesting
such variance as outlined in his application submitted to the Board,
dated November 4, 1968.
No one appearing in opposition to the requested variance, Chairman
Friere declared the hearing closed.
After a careful analysis and discussion by the Board of the facts
upon?which applicant based his request for the variance above described,
and after deliberation, Dr. Brady moved, seconded by Mr. Swaby and
unanimously carried, that the application of-Salvatore G. Donzella for a
rear;yard
variance of seven (7) feet as outlined in such application be

same is in all respects granted and approved.
Chairman Friere polled the Board and the vote was as follows:
