A hearing was held before the Zoning Board of Appeals of the
Village of North Tarry town*,- M»Y. on the above date. .

Mr. Friere called the hearing to order at 8:00 P.M.
Counsel Chessari read notice of hearing to hear and consider an
application by Tarrytown Realty Corp., owner of premises located at
300 North Broadway designated as Section 17, Block 20, Lot 25 on the
Tax Assessment Map for a variance from Section 62-15A and B 8 E of
the Zoning Ordinance to permit the erection of a fascia sign 4 ft. by
55 ft., said total area of sign exceeds the area limitation.
Mr. Vincent Frontero, 366 No. Broadway, Jericho, N.Y. stated
that his client is applying for a variance to enable the applicant
to erect a fascia non-illuminated sign for his agency on Route 9
bearing the name of Tappan Motors.
The present sign has been blocked
by the traffic directional sign which was installed by the"State
Traffic Dept., said Mr, Frontero.
This sign'is to conform1with
the sign program initiated by the Chrysler Corp.; The sign will in
no way create a traffic hazard, said Mr. Frontero.

be removed, but Mr. Kahn stated that it was not his intention to do so.
Mr. David McClintock, 22 New Broadway, statedTthat he never had
any trouble seeing his present sign.
If the Zoning Board has a
regulation for signs, they should abide by this regulation, said Mr.
McClintock.

�-2Mrs. Harry Lewis, 260.Kelbourne Avenue,:stated that she did
not know that the application was for a larger sign.
She stated that
there were too many signs at that corner and if this variance is
granted, there would be requests for more large signs,
Mrs. Mary Ward, 26 New Broadway, agreed that we have too many
signs now.
She stated that there was plenty of advertising both
inside and outside the building.
Mr. Kneeland Moore, 5 Harwood Avenue, stated that he worked with
Mr, Gasparovic on the Planning Board and felt that the restriction
included in the Zoning laws met all needs of commercial people and
for the character of the Village.
He statednrhat he did not feel
the variance was needed,
Mrs. Kneeland Moore, 5 Harwood Avenue, representing the
Conservation S Beautification Committee, agreed with Mrs. ^ Lewis and
that the variance would hardly improve the looks of the Village.
Mrs. Henry Silver, 263 Kelbourne Avenue, stated that she did
not wish to see the Zoning Law broken, as far as the large sign is
concerned.
She stated that she felt the pairing meters should be
removed on North Broadway since no one puts money in them,
Mr. Friere stated that parking is not within the jurisdiction
of the Zoning Board.

Mr. Caraley stated that the Zoning Board is very specific of
findings and does not see that they exist in this case, Reading
from the ordinance which refers to hardship, Mr. Caraley questioned
Mr. Frontero that he has not submitted any material at all fulfilling
the conditions,
Mr, Frontero stated that his client is being impeded by a
traffic sign which would be a unique hardship with^respect to this
specific property and that the State requires a sign identifying the
business.
In answer to Mr, Caraley1s question if the State required a
254 sq, ft, sign, Mr. Frontero answered that the State does not
specify the size.
Mr. Caraley noted that the ordinance does not prohibit the
installation of a 100 ft. sign.
The Clerk read a petition signed by 21 members5of the Sleepy
Hollow Garden Club opposing the erection of the 4 ft. by 55 ft,
fascia sign at 300 No. Broadway.
There being no further discussion, Mr. Friere closed the meeting
and informed the applicants that a decision will be made by the Board
and they would be notified of same.

to erect a sign. He has the engineer's report which ascertains whether
or not the building will hold the sign.

Following a discussion, Pat Lupi moved, seconded by David Page
that it is the unanimous judgment of the Board that the conditions

Public hearings were held before the Zoning Board of Appeals

Chairman Friere read the notice of hearing on the application of
Eugene J. and Katherine Buonanno for a variance from the provisions
of Section 62-8B, R-4, 7 for permission to extend a garage three feet
closer to the front property line resulting in a front setback from
the front property line of 4.64 feet on the east and 4,83 feet on
the west on property known as Section 17, Block 21, Lots 54-56 and
as 29 Gordon Avenue.
Chairman Friere asked if there was anyone present who would like
to address the Board on the hearing.
Chairman Friere stated that members of the Zoning Board reviewed
the request for the variance on Saturday and felt that this variance
should be granted,
Messrs. Page and Linzer have indicated their approval of the
variance, said Chairman Friere.
Mr. Peter Esteban moved, seconded by James Margotta that a
variance be granted to Eugene £ Katherine Buohariiio from the provisions
of Section 62-8B, R-4, 7 to extend their garage three feet closer
to the,front property line of 4,64 feet on the east and 4.83 feet on
the west of property known as Section 17,\Block 21, Lots 54-56 on the
official tax map and also known as 29 Gordon Avenue.
Chairman Friere read the notice of hearing to consider an
application of"Philipsburg Manor Estates for, aW variance from the
provisions of Section 62-8B, R-4-7 .for a 15 -0 setback on a new
dwelling from curb line.for property known, as
Section 17,kBlock 1,
Lot 1-A3 which would otherwise require 20 -0n and the application of
Philipsburg Manor Estates for a side setback line for a new dwelling
on a corner lot designated as Section 17, Block 1, Lot 1-A5.

�Chairman Friere asked if there was anyone present who would like
to address the Board on the request for a variance,
Mr. Royden Letsen, Attorney for Philipsburg Manor Estates urged
the Board to grant the variances on Lots 3 and 5.
Mr, Gasparovic stated that the lots were subdivided with 50 ft,
right-of-way. The Fire Department insisted that a cul-de-sac be inserted
in the area.
Reviewing the request for the variance, it was suggested that the
applicant be given a ten ft. variance from the right-of-way
rate of

cul-de-sac on Section 17, Block 1, Lot 1-A3 arid a 5V 0 side setback
from the right-of-way line of cul-de-sac for property known as Section 17,
Block 1, Lot 1-A5.
Chairman Friere stated that the members of the Zoning Board
reviewed the request and felt that this variance be granted.
Messrs. Page and Linzer have indicated their approval of the
variance,
Mr, James Margotta moved, seconded by Peter Esteban that the
PhilipsburgrManor Estates be granted a variance from the provisions
of Section 62-8Bj R-4-7 for a lO'-O" setback on its, new dwelling •.
from the right-of-way lines of the cul-de-sac on property known as
Section 17, Block 1, Lot 1-A3 arid a variance from the provisions of
Section 62-8B;;R-H-7 for a S'-O" side setback on new family dwelling
from the right-of-way line of cul-de-sac on property known as
