PUBLIC HEARINGS

Two hearings were held before the Zoning Board of Appeals of
the Village of North Tarrytown, N.Y. on the above date.

Mr. Friere called the meeting to order at 8:00 P.M.
Clerk Fallacaro read the first notice of hearing to consider
the request of Michael Bourke for relief on appeal from a decision
of the Building Inspector in denying a permit on applicant's proposal
to construct an additional apartment and for a variance from the
provisions of Chapter 62, Section 14-A-l requiring a minimum area
of 180 sq.. ft., exclusive of aisles or driveways, and for a ^variance....from the provisions of Chapter 62, Section 14-B-2 whereby ;the required
off-street parking space for more than two vehicles may not be located
in a required front yard and for a variance from the provisions of
Chapter 62, Section 14-E whereby the recjuired parking space is 1.2
spaces per dwelling unit, on property known on the Tax Assessment
Map of the Village of North Tarrytown as Section 16, Block 14, Lot 3A.
Mr. Page, Building Inspector, stated that he denied a building
permit because Mr, Bourke could not provide parking for the tenant
in the fifth apartment and cited other reasons, such as ventilation,
etc.
Mr. Margotta stated that according to his application,he is not
providing parking for any cars.
Mr. Page stated that he does not have space for automobiles and . / "
cannot in any way live up to the distance of; automobiles from the building
or property line. He does not comply with the.code, said Mr. Page.
Mr. Larry Drese, Attorney for Mr. Bourke, stated that the
building inspector is correct that there is no off-street parking.
He stated that there is on-street parking available in the area. As
far as they are aware, there were no complaints"from residents. They
would be adding probably one or two carsf he said.
Mr. Drese stated ttiat the reason his client is asking for another
apartment in the building is -because the building * is ?not making any
profit ^ He presented;a statement showing a $2200 loss in the last
calendar year. Without theadded income of tKe^property,;ttiey willV
not be able to run the property as it is now, he said. He stated that
it would be difficult to put parking on the lot'and if you do it,
it would ruin the neighborhood.

-2Mr. Ugo Checchi, 51 College Avenue, objected to the granting
of the variance because of the danger of changing the character of
the street. He stated that it was a dangerous corner.
Mr. Francis Jackson, 43 College Avenue, stated that he does not
see where this is a hardship. He stated that the owner could get in
touch with rent control requesting additional income to meet costs.
Mr. Armando Galella, 40 Depeyster St., requested that the
character of the Village be left as it is arid objected to granting
the variance.
Mr. Mario Belanich, 153 No. Itfashington Street, stated that he
did not think the fifth apartment would fit in the area, and was
opposed to the granting of the variance.
Miss Grace Cresswell, 48 College Avenue, stated that there are
two apartment houses on College Avenue. One apartment house does not
have parking and the other, a six family house, has limited parking.
She objected to granting the variance,
Mr. George Checchi, 46 College Avenue, stated that allowing
another apartment would bring the possibility of having two additional
cars and was opposed to the variance.
Mr. Joseph Kelly, 27 College Avenue, stated that he opposed the
granting of the variance.
Mrs. Mary Petcoff, 27 College Avenue,.stated that at one time,
she was told she could not have another family in her house because
of no parking facilities and opposed the granting of the variance.
The Bourkes presented an affidavit that surrounding property
owners were notified of the request for a variance,
Following a discussion, Mr. Linzer moved, seconded by James
Margotta that the variance be denied.

the building inspector in denying a permit on applicant s proposal

install three seating booths and for a variance from the provisions
of Chapter 62-CI, Highway Commercial on property known on the Tax
Assessment Map as Section 15, Block 14, Lot 15.
Mr, Page stated that he had rejected his application for a
building permit. He stated that Mr. Thorsen would like to install
three seating booths so that people could have a, placeito sit'*arid eat.
He stated that he believes that allowing the booths,would'elimiriate
people from eating and throwing chicken bones out into the street.
Mr. Margotta stated that he talked to the Chief of Police arid
asked him if there was any problem as far as parking congestion arid
was told that he has not had any complaints and did not anticipate
any problems.

�Mrs. Mary Moore, 5 Harwood Avenue, stated that she was part
of the group who opposed the construction of KFC. She stated that
three booths .would constitute a restaurant which would be in violation
of the agreement that the Village entered into when the permit was
granted.
Mr. Michael Zarrilli, 95 Beekman Avenue, stated that the variance
should be denied. He stated that the owner is not living up to the
requirements.
Mr. Margotta stated that spot zoning is when you give a business
in area a peculiar advantage of another business. This business is
within 100 ft. of the boundary line. It does not give him a peculiar
position where he has an advantage over where no one near him can
build.
Mr. Page stated that spot zoning is when you upgrade a zone or
down grade.
Mr, Thorsen, part-owner of KFC, stated that they are asking for
the variance because they are having difficulty financially staying
here. Unless they increase their sales in some manner, they will be
forced to close, he said. He stated that they can raise prices, but
do not believe this is the way to go. They are trying to keep prices
as low as possible, he said. He stated that many traveling people,
such as salesmen, would like to have a place to set and eat for lunch.
He stated that he needs this extra business and that it will be an
answer to their staying.
Mr. Aubrey Hawes, Millard Avenue, a director of the Philipse
Manor Improvement Association, stated that they opposed the construction
of KFC. He stated that it clearly shows the difference between C-l
and C-2 district.
Mr. Margotta asked of the Board,'•• would.'':you rather have a viable
business or a vacated premises where the building deteriorates. He
stated that in Port Chester, a KFC has gone out of business and the
building has deteriorated.
Mr. Swaby stated that there are no facts or figures to support
their request for the variance because of a hardship.
Mr. Thorsen stated that he would be happy to submit records.
Mr. Margotta suggested that Mr. Swaby review the figures with
Mr. Thorsen's accountant.
Mr. Mario Belanich, 153 No. Itfashington Street, stated that he
wouldn't consider this-to be -a restaurant;if three booths were allowed.
He stated that the owner should.be permitted to install a couple of
booths. We want to welcome business in North Tarrytown and not chase
it away, he said.
Mr. Thomas Gleasoh, 95\Beekman•AVenue, stated that :he did not
feel it isvthe business of the Village or Zoning Board to guarantee a
man a business.

�-4Counsel Friou stated that if the Board would like to hear
evidence and if Mr. Thorsen can produce it, it would be in order.
Mr. Kneeland Moore, 5 Harwood Avenue, stated that the only
basis they were granted a permit was the fact'that they were a retail
store and not a restaurant. No restaurants are permitted in the
C-l area, he said.
Mr. Margotta stated that at one time, a letter was written to
th e P1 anning Boar d torezone the •; - area. He stated that he pre f ers to
see a going business arid would like to give him every opportunity.
It was his understanding that they met and complied with the agreement,
said Mr. Margotta.
Mr. Friere stated that the matter of spot zoning should be
referred to the Planning Board.
Counsel Friou stated that he would like to check the books as
to what is allowed and will render an opinion.
Mr. Arcate stated that he was a member of the Board at the time
the agreement was made. The Board did not grant a variance, he said.
By not granting a variance, he said, we defined the very use which 5is
asked for here. He stated that he was personally disappointed that what
he understood to be more than a gentleman's agreement certain physical
things would be done. This has not been fulfilled, he said. That is
not the cause for this Board, said Mr. Arcate. He stated that he has
not seen enough evidence.
Mr. Linzer stated that it provides honest work for young
people in our community and we should do whatever is in our power
to encourage business to stay with us; It is better to have this
than a vacant business, said Mr. Linzer.
Mr. Linzer suggested that a decision be withheld until grounds
are produced to help the Board in making a decision.
Mr. Page inquired if the-Board would'consider a temporary variance
to see what effect this would have on the business and quoted Section
62-59D of the Zoning Ordinance.
Mr. Margotta suggested that the former building inspector be
present at the next meeting.
Following a discussion, James Margotta moved; seconded by;Edward
Swaby that a decision be deferred to April 18th, in order.to allow
Mr. Thorsen to produce the necessary facts and figures. Carried.
There being no furttier discussion, the meeting was adjourned.

The Zoning Board of Appeals met on the above date to render
a decision in the matter of KFC of North Tarrytown.

Chairman Friere called the meeting to order at 8:00 P.M. and
stated that the purpose of the meeting was to hear the report of
KFC which will determine whether or not a hardship exists.
Mr. Dave Thorsen presented his income tax return for the
period May 1, 1976 - April 30, 1977, as well as a statement of his
profit and loss for the period 5/1/77-3/30/78. His accountant was
also present to answer questions made by the Board and Counsel.
Mr. Fred Poli, Sleepy Hollow Road, inquired as to why should a
man be deprived of making a living and cited a case whereby teenagers
are gathering in a center whereby the police have been called constantly
for disturbances. He stated there are no problems in Mr. Thorsen's store.
Mr. Friere stated that he talked to Chief Jandrucko and was told
that there have been no traffic problems in the area.
At this time, Mr. Friere read a note from Roman Windas, former
Building Inspector, regretting that due to a prior commitment, he
would not be able to attend the meeting this evening. Mr. Windas stated
in his letter that to his knowledge, there were no outstanding items
in regard to the construction of the KFC building. He also stated
that the Beekman Avenue island was extended west and two curb cuts,
instead of a single cut were made on to Beekman Avenue at the Village's
request.
In reviewing the statment of profit and loss, Mr. Swaby stated
that essentially, the store was operating'at a loss. He cited one
obj ection that it was not zone; for". retail business . He stated that
he has some objection to its becoming a restaurant use, but on
the
:
other hand, the present owner has made it:better looking than it has
been. He inquired as to the feeling of the Board to grant the variance
on a temporary basis.
Mr. Margotta stated that a restaurant on that corner is better
than any of the uses for which it is zoned.
Counsel Friou stated that if the Board grants an exception, would
it be fair to the businessman to give him a two year variance. He will
have to re-apply to the Zoning Board.

Following a lengthy discussion, James Margotta moved that the
KFC of North Tarrytown be granted permission to install three seating
booths on premises known and designated on the Village Tax Assessment
Map as Sect ion 15, Block 14, Lot 15 based upon the following findings:
(a) There are special circumstances or conditions applying to
the land or building that do not apply generally to land or buildings
in the neighborhood:
1. Land is small and odd size.
2. It is located at a five way intersection including
Route 9, Beekman Avenue and Route 448. It has been
a difficult lot for which to find uses.
3. The present building as improved is a special use
building and cannot readily economically be used for
other than fast food preparation and sale.
4. There are no other building/lot combinations like this
one in the (C-l) neighborhood. The (C-l) neighborhood
includes a tire sale outlet, automobile storage and
salesrooms (to the north) and apartment houses to the
south, gas stations across Broadway to the east.
(b) The circumstances or conditions are such that the strict
application of the provisions of the ordinance would deprive the
applicant of the reasonable use of the land or building.

The requested ordinance would permit the]installation of three
(two bench) booths seating 12 to 18 people. This would permit that
many persons to eat the product;on the premises. There would be no
external change in the building for this purpose.
The variance would permit the applicant to realize and estimated
10% increase in"gross sales orver figures shown on profit and loss
statement for 5/1/77 through 3/30/78, according to statements of
applicant. The applicant expects that such an increase would-give
it a breakdown in cash flow and permit economic survival in hope of
profitability.
(c) The Board sees no other simple means for achieving ;the
reasonable use of the land or building as presently constituted.
This follows from the special purpose design, lack of adequate size
and shape of lot and unique location.
(d) The variance as granted is the minimum;variance that will
permit the reasonable use of the land or building all as noted above.
(e) Such relief .can^be granted without-substantial detriment to
the public good and without substantial: mprovementjtto
the'intent and
:
purpose of the Comprehension Land Use'*Plan "and Zoning Ordinance.

�Proof of notification of neighbors was filed as required by the
ordinance. No objections were received from neighbors although three
persons residing over 1/2 mile from site expressed negative opinions.
The police chief made a favorable report on use of premises
and traffic flow.
The Board views this proposed use as favorable to the neighborhood
when considered in light of other nearby uses.
The Board finds this variance may help keep this building alive
as an /economic:unit in the Village and avoid area depreciation decline.
CARRIED UNANIMOUSLY.

Mr. James Friere, Chairman, called the hearing to order at 8 P.M.
after which Clerk Fallacaro read the notice of hearing to consider.the
request of Mallory Battery Company for relief on appeal from a decision
of the Building Inspector in denying a permit oh applicant's proposal
to install a bulk helium storage vehicle on Mallory Property and for
a variance from the provisions of Chapter 62, Section 13E, 2A, 2B
in a residential zone and for a variance from the provisions of
Chapter 62, Section 13F-1 to erect a ten ft. fence around said vehicle
whereby the Zoning Ordinance requirements that no wall or open or solid
fence in excess of three feet in height shall be erected along the
side and fear yards in;any residential district on property known
and designated on Village Tax Assessment Map as Section 15, Block 3,
Lot 3A.
Clerk Fallacaro read a letter from Mrs. Anne Ennis, 33 Kendall
Avenue, stating that she opposed the-project.
Mr. Margotta inquired of one of .the representatives from Mallory, ;
if gas was accepted and was answered "Yes", that it would be pressurized
Mr. Margotta inquired as;to why the tank^could not be^placed
below ground and was answered that it would be to ho advantage.
Mr. Margotta stated that it would be unsightly and&gt;he was answered
that the 10 ft. fence would be "installed whereby no one would trespass
and it will be facing the parking lot.
Mr. Linzer inquired as toithe size of thevtankiand?was told that
it would be 50,000 cu. ft., 24 ft. long, 7 x 8 otherwise. ..--'"«/•
On a question of Mr. Swaby as to the danger, he was answered
"none". It cannot be ignited. .If it was in an enclosed area, it
could suffocate, said; the representative.
Mr. Margotta stated that his main objection1 would be to have : '•'
the tank there permanently and suggested that it be placed below the
ground.

Ah unidentified resident inquired as to what facilities are used
to expedite vapors eminating from it that escape and was answered that
it would be exhausted out into the air.

�-2An unidentified resident stated that she agreed with Mr. Margotta.
The representative from Mallory answered that they will not be able
to test the tank if a leak occurs. They would then have to dig it
out of the ground.
On a question of Mr. Johnson as to how to store the helium, he
was answered through cylinders. Everyjtime you transfer helium, you
pick up contaminates, said the representative.
Mr. Carmen-Capossela stated that when you increase the supply
of helium, lithium is increased.
An unidentified resident inquired oh what grounds was the variance
being requested arid was ans-weredby the building inspector that the
tank was being located outside the building in a front yard and a ten
ft. fence being requested would be in violation of the code.
Mrs. Alice Santos, Kendall Avenue, stated that she feels the
tank is dangerous to their health. Her family opposes the tank
going up.
Mr. Page stated that there is no space to bury the tank underground .
Chairman Friere inquired of:Mallory's representative if the
variance is not granted, what effect would this have on the company.
Mr. Fehling stated that this question cannot be answered right
now. They are working with delivery of bottles a couple of times
per week and there is a danger of contamination to the product.
Miss Ellen McDonough, Kendall Avenue, stated that her people
have lived on the street for fifty years and first they had problems
with Luberger delivery trucks and now there will be a problem with
Mallory.
Mr. Johnson inquired as to what they were experiencing in
defects and was answered out of 19 bottles, 13 bottles were bad.
Mr. Richard Kelly, 39 Kendall Avenue, stated that he is opposed
to the variance because it will expand and accelerate lithium in the
area. The firemen will have a tough time in putting out a fire should
one occur, he said,
Mr. Arcate inquired if there would be any other alternatives
even though they might require a variance for another use. Is there
some way where we could avoid the cosmetic invasion "of their property,
inquired Mr. Arcate. He suggested an opaque type fence.
Mr. Forster submitted receipts to the effect that surrounding
property owners were notified of the request for a variance.
Chairman:Friere stated that comments were heard and the Board
will make a decision within thirty days.
No further comments, Mr. Linzer moved, seconded by Mr. Margotta,
that the hearing be closed.

A meeting was held before the Zoning Board of Appeals of the
Village of North Tarrytown, N.Y. on the above date.

The meeting was called to order by Chairman Friere at 8:00"P.M.
Building Inspector Page read the minutes of the previous meeting
of May 1978 and was approved by the Board.
Mr. Margotta asked if Mallory had come up with any alternative
to their previous request. Mr. Page answered, "He had not received
any.
Mr. Linzer, remarked a fence had been built. Mr. Fehling of
Mallory explained, this was a sample fence to show what a chain link
fence with strips inserted would look like. Photos of;the fence|were
exhibited to members of the Board. Mr.Linzer
inquired'if the intent:
ion of Mallory was to erect a similar fence. Mr. FeHling replied,
"Three sewer lines come together in this area making other methods not
feasible.
Joseph Schwer, 95 Beekman Avenue asked if any danger existedffrom
shrapnel or other debris from this tank existed. Mr. Fehling replied
this tank meets all O.S.H.A. safety requirements and these tanks must
be tested in the same manner.
Margotta asked if it was true that an increase in HelitmV would
increase the amount of Lithium on premises. Fehling "answered, "This
would be a bulk purchase of Helium and Mallory Battery Co. would be
saving money.
Discussions from MargottaV Arcate and Linzer, re: Tank being
permanent arid is tank a structure?
Mr. Linzer moved seconded by Arcate a one (1). year variance be
granted to Mallory Battery Co.and at that time they could apply for
an extension of one (1) more year or apply for a permanent variance.

Chairman Friere called the hearing to order at 8:15 P^M.
Morton Linzer read the notice'and • appealconcerning the request
fora variance to overcome the refusal by Building Inspector ;to
grant a building permit to Mahue 1 arid John Cappello to" construct
a wall over 3 feet high at 44 Pocantico Street, North Tarrytown.
Mr. Margotta indicated the wall was a part of other wall areas and
much like other walls in the area.
Mr. Swaby reported the wall was "in keeping with the nature of other
walls in the area.
Mr. Friere read a letter from John Arcate, member who is on vacation,
indicating his agreement to grant a variance.

Mr. Margotta moved to grant'a variance to'construct a 4 foot 16 inch
wall at 44 Pocantico Streety North Tarrytown to replace the present
wall. Mr. Swaby seconded the motion.

All membersJvoted in favori;of the motion and Mr. Page was directed to
issue a permit to the Cappellos.
Mr. Linzer moved to: adjourn the meeting. Mr. Margotta seconded the
motion and the meeting was adjourned at 8:30 P.M.

One hearing was held before the Zoning Board of Appeals of the
Village of North Tarrytown, N.Y. on the above date.

Chairman James Friere opened the meeting at 8:30. Attorney Donald
Walsh represented his Client Enrico Solari in regard to various building
violations. Clerk Louise Croke read the Public Notice.
Mr. Walsh presented to the Chairman an application by former Building
Inspector
to extend parking lot, dated February 22, 1977,
Chairman stated that he did not have a Site Plan. Mr. Walsh stated that
Site Plan was his client's omission and that hewas sorry he didn't do
it. Mr. Chairman read all violations pertaining to the case. Mr. Margotta
s didn't understand #50-6 or #62-21-C. Stating that 90% of the people back
) out of their driveways, particularly in Webber Park. Mr. Linzer asked
when the license was filed and when did work begin. Mri Linzer asked
why was this just coming up?
Mr. Page stated that he inherited this.
April 1977 Mr. Jelenek ordered violation. It has been in the works.
Mr. Ponzini said that it was taken out of the Justice Court after'discussion with Mr.. Walsh and the Building Inspector and it was decided
to place it before this Board. Previous Court was not appropriate.
This seems a better way to give Mr, Solari a chance to give his reasons,
Mr. Margotta asked if Mr. Solari applied for permit and not Site Plan,
Building Inspector said none. Application was vague. Mr, Walsh stated
that his Client went ahead and did this work and thought application was
okay. Could they go through allegitations and see which ones should stay
and which should be removed?
Mr. Linzer asked if there had been any comments from the neighbors.
Mr. Page stated that all this was instituted by a taxpayer; but I don't
see any here tonight.
Mr. Arcate asked when permit was dated. February 1977. March 1, 1977
work began. May 1977, after it was revoked, work was completed.
Mr. Margotta stated that if Site Plan is needed, the Building Inspector
should tell the person.

It shouldn't be held against the homeowner.

The Chairman stated that application was for parking only*
cut a lot more curb than necessary,

Mr. Arcate stated that records were needed or a history to see
who is to blame. The Building Inspector or Client. Mr. Chairman
stated that application was vague.
Mr. Linzer re-stated that permit was issued in February 1977 work began March 1977 - April 1977 violation - May revoked permit
after work. No plans accompanied. Did Mr. Page contact Mr. Jelenek?
Mr. Page answered, no, Mr. Jelenek left some months before.
Mr. Ponzini stated that there had been a lot of delay.
Mr. Chairman stated that the violations are there. If Mr. '. Solari
agrees to put everything back to what the code says there should be
no problem.
Mr. Walsh states that permit was issued.
Mr. Chairman states that permit was given for one thing. A halfdozen things have been done on that one thing,
Mr, Walsh - he applied for permit, Mr, Chairman - yes but he
exceeded for what the permit was for. That permit was given for a
couple of cars and then he makes plans for four cars. It's not in
the zoning.
Mr. Ponzini - Lets adjourn subject to Mr. Solari fixing the
violations to Building Inspector's satisfaction. If Building Inspector
reports back it's okay Mr, Walsh can make application for permit to
open a curb.
Mr, Page - I think Council's recommendation is ideal. Bring
Site Plan to meet with present code. No need for variance.
Mr. Arcate asked Mr, Page if arrangement was made by Mr. Gasparovic
to extend size of house to include four lots under one deed. Mr, Solari
answered, "no."
Mr, Page said permit for house should never have been
given.
Mr. Linzer stated that discussion regarding permit for house was not
pertinent to meeting tonight. Mr. Margotta said that notice states
nothing about house. Meeting was not called for this.
Mr. Walsh suggested that Mr; Page and client get together and
work something out and come back next month.
Mr, Ponzini stated that biggest complaint was curb and,parking.
Mr, Chairman said thirty days would.be.enough time to work out
a solution. Hearing was adjourned for thirty days not to exceed.

Mr. Arca'te stated that if there were other violations we should
address them also*
Mr. Chairman said to leave it to the Building Inspector. Mr.
Linzer stated that it was up to the Building Inspector to make the
violations known. Mr. Arcate stated that the Building Inspector
should inform Mr. Solari to clear up all possible violations.
Mr. Ponzini stated that it was up to the Building Inspector to
inform him so it could be dove-tailed. Maybe it could all be joined
in one meeting not to exceed forty days by stipulation of Council,,
