Chairman Arcate called the meeting to order at 8:20 P.M.
Linda Fukuchi, clerk,,read the public notice of hearing to consider
the request of Dimitrios Papadopoulos, 49% Elm Street, for an appeal to
obtain a permit for the enclosure of an existing front porch.
It was noted that the porch is presently roofed. Also noted was
that other houses in Mr. Papadopoulo's area have enclosed porches.
It was also noted that although the existing porch does not satisfy
the 20 ft. setback requirement, the proposed enclosure will not diminish
the setback.
A list of neighbors along with their signatures was presented,
saying they had notice of the proposal and that they had no objections.
A motion made to end the hearing was made by Edward Swaby, and
seconded by Frank Paolantonio. The motion was unanimously approved.
The public notice of hearing was then read by Linda Fukuchi, clerk,
to consider the request of Mario Di Felice, 35 Gory Brook Road, for an
appeal of the Building inspector's denial to obtain a permit for the
construction of a sun deck at the back of his house.
Chairman Arcate asked if the Board"had a list of neighbors who were
notified of said construction. The clerk had received postal receipts
of notice to neighbors as required.
Mr. Armando Galella Addresssed .the board ?as the representative?of
Mr. Di Felice who was out of town. * Mr. Galella presented to the Board
seven letters from neighbors of Mr. Di Felice. Six of the letters
indicated no objection to the proposed construction.

William Hongach, of 30 New Broadway, addressed the Board,;saying
that a sundeck would infringe on}his ^privacy, as\the Jdeck- would be
almost at his property line. Should someone fall^ for example, off said
planned deck for the Di Felice house, they would fall on his property.
He feared the distance would be too close to His second floor windows.
Building Inspector, Mr. Page, noted that this property is presently
non-conforming due to lot size and the size of the house.
It was also noted that said extension would bring 3^ houses close
together.

There being no further hearings, Chairman Areate thanked those
present for their participation and invited them to remain for the
business meeting. A motion to end the hearing was made by Mr. Ceconi,
seconded by Frank Paolantonio. Motion carried unanimously.
Business Meeting
The minutes of the Board's last meeting were accepted.
I.

49% Elm Street - Dimitrios Papadopoulos
As Mr. Papdopoulos was unable to attend the Board's hearing and
was not represented, it was asked if he was required to be present.
Attorney Ponzini said no, he need not be present, as all proper and
legal steps had been taken, along with the public notice in the newspaper. He also noted that no one voiced any opposition, the Board
could act as they saw fit.
A motion to grant the said variance in accordance with Sections
62-2 and 62-40c was made by Mr. Swaby, and seconded by Mr. Ceconi. The
motion was unanimously approved.
II. Concerning the variance requested by Mr. Di Felice," .Chairman Arcate
read the letters from neighbors regarding the construction of a sundeck.
One neighbor was against it.
Chairman Arcate gave his own view, noting that variances may be
granted especially if the zoning rules cause-undue'hardship on'the owner.
But, he noted, the variance being sought is for recreational use rather
than living space. He could not justify MrV Di Felice's appeal as one
of hardship.
Mr. Swaby concurred, saying the Board members should'support the
decision of the Building Inspector, Mr.. Page. As this is not '.'hardship",
he made a motion to deny the granting of a variance as not•satisfying
Sections 62-2 and 62-40c, seconded by Mr. Paolantonio, and carried unanimously.
Mr. Page noted that Mr. Zelig, of 17 Hemlock Drive, has no certificate
of occupancy, and by law, cannot live there.
In regard to another matter the board members/agreed:to send - a proposal to the Board of Trustees asking that the Building Inspector be given
the power to enforce a time limit on building permits.
Mr. Page noted he has open building permits dated back as far as
1967. Mr. Page suggested a 12 month time limit subject to extension if

circumstances warrant
There being no further business ;to discuss, Board member
Mr. Ruane made a motion, seconded by Mr. Swaby, to end'tonight' s
meeting, which carried unanimously.

Chairman Arcate called the meeting to order at 8:00 P.M. for a hearing to be held before the
Zoning Board of Appeals.
Linda Fukuchi, clerk, read the Public Notice of hearing, to consider the request of Boyce
Realty Co. of 159 Wildey St., in Tarrytown,

for a n appeal to obtain relief for a building

permit to erect a proposed fence of 8 feet in height with a sliding gate assembly, 16 ft.
in height, as Zoning Ordinance 62-13 (F) of North Tarrytown limits the height of any fence
in any business area to 6 ft. the - fence is to b e located on* the southern side of Clinton
St. , between Cortlandt St. and Beekman Avenue.
Chairman Arcate then asked if anyone present wished to address the Board:
Peter Blasi, Esq., represting Boyce Realty Co.y described a map of North Tarrytown (Rider
A o f the petition) showing the design and location of the proposed fence.

He said the

reason for the additional height of the fence is due to constant traspassing by either
children playing in the area, or animals straying.

Mr. Blasi also presented a detailed sketch (Rider .B of the petition) o f the proposed fence,
showing how the gate iri this fence could b e rolled back on an overhead trolley to permit
trucks to enter.

H e said the fence would n o t b e used so as to totally close .off the

property as the gate would allow access from Clinton Street.

Chairman Arcate asked if all owners within 200 ft. of Boyce Realty Corp.' had been advised
^^^^of their plans to construct the fence and the public hearing of the date. Mr. Blasi
replied in the affirmative, and an Affidavit of Service by registered mail with the list
of all such owners was given to Chairman Afcate and made a part of the record.
Mr. Henry Boyce, owner of Boyce Realty, then addressed the board. He mentioned that cars,
and sometimes taxis, have driven thru on his company's lot.
Mr. Boyce proceeded to explain to the Board members that another fence will be erected
on the part of the property, which is in Tarxytown. *The side has already been fenced so as
to protect the lot. The overhead trolley support beams for the fence and sliding gate
would be of a height of 16 ft., to allow the passage of trucks into the garage.
Neighbor Joseph Mann's property would be alongside of the proposed fence, it was noted,
as members questioned how the fence might affect the area. Mr. Marin's name was on the
list of people notified by Mr. Blasi, and on a sworn affidavit of names of all notified.
An informal discussion took place between Mr.; Boyce, and Marvin Pickett, another neigHbor
^P^at which time all plans were reviewed. Mr. Pickett said he was in favor of the fence,
but upset that the company' s trucks would still be visible from the street while driving
by. Chairman Arcate asked if an opaque fence of a fence with slats could be a possibility.
Mr. Ceconi spoke against the idea of slats on the fence, as it might encourage children to
climb and break them. It was also rioted that such-slats were used by the Village in a fence
at the garage with poor results. He suggested a cosmetic cover such as ivy to camouflage
the open fence areas. Mr. Pickett said he was not at all against Mr. Ceconi's suggestion
of the ivy, or similiar planting.
Mr. Pickett was asked by the Board if a fence for Boyce Realty is preferable to its present
condition? He replied in the affirmative, saying as long as Clinton Street would remain
basically a*residential area,and not an industrial one.
Chairman Arcate then asked if there were any further comments. There being none,
Mr. Ruane made a motion, seconded by Mr. Swaby, to end the hearing which was carried

Business Meeting
r^^Chairman Arcate called the meeting to order. He asked for members to act on whether or
not a variance should be granted to Boyce Realty Co.
Mr. Ceconi made a motion to grant a variance to Boyce Realty, so as to enable them to
build the fence proposed in the petition for a variance. Mr. Ceconi commented that
some kind of screening should be provided for neighborhood.
Chairman Arcate agreed, however, no ted that this was not conditional as the board had not
determined such a design provision of the fence.
Counsel Robert Porizini said that as he understands the Board, the screening is not a legal
condition for the granting of the variance but may be added as a required at the Board's
discretion. He, however, suggested that the Board grant a variance only for the life of
the fence, once constructed. If at a late date it need be removed a new variance would
be needed for the new fence.

A motion was then made to grant a variance to Boyce Realty Co. in accordance with

^Pparagraphs 62-2 and 62-40 to construct a fence on the Clinton Street side of their lot.
This motion was by Mr. Ceconi, arid seconded by Mr. Swaby. The motion was carried7unanimously.

notice given. He also noted that the second hearing, planned for Oct.: 2nd, thatof ; ~\ ,

Appeals, at a meeting held on October 2nd, granted Boyce KBalty Co.
a variance from Section 62-13 (F) of the Zoning Ordinance to erect an
eight ft. fence in height with a sliding gate assembly on Clinton Street,
North Tarrytovn, on property known and designated as Section 16, Block 4,
Lots 17 &amp; 18, said variance be granted for the life of the fence once
constructed, after which another variance is required.

Chairman Arcate called the meeting to order at 7:45 P.M.
Linda Fukuchi read the notice of hearing to consider the
request of Mr. San Juan for an appeal from a decision of the
Building Inspector to construct a second floor porch at 28 Hudson
Street, No. Tarrytown.
Chairman Arcate.asked if there was anyone who would like to
address the Board.
The Building Inspector, Mr. Page explained briefly,that Mr.
San Juan's application for a ^variance had been * denied solely due
to the regulations in the Zoning .code. He noted:that other homes
in the applicant's neighborhood have been built with porches on
their second story.
Chairman Arcate asked if there was anyone present at tonight's
hearing who objected to said construction.
Two neighbors of Mr. San Juan, Mary Kay Vincek and Rudol^Medina,
stated they were in favor of such construction and supported Mr. San
Juan's building said porch.
Board member Frank Paolantoiiio asked the owner whether the
intended second floor porch, if built, would be enclosed. The reply
was in the negative.
The clerk conversed with Mr. San Juan in Spanish and offered to
serve as an interpreter. He indicated appreciation and satisfaction.
As no one wished to contest Mr. San Juan's application for the.
variance, Chairman Arcate "asked for a motion to close the'hearing and",
to adjourn for the business meeting: Said motion "was made by Mr. Swaby,
seconded by Mr. Paolantoriio, and carried by a unanimous vote.
BUSINESS MEETING

The motion to grant said variance for Mr. Sari Juan was made by
Mr. Swaby, carried by Mr. Paolantbnio, and the variance was granted by
a unanimous vote.
