Announcements: Acting Chairman Judge said that the minutes will be tabled because there are

1) The Salvation Army, 86-96 Valley Street, Public Hearing to Extend Variance
Acting Chairman Judge read the public hearing notice and confirmed that the returns were in.
Attorney William S. Null represented the applicant. Mr. Null stated that the Salvation Army is
requesting an extension on variances that were granted on January 15, 2014 for 99 Valley Street.
Variances expire after one year. There were no proposed changes.

2) James Thornton, 54 Hudson Street, Public Hearing for a New Two-Family Residence
Acting Chairman Judge read the public hearing notice and confirmed that the returns were in.
James Thornton represented himself. Mr. Thornton said that the house has a non-conforming
width and requires only a small variance. The design is consistent with the neighborhood. Other
designs were explored, but this was the only one that worked.
Mr. Wernick asked if there was a driveway. Mr. McCarthy responded by saying that there is a
driveway for two cars, but only one access point, so a variance is required.
Mr. Judge asked if there were other two family homes in the neighborhood. Mr. McCarthy said
that most of the homes in the neighborhood were two family homes.

Faith Fusillo of 50 Hudson Street spoke. Ms. Fusillo was representing her mother who owns the
house next door. Ms. Fusillo is concerned about the distance between the two houses and what
will happen during construction. Mr. McCarthy said that the engineers must take precautions
during construction to make sure that the property next door is not damaged.
Claire Davis of 25 Hudson Street likes the design, but feels that the house is set too far back from
the street. Ms. Davis feels that it is inconsistent with the rest of the neighborhood.

Acting Chairman Judge said that the resident's concerns are valid, but that the variances are not

property developed. Alternatives have been explored and the design is in keeping with the
neighborhood. The project is a type II action under SEQRA.

said that the deck will improve use of the back yard and create better access. The project is in

Sean McCarthy said that the reason a variance is required is because the house is nonconforming and that the deck would normally not need a variance.

The new design is similar to other houses in the neighborhood, but the floor /area ratio is too
large requiring a variance. Mr. Thornton said that the house requires only a small variance.
Mr. Judge asked if the footprint had changed. The applicant responded no.

Attorney, Marianne Stecich represented the applicant. Ms. Stecich requested an interpretation of
the zoning code as it relates to converting a single-family residence at 212 Beekman Avenue to a
two-family residence.
Ms. Stecich gave a history of the property. She explained that the house is in a two family zone
and so the conversion is "as of right". She also argued that the setbacks and parking
requirements do not apply because they were grandfathered in when the zoning code was
changed. For this reason, Ms. Stecich believes that a variance is not required. There was a
lengthy discussion regarding the merits of her argument.

2) Lighthouse Landing Venture, LLC, Edge-on-Hudson - Public Hearing, 199 Beekman
Tim Judge read the public hearing notice into the record and confirmed that the receipts were
received.
Chairman Koffler informed the applicant that since there are only four Board members present, a
vote would have to be unanimous in order to pass.
Attorney, Mark Weingarten represented the applicant and introduced other representatives from
Edge on Hudson. Mr. Weingarten said that a variance is needed to increase the height of three
buildings from 42' to 48'. He said that the reason for the height change is to adapt to a changing
demand in the housing market. Mr. Weingarten said that the Planning Board has recommended
the project. He said that the number of units has not changed and believes the visual impact is de
minimis because there are other approved buildings on the site that exceed 48'.
Planner Andy Tung gave an overview of the project. He provided visual aids to demonstrate the
visual impact of the taller buildings.

Chairman Koffler said that this was a use variance and asked Mr. Torres to address the use
variance criteria. Mr. Torres was not prepared to address all four of the use requirements and did
not have supporting documentation to prove financial hardship.
The applicant requested an adjournment.

Peter Direnzo represented himself. He is requesting a variance for second floor addition and
detached shed. Mr. Direnzo has owned the house for 15 years. He said his house is too small for
his family and would like to increase its size similar to that of neighboring homes. He is
proposing to add a master bedroom and extra bathroom.
Mr. McCarthy said that this is an existing non-conforming home which is the reason for the
variance.
