Following a discussion, Trustee White moved, seconded by Trustee Gandolfo that the matter be referred to the Board as a committee of the whole before a decision is made and that Chief Spota and the school principal be contacted to see if violations have been corrected and tha Mr. Pellegrini provide the Board with a certified copy of an audit for the last two years to ascertain whether or not the increase would be warranted and a report made at the March 22nd meeting. Carried. Trustee Cavalieri moved, seconded by Trustee White that the hearin be closed. Carried. Trustee Soriano moved, seconded by Trustee White that the minutes of the February 1st meeting be approved with minor correction. Carried Deputy Mayor Timmings asked if there was anyone present who would like to address the Board may do so. Mr. John Carroll, Hunter Avenue, talked about the increase in crime and asked that the police force be increased ten additional men^^tte stated that we should have a walking policeman. Deputy Mayor Timmings stated that the present force is 23 and he is asking for 17 additional men. In a study that he has made, said Deputy Mayor Timmings, the cost would be about 36 -$39,000 per man. The requei that Mr. Carroll is making is -pfe^Bicjjjj/y impossible, he said. Mr. John Carroll stated that he placed on each desk a copy of a deed whereby the Kingsland Point property west of the railroad tracks would default to the Brooklyn Hospital if the property is not used for recreational purposes, and asked what the Village is going to do about it. Deputy Mayor Timmings stated that Mayor Zegarelli and Trustee Gandolfo have been meeting with County representatives regarding the pai Mr. Carroll asked for a referendum to take over the park I Trustee Gandolfo stated that an understanding of the basic agreemei that as long as the park is used for park lands and recreational purpose She stated that there are no express provisions in the deed that it must be used by North Tarrytown only. She stated that if any of the parties were in violation, it would revert to the Brooklyn Hospital. Trustee Soriano stated that County condemnation started in 1925 anc was culminated in 1928, and in turn became Westchester County park lands The property has never been used other than park lands. Counsel stated that there is a State law whereby once property has been dedicated as park land, that is the only use it can continue as without a special legislative act to change the particular property. Trustee Gandolfo stated that we will have someone review all the documents and deeds. i �-3- S^_ Mr. James Donovan, Hunter Avenue, stated that he supports Mr, Carroll's statements and urged that the matter be looked into. Trustee Gandolfo stated that this has been looked into very thoroughly. She stated that they reviewed the legal ramifications. We have known all along that if the park was not used for recreational purposes, it would revert back to the Brooklyn Hospital, said Trustee Gandolfo. We are very aware that the park must be used for park lands and recreational use, however, she disagreed with the statement that it was supposed to be used for North Tarrytown only. Trustee Cavalieri stated that this was dedicated park lands over which the State oversees the same. Trustee DiFelice moved that the Mayor and recreation committee investigate the clarification of the deed further and if deemed necessary to obtain quotes for a title search for Kingsland Point Park, seconded by Trustee Cavalieri. Carried. Mr. James Donovan, Hunter Avenue, inquired of the Board if any consideration was being taken for reducing the speed limit on Route 9, between the Sleepy Hollow entrance and Bellwood Avenue entrance. He stated that motorists are coming down in excess of 40 miles per hour and suggested a speed limit of 30 miles per hour. He noted the fatal accident on Christmas Eve at Bellwood and Broadway. Deputy Mayor Timmings stated that the driver of the vehicle was arrested for driving while intoxicated. People in that condition, speed signs are meaningless, he said. Following a short discussion, Trustee Cavalieri moved that the State be petitioned to lower the speed limit from Pierson Avenue north to the Village line, seconded by Trustee Gandolfo. Carried. Mr. Mario Belanich inquired about an article appearing in the local newspaper which is questioning the residency of the Village Justice. If his residency has been found to be illegal, said Mr. Belanich, then all of his court cases would have to be rescheduled thereby costing the Village additional money. Deputy Mayor Timmings stated that we have one legal opinion that if he is declared a non-resident, the cases he has heard will still be valid. Mr. Belanich also inquired as to the rumor regarding the Village dumping sand mixed with salt to cover something up in Douglas Park. He stated that this was a waste of money. Trustee Soriano stated that we have an erosion problem in Douglas Park. An employee went to the wrong storage bin and took the sand with a minor amount of salt, about five pounds. This will not contaminate the water. As soon as weather permits, the sand will be removed, said Trustee Soriano and the problem in the park will be filled in with left over fill. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri.reported that renovations will commence at the % i \ �-4new Village garage facilities on or about March 1st. Ground-breaking ceremonies will be held at the site on March 6th at 11 A.M., said Trustee Cavalieri. Heating controls updating and improvements are near completion, said Trustee Cavalieri. The contractor is waiting for the delivery of additonal valves. Trustee Cavalieri stated that a meeting will be held on March 11th at 8 P.M. with the Buildings & Grounds Committee, the Architectural Review Board and Ronald Turnquist, Architect, to study the utilization of space in the Village Hall and/or other Village buildings as deemed necessary and instruct the Clerk to notify all parties involved. FINANCE & DEVELOPMENT I Trustee Gandolfo reported a balance of $12,489.81 in the General Fund as of February 16, 1982. Trustee Gandolfo moved, seconded by Trustee DiFelice that action of the Treasuer in depositing a c.d. note in the amount of $800,000 for thirty days at 117* interest in the First National Bank of North Tarrytown be confirmed by the Board. Carried. Trustee Gandolfo stated that there is an excess of $100,000 in H200 Capital Cash account and moved, seconded by Trustee DiFelice that action of the Treasurer in securing a c. d. note in the amount of $100,000 for thirty days at 11% in the First National Bank of North Tarrytown and maturing March 10th, be confirmed by the Board. Carried. Trustee Gandolfo moved, seconded by Trustee Cavalieri that the following resolution be adopted: WHEREAS, by Act No. 49-1976, the County Board of Legislators authorized the County Purchasing Agent to act as Purchasing Agency for any city, town, village, school district or other unit of local governs within the County of Westchester, provided that said unit of local government by act, ordinance or resolution authorizes the County Purcfc| Agent to act as its Purchasing Agent for items purchased by the Count)! and empowering designated officers and employees to sign requisitions,! and further directing the proper official of local government to audit J pay County bills for the cost of County services within thirty (30) day: after the receipt of said bill by the local government, and further authorizing the proper official of the local government to provide the County with such insurance coverage as may be required by the County's Director of Risk Management, NOW, THEREFORE, BE IT RESOLVED, that the County Purchasing agent is hereby authorized to act as Purchasing Agent for the Village for the period from January 1, 1982 - December 31, 1982, and be it further RESOLVED, that the following officers and employees of the Village are hereby authorized to sign appropriate requisitions and be it furthei i \ �-5- <&?/? RESOLVED, that the following named officials are hereby authorized and directed to audit and pay County bills for the cost of County services within thirty (30) days after receipt of said bill; and be it further RESOLVED, that the following named officials are hereby authorized to secure and to provide to the County of Westchester any and all insurance required by the County's Director of Risk Management, in accordance with the County Act No. 49-1976. RESOLVED, that the Village Treasurer and the Village Clerk be authorized to sign appropriate requisitions. Carried. Trustee Gandolfo stated that the committee met with the Public Safety Committee last week and discussed budget items. GOVERNMENTAL RELATIONS Trustee White read a letter from Mr. Herman, Division of Housing, acknowledging the Village's request for another meeting with his representative to discuss ETPA. Trustee White stated that a meeting has been scheduled for March 4th at 8 P.M. in Village Hall. Trustee White stated that the Citizens Advisory Committee will hold a meeting on February 17th to discuss the Small Cities Program. LABOR RELATIONS Trustee Timmings stated that Counsel is handling the discrimination complaint against the Village by Kevin Shubrick, Trustee Timmings moved, seconded by Trustee Soriano that action of Counsel be confirmed. Carried. Trustee Timmings stated that five grievances have been filed by CSEA employees and the Public Works and Labor Relations Committees met with Mr. Biros to discuss them. A management report will be made by the end of the week. Trustee Timmings stated that the police contract is waiting for the Mayor's signature. Trustee Timmings moved that the Treasurer be authorized to pay the police departnnent^r^ new rate effective Friday of this week/^fhi^m^m^^if^tee/SoT^aho. Carried. Trustee Timmings inquired if the Board would like to move on the Chief's salary tonight. By law, we have to give him the same increase as the Lieutenants receive, he said. Trustee Cavalieri moved that action be tabled, seconded by Trustee DiFelice. PUBLIC SAFETY Trustee DiFelice reported that the new scott air packs have been delivered to the fire department. A training session will be scheduled at the Fire Training School. % \ �-6The tentative date for the annual ambulance corps dinner has been scheduled for March 20th, said Trustee DiFelice. Trustee DiFelice stated that he is in receipt of a letter from Secretary of Fire Council Glenn Amesbury requesting the assistance of the Board in acquiring fire records from former Fire Chief John Cellant Trustee DiFelice moved, seconded by Trustee Cavalieri that Villag< Counsel be authorized to send Mr, Cellante a letter to turn over all fire records during his term of office to Fire Council. Carried. Trustee DiFelice moved, seconded by Trustee Gandolfo that specifi cations be prepared and bids be returned on May 19th on a new fire | chief's car to replace the old sedan. Carried. I In the meantime said Trustee DiFelice, the committee will check I with the County Purchasing Agency to see if there is one available. Trustee DiFelice stated that the Building Inspector is requesting our permission to notify the owner of 21 Beekman Avenue that he may make the necessary repairs provided that he complies with the N.Y.S. Building and Fire Codes, and so moved, seconded by Trustee Cavalieri. Deputy Mayor Timmings amended the motion to include the owner of 174 Cortlandt Street also. Motion carried. Trustee DiFelice stated that he checked into an article appearing in the newspaper regarding the Elmsford fire apparatus and was informed by the Village Clerk of Elmsford that the cost of a new pumper would be about $200,000, however, their fire committee decided to seek bids to repower and remodel the truck and received a bid of $80,000, with 3-4 months to update the truck. Trustee DiFelice stated that Counsel met with the police committee Chief Spota and a representative from the Pistol range for a preliminar discussion to outline guidelines for the range by outside organizations Another meeting will be held on March 25th with other organizations fox a final agreement, said Truste DiFelice. I A flyer is being mailed to residents through the police departmeii with listings of all services provided by the Village, said Trustee DiFelice. With regard to the usage of 911 for emergency calls, Trustee DiFelice stated that there is a controversy between the Police Chiefs Association and State officials. The Chief will notify him when the next meeting will be held. Trustee DiFelice stated that the Chief gave a presentation to the Exchange Club on Crime Prevention, Trustee DiFelice stated that John Cappello has satisfactorily completed his probationary period and moved that he be placed on permanent basis, seconded by Trustee Soriano. Carried. I > �-7- - ^ PUBLIC WORKS Trustee Soriano gave the following report: Quarterly meter readings have now been completed. Bank balance as of February 16, 1982 is $20,560.36. Four spreaders were used during the freezing rain and sleet storm on February 9th. Removed snow and ice following the alternate side restriction schedule. Filling potholes throughout the Village with cold patch. Removed tree stumps on Depeyster Street, College Avenue, Pocantico Street and Crane Avenue. The holiday this week falls on February 19th. paper or bulk pickup. There will be no RECREATION & PARKS -: Trustee Gandolfo gave the following report: The highway department has begun working in the parks. All picnic benches and tables are being repaired. The Easter egg hunt, co-sponsored with the Tarrytown Recreation Department and the Knights of Columbus, originally scheduled for March 27 will be held on April 3rd, instead. This week's ski trip is to Jiminy Peak on February 18th and Belleayre on February 21st. The Recreation Department will show the movie "Til the Clouds Roll By" for the N.T. Senior Citizens. Winter/spring programs are on their way. Aerobics classes have 70 adult residents participating, while the Youth basketball has 17 residents; floor hockey-25; racquetball-18; ski trips-35 youths, teens, and adults participating. Box lacrosse-25 teen residents and in ice skating and ice hockey-400/ residents participating Next week, women's Softball warmups and indoor tennis will start. Trustee Gandolfo stated that the Board met with Tarrytown Board discuss ice skating and it was agreed that North Tarrytown would send Gary Thomas for four hours per day and they would hire part-timers when needed. We would pay these employees, she said. Trustee Soriano moved, seconded by Trustee White that action of the committee be confirmed. Carried. SENIOR CITIZENS Trustee White stated that the citizens had a Valentine's Day party today. Plans are being made for a trip to Florida, she said. r V �Trustee White read a letter from Mrs. Nellie Sbezzi thanking the Mayor and Trustees for their gifts for their raffle. Trustee White reported that a grant of cheese for citizens has been made and it will be distributed at the Opportunity Center. Applications are being taken now, she said. Trustee Soriano acknowledged a letter of thanks received from Mr. & Mrs. Connors for the smoke detectors and stated that Trustee DiFelice was instrumental in obtaining these detectors for the citizens Trustee Soriano stated that the Village received $600 from the Town of Mt. Pleasant for the Senior Citizens Program. TAX EXEMPT & ASSESSMENT Trustee Timmings reported that nine grievances were filed today totaling $488,510 in requests for reduction in assessments. i At this time, Trustee White moved, seconded by Trustee Soriano that the Board meet in executive session to discuss a personnel matter, Trustee Soriano moved that John Biros' basic salary be raised to $27,000, excluding the $2,000 he receives as purchasing agent and $5,0( he receives as Supt. of Public Works; amount of $27,000 plus $5,000 be taken from the Water Account, seconded by Trustee DiFelice. Deputy Mayor Timmings polled the Board as follows: Trustee Gandolfo " Soriano - Yes - Yes Trustee Cavalieri " DiFelice White Deputy Mayor Timmings voted "Yes". - No - Yes - Yes Motion carried. Trustee Gandolfo stated that when the Board voted on retroactive increases several meetings' ago, a former employee of the recreation department was omitted. Trustee Gandolfo moved, seconded by Trustee Soriano that Robert Lugrezia be awarded retroactive pay to June 1, 1981, at 870 of his salary of $10,000 to the time he resigned. Carried. I MAYOR'S REPORT: Deputy Mayor Timmings moved that the Mayor be authorized to sign the contract, approved by Counsel, on the former Strand Property which was awarded to Laurentino Rodrigues, seconded by Trustee Soriano. Carri Deputy Mayor Timmings stated that with regard to our home rule request for a Board of Assessment Review, Assembly Bill 9345 and Senate Bill 7588, eight copies have been received for the Mayor's signature an he so moved that the Mayor be authorized to sign them, seconded by Trustee Soriano. Carried. Deputy Mayor Timmings stated that the Mayor obtained additional information from the National League of Cities and it will cost our Village $439 to join the organization. He suggested that this amount be included in the next budget. i i i �-9- ^^f Deputy Mayor Timmings stated that at the Village Officials' meeting held last week, a speaker talked on the subject of arbitration and noted that there is an organization in Ridgewood, New Jersey, who evaluates arbitrators. A list can be supplied to Villages at a cost of $150 for the services. iV>. » : ;l Deputy Mayor Timmings stated that a letter has been received from CSEA that we are not complying with the procedures as outlined under the Workers Compensation Law. It is our understanding that we are in full compliance, said Deputy Mayor Timmings. COMMUNICATIONS Hi i ' Communication from Mr. & Mrs. H. Landow, 162 Merlin Avenue, opposing the proposed Local Law for recreational vehicles was read and filed. fcf Communication from Village Clerk of Tarrytown notifying the Board that the Planning Board of Tarrytown will hold a public hearing designating the Warner Library as a Village Historic Landmark on February 22nd was read and filed. Communication from Willis Moon, Recording Sec'y. of Fire Patrol, requesting a meeting with the Board to discuss repairs to their kitchen was read. Trustee Cavalieri, Chairman of the Buildings & Grounds Committee, called for a meeting on February 25th at 9 P.M. Communication from Laurentino Rodrigues requesting permission to park a dumpster in front of the former Strand Theater in order for him to renovate the building was read. Counsel advised that no action be taken until such time as Mr. Rodrigues obtains legal title to the property, as well as obtaining a building permit. Communication from Glenn Amesbury, Sec'y. of Fire Council, regarding changes in personnel in Fire Patrol and Rescue Hose Companies, as well as an exempt certificate for William Mowatt was read. Trustee DiFelice moved, seconded by Trustee Soriano that action of Council regarding changes in personnel be confirmed and an exempt certificate be issued to William Mowatt. Carried. With regard to the status of the out-of-town fireman in Fire Patrol Company, it was stated that it is legal for him to answer fire calls, after which, Trustee Soriano moved, seconded by Trustee Cavalieri that Anthony Vadala be granted permission to join Fire Patrol Company. Carried. ¥ NEW BUSINESS Trustee Gandolfo stated that a complaint was made regarding the ramp for the handicapped coming into Village Hall and moved that Mr. Doorley, CDA Director, be requested to either have the ramp repaired or a new one installed, seconded by Trustee Cavalieri, and that the cost for same be taken from CDA funds. Carried. it r �sff -10Trustee DiFelice inquired as to whether or not an official Opinion will be obtained regarding the residency of the Judge. Deputy Mayor Timmings stated that one opinion has been received. Trustee DiFelice moved, seconded by Trustee Cavalieri that the Mayor be authorized, through special Counsel, to contact the Attorney General and the Office of the Court Administration for an opinion. Carried. Trustee Soriano moved, seconded by Trustee White that the bills submitted on the General Fund and Water & Sewer Department warrants dated February 16, 1982 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. ' f <l«\ / er; > : V v At this time, Mayor Zegarelli, together with Trustee DiFelice, presented certificates for completion of training school, as well as Village certificates for outstanding service to members of the North Tarrytown Auxiliary Police. Mayor Zegarelli conveyed the Village's best wishes to all individuals for their good work. Trustee DiFelice moved, seconded by Trustee White that the minutes of the meeting held on January 18, 1982 be approved, as corrected, with corrections. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mr. George Kuntz, representing the P.M.I. Association, inquired if the Board was going to adopt an ordinance regarding the parking of recreational vehicles or motor homes in the Village and if it will effect the whole Village or the Manor people. Mayor Zegarelli stated that the Board is still reviewing the ordinance in detail. He assured Mr. Kuntz that the ordinance would not be adopted this evening. He stated that we need to expand on the definitions. The newspaper will be notified when this item will come up as part of the regular order of business, said the Mayor. Trustee Timmings suggested that if the P.M.I, has an official position on this proposal, that it be put in writing to the Board. Mr. B. Rice, President of the "Friends of the Library" urged an increase in the library budget. He stated that the library budget had increased because of the fact that it was opened on Sunday. People work during the day, he said, and cannot get to the library. Trustee Gandolfo stated that Tarrytown has requested an additional $5,000 in order to open on Sunday. \ �-2Mr. Joseph Schwer, 95 Beekman Avenue, Vice-President of the Van Tassel Tenants Association, stated that four years' ago, the organizat asked the Board to bring the ETPA into this Village. He stated that h is aware that members of the Board met with a representative from ETPA It is necessary for the North Tarrytown Senior Citizens, said Mr. Schw He stated that as soon as an apartment becomes vacant, the rents have been increased and he is recommending that the Board make a decision. Mayor Zegarelli stated that the Board met with various people in order to learn more about ETPA and how it applies to the Village and i we should go into it. He stated that in a check of how much the Van Tassel paid in taxes on the building, it was found they paid $24,500 o less than $100 per unit. We have been through tax certiorari cases i where the Village has lost, said the Mayor. He knows the concerns ofB the residents. I Mayor Zegarelli inquired as to how would the Tenants Association propose to the Village on how the Village should address any change in the" status of the V.T.'s rent and lease arrangements. In particular, asked the Tenants Association if they would be willing to forego rent control and have the entire building put on ETPA. Mrs. Jennie Hennessey, 95 Beekman Avenue, stated that she has to put a month's salary for her rent which has been increased $121 mtfjxe,, she said. Mrs. Margaret McClintock, 95 Beekman Avenue, stated that tenants renting an apartment for $250 have been told that their rent will be $400 per month for their four room apartment. Trustee White stated that one of the questions raised with the representative from ETPA was that when an apartment is vacant, the owni does not have to tell the next tenant how much the previous tenant was paying. Answering Mr. Schwer's statement regarding electrical work being J in the building, as well as electrical violations, Mayor Zegarelli staj that the Building Inspector is the Code Enforcement Officer and urged! Schwer, as well as other tenants, to complete the necessary complaint! forms so that the building isnpector can process their complaints. I On an inquiry from Mrs. Yolanda Mallery regarding the ratio of taj money, Mayor Zegarelli stated that every time we try to do something td help the tenants by restricting the rent to the V. T., the landlord td around and goes to court and obtains a tax abatement against the Villa^ Assessment roll. The tax abatement won by the V.T. does not revert bad to the individual tenants or is it utilized for the upgrading and repai of the building. The Mayor stated that the end result is that both th< tenants and the Village have lost when the V.T. wins in a tax certiorai matter. Trustee Cavalieri stated that the building inspector gave Tom Gle* complaint forms a couple of times, but none were ever completed. He suggested another meeting with Mr. Bronstein, Mayor Zegarelli stated that we have discussed this matter with otl Villages who implemented ETPA, as well as the Village Officials Associ and will again discuss the matter with other Boards. Mfcs. *fergo Stewart, 95 Beekman Avenue, stated that if we can get ETPA into our Village, it would be a big help to tenants with leases. i s i r �-3. "**" Mayor Zegarelli stated that we will be meeting with Mr. Bronstein, as well as a committee from the Van Tassel Association. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri stated that Johnson Control workers have been here since January 19th refurbishing the heating control system. Piping work is almost completed, he said, The installation of new valves and thermostats will follow, he said. A new 50 gallon hot water tank was installed in Union Hose quarters, said Trustee Cavalieri. Trustee Cavalieri -stated that we are waiting for word from the Rifle Club to complete improvements to the rifle range in the basement. A contract will be needed between the club and Village and for its use, said Trustee Cavalieri. Mayor Zegarelli instructed Counsel to hold a meeting with the Chief and public safety committee to prepare the guide lines. FINANCE & DEVELOPMENT Trustee Gandolfo stated that she, together with Trustee Soriano and Trustee White, met with Dr. Sweet and Messrs. Spencer, Pound & Gorman to discuss the dredging of Fremont Pond. Mr. Gorman received a letter from the School Board requesting additional requirements. Hopefully, when these requirements are met, Mr. Pound will be able to begin. She stated that she is in receipt of a letter from Mr. Pound submitting a copy of the spoil site plan which was previously submitted to the School Board also. The current frozen condition of the ground precludes construction of the spoil area, she said. Mr. Pound will commence work at the earliest possible date, said Trustee Gandolfo. Trustee Gandolfo reported a cash balance of $17,393.52 in the General Fund as of February 1, 1982. Trustee Gandolfo stated that a "Special Municipal Aid" check in the amount of $49,551.00 has been received. This check is in addition to the regular State aid revenue sharing for the current fiscal year. Trustee Gandolfo moved, seconded by Trustee Soriano that action of the Treasurer in investing a certificate of deposit in the amount of $100,000.00 for 30 days with the First National Bank of North Tarrytown at 11% be confirmed. Carried. Trustee Gandolfo stated that we are in receipt of a request from the library for an increase of $48,000. A meeting was held with the Tarrytown and Library Boards last week. She reviewed budget requests from other departments. Trustee Gandolfo called for meetings with committees to discuss the budget. \ �-4Trustee Gandolfo moved, seconded by Trustee Soriano that the nonunion employees receive salary adjustments and increases as presented, effective immediately and retroactive to June 1, 1981, money to be transferred from Contingency Fund. Mr. Doorley is ascertaining wheth or not the $30,000 can be transferred into other areas. She stated that the Board should consider earmarking the money for some kind of project, for instance, paving work is needed. GOVERNMENTAL RELATIONS Trustee White reported on a new law affecting parking spaces requirements for the handicapped in malls, etc. Trustee White reported that the building inspector is looking for code enforcement help. LABOR RELATIONS Trustee Timmings requested an executive session under unfinished business to discuss the holidays during this month. Mayor Zegarelli stated that the Board will hold meetings during February as follows : I I February 8th, February 9th and 10th and 16th. Trustee Timmings reported that the government has announced that the CPI increase for 1981 was 8.9%. If inflation continues at the same pace through the end of March, our contractural police salary increase would be 8.4%. You can use the 8.4% for preliminary self-budgeting. Trustee Timmings reported that the police contract is in its final stage of review and can be reviewed at the work session on Feb. II Trustee Timmings moved, seconded by Trustee Gandolfo that if the contract is agreeable to the entire Board that the Mayor be authorized to sign it immediately. Carried. Trustee Timmings stated that he, together with Village Counsel, attended the grievance hearing of former Ptl. John Quartucio on Jan. 28i One of the documents we submitted was from the Dept. of Audit & Control which stated that even outside of collective bargaining, a Village may require employees to reimburse the Village for the cost of the training * r �-5- ^ ^ _ if they voluntarily leave Village employment. It will be interesting to see how the arbitrator rules with this kind of document as part of the Village presentation, said Trustee Timmings. PUBLIC SAFETY Trustee DiFelice stated that Rescue Hose fire apparatus committee cancelled two truck demonstrations due to poor weather. In connection with a bill in the Assembly regarding Games of Chance, Trustee DiFelice moved, seconded by Trustee Cavalieri that a letter be sent to Assemblyman Peter Sullivan urging his support for Assembly Bill A335, Carried. Trustee DiFelice moved, seconded by Trustee Cavalieri that letters be sent to our Assemblyman and Senator urging their support of Senate Bill 4295 and Assembly Bill 5865 (Mobile Radio Dist. Coalition) to permit a single band communication between police departments. Carried. In regard to the intersection of 448, Bedford Road, Trustee DiFelice reported that the highway contract which was placed under restriction on January 20, 1981 has been completed and said restriction is hereby cancelled. PUBLIC WORKS Trustee Soriano gave the following report; Clearing snow around fire hydrants. Beekman Avenue. Repaired leaking hydrant on Bank balance in water, and sewer account as of Feb. 1st is $24,747.13 Twoimen were injured at 'a fire at/174-176 Cortlandt Street. Salt/sanaed roads on January 23rd after which plows were used when snow began to accumulate. The Supt. of Public Works is recommending that in order to improve the efficiency and effectiveness of our plowing operations, that an ordinance be adopte d and enforced for one side parking on any Village street during a snow storm. Trustee DiFelice moved, seconded by "^m^tjee White that action of the Public Works Committee in appointing w^uisT Ortiz Sanitation Man at a salary of $15,585, less $500 upon completion of his probationary period, effective January 22, 1982, be confirmed by the Board. Carried. Trustee Soriano read a letter from Albany clarifying Article 346 of the highway law which stated that sidewalks and appurtenances shall be maintained and shall be continuing to be maintained by the Village on Route 9. Mayor Zegarelli stated that the only way of getting a final determination is by court action. Trustee Soriano reiterated the drainage problem on Route 9, east side. The matter was referred to Counsel. \ �-6RECREATION Trustee Gandolfo gave the following report: Aerobics/Joy classes resume this evening. Youth floor hockey commences this week at John Paulding. Tennis lessons and racquetball registrations will be extended to February 17th. Advanced typing was cancelled because of lack of registration. This week's ski trip is to Butternut on Feb. 6th and Vernon Valley on Feb. 7th. i Andrews Lane shack was broken into sometime between Jan. 23rd an 26th. The lock to the shed was taken. On January 27th of 28th, the shed in Douglas Park was vandalized One of the locks was broken, however, no one was able to enter the shed Trustee Gandolfo stated that several meetings ago, a resolution wa passed granting several part-timers an increase from $3.50 to $4.00 and some were included for retro-active pay. She stated that she neglected to increase John Nicol's pay and so moved that he be included in the retro-active pay increase to $4, seconded by Trustee Soriano. Carried. Trustee Gandolfo stated that she would like to clarify the matter of the rate per hour for part-time workers. Several months ago, parttimers' rate per hour was increased from $3.50 to $4, retroactive to June 1, 1981. This pertained to a certain group of people. However, all part-timers will receive $4 per hour, effective the date of the November 16th meeting, with the exception of the dog warden who is on a contract basis. Trustee Gandolfo nf^ed that the rate per hour for all part-time employees other than those presently under contract and those in the recreation department, will be increased to $4 per hour; that those Mayor Zegarelli polled the Board as follows: Trustee Timmings Gandolfo " Soriano Mayor Voted "Yes". - Yes - Yes - Yes Trustee Cavalieri " DiFelice " White _ Yes Abstain Yes Motion carried, Trustee Gandolfo stated that the plans for the utility building for recreation have been reviewed by the building inspector and Counsel has approvedrfthe specifications and so moved, seconded by Trustee Sorian that bids be? returned on March 22nd jon the project, money to be taken from CDA funds. Carried. �^#y -7SENIOR CITIZENS Trustee White stated that a meeting was held today with 100 people in attendance. Mr. Walter Michele spoke on full value assessment. Miss Margaret Nixon spoke to the group regarding arts and crafts. Trustee White read a letter from Mrs, Nellie Sbezzi inviting the Mayor & Board to attend a luncheon to celebrate Valentine's Day, Washington and Lincoln's birthdays. Trustee Gandolfo stated that cheese will be coming from the government for the Senior Citizens. TAX EXEMPT & ASSESSMENT Trustee Timmings stated that he, together with Counsel, has been in touch with the Municipal Law Resource Center, regarding cuts on tax exempt property on the roll, however, it has been very discouraging. MAYOR'S REPORT: Mayor Zegarelli brought to the attention of the Board an invitation to join the National League of Cities organization at a cost of $439 per year. Following a discussion, the Mayor asked the Board to review the matter. Mayor Zegarelli stated that a letter was received from the N.Y.S Conference of Mayors asking for comments on the proposed use of 911 as a primary State-wide emergency number. The matter was referred to the public safety committee. Mayor Zegarelli read a letter that he will send on behalf of the Board, upon approval, regarding the Village's feelings on Kingsland Point Park. The letter outlined the number of years the Village proposes to take over the park, transition of the property, security, maintenance, admissions, etc. Trustee DiFelice moved, seconded by Trustee White that the Mayor be authorized to sign the letter and that it be sent to the County Department of Parks. Carried. COMMUNICATIONS Communication from Sec'y. of Fire Council, Glenn Amesbury, regarding changes in personnel in Fire Patrol and Union Hose Companies, as well as an exempt certificate for John DiCairano was read and on motion duly made by Trustee Timmings, seconded by Trustee White that action of Council be confirmed and that an exempt certificate be awarded to John DiCairano. Carried. The Clerk informed the Board that the 1982 Assessment Roll has been completed and that the tentative figure is $40,051,381. In connection with the Assessment Roll, Mayor Zegarelli informed the Board that Grievance Day will be held on February 16, 1982, between the hours of one and five in the afternoon and 6 - 8 P.M. �The Clerk informed the Board that Village Treasurer Irene Amato had filed her report of unpaid taxes for the year 1981 as of January 31 1981, totaling $57,662.87 and in connection therewith, the following resolution was offered by Trustee Timmings, seconded by Trustee Gandolf< and was adopted: RESOLVED that the Board of Trustees sell all unpaid taxes for the year 1981 on March 18, 1982 pursuant to Section 1436, 1450, 1452 an 1454 of the real property tax law and amendments thereto the same terms! and conditions as the sale held on March 19, 1981 at the Village Hall, 28 Beekman Avenue and the Treasurer be and she hereby is directed to publish the proper legal notice for three consecutive weeks beginning February 24th, March 3rd, and March 10th, and be it further J RESOLVED that a copy of this resolution be given to the Treasured with the return of unpaid taxes as certified to by the Board. Carried* UNFINISHED BUSINESS Trustee Timmings moved, seconded by Trustee Gandolfo that all departments will celebrate Lincoln's and Washington's birthdays on February 12th and February 19th and that the Clerk be instructed to notify CSEA President. Carried. There will be no bulk pickup during those weeks. Trustee Soriano stated that the 79 College Avenue Directors had advertised for the sale of 79 College Avenue, however, the corporation does not have the amount of money to cover the cost of the advertising fees. Following a discussion, the matter was referred to the finance committee. Trustee Soriano stated that the Board is in receipt of a letter from the Mayor of the Village of Sylvan Beach, New York, requesting support for the next legislative meeting, to exempt Villages from itei^ 3 and 4 of the Town Highway budget. The Sylvan Beach Mayor stated thM it is their hope that this will be a beginning for all Villages to befl exempt from the double taxation, ™ Trustee Soriano moved, seconded by Trustee Gandolfo that the Village support the Village of Sylvan Beach, New York, and that a lette be sent indicating the same. Carried. Trustee Gandolfo stated that there was some discussion about the Rockefeller family contributing land for park purposes and the effect it would have on North Tarrytown. She inquired if Counsel could check into the matter if we have any legal way of stopping the proceedings. Counsel stated that you cannot stop the disposition of land, only the use of land. Following a discussion, the matter was referred to the tax exempt property and assessment committee for a status report. i % r * �Trustee Timmings moved that members of the State Legislature be contacted urging them to oppose the passage of the Governor's budget, as long as it contains a cap on revenue sharing, seconded by Trustee White, Carried. Trustee Gandolfo moved, seconded by Trustee White that the bills submitted on the General Fund and Water & Sewer Department warrants dated February 1st, 1982 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Trustee Timmings moved, seconded by Trustee White that the minutes of the meeting held on January 4, 1982 be approved as written. Carried. Mayor Zegarelli read the notice of hearing on a proposed local law entitled recreational vehicles which would make it unlawful for any person to park any recreational vehicles, which shall include a camper, camper trailer, motor home, trailer, boat or pickup with a gross weight in excess of 1% tons upon any road, street or highway in any residential area and asked if there was anyone present who would like to comment on the proposed local law, Mr. Robert Eisler, Pierson Avenue, requested that the Board postpone any vote on the proposed law. He stated that he was in the process of obtaining information which he believes would be unconstitutional for the Board to pass the law, He stated that he sees a purpose, but no advantage to it. Mayor Zegarelli stated that just because the hearing is tonight does not mean that it will be voted upon tonight. Mr. Eisler stated that he would like to submit a petition against the law and as much information he can get in opposition to it. Trustee Gandolfo suggested that if people are going to sign the petition have it specific, i.e., in opposition to campers and pickup trucks or both so that the Board will have more information. The law encompasses several types of vehicles, she said, and that he be specific as to what the people would be for or against, Mr. Gerald Patrigani, 419 North Broadway, stated that he invested $25,000 in an RV and questioned as to where he could park it. Mayor Zegarelli quoted the proposed law in part which states that no vehicle, etc. shall be stored in any front yard or side yard. He stated that there was no clause prohibiting him from parking it in a back yard. Ws , �-2Mr. John Garibaldi, 138 Harwood Avenue, stated that he was a real estate broker and when he moved into his home twenty-one years' ago, he was told that he is not allowed to have a real estate office in his home because it is a residential area. Mr. Patrigani lives in a one family residential zone. His van should be parked in a business area. He stated that if you permit such vehicles, etc. to be parked in a one family zone, the Village would have to re-assess the area. In this instance, he said, there is no hardship. He stated that his neighbor has parked a mobile home in his front yard for over a year and it is depreciating his property. He stated that if he continues to park the mobile home, he will ask for a reduction in his assessment. Mr. Eisler stated that recreational vehicles are not considered commercial, however, if someone is living in the trailer, then Mr. Garibaldi would have a grievance. If he uses the trailer once a year he would not be living in it, he said. Mr. Garibaldi stated that the owner had a refrigerator on the back of the home. Who is to say if he was not living in it. i Mrs. Helen Roberts, 266 Harwood Avenue, stated that she was concerned about the trailer parked on the street. She stated that parking such vehicles in plain view spoils the residential character of the area. She stated that she does not like seeing the trailer ever day. Trustee Timmings stated that he had two calls addressing the subje He stated that people are in favor of this law, but feel it should be extended. The law should be more encompassing, he said. Mr. Joseph Finnegan, 154 Farrington Avenue, speaking as a realtor stated that there is a house for sale on Kelbourne Avenue in the amount of $185,000. We have been very strict about one family residences and the Board should think very seriously before allowing these recreationa vehicles to be parked in those areas, Mr. Raymond Avellino, Ridge Street, questioned the interpretation of pickup trucks. He stated that every truck in the Village would ha" to go if the 1% ton pickup is prohibited. Mr. Mario Belanich, 150 No. Washington Street, inquired as to ho this proposed law was originated. Mayor Zegarelli stated that he and Board members had received written and oral requests from residents objecting to these vehicles being parked in residential areas. On a question of Mr. Belanich if the law was passed what a person would do if he has a camper, Mayor Zegarelli answered that he would ha\ to find an alternate area to store it. Mrs. Frank Baker, Gordon Avenue, inquired about any ordinances prohibiting commercial vehicles to be parked in residential areas. S stated that there is a commercial vehicle parked in front of her home which is taking 2-3 parking spaces. The owner does not even live ther( and if she has friends over, they cannot find a place to park. �-3- Jgf Trustee DiFelice quoted an ordinance which prohibits parking more than 48 hours on any street. Mayor Zegarelli stated that the comments will be taken into consideration and the proposed law will be reviewed in detail. No other comments, Trustee DiFelice moved, seconded by Trustee Gandolfo that the hearing be closed. Mayor Zegarelli asked if there was anyone present who would like to address the Board on any other matter. Mr. Mario Belanich commented on the snow cleanup throughout the Village and inquired what happened. Trustee Soriano stated that parked cars made it difficult to remove the snow. All streets were opened, he said. He stated that even if we were to tow the cars, we had no place to store them. Mr. Stephen Maceyak, 13 Elm Street, stated that when he went to see Mr. Biros on Thursday about his street, he was told that he did not know the police told people to move the cars. He questioned as to why the Village rented trucks when we had a truck "sitting" at the Village garage. Trustee Soriano read part of the Supt, of Public Works' report which gave an account of salt spreading and plowing of streets and said he would stand by it. Mr. Maceyak questioned as to why one of the spreaders was not inspected (as indicated in the report) and was answered by Trustee Soriano that after it was taken out again, it broke down, Mr, Garibaldi complained about the double parked cars at Tappan Motors on Route 9 whicri are causing a safety hazard to cars coming south. He also noted the signs at the Deli near McCall-Frandsen, as well as the obsolete gas pumps in front of it and suggested that they be removed. This would give him a decent parking lot, he said. The matters were referred to the building inspector. Trustee Timmings suggested that Mr. Garibaldi write to the DOT, copies to Goodhue and Sullivan, regarding the traffic pattern on North Broadway, He stated that DOT did make a survey, but would not change the traffic pattern, We have no cooperation from the State of New York, said Trustee Timmings. Mr. Maceyak noted the article in the local newspaper about Search for Change and inquired if there was a liaison between the Village and the organization. Mayor Zegarelli explained the events which took place in connection with the organization when they first approached the Board. Trustee Cavalieri stated that when the Board met with the two gentlemen, they were talking about Senior Citizen housing. When the organization went to the County Board of Legislators1., they talked about some other project. �-4REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri stated that on January 13th, a representative from the Federal Energy Department was present to check over the Villag buildings to make an evaluation of the efficiency of our heating system A report will be forthcoming. FINANCE & DEVELOPMENT Trustee Gandolfo reported a cash balance of $96,488.00 in the General Fund as of January 18, 1982. Trustee Gandolfo moved, seconded by Trustee Timmings that action of the Treasurer in reinvesting a c.d, note for thirty days at 11% at the First National Bank of North Tarrytown be confirmed. Carried. i Trustee Gandolfo reported that the total estimated revenues to be collected for the fiscal year ending May 1982 is $3,053,461. Trustee Gandolfo moved, seconded by Trustee Timmings that the Treasurer be authorized to attend a Municipal Finance seminar at the Marriot Hotel on January 21st, with registration fee of $25. Carried. Trustee Gandolfo stated that a meeting will be held on Wednesday evening with a school board representative, this Board, Mr. Pound and Mr. Cropper regarding Fremont Pond. Trustee Gandolfo stated that her committee is reviewing the six month spending report and most departments are within their budgets. Noting that the Acting Village Justice budget has exceed its appropriate she is calling for a meeting with the Judge and Acting Judge. GOVERNMENTAL RELATIONS Trustee White st ated that a letter has been received from the Westchester County Department of Planning confirming the proposals fo public improvements, recreation, parking, community service, fire protection and boat basin, This is in connection with the UDAG Prog She stated that she is asking the Advisory Board to schedule a meeting to discuss the Small Cities Program. J Trustee White noted a memo from Curtis Heath, Chairman of the Environmental Conservation Committee, regarding a revised tree ordinana It will be discussed in their meeting, she said. Mayor Zegarelli stated that a public hearing will have to be held at a later date. Trustee White moved, seconded by Trustee Timmings that membership in the Westchester County Municipal Planning Federation be continued. Carried. LABOR RELATIONS Trustee Timmings stated that at the last meeting, the Board author him to send a letter to CSEA pertaining to Lincoln's and Washington's j Birthdays. Trustee Timmings stated that the grievance filed by former patrolman John Quartucio will be arbitrated on January 28th in White Plains, This might substantiate the Village's position, he said. PUBLIC SAFETY Trustee DiFelice stated that Rescue Hose' new fire apparatus committee is meeting tonight. The committee met with the Fire Chief and members of Fire Council and Fire Patrol to discuss the acceptance of an out-of-town fireman. The wardens claim that according to a law passed in 1977, it is legal for an out-of-towner to be elected in the local fire department,' Trustee Timmings moved, seconded by Trustee White that the Village Attorney be instructed to obtain an opinion through the State. Counsel stated that if a fireman had lived here and moved out-oftown, it would be permissible for him to remain in our department. Trustee Gandolfo questioned the Village's liability. Mayor Zegarelli stated that there is a question if the Village can provide service on a regular basis. He stated that the ambulance was on a routine basis for several days, if not weeks, on call covering Tarrytown Trustee Gandolfo stated that she was informed that the Corps answered no more than ten calls. They were only on an emergency basis. Trustee Timmings stated that the Village of Tarrytown does not sponsor the ambulance corps. | j '' >l» Trustee Gandolfo suggested that the Fire Chief submit a report as to how many times the Corps has been going to Tarrytown. 11 On an inquiry of Trustee Timmings as to who was calling North Tarrytown, Trustee DiFelice answered that the Tarrytown police have been calling us. Trustee DiFelice stated that a request has been made by the KnappMcCarthy Taxi Company for an increase in taxi fares and moved that a public hearing be held on February 16th on a proposed increase, seconded by Trustee Cavalieri. Carried. Trustee DiFelice reported that surplus food is available for the needy in New York. State, He stated that he requested an application from the State. During a discussion, it was stated that she was receiving $4.00 pe hour. Trustee Gandolfo stated that unless mentioned otherwiset part-time should start at $3,50 per hour. Trustee Cavalieri stated that we should have a recommendation from the public safety committee. Trustee Timmings moved to amend the motion that she receive $4.0 per hour, seconded by Trustee White. Snow being cleaned around the fire hydrants. Bank balance as of Jan. 18th is $17,581.23. •M Repaired shoulders along Sleepy Hollow Road, built new manhole on storm sewer on Valley Street, Sealed joints on College Avenue and North Washington Street. Spread salt on Routes 9 and 448 during snow storm on January 13th throughout the Village, Snow was removed in the Sleepy Hollow Manor, Philipse Manor, Webber Park and the Village, Two breakdowns with the pickup trucks, and two water department trucks plowed up the slack. On January 14th, plowing continued as well as sanding. On Saturday, snow was removed on Beekman Ave., Elm,- Francis, Barnhart, Kendall and Clinton Streets. 300 tons of salt and 100 yards of sand was used for 11" of snow. Police department cooperation was good, til i *! 1!!' S Snow was being dumped in the area of Devries Field, not on the ballfield. All garbage pickups were made as scheduled. The commission would like the Village to sponsor a display of North Tarrytown's heritage, the weekend of May 22-23 at Playland. A meeting will be held on Saturday morning and anyone who is interested in helping with the display is invited, she said. One of the projects will be photographs of people at work and play from 1860 on from each respective Village. An oral history of the Village will be taped and recording of senior citizens topic "I Remember North Tarrytown" giving versions and accounts of what happened. k'u Trustee Cavalieri stated that an article appeared in the local newspaper that the Village was being sued $130,000,000.00 and stated that the newspaper should put a retraction of that article since no papers were served upon the Village, et al. 1 i Mayor Zegarelli stated thaothe time has come for a re-appraisal of the matter. Trustee White moved, seconded by Trustee Timmings that the minutes of the meetings held on December 21 and December 28, 1981 be approved as written. Carried. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri reported that maintenance of the buildings is continuing. A meeting will be held with the Johnson Control representative to determine the date that work will commence on the heating system. FINANCE & DEVELOPMENT Trustee Gandolfo reported a cash balance of $993,225.55 in the General Fund as of January 4, 1982. Trustee Gandolfo moved, seconded by Trustee Timmings that action of the Treasurer in investing the amount of $100,000 in a certificate of deposit on December 24, 1981 at the First National Bank of North Tarrytown at 117o interest be confirmed. Carried, Trustee Gandolfo stated that she is in receipt of a six month status report on all department spending and she will meet with her committee on January 6th to discuss the report. Trustee Gandolfo stated that last year an independent organization ! requested funds during the mid-year for which we were not prepared. She stated that she would like to send a letter to the Tarrytowners and Proud of It organization to ascertain whether or not they are going to seek funds so that the amount can be allocated in the next budget. �-2- Trustee Soriano moved, seconded by Trustee DiFelice that 200 calendar days for compliance be established for completion work. Trustee White moved, seconded by Trustee Timmings that the contractors be notified by certified mail by January 1st, 1982. Trustee Timmings moved, seconded by Trustee White that the bid bonds from all but the top two bidders be returned immediately and the others returned when we have a signed contract. Carried. Trustee Soriano moved to accept the bid of Laurentino Rodrigues, 56 Clinton St., No. Tarrytown, N.Y. for the former Strand Theater in the amount of $45,000, subject to the provisions outlined in the public notice. Trustee Soriano moved, seconded by Trustee DiFelice that David Freyler be terminated as Sanitation Man effective December 14, 1981. Carried. • 'Iff W" -J Trustee Soriano stated that the job will be posted and the position be made known publicly, Trustee Soriano stated that John Biros is attending a meeting of the Executive Board, New York Section American Water Works in New York City. * Trustee Soriano stated that he has written to the Attorney General and the Dept. of Audit & Control requesting clarification of Article III, Section 46 of the Highway Law. He stated that there is a serious drainage problem on Route 9 which is causing flooding of homes off route 9. In a letter received from DOT dated August 24th, 1981, he was informed that the State was not responsible for roadside maintenance and drainage. He was asking the Attorney General for clarification and the Dept. of Audit & Control if there were any possible funding for drainage work on Route 9. He stated that the State did some drainage work on Route 9 in Briarcliff, He is waiting for a reply, said Trustee Soriano. Trustee Cavalieri suggested taking action against the State. & v �.4. ' Mayor Zegarelli stated that he has written several letters and stated that he will send a letter to the New York State Conference of Mayors for an interpretation of the Highway Law and how other communitie have responded to the provisions of the law. RECREATION & PARKS Trustee Gandolfo gave the following report: The Winter-Spring brochure has been mailed to residents, courses availabe are: basketball, floor hockey, gymnastic clufo girls spftball dad's club baseball, soccer, Tiny Tot baseball, box lacrosse, aerobics/j etc. Box lacrosse and youth basketball start this week. Floor hockeywill start Feb. 4th. Ice skating at the Tarrytown Lakes started last week for two days The agreement has not been finalized. The lakes froze one day and a laborer was sent for four hours after permission was obtained from Board members. Trustee Gandolfo moved, seconded by Trustee Cavalieri that her action be confirmed. Carried, This weekend's ski trip is to Whiteface Mountain Jan, 8-10th. Trustee Gandolfo moved, seconded by Trustee White that Pat Lofaro and Gary Thomas be authorized to attend the conference at the Tappan Zee Towne House in Nyack on January 27th on Professional Turf and Landscape, with expenses, said cost to come out of recreation budget, Carried. Trustee Gandolfo suggested a meeting be held with the entire Board to discuss Kingsland Point Park, Mayor Zegarelli stated that Mr, Dolan's office called and they will be forwarding to him an outline of a proposed agreement for the Village's takeover of Kingsland Point Park and at that time, Mayor Zegarelli stated that he will call a meeting of the Board to discuss a response and our own provisions. I SENIOR CITIZENS Trustee White reported that the citizens will see a movie at their next meeting. Tarrytown citizens have also been,invited. Six birthdays were celebrated and a Valentine^ party will be held. The citizens thank the Mayor and Trustees for the cooperation given to them during the past year, said Trustee White, This month will be dedicated to shutins, she said. Trustee White moved, seconded by Trustee Soriano that William Doorley be granted a salary increase of $500, effective at the next pay period. In reviewing the last nine months, he noted that College Arms and the Margotta Courts are tax exempt properties and the Van Tassel is assessed by the income it derives. They are paying taxes on a depreciated rate. As a result of the library cards issued in those properties, the Village is paying over $16,000 to the library in subsidies on properties we get little or nothing in tax collections. He stated that we should keep this in mind when we-have our next contract session witlv^Tarrytown on funding the library. Trustee Timmings stated that there were cards from a resident of New York City who works in the Pocantico Hills school district, an Ossining resident who attends St, Teresals School which is charged to North Tarrytown. He stated that we are paying for library cards for 21 Beekman Avenue, as well as other addresses not in North Tarrytown. He stated that we should be paying for ligitimate residents within the corporate limits of the Village. MAYOR'S REPORT , j Mayor Zegarelli stated that a memo has been received from Counsel regarding Games of Chance, Trustee Gandolfo moved, seconded by Trustee DiFelice that Counsel be authorized to further investigate as to the validity of the existing law of games of chance in the Town of Mt, Pleasant and how it applies or does not apply to us. Carried. Mayor Zegarelli stated that he is in receipt of a proposed legislation such as the one in Tuckahoe on the establishment of a Board of Assessment Review and has asked Counsel to review it. Mayor Zegarelli noted the work of Ronald Turnquist did on the Village garage and he stated that the Board may wish to establish a position of Village Architect in an advisory capacity, In talking to Ron Turnquist, , he was informed that he would be favorable to this. There would be no compensation, said the Mayor, Mayor Zegarelli stated that he will confirm everything with Mr. Turnquist before any appointment is proposed. m COMMUNICATIONS , j < Communication from Sec'y. of Fire Council Glenn Amesbury, stating I that the out-of-town fireman elected active member of Fire Patrol works | in the Village of North Tarrytown and would be available to run to a fire j was read. Trustee DiFelice stated that a meeting will be held with Fire Council and the Board to discuss this matter. Counsel stated that he issued a memo on this ruling. 1 �I -6In connection with the Village garage, Trustee Cavalieri stated tha the Board should start looking for a Clerk of the Works. He suggested James Margotta because of his background in the field of construction, however, during the discussion, it was stated that Ron Turnquist would be making daily visits to the job site and would inspect the work being done. Trustee Cavalieri stated that Mr. Turnquist made a sketch of the work to be done at Barnhart Park, The Village would gain about two acres of land at the Park if cribbing work is constructed and suggested that the Board consider this.
