PUBLIC HEARINGS NORTH TARRYTOWN, N.Y February 28, 1983 A regular meeting of the Board of Trustees of the Village of North Tarrytown was held on the above date. Present Philip E. Zegarelli, Mayor Stephen Maceyak Janet Gandolfo Peter Soriano Joseph D. Lofaro Mario DiFelice Emmanuel Lobato, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Soriano moved, seconded by Trustee Gandolfo that the minutes of the meeting held on February 14, 1983 be approved as written, Carried. Mayor Zegarelli read the notice of hearing on a proposed Local Law entitled "Gardeners" which would require a license and which would designate the appropriate times for the performance of all gardening work, etc. and asked if there was anyone present who would like to address the Board on the proposed law, t '• 1 , •m i Trustee Maceyak explained that especially in the Manors and the Webber Park area, gardeners doing work on properties would deposit the leaves and other materials into the street. He stated that this proposed law would require a gardener to apply for a permit. He stated that gardeners are paid to take the material away. A woman spectator stated that she has someone working for her, however, he bags the material. Others are careless about it. i) 1 Trustee Maceyak stated that grass clippings are strewn all over the street and have to be removed by the Village highway department. i'» A woman spectator stated that this is not only done by the gardener, :t but by the property owner himself. It is not the fault of the gardener, but the owner. she said. On a question raised by a woman spectator if the same rule applies to the dumping of leaves in the gutter and Trustee Maceyak answered that a separate local law is in effect. This particular local law gives the Village more control, he said. Trustee Soriano stated that gardeners have taken down trees which took a lot of time for the department to remove and Trustee Maceyak answered that the Village had taken one day to chip trees in the Village No other comments, Trustee DiFelice moved, seconded by Trustee Gandolfo'that the hearing be closed. Vs'- i 'ft r •%<* �-2Mayor Zegarelli read the notice of hearing to amend the Garbage and Refuse Collection Rules and Regulations which would add additional holidays whereby garbage will not be collected and include additional commercial pickups and asked if there was anyone present who would lil to address the Board. Trustee Maceyak stated that the additional commercial pickups woi be for the best interest of the Village and businessmen. He stated t\ complaints were received from the commercial establishments that altho they paid for pickups with private contractors, the refuse would be lei out on the curb making it an unsightly condition until such time as tl refuse is removed. ' | No other comments, Trustee Lofaro moved, seconded by Trustee Sori that the hearing be closed, Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board on any other matter, Mr. Mario Belanich, 153 No, Washington St., suggested that notice be given to the police when a holiday occurs regarding alternate side parking being suspended. He stated that he has to call the police every time a holiday falls during the week. Mayor Zegarelli stated that if it is an official holiday and recognized by the Village, parking is suspended automatically. Mr. Belanich stated that the police have told him that the Board has to authorize the parking suspension. Mayor Zegarelli stated that under the contract, we have designate officially what the holidays will be. He stated that the police know what the holidays are because they gear their schedules accordingly. Trustee DiFelice stated that the Chief has a list of holidays foi the year which are also posted at the desk. He stated that he would give each police officer a schedule. At this time, Trustee Lobato moved to suspend the regular order of business, seconded by Trustee Lofaro. Mayor Zegarelli inquired as to the reason and was answered by Trustee Lobato for the purpose of a resolution. Trustee Lobato moved the following resolution, seconded by Trust* Maceyak: WHEREAS, the continued operation of the General Motors Corporatiot assembly plant is of vital importance to the Village of North Tarrytcw WHEREAS, every member of the North Tarry town Board of Trustees hi expressed an interest and desire to explore ways in which the Village help ensure the continued operation of the General Motors plant in North Tarrytown; WHEREAS, every member of the Board of Trustees has agreed to resp and maintain the confidentiality of General Motors and information concerning the plant problems and plant operations which may come to t attention; �S~-. 76 V -3WHEREAS, the Mayor, without prior notice to the Board of Trustees, attended meetings with officials of General Motors and higher government officials concerning solutions to the General Motors plant problems in the Village, and briefed the Trustees concerning the meetings only after being confronted with the fact of his attendance; WHEREAS, the briefings concerning the meetings has been inadequate; WHEREAS, the Board of Trustees has twice resolved that the Mayor be accompanied by another Village official at any meeting concerning the General Motors plant which he attends; WHEREAS, the Mayor has with impunity ignored these resolutions on the pretext that he was unauthorized to bring another Village official with him; WHEREAS, the Mayor did attend a meeting in Detroit concerning the General Motors plant at Village expense, after informing the board that his expenses were to be paid by Westchester County; W WHEREAS, the Mayor did give notice to the Board of Trustees of a briefing concerning a meeting he attended with numerous officials on the subject of the General Motors plant, and that the notice was given in a manner calculated to miss the attention of the Board of Trustees and contrary to the usual practice of this Board of giving telephone notice or message delivery by the Village police; WHEREAS, the Mayor did then issue a press release falsely giving the impression that the members of the Board of Trustees were not interested in attending the briefing; WHEREAS, the alleged" personal on the subject of statements he has Mayor has issued campaign literature touting his responsibility for bringing about high level meetings the General Motors plant, contrary to numerous made to the Board, WHEREAS, the Mayor has sought to use the problems with the General Motors plant to his political gain while hiding his participation in various meetings from the Board of Trustees; NOW, THEREFORE, BE IT RESOLVED • *!• The Mayor Philip E. Zegarelli is publicly censured for his failures t<! abide by the prior resolutions of this Board, for his failure to permit any involvement of the Board of Trustees in the process of searching for solutions to the problems of the local General Motors plant, and for giving contradictory statements to the Board of Trustees and to the public; jj, concerning his involvement in the search for solutions to the local problems of the General Motors plant. Mayor Zegarelli stated that he has briefed the Board and filled them in on all the facts. He stated that the Board was doing this willfully and spitefully, and told the Board and people in the audience that he will continue to do what he is doing. Trustee Soriano stated that he thought he should and still maintains that he be given permission to go. It was only fair that he accept the opinion of the Board and have someone go with him. 1 £': « v �-4- Mayor Zegarelli stated that the invitation came to him as the Mayd Individuals on the Board know exactly who was invited. I 1 Trustee Soriano stated that it was a matter of record several months' ago that the Mayor would concur. Following a discussion, Mayor Zegarelli polled the Board as folio Trustee Maceyak - Yes Trustee Lofaro - Yes Gandolfo - Yes " DiFelice - Yes " Soriano - Yes " Lobato - Yes Mayor Zegarelli voted "No". Motion carried. | I Mayor Zegarelli stated that he would like to take this opportunity to recognize Lorraine Annicchiarico who has been officially recognized by County Executive Andrew O'Rourke for her fine work in making the banner for the Westchester County Tri-Centennial and moved that a certificate be awarded to her, seconded by Trustee Soriano. Carried. REPORTS OF COMMITTEES ADMINISTRATION & CONSTRUCTION Trustee Soriano stated that the new Village garage was dedicated last Saturday and there was a fine turnout. He thanked Mr. Biros for obtaining the programs at no cost to the Village. FINANCE & REAL ESTATE Trustee Gandolfo moved, seconded by Trustee Lobato that action of the Treasurer in depositing a certificate of deposit in the First National Bank of N. Tarrytown for thirty days at 7%% be confirmed. Can Trustee Gandolfo stated that a voucher has been received from H. Lampert forlthe amount of $298.50 which the Board has agreed to settle his claim and moved that he be paid, seconded by Trustee Maceyak. Carr! Trustee Gandolfo reported a balance of $34,048.42 in the General Fund as of February 28, 1983. Trustee Gandolfo moved to transfer $5,000 from A3120.2, Equipment Misc., to A31204, Other Expenses, seconded by Trustee Soriano. Carried FIRE Trustee Lofaro moved that the first day of April be designated Fire Chief's Day, seconded by Trustee Gandolfo. Carried. Trustee Lofaro moved that the Fire Chief be granted permission t< take the Chief's car to Lake George on Saturday in order to obtain information for the forthcoming Chiefs' Convention, seconded by Trustc Soriano. Carried. Trustee Lofaro stated that there in the amount of $900 for boarding up damaged during a fire, and moved that and request that he forward it to Mr. Gandolfo. is a bill from Quinn Contracting Pasquale's restaurant which was the bill be sent back to Mr. Qui Albanese, seconded by Trustee �*-? -5Trustee Lofaro stated that the Fire Chief directed Mr, quinn to board up the restaurant. Trustee Gandolfo suggested that the contractor send the bill to the owner. Counsel Ponzini stated that normally this is our obligation since we ordered it boarded up, however, the Board can send the bill directly to the owner of the property and if he does not pay, it would immediately become a lien on the property. Motion carried. GOVERNMENTAL RELATIONS-SENIOR CITIZENS I • Trustee Soriano stated that the Interfaith Council will formulate committees to sign an agreement in connection with Senior Citizens' housing. Progress is being made, he said. He stated that he will continue to attend the meetings until his term runs out. LABOR RELATIONS Trustee Lobato stated that the committee is still on a hold condition until the challenge to decertifications of CSEA is resolved before Perb. To his knowledge, no date has been set for a hearing. | * )* On a suggestion of Trustee Soriano that dental benefits be included |! in negotiations, Trustee Lobato stated that the committee is looking to ju extend benefits to all employees after information is gathered on I certain categories of benefits. Consideration will be given to union '!',' employees with the expectation that all non-union employees will be covered POLICE & LIGHT I Trustee DiFelice stated that the committee held a meeting to discuss | the problem as to who called whom for assistance in connection with the \: Ossining hostage situation, It was the sense of the committee that we If, leave it lay, he said. Trustee Lobato suggested that a conciliatory letter be sent to Ossining that it was not the intent to put them on the spot, but look forward to our respective police departments in keeping with our fine record. Trustee Maceyak moved that a letter be sent to the Village of Ossining reflecting on our discussions, seconded by Trustee Lobato. ti •:- Trustee Maceyak stated that in past practices, bills were never interchanged. This has been a mixup, he said, and we should not let this go by. Mayor Zegarelli stated that he did talk to Mayor Joseph Caputo and explained the matter to him. Mayor Zegarelli polled the Board as follows: K ' �-6Trustee Maceyak - Yes " Gandolfo - Yes " Soriano - Abstained Mayor Zegarelli voted "Yes". Trustee Lofaro - Yes " DiFelice - No " Lobato - Yes Motion carried. Trustee DiFelice stated that a letter was received from Acting Chief Lt. Weaver of Tarrytown thanking Ptlmen. Kiggins, Schrank, Biro, Reddy for their assistance in attempting to apprehend a suspect who robbed a store in Tarrytown and moved that copies be placed in their folders, seconded by Trustee Soriano. Carried. Trustee DiFelice stated that he is in receipt of a memo from the Chief that Ptlmen. Kiggins and Schrank and their canine be commended f< being the first cocaine units in Westchester County to be certified in narcotic detection and additionally for graduating first and second in their class. Trustee DiFelice moved that a letter of commendation be sent to the officers, seconded by Trustee Lofaro, Carried. A letter was sent to Col. Lester Frost and Trooper Berhle of the Connecticut State Police for their cost-free housing and training for the canine units. Trustee DiFelice stated that John Thomas will have completed his twelve weeks' probationary period and moved that a letter requesting an extension of forty weeks be sent to personnel office. Carried. I The Village Clerk was instructed to obtain a local and County -I patrolman list. Trustee DiFelice noted a letter from Ptl, Ciffone which is refern to the Board as a whole and moved that the Board go into executive session to discuss the matter, seconded by Trustee Soriano. Carried. After the Board returned, Trustee Soriano moved, seconded by Trustee Lofaro that the Board continue its regular order of business. Carried, PUBLIC WORKS Trustee Maceyak gave the following report: Replaced broken hydrant on Beekman Avenue, near Union hall, as well as repairing meters found defective during the latest meter readii Pumped out gas and diesel tanks and hoist-well at new garage, as well as the pump room in Central building. Trustee Maceyak moved, seconded by Trustee Soriano that John Bir| be granted permission to attend the spring meeting of the New York I Section American Water Works Association on April 24-27 in New York C| with expenses. Carried. | Balance in the water account as of February 28, 1983 is $28,367.81 Removing snow in the Village and Webber Park as well as from aroui catch basins in Philipse and Sleepy Hollow Manors as a safety precauti< in the event of rain. �S-iy -7Trustee Maceyak moved that John Biros, Mike Apollonio and the public works department be complimented for their excellent job in snow removal and for the way expenses were kept down. The department moved some equipment to the new garage and set up shelves, work benches, etc. The sign maintenance man was also moved in. Crews have been routinely rotated in the Manors and Webber Park. Trustee Maceyak stated that the committee will postpone the appointment of a sanitation worker. He stated that the department is running fairly well. We can save the Village money by not appointing a man at this time, he said. Men are being moved around and he stated that he does not feel it is important at this point. On an inquiry of Mayor Zegarelli if the job will be deleted, Trustee Maceyak stated that it will be held in abeyance. Trustee Soriano stated that he recommended that possibly two people could be appointed of which one would be a cleaner. Trustee Maceyak stated that men were re-arranged in the public works department. He stated that there were too many men in one department. Mayor Zegarelli proceeded to nominate Anthony Annicchiarico for the position of sanitation man, however, there was no second. Mayor Zegarelli moved to abolish the position, seconded by Trustee Gandolfo. Trustee Lobato moved to postpone the issue indefinitely, seconded by Trustee Soriano. Carried, Mayor Zegarelli inquired of Trustee Maceyak a memo received regarding one of the men in the highway department. Trustee Maceyak stated that it was a complaint and he, together with Mr. Biros, decided that the man will be reprimanded for his act and if it happens again, we can suspend the gentleman. RECREATION & PARKS Trustee Gandolfo gave the following report: This week's ski trips are to Belleayre on March 5th and Hunter Mountain on March 6th. The department is planning for its up-coming softball season. The women's organizational meeting will be held on March 1st in the Village court room. The men's organizational meeting will be held on March 3rd in the Village court room. Meetings to be held at 7:00 p.m. The Dads' Club baseball kickoff will be held on March 11th at the Morse School auditorium at 7 P,M. Boys age 6-14 are welcome, as well as their parents. �-8TAX EXEMPT PROPERTY & ASSESSMENT Trustee Lobato stated that Grievance Day was held and people had requested reductions in their assessments. He stated that the Board will meet on March 2nd at 8 P.M. at a public meeting during whi< grievances will be reviewed. MAYOR'S REPORT Mayor Zegarelli stated that he is in receipt of a Fire Code from the WCVOA and has asked the building inspector to review the code. Mayor Zegarelli noted a letter from the Power Authority regarding refunds totaling 1/4 million dollars whereby Con Edison will divide the refunds among its customers and the Power Authority customers j utilizing State power. Mayor Zegarelli noted a press release from Senator Flynn of his efforts to restore cuts to municipalities in school districts regardin; State Revenue Sharing. COMMUNICATIONS | Communication from Lawrence Kosilla, Sec'y. of Fire Council regarding firemen receiving compensation for volunteer work, as well ai people using the ambulance room was read and referred to the fire committee for a meeting with Counsel and Fire Chiefs. | Communication from the Central Veterans Committee requesting permission to hold their Annual Memorial Day Parade on May 30th, together with services, was read. _| Trustee Lofaro moved, seconded by Trustee Lobato that permission be granted. Carried. Communication from Ptl. Henry Mockler retiring from the police force effective April 1, 1933 was read. Mayor Zegarelli moved, seconded by Trustee Maceyak that Ptl. Mockler's resignation for retirement be accepted with regret effective April 1, 1983 and that a letter of thanks for his many years of servic be forwarded to him. Carried. Communication from John Dobbins, co-chairman of the Tarrytowns Wolfpack Club, extending an invitation to the Mayor and Trustees to attend their awards meeting on March 12tl\ - ~^>iin the Holy Cross auditorium was read and accepted witn tne thariksTof the Board. UNFINISHED BUSINESS Trustee Gandolfo moved that Turnquist Architects' final bill for the Village garage project be paid, seconded by Trustee Maceyak. On the question, Trustee Soriano stated that he was opposed to paying the bill until we have the satisfaction of knowing what the liquidated damages are. �it 3 * % -9- Trustee Gandolfo stated that the bill represents payments from November 15-January 15th. Estimated completion time of the project was November 15th. Because of problems along the way with the water and electricity, the project went longer than we thought it would, she said. The architect worked from November to January, said Trustee Gandolfo and in all fairness to him, we should pay the bill. He did at some point advise us that the project would take longer. Mayor Zegarelli polled the Board as follows: Trustee Maceyak - Yes Gandolfo •- Yes " Soriano - Yes Trustee Lofaro Yes " DiFelice - No " Lobato Yes Motion carried. Trustee Gandolfo stated that with regard to the Somers final payment, Mr. Lamberti was supposed to give us additional information which! \ was not received, and therefore, moved that payment be withheld for the \ time being, seconded by Trustee DiFelice. Carried. f Counsel stated that since our last meeting, he had sent a letter to Somers Contracting. (Copy in official minutes) With regard to the hearing on amendments to the garbage collection «; t rules and regulations, Trustee Maceyak moved, seconded by Trustee DiFelicef ;f that the following be adopted: (see attached) With regard to the hearing on a local law entitled "Gardeners", Trustee Maceyak moved, seconded by Trustee DiFelice that the following Local Law #2 of 1983 be adopted: (in detail official minutes) Trustee Maceyak stated that the Mayor requested John Biros to give him a report on the job projects and locations worked on in January. Trustee Maceyak moved, seconded by Trustee DiFelice that the following be made a part of the minutes: ;' \ i \ (see attached) Mayor Zegarelli asked if all the inspections occurred between 7 and 7:30 P.M. when the incident of vehicle use by Trustee Maceyak occurred and was answered that the report was a daily and not hour by hour summary of the job sites. Mayor Zegarelli inquired about the outcome of the police committee meeting as a result of "charges" against the Mayor made at the last meeting of the Board, if the Chief was asked if he, the Mayor, demand that he bring the.report of the Mayor to the District Attorney and that he be brought up on charges. ">> Trustee Lobato answered that they did not discuss bringing him, the Mayor, up on charges. //A fa* ' "tl - .%M %US- �^ -10Mayor Zegarelli asked if they asked the Chief if he, the Mayor, demanded the Chief to go to the District Attorney. Trustee Lobato answered that the Chief said "no". The Mayor then asked if the Chief was even asked to go to the District Attorney by the Mayor and Trustee Lobato answered that the Chief said "no"., Trustee Soriano moved, seconded by Trustee Lofaro that the bills submitted on the General Fund and Water & Sewer warrants dated Februar 28th, 1983 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee DiFelice moved, seconded by Trustee Soriano that the same be duly adjourned. Carried. Pursuant to the terms of the contract between the Village of North Tarrytown, as Owners, and your firm, as General Contractor, North Tarrytown is presently holding $21,913.75 as retainage. If it is your intent to to request payment of this retainage, I would instruct you, pursuant to the terms of the contract, to make formal application to Mr. Turnquist. Mr. Turnquist will then have an opportunity of ten (10) days to review your request and forward his recommendation to the Owner. Furthermore, I would advise you that you must satisfy the Architect and the Owner that this project is free from all liens for yourself as General Contractor and for all of your subcontractors i i f It i 1 Lastly, all outstanding punch list items must be completed to the satisfaction of the Architect and the Owner. I would inform you at this time, that a certain sum of money will be retained to insure completion of those punch list items. PERSON — Includes any individual, firm, partner- ship, corporation or business entity of any form, style or nature. / �PRIVATE PROPERTY — Includes all real property, improved or unimproved, owned by any municipal corporation, corporation, person, partnership, firm, association or otherwise which is not included in the definitions of "public highway" or "public place" in this section. PUBLIC HIGHWAY — Includes any street open to the public for its full width from property line to property line, including the sidewalk area, whether or not installed. PUBLIC PLACE — Includes any real property avail- able to or open to use by all or a majority of the property owners or residents of the Village of North Tarrytown. § II Compliance required. A. No person or employee or any person shall perform or cause, suffer or permit others to perform or work as a gardener within the Village of North Tarrytown, except when such performance or work is done in compliance with the regulations set for in § III below. �B. No gardener shall perform work within the Village of North Tarrytown unless duly id. licensed pursuant to this Local Law. C. Licenses - All gardeners shall complete the necessary licensing application on the form provided by the Village Clerk. All applications are subject to review and approval by the North Tarrytown Chief of Police. A non refundable application fee of $25.00 shall . be paid on presentment of said completed form. D. All gardeners shall be required to post a ,j bond of $100.00 to insure compliance with this local law. E. '* North Tarrytown residents under the age of ;\ 18 years shall be exempted from § III(D.) but must comply with the regulations enumerated in § IV of this local law. § III Regulations, > I | The following regulations shall be observed by all gardeners and their employees. �A. No person shall operate any power or manual lawn mower or other gardening equipment at any time except between the hours of 8:00 a.m., prevailing time and 9:00 p.m. weekdays, and 10:00 a.m., prevailing time and 8:00 p.m. Sundays. B. 4 No persons shall burn any wastepaper, rubbish, leaves, cuttings, wood or other waste materials at any time. C. No person shall place any garbage, refuse, cuttings, leaves, wood or other materials upon any public highway, public place or private property unless secured in a sealed plastic bag or secured receptacle for the storage of refuse. D. No person shall scatter any garbage, refuse, cuttings, leaves or other waste materials on any public highway, public place or private property"; § IV Penalties for offenses. Ponzini, Counsel \AWenti Emmanuel Lobato, Trustee Mayor Zegarelli called the meeting to order at 8-00 P.M. with a urayer and salute to the flag. Trustee Gandolfo moved. seconded by Trustee Soriano that the minutes of the meeting held on January 24, 1983 be approved as written. Carried< Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. No one appearing, the regular order of business resumed. REPORTS OF COMMITTEES ^ADMINISTRATION & CONSTRUCTION Trustee Soriano noted a letter from R, Turnquist Architect, informing the Board that the punch list items in connection with the public works facility are complete to his satisfaction and recommended that the Village accept the facility, Trustee Soriano stated that we should accept the fact that the building is substantially complete and withhold whatever is legally the Village i.e. the $5100 in liquidated damages. Counsel stated that a letter was sent to the general contractor that if he wanted his retainage back he would have to make a formal request to the architect, Under no circumstances would he receive the retainage until the punch lists have been corrected, said Counsel. Trustee Maceyak stated that in accordance to a letter received from Con Edison about an open account, he did not feel that the Village should be paying the electric bill dating back to Dec. 16th. We should pay as of the date we accept the building, said Trustee Maceyak. The matter was referred to Counsel. �-2Trustee DiFelice stated that we should make sure we have letters from the contractors that they will make all adjustments to the buildii in the near future; that we receive a letter from our architect statinj that the same, that we are covered; and to hold any payments until everything is completed, Following a discussion, Trustee Soriano moved, seconded by Trust Lofaro that this Board accept the new Village garage and direct that wi hold enough money in the retainage to cover any uncompleted work or woi that requires corrections or improvements or any amount that might be necessary for liquidation damages. FINANCE & REAL ESTATE Trustee Gandolfo reported a balance of $251,244.02 in the General Fund as of February 14, 1983. Trustee Gandolfo moved, seconded by Trustee Soriano that action of the Treasurer in investing $700,000 and $400,000 in certificates of deposit for 30 days at 7%7o at the First National Bank of North Tarrytcw be confirmed. Carried. Trustee Gandolfo stated that the finance committee has been meet! with various department heads on various budget requests. Meetings she be completed within the next 2-3 weeks, she said. FIRE - Trustee Lofaro stated that the wardens met with the iaaintainer o alarms. He has been doing his job, but there was a conflict between the police department and fire chief. The matter has been taken care of, said Trustee Lofaro. *„> GOVERNMENTAL RELATIONS-SENIOR CITIZENS < Trustee Soriano stated that the citizens club has been going well Trustee Soriano moved, seconded by Trustee Gandolfo that Washing! Birthday be celebrated on November 21, 1983 and that Village offices b$ closed. He further amended his motion to confirm the date of FebruaryLincoln's Birthday, during which Village offices were closed, seconded ^ by Trustee Gandolfo. Carried. ;' Trustee Soriano stated that the Village of Tarrytown is contribut $15,000 in their budget towards the C.O.C. and is recommending that Noi Tarrytown do the same in our new budget to help maintain the operation the building. LABOR RELATIONS In the absence of Trustee Lobato, Trustee Maceyak stated that th< committee would like to commence negotiations with the police departmei and if anyone has any suggestions to submit the same to the committee. A letter will be going out to the police bargaining unit, he said. Trustee Maceyak, on behalf of Trustee Lobato, inquired Counsel's • advice to start negotiations with the blue collar workers. Counsel stated that we are in notice of objections to the electi< All Trustees received a memo with a copy of the objections and a copy < �^3~s— -3our answer which he prepared. He reviewed it with Trustee Lobato who said it was satisfactory and was forwarded. Mayor Zegarelli moved, seconded by Trustee Maceyak that action of Counsel in answering the objections be confirmed. Carried. POLICE & LIGHT Trustee DiFelice gave the following report for January: (report in detail official minutes) Trustee DiFelice stated that we are in receipt of a bill from the Village of Ossining for their aid on January 30th when a disturbance occurred on Beekman Avenue. Trustee Maceyak stated that this was more of a retaliatory measure when a^r&^department aided Ossining. Mayor Zegarelli stated that he was talking to Mayor Caputo of Ossining regarding our bill. We sent the bill physically to Ossining, said the Mayor, to be included in the package to Senator Goodhue for reimbursement from the State. He stated that the Village of Ossining took it to mean that we were specifically billing them, said the Mayor. A letter was sent to Senator Goodhue with a copy to Senator Flynn. Trustee DiFelice stated that there was no red alert and we are going to have to pay the overtime. He stated that the Chief took it upon himself. Trustee DiFelice stated that the Chief told him that he received a call from the Ossining Police requesting aid if the hostages were going to be brought down from Ossining to the hospital, after which, Trustee Gandolfo stated that if that is the case, they should pay us. At this time, Trustee DiFelice placed a call to the Chief to appear at the meeting to clarify the matter. (It was learned that the Chief was at a meeting,) It was recommended that the police committee meet with the Chief to discuss the matter further, Trustee DiFelice read a letter from Edward Beck commending members of the police department for their aid during the snow storm last Friday evening. The letter will be placed in records. Trustee DiFelice stated that he asked the dog control officer to come this evening to discuss a bill before the Senate and Assembly which provides that dogs be destroyed one day after the holding period. Our ordinance calls for seven days holding period and the State says five days, said Trustee DiFelice. The SPCA in Briarcliff will not go along with this provision and have gone to Albany to protest this measure, he said. Mrs. Isler, Dog Warden, stated that it takes people 3 - 4 days before they realize that their dog is not coming home and this would not be fair to the owner and animal. She stated that the dogs she has taken �-4over to Briarcliff are kept eight days and longer and have all been adopted. This is the way it should be, she said. Following a discussion, Trustee Maceyak moved, seconded by Truste Soriano that our Ordinance be maintained at the existing seven days aiu that we contact our State Legislators to get Senate Bill 215 and Asseml Bill 252 out of committee, copy to Senator Goodhue. Carried. PUBLIC WORKS Trustee Maceyak gave the following report: Reading of meters for quarterly billing is in progress. being cleared around fire hydrants, Snow is Bank balance in the Water Account as of Feb. 14th is $22,892.34. Routing cleaning of catch basins. During the snow storm on Feb. the department sanded and salted. Snow was being hauled to our lot on Elm Street, on Saturday and was being removed on Sunday with two crews. Trustee Maceyak complimented John Biros, Mike Apollonio •'and the highway department for an excellent job done during the snow storm. In preparation for cleanup schedule for the 1983-84 year, it is noted that there are two holidays in one week in the month of November, Nov. 8th and Nov. 11th. This is contrary to our union contract, said Trustee Maceyak and moved that Veterans Day be celebrated on November ] seconded by Trustee Soriano. Carried. Trustee Maceyak stated that there was some controversy a few wee} ago of his riding in Village vehicles and he felt that he was accused unjustly and the accusations were not presented in a proper way. He stated that he gave a lot of time to the job and will not be ridiculed by having pictures taken of him. He stated that the action was wrong ( the part of the Mayor. He stated that he could have gone to the Board to him, but pressured the District Attorney, The District Attorney cJU him of everything, said Trustee Maceyak, He stated that if a hearing i required of his conduct, he would like to have it. He stated that he would also like to have a hearing on the conduct of the Mayor going to the District Attorney, said Trustee Maceyak. Mayor Zegarelli stated that he did see him (Trustee Maceyak) and followed him. He stated that he did not feel he had to go directly to the Chief of Police and did not demand that the Chief go to the Distri< Attorney. The Chief went on his own. He stated that he (The Mayor) di< not bring the letter to the newspaper, but that Trustee Maceyak did. Trustee Maceyak admitted giving the District Attorney's letter to the newspaper. Mayor Zegarelli stated that the issue is not dead--not closed, and considered it open. He stated that Trustee Maceyak committed an unlawful act and betrayed public interest. He stated that he followed | him for/ffiree days and that Trustee Maceyak admitted to eight days use of the vehicle. �-5Trustee Maceyak stated that he would like to have a departmental hearing. Mayor Zegarelli stated that he would like John Biros to present all job projects. Trustee Gandolfo stated that we should have a hearing before the Board. Mayor Zegarelli stated that he saw something wrong and reported it. Trustee Gandolfo stated that included in the hearing should be the Mayor's improper use of the police department for his personal investigation. Mayor Zegarelli stated that he turned everything over to the Chief of Police and told him to do what he had to under the law. Trustee DiFelice inquired of the Mayor as to what authority he had to direct the Chief on any matter. He stated that a memo was given to all Board members by the Mayor that they were not to direct any orders to department heads unless it went through committee. Mayor Zegarelli stated that Trustee DiFelice referred to policy items and that the Mayor saw the law was being violated and reported the matter to the Chief of Police. He quoted Section 4-400 of the Village Law as follows: l."It shall be the responsibility of the Mayor:" (b) "to provide for the enforcement of all laws, local laws, rules and regulations and to cause all violations thereof to be prosecuted." Mayor Zegarelli stated that he did what the law requires him to do. He also stated that the Chief and District Attorney never interviewed him, but that his report will be sent to the District Attorney in due course. RECREATION & PARKS Trustee Gandolfo gave the following report: Fifteen children took advantage of the $1.00 discount at the Strand Roller Skating Center over the Super Bowl weekend. There is still no ice skating. Ski trips are in full swing. This weekend's trip is to Hunter Mountain on February 19th. During school recess, there will be a trip to Jiminy Peak on February 24th. The Westchester Ski Teens are presenting a Paris and London trip during the spring vacation, April 22-30. Anyone interested should contact the Recreation office. Out of the 24 programs we offered in our winter/spring brochure, only two of them are not going: Ice skating and horticulture. That leaves us with 86% of the programs offered in the fiscal year 1982-83 that were successful. On January 8th, a vehicle was stuck in Douglas Park, but caused no damage. Gary Thomas devised a lock that will keep half the gate locked. This will ensure that vehicles will be kept out and the other half will be open so that citizens can enter the park. TAX EXEMPT PROPERTY & ASSESSMENT Trustee Lobato - absent. �-6COMMUNICATIONS Communication from Antonio Pereira, 131 Beekman Avenue, requestinj sidewalk repairs was read and referred to the public works committee. Trustee Lofaro moved, seconded by Trustee Maceyak that action of the Board at a recent work session in granting permission to the Women Auxiliary of the Italian-American Ind. Club to hold a buffet/dance on February 12th at 95 Beekman Avenue be confirmed. Cuban Club to hold a dance on February 12th was cancelled. j Communication from the Cuban Club to hold a dance on February 19t( at 45 Beekman Avenue was read. Trustee DiFelice stated that in meeting previously at a work sessj with representatives of the 6lub, they were told by the representative! that they would like to cancel their request for the dance until they investigated the cause of a disturbance at the club a couple of weeks' ago. Following a short discussion, the Board denied the request. Communication from Laurentino Rodrigues, President of Rodrigues Enterprises, requesting consideration of his previous request to insta video games in the Strand Roller Skating Center was read. Mr. Rodrigu states in his letter that he may have to close if his request is not granted. Trustee Soriano stated that if the Chief feels that there will be no problems and this would not create a nuisance, we should reconsider He stated that the owner is having a hardship. Trustee Maceyak suggested that the matter be referred to the poli committee for a meeting. The Clerk informed the Board that the 1983 Assessment Roll has b« completed and that the tentative figure is $40,132,397. In connectioi with the Assessment Roll, Mayor Zegarelli informed the Board that Gri< Day will be held on February 15, 1983 between the hours of one and fi^ and 6 - 8 P.M. The Clerk informed the Board that Village Treasurer Irene Amato 1 filed her report of unpaid taxes for the year 1982 as of January 31, ' totaling $24,200.88 and in connection therewith, the following resolui was offered by Trustee Lofaro, seconded by Trustee Maceyak and was ad< �"T " • l 1 ^ II 17 .it -7- • RESOLVED that the Board of Trustees sell all unpaid taxes for the year 1982 on March 17, 1983, pursuant to Section 1436, 1450, 1452 and 1454 of the real property tax law and amendments thereto the same terms and conditions as the sale held on March 18, 1982, at the Village Hall, 28 Beekman Avenue and the Treasurer be and she hereby is directed to publish the proper legal notice for three consecutive weeks beginning February 26, March 5th and March 12th, and be it further w RESOLVED that a copy of this resolution be given to the Treasurer with the return of unpaid taxes as certified to by the Board. Carried. MAYOR'S REPORT Mayor Zegarelli noted that he sent letters to the State regarding proposed cutbacks in State aid to school districts and municipalities. Mayor Zegarelli stated that he received a letter and briefing booklet from Congressman Ottinger concerning a Community Block grant type of program similar to what we used in getting funds for the water treatment plant. Congressman implies that if we have our plans ready to go, we should be able to get funding for purchases that are already in the works, said the Mayor. The only project that he could think of atthis time that would be suitable would be in the northern loop, UNFINISHED BUSINESS Trustee DiFelice stated that Con Edison is proposing an increase in electrical rates and moved, seconded by Trustee Gandolfo that a letter of protest be sent to the Public Service Commission. Carried. Trustee DiFelice moved, seconded by Trustee Soriano that a letter be sent to Governor Cuomo to appoint a Westchester representative on the Public Service Commission. Carried. Trustee Soriano noted a memo from the building inspector requesting the Board's approval of either the County code calling for 68° between the hours of 6 A.M. - 10 P.M. when the outside temperature falls to 55^ or the local code for 70° temp, between Nov. 1 and May 1st, 6 A.M. - 11 P.M. when the temp, outside drops below 55 degrees F, or the State code that the owner shall maintain a temperature of 68 degrees, with no mention of hours. The matter was referred to a work session. Trustee Soriano noted a memo from Bill Doorley submitting names of people requesting the vacant apartment at 79 College Avenue. Mr. Doorley suggested the name of Diane Whiting, said Trustee Soriano, after which the Board concurred. Trustee Soriano noted the Mayor's memo on each Trustee's desk regarding a meeting he will be attending at General Motors on Friday and proceeded to move that he be granted permission to attend, however, a discussion ensued whereby Trustees stated that another member of the Board should attend with the Mayor. Mayor Zegarelli stated that General Motors issued the invitation and that he alone as Mayor, was invited to attend. NEW BUSINESS Trustee DiFelice stated that in light of the cutbacks from the State, and he so moved, that a letter be sent to the school board on behalf of the taxpayers that the Board of Education work at their budge for the taxpayers, seconded by Trustee Lofaro. Trustee Soriano moved, seconded by Trustee Lofaro that the bills submitted on the General Fund and Water & Sewer warrants dated Feb. 14t 1983 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attachef to the warrants. January 24, 1983 \ A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present t Philip E, Zegarelli, Mayor Stephen Maceyak Janet Gandolfo Peter Soriano Joseph D. Lofaro Mario DiFelice Emmanuel Lobato, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P,M. with a prayer and salute to the flag. Trustee Soriano moved, seconded by Trustee Lobato that the minutes of the meeting held on January 10, 1983 be approved as written. Carried. Mayor Zegarelli read the notice of hearing to consider a proposed law to amend Section 57-45 of the General Code "Unloading of autocarrying trucks or trailers prohibited; penalty" and asked if there was anyone present who -.vould like to address the Board on the proposed law. Before hearing comments, Mayor Zegarelli acknowledged receipt of several communications from William Barron, Principal of the Public Schools of the Tarrytowns dated January 21stj copy of a memo to Mr. Blueglass from John McCleary, Director of Athletics; and a two page letter from Murray Blueglass, Supt, of Schools to the Mayor & Board of Trustees dated January 24th in opposition to the proposed law. Mr. Howard Porty, Assistant Supt^ of Schools, speaking in behalf of Supt. Blueglass, stated that a safety hazard exists for the children attending schools. He stated that the unloading of cars blocks the view of buses coming out of the school entrance north bound. He stated that children do not always cross at Depeyster Street and drivers do not see the children, and urged that the Board not allow unloading in front of the school. He stated that it was unsafe for children. Mr. James Downey, North Broadway, stated that he lives across the street from the unloading site. He stated that .the drivers unload at 7 A.M. and make an excessive amount of noise. Mr. Frandsen stated that some time ago, the Board allowed him permission to have his cars unloaded in front of his showroom and would not like to lose this privilege. He stated that it would be unfair for them to go up that far. He stated that they have been unloading on the sidewalk, but the police feel that they are blocking traffic. �-2Trustee DiFelice stated that if he blocks the sidewalk, he will have to unload in the designated area, otherwise, the driver will be ticketed. Trustee DiFelice stated that the police department has had many problems with the school. Students run wild all over the grass and the school was forced to erect a fence around the Paulding school. T] were requested to continue the fence along the high school area, but the repeated'•jails were left unheeded, said Trustee DiFelice. Students do not cross where the school guard is stationed, he said. At the las snowfall, children were sleigh-riding on the S.H.H.S. lawn and on to Route 9, said Trustee DiFelice. The school cannot handle the students There is no blockage of view, he said. Chief Spota investigated the area and reported that there is no problem, said Trustee DiFelice. Trustee Lobato stated that this is the first time this has been brought up and suggested that the matter be referred to the Board. He stated that the point of Mr. Frandsen seems to be a workable solution. Mr. George Kahn, Tappan Motors, stated that he has been using the area for about six weeks and believed that it is working out very well If it is in the best interest of the community, he said, this is the best place, He stated that as far as safety is concerned, he had no calls of any safety problems. The crossing guard has not complained, he said. ] A woman spectator stated that after she had left her daughter off] at the school, coming back on Broadway, she almost had an accident ( because of the unloading of cars in front of Frandsenfs which were parked on route 9. Trustee Soriano stated that people come from all points. When I they come, they have to have a place to deliver, He stated that the area for delivery is 100 ft. in length. Trustee DiFelice stated that there should be no unloading before 8:00 A.M. according to the Local Law. He will have the police check on this, he said, No other comments, Trustee Gandolfo moved, seconded by Trustee Soriano that the hearing be closed, Carried, It was recommended that the proposed law be referred to the Board as a committee and report at the next meeting. Miss Deirdre Lovecky stated that she thought the question of parking permits for 1 Riverside Drive was settled and asked what the problem was concerning them. Trustee Maceyak explained his understanding whereby each family would receive onesticker for $1, They could purchase an additional sticker for $12 which would allow them to park in the commuter area. Anottoer-sticker to park in front of 1 Riverside Drive would cost $1, also. �syr -3Trustee DiFelice stated that there are 14 spaces and no one would be out a parking space. He stated that they would purchase a sticker for #1 Riverside Drive and it would be their option to purchase the $12 sticker to park up from their building. Following a discussion, Trustee Lobato moved, seconded by Trustee Soriano that residents of 1 Riverside Drive will have the option to purchase a parking sticker for each vehicle on a first come first serve basis and the sticker will entitle them to park at 1 Riverside Drive in the area in front of 1 Riverside Drive that is reserved exclusively for residents of 1 Riverside Drive, and the Village will offer for sale a maximum of 14 stickers. Trustee Lobato amended the motion that additionally, the residents of 1 Riverside Drive may purchase the $12 commuter parking stickers at their option, seconded by Trustee Soriano. On the amendment, motion carried. On the motion as a whole, carried, ^-REPORTS OF COMMITTEES ADMINISTRATION & CONSTRUCTION Trustee Soriano stated that he is terribly dissatisfied with the liaison the Village is having with its architect on the construction of the new Village garage. He stated that he heard over the weekend that the lift is not the proper lift for the trucks. He stated that at the very first work session, he was told by the Mayor not to interfere and speaking for himself, he adhered to the policy. He stated that he cannot see the delays that we have been having, as well as the improper lift. Someone should pay for the delay, said Trustee Soriano. The building inspector cannot accept the building because some of the specifications have not been adhered to. Trustee Maceyak moved, seconded by Trustee Gandolfo that the dedication of the Village garage for Saturday, the 29th, be postponed. On an inquiry from Trustee DiFelice as to why no legal action has been taken, Trustee Lobato stated that the Village Attorney does not take any action unless ordered to do so by the Board. He suggested that the Board review the last memo from the Attorney and at the next work session be in a position to give direction to the attorney. Following a discussion, meetings were scheduled with Messrs. Page and Turnquist. Motion carried. FINANCE 6c REAL ESTATE Trustee Gandolfo reported a balance of $25,694.72 in the General Fund as of January 24,. 1983, Trustee Gandolfo moved, seconded by Trustee Lofaro that those people on fire watch receive $4.25 per hour, as well as any other part-timers. Carried. �-4Trustee Gandolfo stated that this increase was made at a previous meeting o£ the Board and should have included the men on fire watch. Trustee DiFelice reminded the Board of the firemen's law that firemen should not get paid for any services. Trustee Gandolfo moved, seconded by Trustee Soriano that Counsel be instructed to write the Fire Wardens reminding them that anyone working on fire watch and receives pay might be jeopardizing their rig to benefits. Noting bills from Herlihy-Donovan and Rigid Electric in connectio with the new Village garage, Trustee Gandolfo stated that the only Ml which should be paid is Herlihy-Donovan. As per memo from R. Turnquis Rigid Electric was withheld for the present. Trustee Gandolfo moved, seconded by Trustee Lofaro authorizing the issuance of $47,500 Serial Bonds to finance the additional cost of the construction of a multi-purpose building for use by various Villag departments: (copy in detail official minutes) Trustee Gandolfo moved, seconded by Trustee DiFelice authorizing the issuance of a $2500 Capital Note to finance additional cost of the construction of a multi-purpose building for use by various Village departments: (copy in detail official minutes) FIRE Trustee Lofaro reported that the fire wardens will hold a meeting with the maintainer of alarms to discuss his duties, Trustee Lofaro stated that Union Hose Co. plans to take its apparatus to Pennsylvania for the replacement of a part and moved, seconded by Trustee DiFelice that the firemen be granted permission to take the apparatus to vPa. with expenses. Carried. GOVT'L. RELATIONS-SENIOR CITIZENS Trustee Soriano stated that the 1983 Energy Assistance Program has commenced. This is to help people on a fixed income to pay their heating bill, he said. The citizens held their regular meeting and are doing well. LABOR RELATIONS Trustee Lobato stated that he received a letter from the North Tarrytown PBA signed by the Chairman requesting negotiations be commet Their contract expires in May, he said, He stated that he is asking t Board to authorize the labor relations committee to commence negotiati with the PBA. �sy^ 5- Mayor Zegarelli stated that the Board should make suggestions and meet first before the meeting with the PBA. Trustee Lobato stated that if anyone has any specific suggestions to let him or any committee member know. Trustee Lobato stated that recently we had a situation whereby the CSEA made a charge of unfair labor practices against the Village for discussing with the foremen the possibility of them having individual contracts with the Village. As a result, we apologized for meeting with the foremen. During our subsequent investigation, we discovered that the job titles which were used to stipulate the negotiating unit were those taken from the payrolls, said Trustee Lobato. Those payrolls incorrectly showed the foremen as assistant foremen. During several past meetings of the Board, resolutions were adopted appointing the assistant foremen either working foreman or water and sewer foreman. The labor relations committee was not in error in meeting with the foremen since they were not in the stipulated negotiating unit. Trustee Lobato moved, seconded by Trustee Maceyak that the Village Attorney be instructed to contact PERB to have the bargaining unit amended so that the three foremen, Hercules Shubrick, Michael Apollonio and Manuel Cappello are not stipulated by North Tarrytown to be members of the bargaining unit. Carried. Trustee Lobato moved, seconded by Trustee Maceyak that a letter be sent to PERB in response to the unfair labor practice charge pointing out that the three foremen should not properly be members of the bargaining unit. Carried. POLICE & LIGHT Trustee DiFelice moved, seconded by Trustee Lofaro that North Tarrytown participate in the upcoming Sergeant's exam. Carried. Trustee DiFelice read a thank you letter from the Ledwith Family for our expression of sympathy. Trustee DiFelice stated that with regard to the hostage crisis, we have bills amounting to $3,536.20 for 297 hours of overtime and food. He stated that we should be reimbursed by the Village of Ossining. A discussion ensued after which Trustee DiFelice moved, seconded by Trustee Lofaro that a bill be sent to the Village of Ossining and a copy to the State for reimbursement. Carried. Trustee DiFelice stated that the Chief of Police received several letters from different departments of the hospital staff commending the police department on a job well-done. �-6- Trustee DiFelice read a letter from Joseph Leuner, 10 Evergreen Way, commending several patrolmen for locking his garage door when the automatic control shorted out while he was away and moved that a copy be placed in their folders, seconded by Trustee Lofaro. Carried.i Trustee DiFelice stated that Ptl. Ciffone is still out on sick leave. The Chief will have a final report as to his medical status. PUBLIC WORKS Trustee Maceyak gave the following report; Cleaned and repaired sanitary sewer lines with sewer jet in Fremont Road, Prepared the Croton pump station for painting by cleaning the walls and buffing and waxing the floors, Bank balance as of January 24, 1983 is $24,287,86. Excavated and repaired undermining in the gutter on the east side of Fremont Road. Reconstructed catch basin and replaced with regular casting over storm sewer on an easement across property of 45 New Broadway. During the storm on January 15th, the department sanded and salt* with all spreaders as well as plowing in the Manors. Trustee Maceyak moved, seconded by Trustee Gandolfo that action of the Clerk in reporting an accident involving the highway sander truck on January 15th be confirmed by the Board. Carried. Trustee Maceyak moved, seconded by Trustee Soriano that Richard Gross, Laborer in the Water & Sewer Department and Douglas DiCairano, Sanitation Man, bejplaced on permanent basis and that the $500 which Wc withheld be included in their salaries. Carried, Trustee Maceyak stated that he received a complaint that crews were hiding and not going on job locations. Along with the Sanitatioi Foreman and himself, he stated that they checked the crews about eighl times in a three week period. They checked County House Road at the pump station where it was reported that the crews were hiding, said Trustee Maceyak, The complaint was found wrong, said Trustee Maceyak but to make future complaints reliable, we are placing drivers' names on the trucks. This has now been instituted. Trustee Maceyak moved, seconded by Trustee DiFelice that a publi< hearing be held on February 28, 1983 to amend the garbage and refuse rules and regulations to include commercial pickups and holidays. Can Trustee Maceyak moved, seconded by Trustee DiFelice that a publi< hearing be held on February 28, 1983 to consider a local law entitled "Gardeners" which would require anyone doing gardening work to obtain permit as well as designating appropriate times to regulate the dispo of cuttings, leaves, etc. Carried. �ty -7RECREATION & PARKS Trustee Gandolfo gave the following report: This is the last week for registration in our winter/spring program. The ski trip for this weekend to Hunter Mountain is $30 which will be held at Hunter Mountain. The movie for the senior citizens will be shown at the Holy Cross Hall on January 28th at 1 P,M, No ice skating because of warm temperatures, TAX EXEMPT PROPERTY & ASSESSMENT Trustee Lobato reported "progress". MAYOR'S REPORT: Mayor Zegarelli noted a letter from the Chief of Police of the Town of Mt. Pleasant offering the services of their dog control officer on a part-time basis for North Tarrytown and referred same to the police committee. Mayor Zegarelli noted a letter received from Mr. M, J. Mignogna, Traffic Engineer D.O.T, that funding and installation of the signal at Route 9 and Depeyster Street will be scheduled in the next traffic signal contract. Referred to police committee and Chief of Police. Mayor Zegarelli noted a letter from the Dept, of Planning, Division of Housing, stating that the sum of $100,000 was allocated for the acquisition of distressed residential property in target areas and that applications for the acquisition grant are available. Referred to the C.D.A. Director. Mayor Zegarelli noted a letter from the Dept. of Commerce to Mr. Salley, Dept. of Planning, that North Tarrytown is among one of the Villages accepted into the 1980 census neighborhood statistics program. Referred to the C.D,At Director. Mayor Zegarelli summarized recent legislation passed by the State Legislature. COMMUNICATIONS 'I I H I II • ll|l. Communication from J. Hockey Boosters Club for a Happy Hour on Feb, 4th at the UAW Hall on Beekman Avenue from 7 P.M. - 11 P.M. was read" and oh motion "of Trustee Soriano,"' seconded by Trustee Lofarot permission was granted. �-8UNFINISHED BUSINESS Trustee Gandolfo stated that department heads have been submittir their budget requests and is still waiting for others. She asked Trustees to submit new specific projects they might like to have incl in the budget. With regard to the public hearing as to the unloading of autocarrying trucks or trailers, Trustee DiFelice moved, seconded by Trust Soriano that the following Local Law #1 of 1983 be adopted: (see attached) On the question, Trustee Lobato suggested meeting with the police chief to discuss the matter further. Trustee Maceyak agreed with Trustee DiFelice that the law would not create a safety hazard. The area is safe. On a question of Trustee Lobato if Mr. Frandsen could have the a unloaded in front of his property, Trustee DiFelice stated that as lor as he does not block the sidewalk or Route 9, there is no problem. Trustee Maceyak stated that the area on Broadway has been working very well. I Motion carried. -NEW BUSINESS Trustee Maceyak stated that the conservation department has a program whereby the Village can purchase 1,000 seedlings for $55.00 which can be planted throughout the Village. Trustee Soriano moved, seconded by Trustee Gandolfo that the Village enter the program and that Pat Lofaro take the necessary acti< Carried, Trustee Maceyak stated that the Board is in receipt of a memo from William Doorley regarding a tenant in 79 College Avenue burning candles and suggested that the Building Inspector investigate the matter. Trustee Soriano moved, seconded by Trustee Lobato that the bills submitted on the General Fund and Water & Sewer warrants dated Januar 1983 be paid after approval by department heads and that the Treasure! be authorized to pay same and that a copy of this resolution be atta< to the warrants. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Soriano moved, seconded by Trustee Lofaro that the minutes of the meeting held on December 27, 1982 be approved with minor correction^ Carried. ADMINISTRATION & CONSTRUCTION Trustee Soriano reported "progress". Trustee Soriano stated that outside of an informal meeting with Ron Turnquist, he does not know where we stand on the new Village garage He stated that he was concerned about the lack of repoire and liaison between Mr. Turnquist and himself as Chairman of Administration and Construction, There is a delay of over six months, he said. Mayor Zegarelli stated that a meeting has been scheduled for Wednesday evening to which Counsel will also be present. On an inquiry of Trustee Soriano if some equipment could be moved into the new building, Trustee Maceyak stated that once the building is accepted, we will commence moving in equipment. FINANCE & REAL ESTATE Trustee Gandolfo reported a balance of $53,360.35 in the General Fund as of January 10, 1983. Trustee Gandolfo moved, seconded by Trustee Maceyak that action of the Treasurer in depositing a certificate of deposit in the amount of $700,000 with the First National Bank of North Tarrytown maturing on January 31, 1983 at 7%% and a certificate of deposit in the amount of $700,000 with the First National Bank of North Tarrytown maturing on February 5, 1983 at 7%% be confirmed. Carried. Trustee Gandolfo stated that she has requested all department heads to submit tentative budget requests to her by January 17th and also requested Board members to submit any requests they might have. &:iE �-2-* Trustee Gandolfo stated that Charles Pound has started to contour the Peabody area, FIRE Trustee Lofaro reported progress. GOVERNMENTAL RELATIONS-SENIOR CITIZENS i Trustee Soriano stated that the citizens have finalized their by-laws and will come up with recommendations. He stated that one of their recommendations is to abolish the commission. He stated that he informed them that this commission was started long before the Board got involved. The citizens are very appreciative of what the Board has done for them, said Trustee Soriano, The citizens have been on many trips and involved in many activities, he said. LABOR RELATIONS Trustee Lobato stated that an election will take place soon for union employees to select their representation organization. He state that he received notices of the election which is required to be poste A ballot will be mailed to present employees, said Trustee Lobato. Tti employee can vote for either Local 860, CSEA, local 1000 A.F.S.C.ME.; 456 Int'l. Brotherhood of Teamsters, or neither, Ballots will be coud on February 3rd by PERB and during the first week of February, we shod have a result. J POLICE & LIGHT I Trustee DiFelice offered the following resolution, seconded by Trustee Soriano: WHEREAS Almighty God in His divine wisdom has seen fit to take unto Himself the soul of the late John Ledwith; and WHEREAS the said John Ledwith was a former Sergeant of the Villag of North Tarry town Police Department having been held in the highest esteem by all those who knew him, now, therefore, BE IT RESOLVED that this Board of Trustees take official notice ( John Ledwith*s deathj and be it further RESOLVED that this resolution be made a part of the official mini of this meeting and a copy sent to the family of the deceased. Carriec Trustee DiFelice stated that he has received a memo from Chief Si that he was able to enroll Patrolmen Kiggins and Schrank and dogs in the Connecticut State Police Academy for certification in marijuana ar narcotics, They will be required to work five days with three days oi for a three week period. According to the Chief, said Trustee DiFeli there will be no cost to the Village for the training, housing facili or certification. i �*3i -3Trustee DiFelice stated that another policeman will be out indefinitely and he wanted the Board to be aware of this. Three men will be off the schedule, he said. A short discussion arose as to whether or not the department would be short-handed. Trustee DiFelice stated that the Chief assured him that there would be no problem. Trustee Lofaro moved, seconded by Trustee Maceyak that permission be granted to Ptlmen. Kiggins and Schrank to enroll in the Connecticut State Police Academy for a three week period at no cost to the Village. Carried. Trustee DiFelice gave the following police report for the month of December: (In detail official minutes) Trustee DiFelice stated that Ptl. Ciffone is on sick leave until further notice, Trustee DiFelice noted a memo from Counsel regarding Riverside Drive parking matter, PUBLIC WORKS Trustee Maceyak stated that the water department scraped, prepared and painted the meter station on the Catskill Aqueduct connection, as well as repairing portions of the sanitary sewer on Merlin Avenue. The bank balance in the water account as of January 10th is $37,146.43, Trustee Maceyak reported that the highway department reconstructed the collapsed catch basins on Evergreen Way and completed sealing of joints for this year, Christmas trees are being removed and run through the chipper, RECREATION Trustee Gandolfo stated that winter/spring brochures are out and will be mailed this week, Trustee Gandolfo stated that registrations may be made at the recreation office for ski trips on January 15th to Bel Aire and Jan. 16th to Butternut Mountain. Trustee Gandolfo stated that it has been suggested by Pat Lofaro if the closing hours at the parks could be changed from 9 P.M. to 6 P.M. because of people using the parks for drinking. Following a discussion, Trustee Gandolfo stated that she would ask Chief Spota for a report to see how badly the situation is in the parks. A report will be made at a later date, �_4TAX EXEMPT PROPERTY & ASSESSMENT Trustee Lobato reported ^'progress" t COMMUNICATIONS Communication from Juan Hernandez, 172 Valley Street, regarding hole in the street at the intersection of Valley and Depeyster Street* was read and referred to the public works committee. Communication from Laura Kahn, L & M Associates, 49 Beekman Aveni regarding sidewalk repairs at 113-115 Beekman Avenue was read and referred to the public works committee, UNFINISHED BUSINESS Trustee Soriano noted requests from several businesses regarding extra garbage pickups and was told that the requests are under consid* ation, Trustee Maceyak requested that Mr, Tucciarone be requested to appear at the next work session of the Board for updates on 21 Beekmai Avenue, 12-14 Lawrence A v e w etc, Mayor Zegarelli stated that Mr. Tucciarone did not attend the la^ work session because of illness, however, he will be asked to attend j the next one. J Trustee Soriano noted the increase in fees at the Croton dump frl $15,50 - $17.00 per ton. 1 With regard to an inquiry regarding the cost for the increase in; part-time employee rates, Trustee Gandolfo stated that the total amour is $2300 which will be taken from the respective budget accounts and i the Contingency Fund, NEW BUSINESS The Board took up the following resolutions in connection with tl forthcoming Annual Village Election; Trustee Maceyak moved, seconded by Trustee Gandolfo that we have ten (10) Election Districts, the same as used in the Town Election of this Village, except that District #21 and District #33 in the Town Election shall be #9 and #10 respectively in the Village Election. Cai Trustee Soriano moved, seconded by Trustee Lofaro, that Registral Day be held on March 5, 1983, from 12 noon to 9 P.M. Carried. Trustee DiFelice moved to have Registration in the lobby of the Municipal Building, seconded by Trustee Lobato, Carried, Trustee Soriano moved, seconded by Trustee Maceyak that Election Day be held on March 15, 1983. Carried, Trustee Soriano moved, seconded by Trustee Lofaro that hours for Election Day be from 7 A.M. to 9 P.M. Carried, �^ 6 -5Trustee Gandolfo moved, seconded by Trustee Soriano that the Clerk be authorized to publish and post the proper notices of Registration and Election Days and also purchase the necessary supplies. Carried. Trustee Lobato moved, seconded by Trustee Lofaro that Voting machines be used in the forthcoming Village Election on March 15, 1983. Carried. Trustee Lobato moved, seconded by Trustee Gandolfo that the matter of requesting the loan of eleven (11) voting machines from the Town of Mt. Pleasant for use in the Annual Village Election to be held on March 15, 1983, be left in the hands of the Administration Committee, also the placing of rails, booths, etc, in the polling places. Carried. Trustee Gandolfo moved, seconded by Trustee Soriano that the Administration Committee be directed to ascertain if the same polling places are available at the same rental, $25.00 for Election Day. Carried Trustee Soriano moved, seconded by Trustee Lofaro that $4,25 per hour be paid to Election Inspectors on Registration and Election Days. Carried. Trustee DiFelice moved} seconded by Trustee Lofaro that the Chairperson be paid $5.00 extra. Carried. Trustee DiFelice moved, seconded by Trustee Lofaro that the bills submitted on the General Fund and Water & Sewer warrants dated January 10, 1983 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee DiFelice moved, seconded by Trustee Lofaro that the same be duly adjourned. Carried. C and moved, seconded by Trustee Lofaro that action of the Board be confirmed. Carried, Mayor Zegarelli stated that he is in receipt of 1982 legislation which not only both chambers have signed, but the Governor as well. Among the items were reimbursing Village fire officials in the perform of their duties, snow removal expenses, zoning requirements, Boards of Assessment Review which grants to the Village the option to form a Boa of Assessment Review. He stated that the Board should think about members for this Board. UNFINISHED BUSINESS Trustee Lofaro stated that the Fire Council had approved the fire zones on Dell Street and moved, seconded by Trustee Soriano that the following Local Law #9 of 1982 be adopted: (Local Law #9 of 1982 entitled "Dell Street Circle: Fire Zone lanes established in detail official minutes) In connection with the public hearing on bus shelters, Trustee DiFelice moved, seconded by Trustee Soriano that the following Local Law #10 of 1982 be adopted: (Local Law #10 "Parking Prohibited in designated areas" in detail official minutes) I I NEW BUSINESS Trustee Maceyak stated that the building inspector has summoned the owner of 21 Beekman Avenue for violations and the time limit has passed. After a discussion, it was the consensus of the Board to meet wit the Village Prosecutor and building inspector on January 6th to discus 21 Beekman Avenue. Trustee Maceyak noted a memo from the Village Attorney regarding Riverside Drive parking. Trustee Lobato suggested that upon receipt of correspondence, the Clerk should stamp the day and time it was received. He also suggest that when a department head gives a memo to their chairman or committe a copy of same should be given to all members of the Board, particular where he would be required to sign the memo. Trustee Soriano stated that several senior citizens had a problem of a planned bus trip to Florida which did not come about and he is j endeavoring to recoup the deposits that the people have paid with the! aid of HELP, I �*T3 7 PUBLIC NOTICE r VILLAGE OF NORTH TARRYTOWN The Board of Trustees of the Village of North Tarrytown at a regular meeting assembled and after published notice and public hearing do hereby ordain and enact Local Law #9 of 1982 which amends the General Code of the Village of North Tarrytown adding Section 57-20J entitled "Dell Street Circle: Fire Zone lanes established; penalty"i.as follows: A. The fire zone or lanes hereafter described or hereby established for a certain portion of the parking area located in the Dell Street circle area; (1) A fire l^ne located on the north side of the Dell Street circle commencing at the edge of the driveway of that premises designated as 49 Dell Street and running thence 26 ft. into the Dell Street circle, as posted. (2) A fire zone located on the south side of the Dell Street circle commencing at the southerly edge of said circle and running thence 26 ft, into said Dell Street circle, as posted. (3) Such area shall thereupon be marked with standard police signs and/or such other markings deemed necessary and proper by the Fire Chief indicating that said above-described area is a restricted fire zone or lane. \* B. $he parking or remaining standing or placing thereon, at any time, of any automobile, truck, motorcycle or other vehicle or any other physical object or material within such restricted fire zone or lane is hereby expressly prohibited. C. Any person, firm or corporation violating the terms of Subsection B hereof shall be punishable by a fine of twenty ($20,00) Dollars for each and every offense; in addition, violator of any of the provisions of Subsection B hereof shall be deemed to be disorderly persons and shall be punishable as such.
