Present: Mayor Frank J. Rey James J. Timmings, III Morris Alter Sean Treacy James J. Nazemetz Michael Hyland John T. Hayes, Jr. Trustees Also Present: William T. Regan, Village Administrator Robert J. Ponzini, Village Attorney Mayor Rey called the meeting to order with a pledge to the flag. Public Hearings-None Approval of Minutes Trustee Hyland moved, seconded by Trustee Hayes to approve the minutes of the December 17, 1991. Trustee Treacy asked that a few additions be added: On page one, under his comments, Trustee Treacy stated that since Mr. Riley was representing his client Mr. Falasca, he questioned Mr. Riley's motives. Additionally under Trustee Alter1 s comments on page one, the end of the sentence should read "for those existing accessory buildings so that they would not need to be replaced", on page two, under Trustee Treacy's comments he wanted it added that after the vote he requested that Board members who voted "No" explain their actions. With those additions/corrections, motion carried 6-0. Approval of Warrants Trustee Hyland moved, second by Trustee Alter, to approve the warrants and authorize the Treasurer to pay the bills. Motion carried 6-1 on roll call vote with Mayor Rey, Trustees Timmings, Alter, Nazemetz, Hayes and Hyland voting Yes and Trustee Treacy voting No. Trustee Treacy stated that there is still overspending in certain departments, especially high legal bills and most purchases by our highway department are being made at Post Automotive and he questioned this. Total of General Fund is $86,655.83 and the Water Department Fund is $28,132.77. Communications, Petitions and Requests The Deputy Clerk read a letter from Restaurante Latino of 68 Beekrnan Avenue informing the Village that they have made application with the NYS Liquor Authority for a wine license. Will be referred to the Police Chief, Attached correspondence was received from the Fire Council regarding the action which took place at their regular monthly meeting. Trustee Treacy moved to accept their action, second by Trustee Alter and motion carried 6-0. The Mayor was in receipt of a letter from Carol Manca of Hudson Terrace requesting that the Board consider revising the Sprinkler Law to bring it in line with the State Building Code Council's 1 �recommendation. Her letter will be referred to the Building Inspector and Bureau of Fire Prevention. Our Village Attorney has been reviewing this and will get back to the Board. Trustee Treacy was in receipt of several letters from the Village of Ossining commending Halpern Enterprises for a job well done in their community. (Letters made part of the record) . Mayor Rey commented that the senior citizens of our Village have written to him stating that the majority of seniors are against the project. Public Comments Mario Belanich asked that the Board consider looking into the possibility of reducing the number of Board members. He also asked that when the towing contract expires, the Board give the contract to a company in North Tarrytown. Luis Penichet, PBA lawyer, addressed the Board stating that the N. Tarrytown police are very unhappy about the current award that was given by the arbitrator. He urged the Board to meet with him again to try to reach an agreement before the PBA challenges the arbitrator's decision in court. He stated the zero award was not only ridiculous, but not comparable to any other municipalities. The Mayor commented that the Board acted in good faith and every effort was made to work something out before it reached arbitration. Trustee Treacy commented that although the arbitrator made his decision, he felt discussion was needed among the Trustees to try and reach some solution in fairness to both sides and he felt the zero award was not in line with the rest of the municipalities. Don Caetano, a resident of Lawrence Avenue, commented that our police department was very efficient and the arbitrator's award was a disgrace and the morale in the department will worsen. There being no further comments, Trustee Hyland moved to close the public comment section, second by Trustee Timmings and carried 6-0. Mayor's Report Mayor Rey commented that after the arbitration hearings that were held and the findings, the Board accepted the recommendation of the attorney. Administrator's Report William Regan stated that the next holiday is Martin Luther King day, January 20th. There will be no recycling on Wednesday that week. William Regan read the Village Prosecutor's report for the month of December 1991. The Zoning Board will meet on January 15, 1992 at 8 PM and the Planning Board will meet on January 16th at 8 PM. 2 �£K33 The Urban Development Corporation Public Hearing on the grant for the storefronts on Beekman Avenue will be held on Tuesday, January 14, 1992 at 7 PM in Village Hall. The Mayor commented that since this public hearing is being held at 7 PM, he will contact the attorney Martin Gold to change the time of the meeting regarding Halpern to 8 PM. Litigation will be discussed in executive session tonight. Resolutions-Attached Old Business Trustee Nazemetz stated that he had received a memo from Lit. Hayes regarding the number of accidents which have occurred on route 9 going north. He would like the Board to consider "no left turn" going north on route 9. This is a very dangerous section for cars to be making these turns into the Manor streets and also coming out of the streets onto route 9. In light of the rental increase of the 21 Beekman Avenue lot, Trustee Hyland asked that the Board consider purchasing the property. Trustee Treacy commented that we should ask the assessor to give us an updated appraisal of the property. New Business Trustee Treacy commented that there was an article in the newspaper on January 1st regarding Phelps hospital being charged with burning red bag waste. The DEC has fined them, but Trustee Treacy wants the Village to get in touch with the hospital and get them to stop this burning. It is endangering the health of our residents and must be stopped. Our attorney commented that he will send a letter to the DEC to see why they haven't taken this matter to the next step. The Mayor commented that the Administrator will write a letter to the hospital regarding our concern over this pollution. Public Comments Mario Belanich who works at General Motors commented that with the new paint plant, there is no pollution from GM. We should check into the incinerator burning at College Arms. Angelo Verdi of Farrington Avenue agreed with Lt. Hayes' idea and suggested that the Manor streets should be closed both ways on Route 9 since there have been so many accidents going into and coming out of these streets. There being no further comments, Trustee Hyland moved to close the public comment section,seconded by Trustee Timmings and carried. 3 �William Regan read a memo from our attorney regarding a new scofflaw program whereby Notices of Default Judgment will be served upon scoff laws. This will enable us to recoup money owed to the Village in fines and penalties. The Village can also consider the possibility of utilizing a collection agency for those who do not respond. Executive Session Trustee Hyland moved, second by Trustee Timmings to adjourn to Executive Session to discuss litigation. Discussion ensued on the Carroll lawsuit. Trustee Treacy moved to accept the recommendation of our attorney Wilson, Bave, Conboy & Bave, to pursue a settlement in this case, motion was seconded by Trustee Nazemetz and motion carried 6-0. Discussion ensued on the PBA contract. Discussion ensued on the sale of the Water Department building. The Mayor polled the Board for approval to sell the building to Leonard Rutligan, who was the highest bidder at $176,000. and authorize the Village Attorney to pursue the closing. The result of the vote was 4-2 with Trustees Timmings, Alter, Hyland, and Hayes voting Yes and Trustees Treacy and Nazemetz voting No. There being no further business, Trustee Timmings moved, seconded by Trustee Alter to adjourn the meeting and motion carried. They w e r e initially involved in the first building to be reconstructed in the Main street area, Two Church street. This is an office building which they have managed since they constructed it. Xn addition, Halpern has constructed two housing projects, Snowden House, an apartment house for relooatlon purposes during the urban Renewal Program, and Maple House a 104 unit apartment structure in the Main street area, for senior citizens. This senior citizen project was the last one that w a s approved by HITD for the Westchester area. Each of these projects has boon very successful, especially the senior citizen project which has served the community v e r y well since its construction and which has an ongoing waiting list. The Halpern Corporation has always been responsible and cooperative with the Village. Since the construction of these projects, the Halpern-Stillman Corporation has continued to manage each of them. Again they have been accessible, responsible and cooperative with the Village on all aspects of the buildings' management. I would highly recommend the Halpern Corporation to any municipality. They have served the Village of ossining very well and have continued to do so over the years. These units are located in Maple House, housing for the elderly and disabled, and Snowden House, housing for low income families. The Village's dealings with Halpern Enterprises have extended over the past fifteen years. We have found them to be dependable and cooperative. The units have been well constructed and any problems which have arisen have been handled in a timely fashion. Cooperation between the Village and the management company have led to the eviction of the more problem tenants and the housing is of great benefit to the residents of Ossining. Halpern Corporation built 2 Church Street (a two story commercial structure)/ 15 Maple Place (a six story senior citizens housing structure), and Snowden House (a ten story subsidized housing project). The Village Building Department did not experience any problems with Halpern during construction/ and we have had none with the management corporation.
