Deputy Village Clerk References Letter from Mr. & Mrs. Bick, 3 Terrace Close regarding two trees at Terrace Close and several phone calls. The meeting was opened at about 7 s 10 PM by R. Sweet and discussion of the problem was made by the chair with input from Joe DeFeo. Two small, adult, red, japanese-maple trees are growing at the western edge of the cul-de-sac which terminates Terrace Close. The Bicks considered the trees to be on their property and desired to transplant them to another site on their property. They alerted their neighbor, the LaMoscolos of their intent and faxed a letter to Joe DeFeo on May 16, 1995. They proceeded to excavate one of the two trees before any response from the Village was given. Thereupon Mr. LaMoscolo asked that they cease any further operation and seek permission from the Village to perform this task. The partial excavation which has been done on one of the trees was replaced with soil by Village personnel to maintain the health of the tree and prevent soil erosion and a dangerous physical condition. The Village has a TREE CONSERVATION law Chapter 52A enacted in 1984 which establishes certain rules and regulations dealing with trees and important forest vegetation of any size. Sec. 52A-7,A. describes the necessity of the landowner with a contiguous property area greater than one acre to be issued a permit by the Tree Commission before any tree on private property may be moved or altered. (Notes This law was invoked during preliminary discussions with the property now known as Bedford Park, a two plus acre area.) �In this particular instance the two trees are located on or near the boundary which establishes the Village's right-of-way on the cul-de-sac. Measurements were made and it appears that one of the trees falls within the Village's line while the second falls just outside the line. The trees would best be described as important forest vegetation rather than classic trees. The trees are growing very close together and the root systems are definitely intertwined. It is unlikely that the removal of the larger of the two trees would result in the remaining tree's survival, i.e. the necessary size of root ball would seriously jeopardize the remaining tree's root system. In an effort to ameliorate the situation and since the Bicks could apply for a permit and might possibly be allowed to remove one tree, albeit dependent on the survival of the remaining tree, now then, the Commission recommends that an offer be made that the Village arrange for a tree of similar size and kind be obtained for Mr. & Mrs. Bick in return for the present two trees remaining in place.
