Present: Mayor Philip Zegarelli Mario DiFelice Richard Spota Thomas Capossela Kay Brown Grala Richard Zieja Andrew Murray Trustees Also Present: Robert Ponzini, Village Attorney Dwight Douglas, Village Administrator I Mayor Zegarelli called the meeting to order with a prayer and pledge to the flag. He asked that everyone remain standing for a moment of silence for Ella Cochrane who passed away recently. She was the mother of Jim Cochrane, one of our village employees. Approval of Minutes Trustee DiFelice moved to approve the minutes of September 20,2005, seconded by Trustee Spota and motion carried. Trustee Spota moved to approve the minutes of September 27,2005, seconded by Trustee Capossela and motion carried. Trustee Capossela moved to approve the minutes of October 11,2005, seconded by Trustee Grala and motion carried. Public Hearing Trustee Grala read the attached the public hearing notice amending Chapter 52 entitled taxis. Police Chief Jimmy Warren gave a brief explanation. There were no comments from the public Trustee Grala moved, seconded by Trustee Zieja to close the hearing, motion carried. I Mayor Zegarelli commented that the Police Committee will review this proposed ordinance and get back to the board. Approval of Warrant Trustee Zieja, seconded by Trustee Murray to approve the warrant of October 25, 2005 subject to review, approval and signatures of the Mayor and Acting Village Treasurer, motion carried. Total of General Fund is $283,921.23, Parking Fund total is $200., Water Fund total is $2,798.71, Capital Fnnd total is $39,988.8© and Trust & Agency total is $33,706.71. Total of warrant was $360,615.45. Mayor's Report The Mayor reported that we have received turn-off notices from Con Ed for 249 N. Broadway and 196 Cortlandt Street. 1 �Public Comments Mario Belanich commented on the resolution to hire a person to do grants. He commented that he thought the Administrator was doing grants for the village. The Mayor responded that the Administrator is working on other projects like the GM-Roseland project and many others now which take up a lot of his time. We will be using grant money we have received to pay for her services. Trustee Capossela commented that the person we are hiring to do the grants will work approximately 10 hours a week for six months. Mr. Belanich commented that he heard something about illegal taping of telephones in the Police Department Mr. Douglas responded that there was an integrated phone system in the Court and Police Department which has now been corrected. Mr. Belanich commented that he heard one of the trustees does not live in the village any longer. The Mayor responded that he is still a resident of the village and just has a temporary residence at this time. Jim Paolantonio asked why he couldn't get a copy of the Santos report which should be available. Robert Ponzini, Village Attorney, commented that according to Open Government, this report must be kept confidential since it involves personnel. Trustee Reports Trustee DiFelice read the attached Public Works Report Trustee Spota reported that the Public Safety Committee met on October 13* with Chief Ojito regarding a complaint and hopefully it will be resolved. The civilian Public Safety Committee met on Monday, October 2 4 u . Trustee Spota commented that Dick Kelly has moved to Connecticut and they would like to appoint Diane Martello as Chairperson. The next meeting will be held on November 21st at 7pm in the board room. Chief Warren has received the certificate for Criminal Justice and an Emergency Response award. Trustee Grala commented that unfortunately the Street Festival had to be cancelled this year due to the bad weather but we did save money. She reported that the Children's Halloween festival was held last Sunday at Kingsland Point Park with pumpkin painting, etc The Haunted Hayride is scheduled for this Friday and Saturday nights. Trustee Zieja reported that we have received invitations from Fire Chief Ojito to attend the annual Fire Inspection on November 5* at 4pm. �Trustee Murray was in receipt of a letter from Assemblywoman Sandra Galef asking Municipal Officials to attend a public informational meeting to solicit input from the public for the proposed Route 9 Enhancement to be held on November 16th at 7pm at the Scarborough Presbyterian Church. He met with Historic River Towns of Westchester to discuss promoting tourism. Trustee Murray commented that we will be hosting the Westchester County Municipal Officials Association meeting this year which will take place on November 10,2005 in Columbia Hose. On November 11 th the Sleepy Hollow Chamber of Commerce will be honoring Cynthia and Doug Ferguson. Administrator's Report Mr. Douglas reported that the project at the Duracell lot for 150 parking spaces is underway. We have awarded the bid for the renovations of the Sleepy Hollow pump station that went out to bid on October 3,2005. The village is working diligently on the water situation with Delaware Water and Village of Briarcliff. Bids for the comfort station and pavilion at Barnhart Park will be going out to bid shortly. We submitted a grant request for the Lighthouse Hudson River Improvement fund. Trustee Caposseia asked about the status of the former Tappan Motors property. Sean McCarthy explained that plans for the erection of 8 townhouses came before the Zoning Board who downgraded it to 6 townhouses. The Planning Board is still reviewing the plans and then it will go back to the Zoning Board. Resolutions-Attached Old Basiness-None New Business Trustee DiFelice commented that the senior's annual Halloween party wiO take place this Friday at Rudy's Bean Rivage in Dobbs Ferry. Communications, Petitions and Requests Village Clerk read correspondence from James P. Maniatis, Attorney for Hollywood North Pizzeria, Inc. informing the village that they are applying to the New York State Liquor Authority for a Restaurant Wine and Beer license at the premises located at 109 Beekman Avenue. (Copy to Police Chief) �Village Clerk read correspondence from Hugh & Carol Jones of 253 Hunter Avenue to Joe DeFeo thanking him and his crew for all the great work they do. Letter also sent to the Mayor. (Placed in Joe DeFeo's file) The Mayor received a letter from a resident of 47 Lawrence Avenue regarding the work being done on that street The Mayor also received a letter from the residents of Clinton Street complaining about the Limo company located at 163 Depeyster Street who are parking on Clinton Street which leaves these residents no place to park. There being no further business, Trustee DiFelice moved, seconded by Trustee Murray to adjourn the meeting, motion carried. Moved;Trustee DiFelice SccondedJrustee Soota Vote: TTnanifflo„Q �Meeting Date: Resolution #: 10/25/05 10/177/05 Resolution of the Board of Trustees of the Village of Sleepy Hollow Authorizing Execution of a Consultant Agreement Grants Writing and Management Services WHEREAS, over the past five years, the Village of Sleepy Hollow, under the leadership of the Mayor and Village Administrator, has been highly successful in obtaining grant funding and low interest loan commitments from County and State sources in amounts ranging from one hundred thousand to several miilion dollars; and WHEREAS, the Village of Sleepy Hollow wishes to expand its grant development and writing program to include other units of government (federal) and various foundations in order to support its redevelopment goals, particularly as it concerns the development of the new Elm Street Senior Center and projects designed to protect and enhance the economic vitality of the downtown business community; and WHEREAS, a highly qualified Village resident, Fiona Hodgson of 26 Evergreen Way, has been identified as providing the requisite skills to undertake these needed functions; and WHEREAS, the Village of Sleepy Hollow is now desirous of contracting for said technical assistance in developing, writing and implementing grants; and WHEREAS, the Village Administrator, by prior action, was able to secure $49,000 in unappropriated fee revenues from the Phelps Industrial Development bond dosing, and has now recommended that $10,000 of this fee be set aside for the initial payment of these consultant services. NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees herein authorizes the Mayor to enter into the below agreement on the terms as detailed herein: AGREEMENT made the 19th day of October, 2005, between the Village of Sleepy Hollow, 28 Beekman Avenue, Sleepy Hollow, New York, 10591, hereinafter referred to as "Village", and Fiona Hodgson of 26 Evergreen Way, Sleepy Hollow, New York, 10591, hereinafter referred to a "Contractor". 1. In consideration of the payment described in section 2, the Contractor shall provide the grant development and writing services enumerated above. �2. For Work performed under this agreement, the Village shall pay to the Contractor a sum not to exceed ten thousand dollars ($10,000) based on a rate of $65 per hour. Payment to be made to Contractor after submission of a properly executed claim form describing the services performed and itemizing the dates and number of hours providing such services. 3. The term of the Agreement shall begin on October 26, 2005 and run for a period of six months with an estimated average of 10 hours per week. The contract terms may be extended upon agreement of both parties and the allocation of additional funds. Notwithstanding the above, the Village may, upon ten (10) days written notice to the Contractor, terminate this Agreement in whole or in part when the Village deems it to be in its best interest In such event, the Contractor shall be compensated and the Village shall be liable only for payment of services already rendered under this Agreement prior to the effective date of termination. 4. The Contractor understands that he/she as an independent contractor is not an employee of the Village nor covered under the Village's personal liability, Worker's Compensation or retirement benefits. It is further understood that the Contractor holds harmless the Village, its officers, employees, and agents from and against any and all liability, damage, claims, demands, costs, judgments, fees, attorney's fees or losses arising directly out of the acts or omissions involved in this scope of work. Lawrence Avenue street repaving will take place the first or second week of November. Tree removal/pruning is ongoing. The street lights that are out on Kelbourne Avenue from Munroe to Route 9 is a Con Edison problem and they have been notified.
