                  <text>A regular meeting of the Board of Trustees of the Village of Sleepy Hollow was held
on Tuesday, June 27, 2006 at 8:00 pm in Village Hall, 28 Beekman Avenue, Sleepy
Hollow, New York.
Present: Mayor Philip Zegarelii
Mario DiFelice
Richard Spota
Thomas Capossela

Robert Ponzini, Village Attorney
Mayor Zegarelii called the meeting to order with a prayer and pledge to the flag.
The Mayor asked that everyone remain standing for a moment of silence for the
following residents who recently passed away; Peter Gandolfo, Stan Pulaski, Joe
Carmony, John Garrison, Emily Basher, Buddy Karr, and Msg. Schroder.
Public Hearings
Trustee DiFelice read the attached public hearing notice regarding the Valley Street
Re-Development Plan. Dwight Douglas gave a brief explanation of the project.
Frank Occhipinti asked about senior housing at the GM site and if this would have
any bearing on the Valley Street project.
The Mayor explained that the Valley Street project is for low income housing.
Mario Belanich asked what was the lowest income that will be considered and who
will be considered for these apartments?
The Mayor explained that the first ones will be the residents of Margotta Courts
and then College Arms.
Ken Gentile and Neil Connick explained the proposed project in more detail.
There being no further comments, Trustee DiFelice moved, seconded by Trustee
Spota to close the public hearing, motion carried.
Trustee Spota read the next public hearing notice regarding the excavation
ordinance and moved to open the hearing, seconded by Trustee Capossela and
carried.
Building Inspector, Sean McCarthy, gave a brief summary.
There were no comments from the public; Trustee Spota moved to close the hearing,
seconded by Trustee Capossela and carried.

�Trustee Capossela read the attached public hearing notice regarding the parking
regulations on Sleepy Hollow Road.
There were no comments from the public. Trustee Spota moved, seconded by
Trustee Capossela to close the hearing, carried.
Approval of Minutes
Trustee Grala moved, seconded by Trustee Morales to approve the minutes of May
23, 2006, motion carried unanimously.
Trustee Morales moved, seconded by Trustee M u r r a y to approve the minutes of
June 13, 2006, motion carried unanimously.
Trustee M u r r a y moved, seconded by Trustee DiFelice to approve the minutes of
June 20, 2006, motion carried unanimously.
Approval of W a r r a n t
Trustee DiFelice moved, seconded by Trustee Spota to approve the w a r r a n t of J u n e
27, 2006, motion carried unanimously.
Total of the General fund is $209,618.67 &amp; 268,296.75, total of Sanitation fund is
$11,969.08 &amp; 37.64, total of the Water fund is 8,995.80 and $3,273.31, total of
Parking Authority fund is $549.00 and the totals of the Capital fund is $4,243.75 and
$65,534.88.
Mayor's Report
Mayor Zegarelli commented that he received letters from General M o t o r s and
Roseland stating the disagreements with each other with regard to finalizing the
PFEIS.
Public Comments
Jim Limpscomb addressed the board regarding letters he had written to the Mayor
about certain trees in the village.
The Mayor responded that he had answered his letters explaining that we do take
care of our trees.
Mario Belanich commented that he hoped that the garbage situation that occurred
on the last holiday would occur on the next holiday.
Mike Blaloek commented that the buses that NY Life uses to t r a n s p o r t their
employees to the station should not be going down Valley Street.
He also commented that the Police Department shouldn't be handling Sykes Park. It
should be handled through the Recreation department.
He commented that he felt the police deserve a raise.
He commented that the issues regarding the C O C need to be addressed.
The Mayor replied that he has a meeting scheduled with the C O C shortly.
Mr. Blaloek and Don Caetano asked about the status of the Auxiliary Police.

�Mayor Zegarelli commented that it is being worked out.
Don Caetano wanted to know why tickets can't be issued for vehicles parked on
village property.
Sean McCarthy explained that it is a code enforcement issue.
Trustee Reports
Trustee DiFelice read the attached Public Works Report.
Trustee Spota reported that the Public Safety Committee met last night and
discussed the traffic study being done regarding proposed changes to route 9 and
New Broadway.
Discussion took place regarding the proposed parking changes on Sleepy Hollow
Road.
Officer Paul Nelson has successfully completed the impaired driving course.
Detective Bobby Checchi has attended the school violence and safety training
seminar.
Trustee Spota commented that we have received letter from the PBA regarding his
abstaining from the vote on the health insurance issue. Trustee Spota explained
that being a former member of the police department, he had to abstain from
voting.
Trustee Spota read the attached correspondence from the Fire Wardens.
The Mayor commented that he does not have any problem confirming their action
as long as the annual physicals are given to them as part of our procedure.
Trustee Capossela reported on several recreation items. Summer concerts are set to
begin at Kingsland Point Park and Morse school, TNT baseball has finished
another successful season, summer travel baseball is on the way as is soccer camp
next week, day camp has started, lacrosse will start July 17th , lighthouse tours are
in full swing and the pitch, hit and run contest was held at Yankee stadium.
Trustee Grala reported that the village received a grant on June 15th for $5000.
from the Friends of the Warner Library and they are working with Tarrytown on
the HVAC fire system.
Trustee Grala commented that Fiona Hodgson who is working on getting grants for
the village is now helping the library receive grants.
She commented that the North Tarrytown Housing Authority has elected William
Davis as their Chairman.
Trustee Grala commented that Jim Hart has done a great job with the organization
of the day camp.

�Trustee Morales commented that the day camp is going very well and is very
organized.
She commented that there seems to be a lot of double parking on Beekman Avenue,
Cortlandt Street and Elm Street.
Trustee Murray reported that the Finance Committee met and reviewed candidates
for the finance department.
Trustee Murray reported that the Downtown Revitalization Corporation had their
first meeting on Monday and they appointed Antonio Rodriguez, Sam Viera and
John Hughes to the Board of Directors and Dwight Douglas as the Executive
Director.
Administrator's Report
Dwight Douglas reported that the Design Sub-Committee met on the Lighthouse
Landing project.
We have received a $30,000. grant for archives and we have applied for a $150,000.
storm water grant which should be forthcoming.
Resolutions-Attached
Communications, Petitions &amp; Requests
Village Clerk read correspondence from Paraiso Costeno Restaurant Corp. of 175
Valley Street informing the village of their intent to renew their liquor license. Copy
given to Police Chief.
Mayor Zegarelli commented that we are in receipt of a letter regarding the
Delaware hook-up.
The Mayor was in receipt of turn off notices from Con Edison for 145 and 150
Cortlandt Street and 48 Beekman Avenue.
The Mayor was in receipt of a letter from GM and Roseland stating that all disputes
have been resolved.
Old Business
Trustee DiFelice commented on the financial report regarding the Corvette show.
There being no further business, Trustee DiFelice moved, seconded by Trustee
Murray to adjourn the meeting, carried.

will hold a public hearing on Tuesday, June 27, 2006, at 8:00 p.m., in the Municipal Building, 28

PLEASE TAKE NOTICE that certain property owned by the Village of Sleepy Hollow,
which is situated at 126 Valley Street, Village of Sleepy Hollow, County of Westchester, State of New
York and identified on the Tax Map of the Village of Sleepy Hollow as Section 16, Block 17, Lots 2028 (the "Property"), will be conveyed by the Village of Sleepy Hollow to the County of Westchester
(the "County"), as a conduit for conveyance under the County's New Homes Land Acquisition
Program to Sleepy Hollow Housing Development Fund Corp. ("SHHDFC") as nominee for Sleepy
Hollow Senior Housing, LLC (the "Company"). The conveyance is to allow for the construction of a
building upon the Property housing residential rental housing. This shall include sixty-four (64) units
for senior citizens of low income, one superintendent's unit and sixty-six (66) proposed parking
spaces, inclusive of parking spaces to be reserved for use by the occupants of the Margotta Courts
housing complex replacing those presently maintained upon the Property.

This project is being

developed and sponsored by Mountco Construction and Development Corp., a New York corporation,
and is being co-sponsored by Westchester Management Group, Inc., a New York not-for-profit
corporation.
The County shall make payment to the Village of Sleepy Hollow in the amount of Two
Hundred Fifty Thousand and 00/100 ($250,000.00) Dollars as consideration for the conveyance of the
Property. It is anticipated that, as required by the County, the County shall reconvey the property to
SHHDFC as nominee for the Company.
PLEASE TAKE NOTICE that a public hearing concerning said disposition shall be held
before the Board of Trustees of the Village of Sleepy Hollow at the Municipal Building, 28 Beekman
Avenue, Sleepy Hollow, New York 10591, on Tuesday, June 27, 2006, at 8:00 p.m. during which the

PLEASE TAKE NOTICE that a public hearing will be held by the Board of Trustees of
the Village of Sleepy Hollow on the 27 day of June, 2006 at 8:00 in the p.m. at
Village Hall located at 28 Beekman Avenue, Sleepy Hollow, New York regarding the
adoption of a proposed local law of the Village of Sleepy Hollow amending Chapter 577A of the General Code entitled Vehicle and Traffic: Parking prohibited in designated
locations, to add the following provisions prohibiting parking:
20. On the easterly side of Sleepy Hollow Road from the point of the intersection with
Bedford Road (Route 448) to the point of the intersection with Webber Avenue there
shall be no parking at any time.
21. On the westerly side of Sleepy Hollow Road from the point of the intersection with
Bedford Road (Route 448) to the point of the intersection with Webber Avenue there
shall be no parking on :
a. Monday, Wednesday and Friday between the hours of 8:00 a.m. and 12 noon.
b. Tuesday and Thursday between the hours of 8:00 a.m. and 3:00 p.m.
Any resident of the Village of Sleepy Hollow is entitled to be heard upon said proposed
Local Law at such public hearing.
Village Hall is handicapped accessible.

A letter was received from Union Hose (E-86) informing the council that Richard Chulla
and John Cappello were voted back on the active list. Chulla and Cappello had been on

The Board of Fire Wardens requests that the Board of Trustees follow the normal course
of action on this matter and forward the names of these members to the Village Clerk.

Resolution of the Mayor and Board of Trustees of the Village of Sleepy Hollow
Setting a Public Hearing to Amend the Zoning Map
WHEREAS, the Village of Sleepy Hollow has created a new municipal parking lot at Andrews
Lane to replace the "Elm Street" parking lot; and
WHEREAS, the Village Administrator and Building Inspector have recommended certain
changes to the official Zoning Map of the Village in light of this change as detailed in the
attached; and
WHEREAS, the Mayor and Board of Trustees now wish to solicit input from the Planning Board
and from the public regarding this proposed map change.
NOW, THEREFORE, BE IT RESOLVED, that the proposed Zoning Map amendments be
forwarded to the Planning Board for comment; and
BE IT FURTHER RESOLVED, that a public hearing is herein set for July 25, 2O06 at 8:00 p.m.

WHEREAS, the Village of Sleepy Hollow ("Sleepy Hollow'*) does not presently regulate the use
of Explosives and the conduct of Blasting in the Sleepy Hollow pursuant to &amp; local law contained
in its General Code, and
WI-IER F AS, Sleepy Hollow believes a local law should be adopted to establish the minimum
safeguards to protect human health, safety and welfare, as well as property, by establishing
reasonable regulations governing the possession and use of explosives and to ensure that the use
and possession of explosives dees not result in injury or property damage, and
WHEREAS, Sleepy Hollow believes it is in the best interests of its residents to assert its right to
designate acceptable hours for blasting operations, set levels for ignition and discharge of
explosive materials and establish acceptable standards governing consequential vibrations

APPROVING COMMUNITY REDEVELOPMENT PLAN
UNDER ARTICLE 15 OF THE GENERAL MUNICIPAL LAW AND AUTHORIZING
DISPOSITION OF VILLAGE-OWNED PROPERTY126 VALLEY STREET PARCEL
WHEREAS, Article 15 of the General Municipal Law of the State of New York (the
"GML") authorizes municipalities to designate areas appropriate for community redevelopment
and to adopt plans providing for such redevelopment; and
WHEREAS, the area comprised of a parcel of Village-owned land located at 126 Valley
Street in the Village of Sleepy Hollow (consisting of approximately 0.4482 acres and designated
on the Village Tax Map as Section 16, Block 17, Lots 20-28), as more particularly shown on
Exhibit "A" attached hereto (the "Valley Street Property"), was designated by the Village Board
of Trustees as an area appropriate for community renewal on April 18, 2006 (the "Project
Area"); and
WHEREAS, the Village Board of Trustees, by Resolution duly adopted on April 18,
2006, directed the preparation of a Community Redevelopment Plan ("CRP") in accordance with
the provisions of Article 15 of the GML; and
WHEREAS, the CRP was thereafter prepared and delivered to the Village Board of
Trustees, in accordance with said directive, a copy of which is attached hereto as Exhibit "B";
and
WHEREAS, the Village Board of Trustees submitted the CRP to the Planning Board of
the Village of Sleepy Hollow (the "Planning Board") on May 2, 2006 for review and certification
for compliance with Sections 502(7) and 504 of the GML; and
WHEREAS, the Planning Board, after a duly noticed public hearing, certified on May
18, 2006 that the CRP complies with Sections 502(7) and 504 of the GML and thereupon related
its certification to the Village Board of Trustees; and
WHEREAS, pursuant to Section 505(3)(a) of the GML, the CRP is now before the
Village Board of Trustees for final review and approval; and
WHEREAS, the proposed CRP seeks to facilitate the redevelopment of the Project Area
with a multifamily residential building providing affordable housing for seniors age 62 and older

�and, by way of such redevelopment, to restore a substantially underutilized, unsightly and
deteriorated property to a beneficial and visually attractive use; and
WHEREAS, the CRP proposes, as the means of such redevelopment, the disposition of
the Project Area (the Valley Street Property) to a selected developer for the purpose of
constructing a building and related improvements thereon providing affordable housing tc
seniors age 62 and older; and
WHEREAS, the Village Board of Trustees has considered, as a step to be taken under
the proposed CRP, the conveyance of the Valley Street Property to the County of Westchester
(the "County") under the County's New Homes Land Acquisition program, and the
reconveyance of the Valley Street Property by the County to Sleepy Hollow Senior Housing,
LLC for purposes of developing affordable housing for senior citizens age 62 and older; and
WHEREAS, as part of the transfer to the County, the Village of Sleepy Hollow
acknowledges that it will forgo its right of first refusal to reacquire property, so as to allow for
the development of much-needed affordable senior housing; and
WHEREAS, the transfer of the property first to the County and from the County to
Sleepy Hollow Senior Housing, LLC wiil provide for a $250,000 payment to the Village in the
form of a grant from the County, and this cost will therefore not be borne by the project, thus
improving its affordability; and
WHEREAS, pursuant to Section 507(2)(d) of the GML, a Notice of Disposition was
published in a newspaper of general circulation in the Village of Sleepy Hollow at least ten (10)
days before the date hereof; and
WHEREAS, the public has been given an opportunity to comment on both the CRP and
the proposed conveyance of the Valley Street Property by the Village to Sleepy Hollow to the
County of Westchester, as a conduit for conveyance to Sleepy Hollow Senior Housing, LLC
under the County's New Homes Land Acquisition Program; and
WHEREAS, pursuant to Section 507(2)(d) of the GML, said conveyance of the Valley
Street Property is before the Village Board of Trustees for approval; and
WHEREAS, said conveyance would be consistent with the CRP, as proposed; and
WHEREAS, the Village of Sleepy Hollow Waterfront Advisory Commission has
reviewed the CRP and the proposed conveyance and redevelopment of the Valley Street Property
with a multifamily residential building providing affordable senior housing and has determined
that they are consistent with the goals and objectives expressed and contained in the Village of
Sleepy Hollow Local Waterfront Revitalization Plan; and
WHEREAS, the Village Board of Trustees, by Resolution adopted on May 23, 2006,
issued a Negative Declaration under the provisions of the New York State Environmental
Quality Review Act with respect to the proposed conveyance and redevelopment of the Valley

�Street Property for purposes of the construction and operation of a sixty-five unit, nine (9) story
building, which will provide sixty-four (64) units of affordable housing for senior citizens (62
years of age or older); it is now therefore
RESOLVED, that
(a)
the Village Board of Trustees finds that the Project Area is a substandard
or unsanitary area, and/or is in danger of becoming a substandard or unsanitary area, and tends to
impair or arrest the sound growth and development of the Village of Sleepy Hollow on account
of its substantially underutilized, deteriorated and unsightly condition,
(b)
The financial assistance to be provided by the Village of Sleepy Hollow,
through grant funds to be obtained from the County, is necessary to enable the project to be
undertaken in accordance with the CRP,
(c)
The CRP affords maximum opportunity to private enterprise, consistent
with the sound needs of the municipality as a whole, for the undertaking of a community
redevelopment program, and
(d)
The CRP conforms to and complements the comprehensive community
plan for the development of the municipality as a whole and will foster the creation of housing
complementing residential uses surrounding the Project Area and serving senior citizens in need
of affordable housing,
(e)
No families and/or individuals will be displaced from the Project Area
and, in fact, implementation of the CRP will bring about the creation of affordable housing for
senior citizens age 62 and older; and it is further
RESOLVED, that the CRP is hereby approved; and it is further
RESOLVED, that, in furtherance of the CRP, Sleepy Hollow Senior Housing, LLC is
selected as the redeveloper to which the Valley Street Property will ultimately be conveyed for
purposes of the construction and operation of an affordable senior citizen housing project; and it
is further
RESOLVED, that the conveyance of the Valley Street Property to the County as a
conduit for conveyance to Sleepy Hollow Senior Housing, LLC under the County's New Homes
Land Acquisition Program, is hereby approved, subject to the finalization of agreements
providing for (a) said disposition of the Valley Street Property and (b) the payment of monies in
lieu of taxes upon acquisition of the Valley Street Property by Sleepy Hollow Senior Housing,
LLC; and it is further
RESOLVED, that said conveyance shall be subject to the CRP, as approved, and that
Sleepy Hollow Senior Housing, LLC shall be required to obtain all permits, variances and
approvals required for the construction and operation of the proposed affordable senior citizen
housing project; and it is further

Authorizing Submission of Grant Application to
Fund Rehabilitation of the Kingsland Point Park Pedestrian Overpass
WHEREAS, pursuant to the Village's Open Space Master Plan for the redevelopment of its
waterfront and the adopted Local Waterfront Revitalization Program the rehabilitation of the
Kingsland Point Park pedestrian bridge has been identified as a key component of needed
infrastructure improvements; and
WHEREAS, a study was performed in 2000 indicating that the structure of the bridge was
sound and that renovation of it was a feasible activity; and

WHEREAS, pursuant to an Inter Municipal Agency agreement by and between the County of
Westchester and the Village of Sleepy Hollow, the Village's responsibility is limited to ongoing
maintenance and operation, and the development of major capital improvement projects remain
the responsibility of the County and the County has indicated its support for this initiative.
NOW, THEREFORE, BE IT RESOLVED that Philip E. Zegarelli, Mayor of the Village of Sleepy
Hollow, is hereby authorized and directed to file an application for funds from the New York
State Department of Transportation in accordance with the provisions of the Transportation
Enhancements Program, in an amount not to exceed $598,266, and upon approval of said
request to enter into and execute a project agreement with the State for such financial
assistance for the reuse and rehabilitation of the Pedestrian Overpass,

WHEREAS, pursuant to the Village's Open Space Master Plan for the redevelopment of its
waterfront and the preliminary concept plans submitted by Roseland/GM for the "Lighthouse
Landing Development", the 1883 Lighthouse at Sleepy Hollow is a vital component and
significant structure within the overall planned development; and
WHEREAS, the 1883 Lighthouse at Sleepy Hollow requires important restoration to preserve
and protect it from further water damage and deterioration; and
WHEREAS, pursuant to an Inter Municipal Agency agreement by and between the County of
Westchester and the Village of Sleepy Hollow, the Village's responsibility is limited to ongoing
maintenance and operation, and the development of major capital improvement projects remain
the responsibility of the County and the County has indicated its support for this initiative; and
WHEREAS, an additional grant funding source to undertake this restoration has been

Fund Broadway Beautification Project
WHEREAS, Broadway as it traverses the Village of Sleepy Hollow has been designated as a
"Scenic Byway" by the New York State Department of Environmental Conservation, and
WHEREAS, sections of Broadway within the Villages of Sleepy Hollow and Tarrytown are in
deteriorated condition requiring repair and streetscape enhancements, and
WHEREAS, the Broadway corridor provides access to significant historic properties and a
signage program has been devised by the Historic Rivertowns of Westchester to highlight these
important sites and help guide tourists to their destinations, and
WHEREAS, a grant funding source to undertake this program of beautification and historic
landmark signage has been identified.
NOW, THEREFORE, BE IT RESOLVED that Philip E. Zegarelli, Mayor of the Village of Sleepy
Hollow, is hereby authorized and directed to file an application for funds from the New York
State Department of Transportation in accordance with the provisions of the Transportation
Enhancements Program, in an amount not to exceed $915,978, and upon approval of said
request to enter into and execute a project agreement with the State for such financial
assistance for the beautification of Broadway, and

WHEREAS, by prior action the Mayor and Board of Trustees negotiated a union
contract with the Teamsters Union which provided for raises for its members for the
fiscal year 2006-2007 as follows:

Setting Annua! Parking Rates at Kingsland Point Park
WHEREAS, the Mayor and Board of Trustees wish to establish parking rates for those persons
desiring to take out annual permits to utilize the Kingsland Point Park parking lots; and
WHEREAS, the Mayor and Board of Trustees are desirous of providing a reduced rate for
senior citizens (herein defined as persons 62 years or older and/or disabled or handicapped).

EXECUTIVE ORDER
Adopting the Use of the National Incident Management System (NIMS)
WHEREAS, natural and man-made disasters have and may occur In any part of the country;
WHEREAS, the majority of emergency Incidents are mitigated by local responders;
WHEREAS, Village agencies may be called upon to respond to and/or assist in recovery from the
effects of emergency incidents and disasters;
WHEREAS, the Village of Sleepy Hollow is committed to achieving a system that will provide a
consistent countywide approach for federal, state, county and local governments to work effectively and
efficiently together to prevent, prepare for, detect, respond to, operate at, and recover from emergencies
and disasters, regardless of cause, size or complexity;

WHEREAS, the Homeland Security Presidential Directive (HSPD)- 5 requires federal departments
and agencies to adopt the National Incident Management System (NIMS) and as a condition for federal
preparedness assistance, beginning in Fiscal Year 2005, state and local organizations are mandated by
HSPD-5 to adopt NIMS as the model for incident management In times of disaster;
WHEREAS, In times of disaster, local and county agencies will work dosely with state and federal
agencies; and
WHEREAS, in NIMS provides a consistent nationwide template for all agencies to work together to
prevent, prepare for, detect^ respond to, operate at, and recover from all hazards;
NOW, THEREFORE, I, Philip E. Zegarelli, Mayor of the Village of Sleepy Hollow, by virtue of the
authority vested in me by the laws and charter of the county of Westchester, hereby order as follows:

All Village agencies which may be required to participate in the
management of emergency incidents and disasters shall follow the
National Incident Management System (NIMS) as the model for
preparing for, detecting, responding to, operating at and recovering
from emergency incidents and disasters.
The Police Department shall be the lead agency for determining overall
village compliance with the requirements of NIMS and oversee the
planning, training and Implementation of NIMS within the Village.
With assistance from the Police Department, each Village
department/agency shall review its agency Emergency Operations Plan
to ensure compliance with the requirements of NIMS.
All Village agencies shall maintain an internal inventory of resources
that may be needed in the event of an emergency or disaster and shall
establish a process that provides for the expeditious Identification and
procurement of external resources needed In an emergency or disaster,
