Present: Mayor Philip E. Zegarelli Deputy Mayor Mario DiFelice Richard Spota Andrew Murray Kay Grala Sandra Morales Thomas Capossela Trustees Also Present: Dwight H. Douglas, Village Administrator Robert Ponzini, Village Attorney Joel Sachs, Special Counsel Diane Jacobsen, Village Treasurer Sean McCarthy, Village Architect At 7 p.m. the Mayor called the board into special session. On a motion of Trustee DiFelice, seconded by Trustee Spota and subject to the review and signoffof the subject Trustee subcommittee chairpersons and the further review and approval of the Mayor and Village Treasurer the warrant of September 12th, 2006 together with any vouchers as consolidated in said warrant were approved. The motion carried unanimously. The attached resolutions were acted on as noted therein. Trustee Spota, citing the fact that most current PBA contracts throughout Westchester required no contribution of its members toward health insurance premium costs, recommended that the Village remove the condition from the PBA negotiations the requirement that future police officers hired after May 31 st , 2008 contribute 20% toward health insurance premium cost after reaching Grade, 1. Trustee Capossela and Deputy Mayor DiFelice indicated their concurrence for this change and requested that an additional resolution to that effect be added to the agenda. No action was taken on this request as on a motion offered by Trustee Murray, seconded by Trustee Morales and carried 4-3, at 8:00 p.m. the special meeting was adjourned: Trustees Murray, Morales and Grala and Mayor Zegarelli voted in favor, Trustees Spota and Capossela and Deputy Mayor DiFelice voting in opposition . ^Respectfully submitted, •-> Dwight n . Douglas, Village__Xdministrator �<Vv Meeting Date: Resolution #: 09/12/06 09/183/06 RESOLUTION APPROVING THE APPLICATION OF THE SLEEPY HOLLOW PBA FOR PERMISSION FOR ADDITIONAL PUBLIC MEETINGS OR GATHERING PURSUANT TO GENERAL CODE SECTION 4 0 - 1 WHEREAS, an additional application has been submitted by the Sleepy Hollow PBA, Inc. ("BPA") for a permit pursuant to Section 40-1 of the General Code of the Village of Sleepy Hollow to allow a public meeting or gathering, and WHEREAS, the Board of Trustees of Sleepy Hollow ("Sleepy Hollow") has reviewed this application and is prepared to approve it with certain requirements. NOW, THEREFORE, BE IT RESOLVED that the application of the PBA is granted with the following conditions: 1. That the PBA provide Sleepy Hollow with a statement of purpose for the meeting or gathering within ten (10) days of the date of this memorandum and that said purpose be acceptable to Sleepy Hollow. 2. That within that same ten (10) day period, the PBA provide Sleepy Hollow with more specific locations for the meeting or gathering, in particular designating if any meeting or gathering will take place in an area without sidewalks. Sleepy Hollow reserves the right to reject any location that may cause a threat to the safety of vehicular, pedestrian or applicant traffic. 3. Sleepy Hollow reserves the right to summarily revoke said permit if at any time the safety or good order of the public is jeopardized. Moved: Trustee Spota Seconded: Trustee Capossela Vote: 6-1 Trustee Capossela voted in opposition: " I vote in opposition because I want the PBA contract settled." �Meeting Date: Resolution #: 09/12/06 09/184/06 RESOLUTION GRANTING MINOR MODIFICATION OF SPECIAL PERMIT UNDER SECTION 62-22.4 OF CODE OF THE VILLAGE OF SLEEPY HOLLOW Sleepy Hollow Senior Housing Project- 126 Valley Street, Sleepy Hollow, New York (Application of Sleepy Hollow Senior Housing, LLC) WHEREAS, on December 17, 2004, the Board of Trustees of the Village of Sleepy Hollow (the "Village Board") received an application, pursuant to Section 62-22.4 of the Code of the Village of Sleepy Hollow (the "Village Code"), for a special permit related to the development of an affordable senior housing project upon property located at 126 Valley Street (the "Valley Street Parcel"); and WHEREAS, the Village Board commenced review of this action in accordance with the mandate of the New York State Environmental Quality Review Act ("SEQRA") and its implementing regulations, and established itself as SEQRA Lead Agency; and WHEREAS, the special permit application was referred to the Westchester County Planning Board in accordance with the provisions of §239-m of the General Municipal Law; and WHEREAS, the Planning Board of the Village of Sleepy Hollow, by a Memorandum Report dated May 18, 2006, recommended the issuance of the special permit; and WHEREAS, the Village Board, by Resolution adopted on May 23, 2006, issued a Negative Declaration under SEQRA with respect to the proposed affordable senior housing project; and WHEREAS, the Village Board, by Resolution adopted on May 23, 2006, issued a special permit to Sleepy Hollow Senior Housing, LLC (the "Applicant") with respect to the project; and WHEREAS, in issuing the special permit, the Village Board waived the requirements contained in Section 62-22.4(F), (G) and (N) of the Village Code pertaining to the project height, density and parking, so as to authorize building height, density and parking proposed by the Applicant as part of the project; and WHEREAS, the special permit issued on May 23, 2006 was based upon project plans that provided for a zero (0') foot setback along the front, rear and side yards of the Valley Street Parcel and did not provide a ten (10') foot landscape buffer, thus necessitating relief from the setback and buffer requirements set forth in Section 62-22.4 (J) of the Village Code; and WHEREAS, the Applicant applied to the Zoning Board of Appeals of the Village of Sleepy Hollow, which denied the requested area and buffer requirement variances; and 2476/19/305746 VI 9/14/06 �WHEREAS, the Village Board enacted Local Law No. 2 of 2006, v/hich amended Section 6222.4 (J) of the Village Code so as to allow the Village Board to waive the setback requirements contained therein; and WHEREAS, the Applicant has modified the project plans as presented on May 23, 2006, which plans now provide a ten (10') setback along the front yard; and WHEREAS, the Applicant thus seeks a minor modification of the special permit, so as to authorize plans that provide for a ten (10') foot front yard setback and zero (0') foot setbacks along the side and rear yards of the Valley Street Parcel upon development of the project; and WHEREAS, the Applicant thus seeks a minor modification of the special permit, so as to authorize plans that provide for a ten (10') foot front yard landscape buffer and zero (0') foot landscape buffer along the side and rear yards of the Valley Street Parcel upon development of the project; and WHEREAS, the Applicant has requested that the Village Board, under the provisions of Section 62-22.4(J) of the Village Code, grant a waiver from the setback and buffer requirements contained therein and modify the special permit issued on May 23, 2006; arid WHEREAS, the Village Board has duly considered this request and deems the modification a modest, and beneficial, adjustment; and WHEREAS, the Village Board has further concluded that the requested, waiver will not result in development that will adversely affect adjoining properties or the surrounding neighborhood; NOW, THEREFORE, BE IT RESOLVED, that the Village Board grants a waiver from Section 62-22.4(J) of the Village Code with respect to the project, so as to permit the setbacks and landscape buffers as depicted upon the plans dated July 10, 2006, last revised July 31, 2006, prepared by Kellard Engineering and Consulting, P.C. and to allow the development with a ten (10') foot front yard setback and landscape buffer and zero (0') foot setbacks and zero (0') foot landscape buffers along the side and rear yards of the Valley Street Parcel; and IT IS FURTHER RESOLVED, that the Village Board expressly finds that the development of the project, as depicted upon the aforementioned plans and subject to the waiver granted under Section 62-22.4(J), will not adversely affect properties adjoining the Valley Street Parcel or the surrounding neighborhood; and IT IS FURTHER RESOLVED, that the special permit granted under the May 23,2006 Resolution of the Village Board is modified so as (a) to include the waiver granted hereunder, (b) remove Condition"!" stated therein and (c) amend Condition "9" to reflect the waiver granted hereunder; and IT IS FURTHER RESOLVED, that all other terms of the May 23, 2006 special permit, except as modified herein, remain in effect. Seconded: Trustee Morales Vote: 6-0-1 �•7>^8 Meeting Date: 09/12/06 Resolution #: 09/185/06 RESOLUTION MODIFYING RESOLUTION NO. 06/120/06 AND AUTHORIZING THE EXECUTION OF LEGAL INSTRUMENTS RELATED TO THE DISPOSITION OF THE VILLAGE-OWNED 126 VALLEY STREET PARCEL WHEREAS, the Village Board of Trustees, by Resolution No. 06/120/06 adopted on June 27, 2006, authorized the disposition of Village-owned land located at 126 Valley Street and identified on the Village Tax Map as Section 16, Block 17, Lots 20-28 (the "Valley Street Parcel"); and WHEREAS, said Resolution was supported by a Negative Declaration issued by the Village Board of Trustees on May 23, 2006 under the provisions of the New York State Environmental Quality Review Act; and WHEREAS, pursuant to said Resolution, the Village Board of Trustees authorized the Village Mayor to execute an Agreement, in a form deemed acceptable to the Village Mayor and counsel, providing for the conveyance of the Valley Street Parcel for the purpose of the development of sixty-four (64) units of affordable senior housing thereon; and WHEREAS, the Village Board of Trustees desires to confirm that the authority granted to the Village Mayor under Resolution No. 06/120/06 extends to any and all other necessary and/or ancillary legal instruments related to said conveyance; it is now, therefore RESOLVED, that the Village Mayor or his designee (said designee being a Trustee of the Village of Sleepy Hollow) shall be and hereby is authorized to execute all legal instruments, in such form as deemed acceptable to the Village Mayor and Village Counsel, related to the conveyance of the Valley Street Parcel as provided for under Resolution No. 06/120/06 for the purpose of the development of sixty-four (64) units of affordable senior housing thereon; and IT IS FURTHER RESOLVED, that such authorization shall include, but not be limited to (a) execution of any and all documents as are required to close said conveyance, including, but not limited to, a Deed, the New York State Transfer Tax Return (TP-584) Form, the State of New York Board of Real Property Services Real Property Transfer Report (Form RP-5217), easements for parking, as well as any and all other documents and instruments deemed necessary or advisable to carry out and close the transaction concerning the Valley Street Parcel, and (2) take all such actions deemed necessary or advisable to carry out the purposes of Resolution I �No. 06/120/06 and the conveyance contemplated thereby, and the taking of any such action, the execution and delivery of any such document or instrument shall be conclusive evidence of its necessity or advisability; and IT IS FURTHER RESOLVED, that this Resolution shall take effect immediately.
