Present: Mayor Philip E. Zegarelli Deputy Mayor Mario DiFelice Richard Spota Andrew Murray Kay Grala Thomas Capossela Trustees Also Present: Dwight H. Douglas, Village Administrator Robert Ponzini, Village Counsel Joel Sachs, Special Counsel David Smith, Planning Consultant Steve Scalisi of STV, Traffic Consultant Sean McCarthy, Village Architect Diane Jacobsen, Treasurer Mayor Zegarelli opened the work session at 6 p.m., noting that representatives of Roseland Properties, the developers for the GM site, had been invited to attend and together with the village's consultants to review traffic impacts associated with the proposed development as described in the FEIS for the project. Over the next forty-five minutes tables, maps and charts were utilized to aid in discussion. Mayor Zegarelli called the board into special session at 7:20 p.m. to hold two public hearings. Trustee DiFelice read the attached legal notice dealing with proposed amendments to the sign ordinance into the record and Mayor Zegarelli opened the meeting for public comment. Two members of the public spoke: Don Caetano of Lawrence Avenue asked whether the revised sign ordinance would regulate trucks with signs and banners placed on them; Mario Belanich of North Washington Street questioned whether the public hearing had been properly publicized and whether it should be held at a work session. On a motion of Trustee DiFelice, seconded by Trustee Spota and carried unanimously the public hearing was held over to 7 p.m. at the next meeting of the board of trustees on January 16l , 2007. Trustee Spota then read the attached legal notice related to parking on Continental Street and Mayor Zegarelli opened the meeting for public comment; Trustee Spota noted that the public hearing was held in response to the public safety committee which was recommending the three parking spaces be eliminated to permit proper emergency vehicular access to that section of the village. Two persons: Rocco Minella of Pleasant Street and Bruno Volpacchio of Continental Street spoke in favor of just eliminating, or �properly signing to prevent parking "at the bend" on Continental street. On a motion of Trustee Spota, seconded by Trustee Capossela and carried unanimously the public hearing was adjourned until the January 16th, 2007, 7 p.m. meeting of the Board of Trustees. The attached Resolutions R-l and R-2 were acted on as noted. On a motion of Trustee Capossela, seconded by Trustee Grala and carried unanimously, a public hearing was set for January 23 rd , 2007 at 7 p.m. to hear public comment on the proposed adoption of the updated New York State Unifcnn Fire Prevention and Building Code. The attached letter from the Fire Wardens was read into the record. On a motion of Trustee Spota, seconded by Trustee Capossela and carried unanimously the actions of the Fire Wardens were confirmed. Trustee Spota noted the generous contributions by Sean and Martha Dugan of $200 each to the Fire, Ambulance and Police Departments. Mayor Zegarclli indicated that a thank you note would be prepared and sent in response. On a motion of Trustee Capossela, seconded by Trustee Grala and subject to the review and signoff of the subject Trustee subcommittee chairpersons and the further review and approval of the Mayor and Village Treasurer, the warrant of January 9 t h , 2007, together with any vouchers as consolidated in said warrant were approved by a vote of 6 to 0. On a motion of Trustee DiFelice, seconded by Trustee Mmray and carried unanimously the special meeting was adjourned at 7:52 p.m. Respectfully submitted, DwightTT Douglas Village Administrator % - �pl-i- i VILLAGE OF SLEEPY HOLLOW NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE that a public hearing will be held by the Board of Trustees of the Village of Sleepy Hollow on the 9th day of January, 2007 at 7:00 p.m. at Village Hall located at 28 Beekman Avenue, Sleepy Hollow, New York regarding the adoption of a proposed Local Law of the Village of Sleepy Hollow amending Chapter 46 of the General Code of the Village of Sleepy Hollow entitled "Signs". The purpose of this proposal local law will be to regulate the placement of Temporary Signs, to restrict their size to 1.5 sf per window and to prohibit them from being located on exit doors and on the exterior of buildings. Illuminated signs shall be restricted so that no more than one (1) illuminated (neon) sign may be placed in a storefront window, its maximum size shall not exceed 3 sf, it shall have an automatic timer shutting off illumination by midnight, and no illuminated sign may be placed in a residential district. Further, no illuminated sign shall be used as an outline to buildings, windows or doors. Sign on public property, shall, with the exception of any sign erected by the Village, Town, County State or other government authority, and all signs pertaining to traffic regulations and parking regulations, not, whether temporary or permanent, be located within or upon the right of way of any Village, Town, County, State road or highway or upon any village, Town, County, State or publicly owned land. Further, no utility pole or tree located in any public right of way or public easement shall be used for the posting of signs. The Superintendent of Public Works shall be authorized to remove any sign placed upon any property owned by the Village of Sleepy Hollow, including but not limited to highways, parks or other public lands. Signs shall be held for a period of not more than 72 hours from removal and if not claimed by the owner within that period of time, shall be disposed of by the Superintendent of Public Works. There shall be a fee of $20 per sign for any person or organization redeeming such illegal sign. A temporary sign permit shall be required for each political sign. A political party or candidate may obtain one (1) temporary permit for all signs, provided that the location of each sign is stated on the application. The fee for an individual temporary political sign permit shall be ten ($10) dollars, the maximum size of a political sign in a commercial district shall be 16 sf. The maximum size in a residential district shall be 3 sf. Political signs may be displayed for a maximum of thirty (30)days for each political campaign. Signs must be removed no later than ten (10) days after the election for political office is concluded. �£V D Awnings with graphics shall be limited to the business name and the property address. Telephone numbers, emails and the like shall be prohibited form all awnings. There shall be provisions for construction standards, design guidelines, and violations shall subject the owner of the sign and/or the owner of the land upon which such sign is placed to a fine of not less than $250. Each sign shall consist of a separate violation. PLEASE TAKE FURTHER NOTICE that the environmental significance of said proposed Local Law will be reviewed by the Board of Trustees, if appropriate, as incident to and as part of said public hearing. The Wardens were notified on December 11, 2006, by Pocantico Hook and Ladder Company No. 1, that Sean Brophy of Croton-on-Hudson, NY was transferred from the Associate to the Active Membership Roster. Sean, who is employed by the County of Westchester Department of Emergency Services as an Emergency Dispatcher has undergone a thorough background check. He is certified by the State of New York as a Firefighter and Emergency Medical Technician and is an active member of the Sleepy Hollow Ambulance Corps.
