Village of Sleepy Hollow
A special work session of the Board of Trustees of the Village of Sleepy Hollow was
held on Tuesday, May 8th, 2007 starting at 6:10 P.M. in the boardroom at Village Hall,
28 Beekman Avenue, Sleepy Hollow, New York.
Present:

David Smith, Planning Consultant
Craig Werle, Environmental Engineer
Mayor Zegarelli called the meeting to order. A follow up discussion of open issues from
the proposed Lighthouse Landing development was held, led by David Smith and Joel
Sachs. This was followed by a review of the proposed Brownfields cleanup, led by Craig
Werle.
At 8:55 p.m. on a motion of Trustee Wray, seconded by Trustee DeMilia and carried
unanimously the Board entered into executive session to review matters of contract
negotiation.
At 9:22 p.m. on a motion of Trustee DiFelice, seconded by Trustee Wray and carried
unanimously the board came out of executive session and into special session to act on
the Resolutions as attached.
At 9:30 p.m. on a motion of Trustee DiFelice, seconded by Trustee Morales and carried
unanimously the special meeting was adjourned.

Resolution of the Board of Trustees of the Village of Sleepy Hollow
Approving Payment of Carryover Vacation Pay
And Revising Board Policy
WHEREAS, the Mayor and Board of Trustees have received requests from several department
heads to carryover accrued vacation leave and/or to be paid out for some portion of said leave
through payroll in lieu of utilizing such leave requests attached hereto; and
WHEREAS, the Mayor and the Board of Trustees recognize that past policy has permitted the
pay out and carry over and accumulation of vacation leave from one year to the next for
Department Heads, but wishes now to modify said policy so as to eliminate potential future
village financial liabilities; and
WHEREAS, the Mayor and the Board of Trustees recognize the need to provide timely notice to
the Village Department Heads to fairly implement this new direction,
NOW, THEREFORE, BE IT R E S O L V E D that the attached vacation payout requests are
herein approved, and
BE I T FURTHER RESOLVED, that the attached vacation carryover requests are herein
approved, subject to limitations: all such carryover vacation must be utilized in the first quarter
of the 2007/2008 fiscal year or it will be considered forfeit; further during the 2007/2008 fiscal
year no carryover of vacation will be considered and all accrued vacation must be utilized within
the year it is earned, and
BE I T FURTHER RESOLVED, that the Vacation Policy contained in the Employee
Handbook of the Village of Sleepy Hollow as adopted on September 16, 20O3 is here in
amended to read:
Section Deleted: (For Department Heads Only: at the discretion and mutual agreement, of the
employee, Village Administrator and Board of Trustees, department heads may receive payment
for up to ten (10) days vacation in lieu of actual utilization of such vacation leave. "
"A maximum often (10) vacation days may be carried over from one (10 year to the next,
provided such carry over is approved by the Board of Trustees. Absent a request and approval
to cany over vacation days as above.. ")
Section Retained: "all vacation days must be utilized within the year for which they were
earned.".

have 10 days carried over into 2007/08, and utilize the remaining 10 days pursuant to the

Given the workload to move the GM project forward, I pushed this request back into August;
but if instructed, will use them up in April and May.
