It was moved by Trustee Schroedel, seconded by Trustee Wray at 5:40 p.m. to go into Executive Session; at 7:30 p.m. Trustee Grala moved, seconded by Trustee DeMilia-Powers to adjourn the Executive Session. Carried. At 7:35 p.m., the Mayor called the Board of Trustees into Regular Session. Present: Mayor Philip E. Zegarelli Kay Brown Grala Thomas Capossela Maria Rose DeMilia-Powers David Schroedel Karin Worn pa Kenneth Wray, Trustees Also Present: Anthony P. Giaccio, Administrator Diane Jacobson, Treasurer Robert Ponzini, Esq., Village Counsel Richard Gross, General Foreman Sean McCarthy, Building Inspector Mayor Zegarelli called the meeting to order with a prayer and pledge to the flag. Mayor Zegarelli called for a moment of silence for John Arcate a former Trustee of the Village who had also served as a member of the Zoning Board of Appeals for 17 years and 11 of those years as Chairman. We send our sympathies to the family and convey our best wishes. Public Hearing - The Mayor opened the public hearing and read the Notice of Public Hearing and indicated the Notice of Publication (attached hereto). He asked if anyone was present to address the Board on the matter. There were no comments from the public. Trustee Capossela moved and Trustee Schroedel seconded to close the public hearing. Carried: 7-0. The Mayor advised that the Board will not vote on the matter and will wait a couple of weeks in case someone did not get notice and wants to comment. Approval of Minutes Trustee Capossela moved, seconded by Trustee Grala, to approve the minutes of October 7, 2008, as submitted, subject to minor typographical errors and/or non-material changes. Carried 7-0. Trustee Wray moved, seconded by Trustee Schroedel to table the minutes of October 14, 2008 to receive further clarification. Carried: 7-0. Trustee Schroedel moved, seconded by Trustee Wray, to approve the minutes of October 21, 2008, as submitted, subject to minor typographical errors and/or non-material changes. Carried 7-0. Approval of Warrants Trustee Schroedel moved, seconded by Trustee Grala to approve Warrant 08OCT17U in the amount of $123,320.69. Carried: 7-0. Trustee Schroedel, seconded by Trustee Capossela to approve Warrant 08OCT23 in the amount of $525.00. Carried: 7-0. 1 �Trustee Schroede! moved, seconded by Trustee DeMilia-Powers to approve Warrant 08OCT28 in the amount of $160,463.61 but the Mayor will hold signing the check until the voucher for $309.00 is Reviewed and approved. Carried: 7-0. Mayor's Announcements Mayor Zegarelli introduced Peter Fiumefreddo who is the Commander of the Hawthorne Post 112 and State of New York Medal of Honor Chairman. Mr. Fiumefreddo presented to the Board a request to have the Westchester County Armed Forces Day Parade in Sleepy Hollow on Saturday, May 16, 2009, at 1:00 p.m. beginning on Beekman Avenue and ending at Horan's Landing on River Street with the laying of a wreath. He gave background on the Armed Forces Day Parade. The parade will include bands, Veterans of Foreign Wars, American Legion, Disabled Veterans, etc. His site committee would like to have a Village representative as part of its committee. Trustee Capossela advised that he would like to be a liaison between the Village Board and the Committee. Discussion ensued relating to the length of the parade and parade route. Trustee Capossela suggested to Mr. Fiumefreddo to get together with Anthony Giaccio and Chick Galella to ride the route to get an idea of how long a walk it is. The Mayor advised that Sleepy Hollow is a community that likes to host parades and feels that if leg work is done in advance he is sure it will be a great success. Mr. Fiumefreddo reminded the Board that relating to the parade that the basic shots will be called by the Board. It was agreed to go forward and meet as earlier suggested by Trustee Capossela. Public Comments Rachel Hansen and others presented to the Village Board, through the Village Clerk, petitions which had been circulated throughout the Webber Park area to ask for help in cleaning up the Douglas Park playground which is located at the end of New Broadway, (see attached) The Mayor thanked them for coming. The Mayor told them that over the last many months and almost a year at least, we have talked about finding the money from a capital project to redo the playground. He advised that they are thinking about moving the playground closer to the street. The Mayor advised that the park has not been condemned and in the past ten years new equipment has been installed. Issues are being addressed relating to the playground. Trustee Capossela advised that this matter was discussed in his committee meeting a couple of weeks ago and that the General Foreman has this on his radar. Trustee Schroedel advised that the Board is looking at breaking off the Parks people from the DPW to focus more on the Village parks. Margers Pinnis of 148 New Broadway addressed the Board reminding them that he had sent a letter to them relating to traffic problems on New Broadway. This was in reaction to a proposal to put stop signs on New Broadway. He feels that there are underlying problems to be addressed first. On the weekends there are a large number of individual cars and heavier truck and bus traffic and tractor trailers that mistakenly travel up New Broadway thinking they are continuing on Route 9. This has been a problem for many years. He would like to see minimal changes to the sidewalks and landscaping that could make that entrance much less inviting to people who are wanting to travel north on North Broadway. He thinks that before stop signs or speed bumps, work on the underlying problem. The Board may want to consider reducing the speed limit to 25 mph on that street. Mayor Zegarelli advised that in conjunction with the application of Grotto Plumbing, Mr. McCarthy has been sketching out some changes that will address your first part of the overall solution of getting that project done. He addressed the suggestion of reducing the speed on the street. Trustee Wray responded that some things Mr. Pinnis suggested or requested or would like to see have been discussed more than once including what the Mayor alluded to from Mr. McCarthy—essentially 2 �pushing out the sidewalk, putting in plants and making it much more obvious that you do not go straight ahead. Trustee Wray said that other members of the neighborhood have come to the Board to speak to them about the actual speeding on New Broadway. There is a real concern in addition to the people who get lost or who don't make the right turn that others who know exactly where they are going are speeding down the street and have requested that we do something about that. That is why he asked to have a public hearing on installing stop signs and speed bumps. Tonight well be setting a public hearing by resolution. He urged Mr. Pinnis and others to come to the public hearing and voice their opinions. The Board needs their input. Mr. Jeremy Zifchock of 15 Pine Street asked when was the last time a DOT traffic study was done? Trustee Capossela responded that about 3 years ago Chief Warren did do a speed study, he believes, basically in between Rice Avenue and Maple Street using a device like a cable that goes across the road that you run over and then as you run over it about 150 feet away it records the street. Chief reported back to them that he had his data showing that so many cars ran over the device and showed only a minor percent were speeding. Trustee Capossela agreed with Mark and Ken that speed is definitely an issue on New Broadway regardless of the study. They need to slow down the speeding on New Broadway as well as keep the trucks and 18 wheelers and buses from going down New Broadway. Trustee Wompa brought up that when people see the cable going across the road, they are going to slow down. Discussion ensued. Trustee Wray also responded that there are two different views that are not incompatible: those who are lost and then the people going too fast. Both need to be addressed. He asked Mr. Ponzini to clarify, but on a Village street, we can have a public hearing and install a stop sign and at the intersection of Route 9 it involves the state and there is a different process. One is quicker to do if we choose to do and the other involves approval beyond our level. Mr. Ponzini advised that we would need to contact the state DOT and tell them what we want to do and they will send a letter and sign off on it. On a Village road, just by Municipal Home Rule, you can adopt a local law and regulate it. Trustee Reports Trustee Schroedel reported that the Finance Committee met last week to discuss our current and future bond obligations in preparation for where we are going and a financial analysis of big projects coming up; the senior center, as well as GM and other potential expenses the Village is facing. We also continue to monitor the expenditures and revenue seems to be tracking last year's rate. In the second half of the fiscal year, tax revenues are likely to shrink and we may be looking to revisit our budget in three months. Trustee Capossela reminded that loose leaves can be placed at the curb for pick up. Clean up from last weekend's Nor'easter is on going. Reminder to all residents that any downed trees that fall on their property very well may have live power lines mixed in and to call Village Hall Monday through Friday; after hours call the Sleepy Hollow Police Department. Do not attempt to remove any downed trees before DPW personnel check it. Flooded roads may present unknown dangers; do not walk through or attempt to drive through flooded roadways-open manholes may exist. Tree trimming and removal is ongoing throughout the village. The stairway at the end of Millard that goes down to Philipse Manor train station is due to be re-open on Tuesday, November 4th. Additional work will continue but access will be open. On Election Day as well as Veteran's Day the DPW will not be working; will be on a holiday schedule for sanitation for the first two weeks of November. Trustee Capossela reported for the Recreation Department that the Haunted Hayride was last weekend. Unfortunately, had a rough night on Saturday and will get a full report back from the public and Finance 3 �Committee. The Lighthouse tours continue until Sunday, November 9 , and Mr. Capossela thanked Mr. Richard Miller for a fine job of tours. Trustee DeMilia-Powers reported that the Administration Committee met to discuss some personnel issues and to discuss the ongoing overhaul of the employee handbook. They will be meeting tomorrow evening with an outside HR company to overhaul the handbook which is definitely needed. Trustee DeMilia-Powers reported that Sean, Karin and she went to the recent senior meeting to present the plans for the senior center on Elm Street and talked to a lot of them. Ms. DeMilia-Powers reported that they had a good interchange between Sean's exhaustive knowledge of the process and Karin and her input into where going with the project and how fast. Trustee Grala reported that the senior housing ribbon cutting ceremony for tomorrow at 11:30 a.m. Trustee Grala reported that the Communications Committee continues to meet and upgrade the website and hopefully add more of the meetings on to the internet. Trustee Grala reported that Daphne asked her to remind the viewers that all cable digital boxes have volume control which usually comes to the home on a low level. The boxes go up to a minimum audio level of 30. Viewers should place their boxes to maximum audio levels and their television should be set just above mid-way. The audio will then be crystal clear and above satisfactory for all. Trustee Worn pa - no report. Trustee Wray reported that the Public Safety Committee met with Chief Warren on October 16th. They discussed preparations for Halloween for this Friday and the number of officers on duty and the assignments for various officers throughout the Village. Also discussed the shortage of police officers currently on the force and to make sure that the Clerk had requested the lists to look at interviewing new prospective candidates for vacancies and possible promotions in the department. Discussed some other personnel issues as well. Trustee Wray read letters from the Sleepy Hollow Ambulance Corps, (see attached). Administrator's Report Administrator Giaccio reported a meeting with the insurance company relating to Division Street working to recoup the losses. Mr. Giaccio reported he is working on dealing with the tree issue on Francis Street. The contractor has issues with the sidewalks as to whether or not to remove the two trees. The Tree Commission and DPW are trying to determine what to do. Chances are that may have to remove the trees. Discussion ensued. Mr. Giaccio advised that he attended the Haunted Hayride on Friday night and thought it was great. He thinks there are some areas to improve in the gymnasium. A financial statement is being prepared for the Finance Committee. He will also be making some recommendations for next year. Resolutions - See attached. Old Business - Trustee DeMilia-Powers brought up that she had asked Sean about Kendal Avenue Extension and its safety of being a one way street but everyone using it as a two-way street. She asked 4 �Sean that in his memo it says that the extension prohibited parking on the extension, but there are 5 spaces on that street. Mr. McCarthy advised that in 1971 the Board adopted parking. Trustee DeMiliaPowers advised that after that there never was anything to change that prohibition. Mr. McCarthy advised that he did not find anything to change that prohibition. Discussion ensued. Trustee DeMilia-Powers then addressed Mr. McCarthy about the Theresa Street question. From Mr. McCarthy's report there has been no request to close the road from the Chief of Police within the past 10 years. Attorney Ponzini advises that any road that is not closed for ten years would be dedicated by public use. Trustee DeMilia-Powers asked Attorney Ponzini how we get back the spaces back from the Van Tassel and he advised that we have them back. The Mayor asked Attorney Ponzini to draft a letter. Mayor's Report Mayor advised receipt of a bill from the Neighborhood House for $90.00 for flu shots which is our portion for our seniors. Diane Jacobson advised that we did not agree to that for last year; the seniors are covered by Medicare. The Mayor asked Trustee DeMilia-Powers to review. For the record, the Mayor advised that we are in receipt of the signed off application grant by Judge Herbert in the GM matter. New Business Trustee DeMilia-Powers brought up a letter from Joseph DePalma wherein he advised that he hit a curb on Beekman Avenue across from Village Hall where the tree roots and curb stick out and damaged his tires. He is looking to be reimbursed. This incident occurred in February of this year. Trustee DeMiliaPowers asked what the policy is on this kind of incident. Discussion ensued. Mr. McCarthy was asked to find out when the parking space was changed to a fire zone/no parking area. Communications, Petitions & Request Village Clerk advised that there will be a Phelps Memorial Blood Drive on Saturday, November 8th, between 9 a.m. and 2 p.m. in Village Hall sponsored by the Fire Department and Village Hall. Public Comment Mr. Margers Pinnis of 148 New Broadway advised that in Douglas Park there is a large tree blocking one of the paths. It is the path that leads down the hill and parallels the Pocantico River. Richard Gross has been asked to check into the situation. Moved by Trustee Wray to adjourn, seconded by Trustee Schroedel. The petition was inspired by a visit to the new Barnhart Park, last week. While I was there, with my children and Mends, I watched employees inspecting the equipment for flaws. Impressed by this, I asked them who oversees the care of Douglas Park. And, they said. "We do". Anyone who visits Douglas Park will find obvious Neglect of the equipment. Defining Neglect: Exposed nails Broken wood surfaces Slippery mildew on wood and plastic surfaces Carpenter bees nesting in the wood of the playground equipment Poison ivy Glass This has led to disuse by most of the Webber park residents with children. More than one person, who I spoke with, actually thought the playground was condemned. When we do visit the park we find teenagers smoking and drinking with beer bottles littered in the sand, sad that they have to cut their party short. With a rumor of being "Condemned", the village should consider either restoring the playground or removing it before one of our children becomes injured and a lawsuit surfaces. A real lawsuit would cost the village, and the confidence of the village government could be in question. An answer to the neglect would be to address the issue of making the playground safe. I would like to personally, and behalf of the Webber park residents, ask the Board members to consider this park and make it part of their 2009 budget for clean up. �from the Historic Sleepy Hollow Websites The Sleepy Hollow Recreation & Parks Department The Sleepy Hollow Recreation and Parks Department provides quality and diverse recreational programming for all ages - from tots to seniors. The Department serves Sleepy Hollow and Tarrytown, combining much of our sports programming to serve our common school district. The Village is currently completing Sleepy Hollow Landing, the Village's only riverfront park, located at the foot of Beekman Avenue, and completing a major renovation of Barnhart Park. On or before the annual organization of the Village Board of Trustees, the Village Administrator shall compile a list of all vehicles owned by the Village, including but not limited to the make, model and mileage of the vehicle, the department and person to whom it is assigned, whether owned or leased, and if leased, the termination date thereof, and the municipal purpose for which the vehicle is assigned. In addition, the Village Administrator, concurrent with his compilation of vehicles owned by the Village, shall prepare a list of employees, by name, position and department, who are entitled to mileage reimbursement in lieu of assignment of a motor vehicle by the Village. Upon receipt of this outstanding list of vehicles and employees entitled to reimbursement, the Village Board of Trustees, no later that the last meeting of the month following the annual organization meeting, shall audit and approve such list. It is further stated that initially, the only employees who shall be provided a vehicle owned by the Village shall be the Chief of Police, the Building Inspector, the General Foreman of Public Works, and any employees granted a vehicle as part of an employment contract. Upon expiration of the current term of said contract(s), however, such provision will be deemed terminated. Such vehicles are provided to the aforementioned department heads for the execution of their official responsibilities, as a discretionary benefit and not to be considered entitlements or a condition of employment. All vehicles, with the exception of the Chief of Police and unmarked police vehicles, will have identifying lettering on doors for Village of Sleepy Hollow and said Department. All employees granted vehicles stated in this section will be required to submit a monthly mileage report to the Village Administrator. The Sleepy Hollow Volunteer Ambulance Corps shall be provided with a vehicle for the Captain and at least one BLS fly car, all of which are governed by the New York State Vehicle and Traffic Law Section 115-c and Section 1104 (attached hereto as Attachment A). The Captain's vehicle is assigned to the Captain for his/her complete term; the assigned vehicle is the property of the Village of Sleepy Hollow and in no way shall be considered a personal vehicle; the assigned vehicle may only be used in accordance with the New York State Vehicle and Traffic Law Section Section 1104. The BLS fly car(s), when not in use, shall be parked at the Sleepy Hollow Ambulance Corps. Building. The BLS fly car(s) will only be operated in the Village of Sleepy Hollow, the Village of Tarrytown, the Village of Elmsford, the Hamlet of Pocantico Hills, or the District of Archville unless otherwise authorized by the Captain. With respect to those employees who are permitted reimbursement for mileage, it shall be their responsibility to record their activities in a daily diary that shall be submitted to the respective Department Head, with the appropriate voucher, on a weekly basis for approval. Failure to do so in a timely manner is subject to review by the employee's respective Department Head, and if need be, by the Mayor and Board of Trustees. All employees utilizing Village vehicles will be issued an annual tax report to be filed with their tax return. NOW, THEREFORE, BE IT RESOLVED, that Sleepy Hollow calls for a public hearing on Tuesday, November 18, 2008, at 7:00 p.m. to consider a local law to amend Chapter 57-5 of its General Code entitled "Vehicle and Traffic" to permit the erection of stops signs at each and every corner of the intersection of New Broadway and Maple Street.
