Present: Mayor Philip E. Zegarelli Kay Brown Grala, Deputy Mayor Thomas Capossela Maria Rose DeMilia-Powers David Schroedel Karin Worn pa Kenneth Wray, Trustees Also Present: Anthony P. Giaccio, Administrator Diane Jacobson, Treasurer Sean McCarthy, Building Inspector Chief Jimmy Warren, P.D. Mayor Zegarelli called the meeting to order with a prayer and pledge to the flag. Mayor called for a moment of silence in memory of all Veterans. Mayor announced the informational hearing tonight, as a result of other meetings in the past regarding safety road issues in the New Broadway area. Trustee Wray addressed the Mayor and the public regarding the traffic concerns on New Broadway. Trustee Wray explained that there were plans in the past and that the Village did a study on this issue. Trustee Wray explained that a discussion was ensued about installing stop signs at every corner or some of the corners. Also, installing speed bumps was discussed as well as lowering the speed to 25 mph. Some Board members have also been told that there are already too many regulations on New Broadway and that they prefer no more changes. Trustee Wray announced that he is in favor of lowering the speed limit. Public Comments: Donna Gates of 53 New Broadway, Sleepy Hollow, NY, addressed the Mayor and the Board of Trustees and informed that she has lived on New Broadway for five years and that there is too little regulation on New Broadway and she is in favor of all of the above. Mrs. Gates mentioned that the speed limit needs to be lowered and that stop signs need to be put up and speed bumps installed as well. Mrs. Gates mentioned that there are too many children and elderly people on New Broadway and that she would like to see something done the sooner the better. Jennifer Lovado of New Broadway addressed the Mayor and the Board of Trustees suggesting changing the flow of traffic at the entrance of New Broadway. She also questioned why nothing has been done about this issue since this has been a problem for several years. Ms. Baiba Pinnis of 148 New Broadway, Sleepy Hollow, addressed the Mayor and the Board of Trustees. Ms. Pinnis read a letter regarding the concerns on New Broadway; please see attached. l �Don Caetano of Lawrence Avenue, Sleepy Hollow, NY addressed the Mayor and the Board of Trustees and suggested that the Chief of Police be informed of local speeders and it should be up to the Police Chief to control the traffic. He also suggested that Route 9 should be fixed to redirect traffic. David Bedel of 122 Van Tassel Avenue addressed the Mayor and the Board of Trustees and suggested that the intersection of Route 9 and New Broadway should be closed and speed limit should be reduced to 25 mph. Sonia Monroe of 63 New Broadway addressed the Mayor, the Board of Trustees and a local resident who asked when the study of New Broadway was conducted and why it was not pursued at the time. Ms. Monroe explained that the study of New Broadway was done in 1998 by several Board Members, the Chief of Police and by the DOT and that this was intensely and very considered, and a report was laid out with different options, and then it just went dead. Ms. Monroe suggested ticketing speeders on New Broadway. Mayor responded and discussion ensued. A resident of 15 Pine Street, Sleepy Hollow, NY addressed the Mayor and the Board of Trustees. He supports changing the layout of New Broadway to minimize traffic, and also suggested that law enforcement presence will help as well. Mayor responded and discussion ensued. Trustee Wompa asked Chief Warren what kind of traffic study was done on-New Broadway. Chief Warren responded and recommended that a traffic expert is best to analyze the situation. Chief Warren also suggested decreasing the speed limit to the minimum of 25 mph, and installing speed humps which are more effective then stop signs. Mr. Frank Rey of Sleepy Hollow, NY addressed the Mayor and the Board of Trustees and suggested that the speed limit of New Broadway be reduced to 25 mph. He also suggested that an architectural rendition be done to show that the entrance to New Broadway is a residential area. Donna Gates of 53 New Broadway, Sleepy Hollow, NY addressed the Mayor and the Board of Trustees again, and asked the Chief of Police to have more Police present on this street "New Broadway" since this issue will take a while to get resolved. Trustee Wray suggested to Chief Warren to ask the Mayor to make this "New Broadway" a targeted enforcement area. Trustee Capossela suggested making New Broadway a one way street, going south, and this would avoid trailers, buses and speeders. However this would cause more traffic on Gordon Avenue. Discussion ensued. 2 �Mario Belanich from North Washington Street, Sleepy Hollow, NY addressed the Mayor and the Board of Trustees and suggested the installation of two signs at the entrance of New Broadway, reading "residential area" and "dead end". Jennifer Lovado, of New Broadway, Sleepy Hollow, NY addressed the Mayor and the Board of Trustees and volunteer herself to become the spokesperson of the neighborhood and to communicate with the Board regarding the traffic issue on New Broadway. Mayor asked that all suggestions and ideas should be submitted to the Board of Trustees or the Police committee. Discussion ensued. A resident of New Broadway, Sleepy Hollow, NY addressed the Mayor and the Board of Trustees and explained that she's lived at the end of New Broadway for 13 years and that cars always get stuck in front of or on her property. She suggested that the problem to be addressed is at the entrance of New Broadway. Trustee Schroedel questioned if any consideration has been given for a small island at the entrance of New Broadway. Mayor responded and discussion ensued. Don Cateano of Lawrence Avenue, Sleepy Hollow, NY addressed the Mayor and the Board of Trustees and suggested that flashing traffic lights be installed at the entrance of New Broadway. Trustee Wray asked if Sean McCarthy, Village Architect, could have drawing ideas on the Villages' website for the residents to have a look at it. Trustee DeMilia-Powers suggested that road reflectors should be considered for the traffic problem on New Broadway. Mayor announced that a brief work session on December 23rd to discuss snow emergencies will take place and the next Board of Trustees meeting will be on December 30th and then called for brief recess. Approval of MinutesTrustee Wray moved, seconded by Trustee Capossela, to approve the minutes of November 25, 2008, as submitted, subject to minor typographical errors and/or non-material changes. Carried 7-0. Approval of Warrants Trustee Schroedel moved, seconded by Trustee DeMilia-Powers to approve Warrant 08NOV21 in the amount of $138,760.93; Warrant 08DEC05 in the amount of $674.00; Warrant 08DEC09 in the amount of $311,414.76; Warrant 08DEC09U in the amount of $11,044.18 and Warrant of 08DEC09R in the amount of $350.00. Carried: 7-0. 3 �Mayor announcements and introductions Ms. Judith Giordano of 89 New Broadway announced that as of December 4th, 2008 there is a Lion's Club of 23 members in Sleepy Hollow. Ms. Giordano announced that a toy drive by the Lion's Club has been put together for the holidays, and asked for cooperation. The drop off location is at the Mahopac Bank and asked if there could also be a drop off location at Village Hall. This information will be posted on the Village's website. Public Comments Roseanna Martinez, vice president of the tenants association of 100 College Avenue, College Arms, expressed concern regarding the increase in rents and explained to the Mayor and the Board of Trustees that she feels the Mayor and the Board "had something to do with it". The Mayor explained again to Ms. Martinez, that the Mayor and the Board of Trustees only negotiated the PILOT program with the new owners of 100 College Avenue, and that the Mayor and the Board of Trustees had no ability, knowledge, jurisdiction or influence in determining any rent increases. Discussion ensued at this time with Ms. Martinez. Trustee Schroedel suggested reviewing the minutes of April 8th, 2008, and see if the new owners misrepresented themselves in any way. Trustee Wray explained about the landlord and tenant court, and suggested that Ms. Martinez look into it. He also explained about the ETPA guidelines, leases and evictions. Ms. Giordano of 89 New Broadway, Sleepy Hollow, NY suggested that Ms. Martinez should call the State Attorney General's office. Don Cateano of Lawrence Avenue, Sleepy Hollow, NY questioned the Mayor regarding the PILOT'S calculations for 100 College Avenue. Mayor responded and discussion ensued. Mr. Mario Belanich of North Washington Street, Sleepy Hollow, NY addressed the Mayor and the Board of Trustees. Mr. Belanich complained that Trustees should not leave the board room while meeting is in session. Mr. Belanich questioned why one of the resolutions was not in the package regarding a staff members' salary increase, and he suggested that no one should get salary increases at this time. Mayor responded and explained that this resolution will be discussed in executive session per Trustee's request. Frank Rey, from the Sleepy Hollow Auxiliary Police, asked the Mayor and the Board for an appointment with the Public safety Committee. Don Cateano of Lawrence Avenue, Sleepy Hollow, NY, addressed the Mayor and the Board of Trustees and suggested that Village employees should not get any raises and suggested that the Village run a tight budget. 4 �Mr. Cateano asked who is going to pay for the electric bill for the Christmas Lights on Valley Street. He suggested that the Police Department be involved. Trustees Reports Trustee Schroedel moved to go into executive session at 8:40 p.m. seconded by Trustee Grala. At 9 p.m. Trustee Wray moved to end executive session, seconded by Trustee DeMilia-Powers. Trustee Schroedel reported that the Village is maintaining the budget that was asked of the Village Treasurer and Village Administrator. Trustee Schroedel reported that resolution 8 will be revisited in the future. Trustee Capossela read DPW and Recreation Reports. (Please see attached) Trustee DeMilia-Powers announced that the annual Seniors Christmas luncheon party on December 17th will be at Tappan Hill Restaurant in Tarrytown. Trustee DeMilia-Powers also announced the pre-bid meeting for senior building project, and that about 30 plans had been picked up by contractors. Trustee DeMilia-Powers announced that the first half of the telephone audit is completed. Trustee Grala reported that the server for the website is not working. Trustee Wompa- nothing to report Trustee Wray-reported that several candidates have been interviewed and are being considered for the Police Officer positions. Resolutions - See attached. Mayor announced that the County will send out notices to everyone who will have a change in voting district. Old Business Trustee Capossela suggested that one of the DPW workers be transferred back to the Recreation Department since that is the where he works most. Trustee Capossela also questioned the Halloween tee-shirt sales. Trustee Schroedel asked that the Clerk's Office provide a copy of the approved agendas and the minutes to Zoning, Planning and Architectural Review Board Chairs. Trustee Schroedel stated that a letter has been received from National Resources, and asked Mr. Smith to explain what the next step is that the Board should take to move "this" along. 5 �Mayor announced that he acknowledged receipts of all communication of all National Resources correspondence for the record. Mr. David Smith responded and discussion ensued, regarding the receipt of this application and how to proceed. Announcements Deputy Village Clerk announced that the Village Clerk's office received a renewal for beer license only for 166 Cortlandt Street, GLE Chester Fried chicken Restaurant. Mayor's Report - Mayor announced turn off notices by Con Edison at 171 N. Washington St., 146 & 148 Cortlandt St., and 249 North Broadway. Mayor announced and read all letters from the Sleepy Hollow Volunteer Fire Department, regarding change in personnel and also the resignation letters of Paul Capello and Miguel Valle. (See attached) Mayor read letter of resignation from Miguel Valle as First Lieutenant of the Sleepy Hollow Ambulance Corp. Marine 7 has served this Department and Village well for a number of years. However, the boat is now increasingly in need of more expensive repairs on a regular basis. If that is not part of the public record, please let Margers know so he can follow up with another letter and e-mail. Since I have lived at 148 New Broadway, the issue of speeding traffic, property damage, and potential serious damage to pedestrians has not been resolved. Ineffective signs posted at the entrance to New Broadway have not resolved the issue. In all due respect to my neighbors, a nuisance STOP sign would only be another ineffective bandaid. A lost motorist might slow down at the STOP sign, but will possibly drive full speed ahead until he/she is forced to put on the brakes at the entrance of Douglas Park. Out of frustration, an occasional motorist can cause property damage to cars on New Broadway while turning his card around. One time we were out $2,000 for property damaged caused by an errant driver. At another time, the beautiful gates to the park were severely damaged. The issue of lost motorists should be resolved at the entrance of New Broadway, not when a driver with a tractor/trailer is already on New Broadway. I strongly support the following measure: Extending the curbs into from both the Hennesy House and Grotto Plumbing to send a clear signal that New Broadway is not a continuation of North Broadway - Route 9 A sign "Welcome to Webber Park," similar to the entrance of Sleepy Hollow and Philipse Manors Clear differentiation should be made at Bedford Avenue close to the diner between New Broadway and North Broadway - Rt. 9. Any signs at the entrance of New Broadway are not effective, because the car/tractor trailer is already on New Broadway. Again, I reiterate, any signs should read "North Broadway" not just Rt. 9. A sign could also point at the direction of Ossining, because one of the most frequently asked questions at the end of New Broadway is: "How do I get to Ossining?" To eliminate excess speed, the speed limit in Webber Park should be reduced to 25. One night I was driving home in a taxi, and I felt the speed was excessive. He was driving right at the speed limit of 30. I grew up in Detroit, Michigan where the residential speed limit was 25. I realize that local residents are also part of the speeding problem. Thankyou Mark for the follow up. I am very strongly opposed to any stop sign and /or speed bump erection. Most importantly such erection does ignore the problem of errant traffic on New Broadway. "Errant" traffic needs to be eliminated, not slowed down at a newly erected stop sign and/or at a speed bump. It is exactly that..."errant"... and this "errant" traffic got onto New Broadway by at problem at the entrance to New Broadway; they are not "errant" because they are doing something wrong while on New Broadway. They need to be diverted from enterinig New Broadway in the first place., which is why we are not fixing the problem with a stop sign for them while they are already on New Broadway! This ignores and now irritates residents even further. The "errent" traffic is still proceeding up New Broadway because of a problem at the source...the entrance way onto New Broadway. Sometimes the same thing has to be repeated over and over for us to get the conceptual framework to understand the problem. The original problem will continue to exist and the "errant" traffic will continue to flow on New Broadway. A stop sign/speed bump has ABSOLUTLELY NOTHING TO DO WITH GETTING THE ERRANT CARS OFF NEW BROADWAY IN THE FIRST PLACE. IT I ONLY SERVES TO MAKE US FEEL LIKE WE'VE DONE SOMETHING, AS IT'S EASY TO STICK UP A STOP SIGN AND USE THIS AS A PLAN , EVEN TO START. NOW WE DIVERT FROM THE REAL PROBLEM WHICH IS AT THE ENTRANCE ONTO NEW BROADWAY. THIS ENTRANCE IS THE SOURCE OF THE PROBLEM. Even the trafcstydy done by Chief Warren showed an insignificant number of speeding cars, hence no need for a stop sign/^^d*>ump to slow them down. A speed limit of 30 IS essentially SPEEDING DOWN NEW BROADWAY, since#s,a residential side street with lots of children and pets and comes to an end at the park. The SPEED LIMIT NEEDS TO BE REDUCED TO 25 MPH so cars are going slower and have less distance to travel in coming to a halt for a pedestrian and to reduce the noise and wizzing by. I can't imagine the still "errant" traffic plus the residential car and truck brakes coming to a new stop and then the aceleration all over again and the accompanying car fumes a new stop sign and or speed bump causes. And again this is not a solution because it has nothing to do with the problem. NOW YOU ARE JUST MANIPULATING THE ERRANT CARS/TRUCKS/TRACTOR TRAILERS ALREADY ON NEW BROADWAY. I live with the very frequent car turing arounds, skinning the sides of our fives cars over the years, besides jumping up out of bed to see if the truck or car has actually hit my car, my neighbor's car or taken down the park gate once again and if anyone has been hit. NOW, THEREFORE, BE IT RESOLVED that Sleepy Hollow hereby adopts and approves this local law amending Chapter 36 of the General Code entitled "Noise"; and BE IT FURTHER RESOLVED that this local law shall take effect upon filing with the Secretary of State. Full reimbursement of the amount spent has been received from the New York State Archives. NOW, THEREFORE, BE IT RESOLVED that the Village Board of Trustees hereby awards Stiloski Automotive the towing license for the period of January 1, 2009 to December 31, 2009. For Telecommunications Analysis and Inventory Report WHEREAS, on November 18, 2008, the Board of Trustees accepted the proposal of IP Telecom Group, Inc. for a Telecommunications Analysis and Inventory Report at a cost of $5,700.00 and authorized the Mayor to sign said proposal; and WHEREAS, the Treasurer, Diane Jacobson, was able to reduce the cost of the proposal to $4,845.00 and has requested that an amended Resolution be approved for record keeping purposes. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Board of Trustees of the Village of Sleepy Hollow accept the amended proposal of IP Telecom Group, Inc. for a Telecommunications Analysis and Inventory Report at a cost of $4,845.00. NOW, THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby confirm the Mayor's appointment extension of Giorgio Cicciarella of 71 New Broadway, Sleepy Hollow, New York as a temporary part time laborer in the Public Works Department to work Monday through Friday at an hourly salary of $15.00 effective January 1, 2009 through March 31, 2009, not to exceed 25 hours per week.
