Now therefore be it resolved - that the Village of Sleepy Hollow engages Community Media to produce public access broadcasts according to the attached agreement and authorizes the payment of five thousand dollars {$5,000} to Community Media as an initial installment on the work described. Be it further resolved that Community Media is eligible for an additional four thousand nine hundred dollars ($4,900) upon successful review of its work after December 1, 2009. Moved: Trustee Stupe! Seconded: Trustee Schroedel Carried: 6-0 �Sleepy Hollow Government Access and Public Access (Community Media) TV Community Media agrees to provide the village of Sleepy Hollow with public access coverage of the following events during the 2009-2010 fiscal year. In general, events sponsored by the village of Sleepy Hollow are the responsibility of the government access producer. Other events or events of interest to both Tarrytown and Sleepy Hollow are the responsibility of the public access producer. "Coverage" means producing, shooting, editing and delivering a finished video in an agreed upon format within two (2) weeks following the event Timing of the finished video may be adjusted by the Village Administrator. Community Media may substitute events as the need arises with the approval of the Village Administrator. Community Media further agrees to work cooperatively with the producer of the Village government access channel to jointly cover indicated (*) events. A "lead producer" is designated for each of these events. The lead producer is responsible for producing the event (deciding how, where and when resources will be used to shoot the event), editing the event and delivering the finished video for air. The lead producer will be given all video shot of the event. For compensation purposes, such joint projects will count as an "event" for both producers even though there will only be one finished product. The project, assigned PIN number 8780.27 by the Department of Transportation, includes curbing, sidewalks, street trees, drainage improvements, street lighting and signage on Broadway (Route 9) between Route 119 and Route 117; and WHEREAS, an Intermunicipal Agreement (IMA) has been executed between the Villages of Tarrytown and Sleepy Hollow which calls for the sharing of certain costs, including the required match, on a pro rata basis; and WHEREAS, the funding under Title 23 U.S. Code, as amended, calls for the costs of the program to be borne at the ratio of 80% Federal funds and 20% non-federal funds, and the Village commits to pay 100% of the non-federal share, together with the Village of Tarrytown as specified in the IMA; and WHEREAS, the agreement covering preliminary engineering and right-of-way incidental work is ready for execution, whereunder the Village of Sleepy Hollow is required to pay all preliminary engineering and right-of-way work expenses up front and then apply to the Department of Transportation for reimbursement of the 80% to be covered by the grant. NOW, THEREFORE, BE IT RESOLVED that the Village of Sleepy Hollow hereby approves the above project; and recognizes that the Transportation Enhancement Program grant is a reimbursement grant requiring the Village of Sleepy Hollow to pay 100% of the federal and matching share of the cost of preliminary engineering and right-of-way incidental work for the project prior to submitting a request for reimbursement of 80% from the Department of Transportation, as appropriated from the Village's capital budget under resolution number 06/131/09 for bond resolution dated June 23, 2009; and �BE IT FURTHER RESOLVED that in the event the full federal and non-federal share costs of the project exceed $111,604, the Village of Sleepy Hollow shall convene as soon as possible to appropriate said excess amount upon notification by the Village of Sleepy Hoiiow thereof; and BE IT FURTHER RESOLVED that Ken Wray, the Mayor of the Village of Sleepy Hollow, is hereby authorized to execute this preliminary engineering Standard Federal Aid Highway and Marchiselli Aid Project Agreement with the New York State Department of Transportation, and all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or applicable Marchiselli Aid on behalf of the Village of Sleepy Hollow with the New York State Department of Transportation in connection with the advancement, approval and administration of the Project; and BE IT FURTHER RESOLVED that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project; and BE IT FURTHER RESOLVED that this resolution shall take effect immediately.
