Present: Mayor Kenneth G. Wray Thomas Capossela, Deputy Mayor Karin Wompa Evelyn Stupel David Schroedel Barbara Carr, Trustees Absent: Bruce Campbell, Trustee Also Present: Anthony P. Giaccio, Administrator Diane Jacobson, Treasurer Sean McCarthy, Building Inspector Janet Gandolfo, Esq., Village Counsel Paula A. McCarthy, Village, Clerk Richard Gross, Village General Foreman At 7:05 p.m., the Mayor called the meeting to order with a pledge to the flag. Public Hearing for Senior Exemption The Mayor opened the public hearing. Fred Gross summarized the proposed senior homeowner tax exemption. This Resolution provides special real estate exemptions for seniors that can prove their annual income is less than $36,000. He also explained that it would be a 50% exemption for Village taxes. He stated that the applicant must prove that they meet the income limits with their application. Don Cateano of Lawrence Ave asked if the income requirements include all incomes. There was an open discussion. Since there were no further public comments, Trustee Carr made a motion to close the public hearing. Trustee Schroedel seconded. It was unanimous (5-0). Approval of Warrants Trustee Carr moved, seconded by Trustee Capossela, to approve the Warrants. It was unanimous (5-0). Mayors Announcements Mayor Wray stated that Trustee Campbell is ill and wished him a speedy recovery. �Mayor Wray announced that a meeting was held last Thursday with the NYSDEC in Albany. The Village has requested that the DEC meet again with the Village on Oct 21, 2009. He encouraged all residents to attend the meeting. Public Comments Irene Amato asked when the Senior Center would be completed. She stated that the residents have waited long enough. Mayor Wray responded that the plans for the next phase are almost completed. He stated that it has taken longer than they intended. Sean McCarthy responded that the next phase of the project includes all of the interior work as well as some landscaping. He stated that the plans would be ready for November and then it would take 4 months to get a contract in place to do the work. Don Cateano asked if he could supply the trees and shrubs. Sean McCarthy responded yes. Armando (Chick) Galleta requested that the Trustees call a special meeting when the bids come in. A member of the public questioned why the Village has over $250,000 in uncollected traffic fines. Trustee Schroedel responded that the Trustees are aware of the matter and are going after the monies. Kate Camalieri of 60 Pocantico Street stated that the house on the corner of Washington Street and Pocantico Street has garbage all over the place. Sean McCarthy responded that a summons was issued by the Village Police. Paul Wichmann of 23 Fremont Road asked about the tax break for seniors. Mayor Wray explained the tax break. Don Cateano asked about the Village prosecutor's qualifications. Janet Gandolfo responded that the individual must be licensed to practice law in the court. Armando (Chick) Galetta asked if a Code Enforcement Officer or Plumbing Inspector have been appointed yet. Trustee Stupel responded that the Trustees have revamped the Village Code and will have a Code Enforcement Officer by the end of the month. Mr. Kaviki asked if the Kendal Ave extension could be a two-way extension. Mayor Wray explained that this would need a public hearing. Trustee Carr responded that some of the Trustees have looked into it and it would result in some lost parking spaces. It was agreed that a public hearing would be scheduled to discuss making the Kendal Avenue extension a two-way extension. �Trustee Reports Trustee Schroedel stated that all Village fines have been increased and that the Trustees are committed to improving the resident's quality of life. He also stated that the Public Safety Committee reviewed the police support for Halloween. He also stated that there was a meeting with the Sleepy Hollow Manor Association. Trustee Carr stated that 2 Silver Oak trees were cut down in Douglas Park. She wanted to know who cut them down. Trustee Capossela read the DPW report and the Recreation report. Trustee Wompa stated that there is an upcoming meeting of the Environmental Advisory Committee. She stated that the committee will have 7 people on it and anyone can join. She also stated that the purchasing agent position has been referred to the Administrative Committee. Trustee Stupel stated that the Code Enforcement position has been submitted. Administrator's Report Mr. Giaccio gave his report (see attached). Resolutions See attached. Old Business Trustee Carr suggested that New Broadway Island construction begin on November 1, 2009. New Business Mayor Wray stated that there is a block party on October 30 from 4pm to 6pm. He stated that flyers will be distributed and the vendors will be kid friendly. Public Comments Mayor Wray stated that tree cutting regulations will be discussed at the next work session. He stated that penults will not be issued for tree cutting unless it's a safety hazard. Don Cateano of Lawrence Ave stated that they cut down the wrong trees. He stated that the Village is neglecting to take proper action. Mr. Kavicki asked why residents have to pay for appliance pick-up. Mayor Wray explained the reasons for the fees. �Mario Bellanich of Washington Street also talked about appliance pick-up fees. Trustee Schroedel responded that the fees and expenses are related to the garbage pick-up. There was an open discussion on the appliance pick-up fees. Mayor Wray explained how the Village is charged to pick-up garbage. Armando (Chick) Galetta stated that Frank Chevrolet went out of business. He stated that it is a day in Sleepy Hollow history. McCarthy Village Clerk AD/pm �Meeting Date: Resolution #: 10/13/09 10/182/09 Resolution of the Mayor and Board of Trustees of the Village of Sleepy Hollow Adopting Native Plant Policies WHEREAS, The Village of Sleepy Hollow has the opportunity to promote sustainable landscapes by choosing native plants, and WHEREAS, invasive, non-native plants are one of the greatest threats to the natural ecosystems and the natural heritage of Sleepy Hollow and New York State; and WHEREAS, invasive, non-native plants are destroying our natural history and identity, disrupting the ecology of our natural ecosystems, displacing native plant and animal species, and degrading our unique and diverse biological resources; and WHEREAS, native plants enhance the beauty of the landscape, maintain and restore biodiversity, minimize maintenance costs and the need for chemical applications, prevent invasive exotic plants from taking root, provide habitat for native organisms, attract native pollinators, butterflies, and birds, and protect local ecosystems and environmental health; and WHEREAS, native plants enrich soil by helping rain to percolate into the soil through their root systems, thereby reducing erosion and water irrigation requirements andfilteringstorm water runoff, which, in turn, improves water quality; and �WHEREAS, native plants have historical and cultural interest that help promote Sleepy Hollow's regional identity; and NOW, THEREFORE BE IT RESOLVED that the Mayor and Board of Trustees of the Village of Sleepy Hollow adopt the following policies related to native plants: 1. Plant materials native to Sleepy Hollow shall be used exclusively in designing, planting, maintaining and managing the landscape features of all Village roadsides, parks, public areas and other Village properties and facilities; unless no native plant fits the ecological niche, in which case, plants which are non-invasive and beneficial to wildlife shall be used in place of native plants. 2. Plans and specifications for any Village of Sleepy Hollow contract involving landscaping and/or plantings shall, where practicable and appropriate, require the use of native plants. 3. Installation of plant species noted in the New York State Top 20 Invasive Species by the Invasive Plant Council of New York shall be prohibited in all Village parks and on all other Village lands, along Village roadsides, and in gardens surrounding Village buildings, and, where possible, these species shall be eradicated from Village parks and other lands, as well as along Village roadsides and in gardens surrounding Village buildings. 4. Site design and construction as well as plant selection shall incorporate considerations such as biological needs, low maintenance, low water usage, character of plant communities at project sites, and minimal need for fertilizers and pesticides. 5. The public shall, through various means, be educated about the importance of native plants to the Village of Sleepy Hollow landscape. �6. BE IT FURTHER RESOLVED that there will be an 18 month probationary period for this position during which time Mr. Tompkins will receive 85% of his annual salary. Moved: Trustee Carr Seconded: Trustee Schroedel Absent: Trustee Campbell Vote: Carried 5-0 �Meeting Date: Resolution No: 10/13/09 10/185/09 Resolution of the Mayor and Board of Trustees of the Village of Sleepy Hollow Adopting Tax Exemption for Senior Citizens WHEREAS, the Village of Sleepy Hollow ("Sleepy Hollow") has conducted a public hearing to approve the continuation of a partial tax exemption for senior citizens for the 2010 Assessment Roll according to Section 467 of the Real Property Law; and WHEREAS, this partial property tax exemption is based in part upon the income of the senior citizens who apply for this exemption; and WHEREAS, it is the intention of Sleepy Hollow to grant the maximum possible exemption in accordance with those income levels to its senior citizens. NOW, THEREFORE, BE IT RESOLVED, that Sleepy Hollow hereby adopts the maximum level of income permitted, together with the highest percent of exemption permitted by Section 467 of the Real Property Tax Law and that the Village Assessor is authorized to accept and grant those exemptions where appropriate in accordance with those guidelines, and BE IT FURTHER RESOLVED, that in determining eligibility and levels of income, ' senior citizen applicants may deduct un-reimbursed medical and prescription drug expenses and/or veteran's disability compensation when calculating the "Total Income" of the owners of real property.
