Present: Mayor Kenneth G. Wray Deputy Mayor Thomas Capossela David Schroedel Barbara Carr Karin Wompa Evelyn Stupel, Trustees Absent: Bruce Campbell, Trustee Also Present: Anthony P. Giaccio, Village Administrator Paula A. McCarthy, Village Clerk Janet Gandolfo, Village Counsel Richard Gross, Village General Foreman Sean E. McCarthy, Village Building Inspector Gregory Camp, Police Chief At 7:03 p.m. the Mayor called the meeting to order with a pledge to the flag. Village Clerk read the announcement for the continuation of the Public Hearing regarding General Motors. Mavor's Announcements: Mayor opened the meeting and evoked the 5 minute rule: Mayor informed the public that the public hearing on this matter would not be closing this evening, that all comments would continue to be reviewed and there would be a discussion at next week's Work Session. Trustee Schroedel stated that, contrary to the assertion that the $11.5 million figure we've been discussing is a bill TO the Village, it is money the Village will receive FROM the developer that the village may spend as it sees fit to meet the increased demands on the Village created by the development. Trustee Schroedel explained that in 2007, the finding statements identified $8.267 million in contributions from the developer to the Village. However, most of the construction was only partial and it would place up to $7 million in additional construction obligations on the Village. Now all the partially built amenities have been removed and many of the other costs and obligations have been transferred the developer, the Village will be able to use the $11.5 million as needed. It is also the developer's obligation to finish the interior and shoreline parks. He noted that, contrary to another public assertion, the Village is not responsible for the development of the interior roads and utilities, which are to be paid by the developer as well. �Public Comments: Alan Singer of 145 River Street addressed the Mayor and the Board and stated that he is concerned about the Village building a proposed bridge to connect Continental Avenue and the GM project and building fire and ambulance facilities. Mr. Singer stated that in his experiences municipalities are uniquely unqualified to build anything. He also stated when municipalities get involved with these projects; it never comes in at the number discussed, he also asked if the road had been inspected, and suggested that the developer should be responsible for the infrastructure. He continued to state, that GM should start to pay taxes to the Village in case they can't sell the property. Jack Gasko of Webber Avenue, addressed the Mayor and the Board and stated that he is concerned about GM not holding responsibility for the contamination of 27 plus acres, and if the Village accepts the land it will jeopardize the Village residents and tax payers, because of its land's liabilities. Richard Plano, of 215 Harwood Avenue and President of the Phillipsburg Manor Association, addressed the Mayor and the Board of Trustees, reading an extensive letter, in which he states the PILOT agreement with GM was a mistake, and the land value is "zilch". He suggested that all records should be posted on the website, and that the Village cannot afford another Duracell debacle. See attached letter. Chuck Lanckester, a resident and President of Sleepy Hollow Manor Association , addressed the Mayor and the Board and expressed concerned about parking and traffic, suggesting that the only solution he can think of would be a major off-site parking facility, with a shuttle system to facilitate traffic. Mayor reminded everyone with additional comments to submit it in writing to the Village Clerk, and that all were invited to attend next week's work session to listen to the Board discuss the public's questions. Jack Gasko, of Webber Avenue addressed the Mayor and the Board, again, and stated that the bridge over the tracks is restricted to 12tons. A major upgrade would have to be done to that bridge prior to any construction. No further comments were made at this time. At 7:30 pm, the Mayor adjourned the Public Hearing until the next Board Meeting. Approval o f Minutes: Trustee Carr moved, seconded by Trustee Schroedel to approve the Minutes of 2/8/2011. It was unanimous. �Trustee Carr moved, Seconded by Deputy Mayor Capossela to approve the Warrant of $578,289.65. It was unanimous. Mavor announcements: Mayor announced that the Village Elections for some districts will be at the Phillipsburg Restoration, instead of the Writer's Center due to a schedule conflict. Public Comments: Mayor opened Public Comments and evoked the 5 minute rule. Richard Plano, of 215 Harwood Avenue, addressed the Mayor and the Board and invited all Manor residents to attend a candidate debate at Phillipsburg on March 3rdrat 8:00 p.m. No other comments were made at this time. Trustee Reports: - Trustee Schroedel reported that the Finance committee met with the auditors last week and it should be ready to make a presentation at the next meeting for the 2009-2010 fiscal year. He also stated that the 2010-2011 budget would be announced soon. Trustee Schroedel also reported that the Public Safety Committee is making a recommendation for a new Sergeant, to replace recently promoted Lt. Bueti. Trustee Carr -Reported that some furnishing for the Senior Center arrived on Monday, and the rest, including Kitchen supplies, will arrive at the end of the week. She also reported that the Environmental Advisory Committee is preparing to clean up the parks, and is working with the schools to educate about the storm water management. Interested volunteers can contact the Administrator at Village Hall to sign up. Deputy Mavor Ca~ossela-Reported that tomorrow, Wednesday, there will be sanitation pick up. He also reported that the last day to sign up for TNT youth baseball is Saturday, February 26th, at the Washington Irving School. Trustee W o m ~ a Reported that she spent time with Fiona Hodgson going over grants and she'll be putting together applications. She also has selected new benches and flower pots for Morse School. Trustee Stunel- Reported that the Safe Housing and Code Enforcement Committee has 15 cases on the calendar for Thursday and she is still searching for collection agency. �Administrator's Re~ort: Mr. Giaccio reported that with Springtime approaching new projects will be starting, such as finishing the natural playground at Douglas Park, this will be going out to bid, and a batting cage to be done hopefully in time for opening day. Mr. Giaccio also reported that a new rail for the steps in front of the Police Station and municipal meters to replace the street meters is in the works. He announced that the after school program this week will be at the James Galgano senior center since the school is closed. The village calendar will be mailed out in a few days. Mr. Giaccio stated that the Village budget is still being worked on. Resolutions: (see attached) New Business: Trustee Wompa expressed concern about cars speeding on Bedford Rd, also known as Rt 448, speeders near the school buses, and pedestrians crossing. She is interested in working with the Police Dept to conduct a new study to find a way to control speeding in that area, and slow traffic down. Discussion ensued. Communications: Village Clerk announced a liquor license renewal application for the Horseman dinner, and announced a request from the Hidalgo family for a memorial walk to take place in March in memory of the late NY City police officer and Sleepy Hollow resident, Ralphy Hidalgo. Public Comments: Mayor opened Public Comments and evoked the 5 minute rule. Mario Belanich of North Washington addressed the Mayor and the Board, and asked if the Board of Elections will inform the residents about the recent change of one election district. He also asked about GM paying taxes, and asked about a Certificate of Occupancy. Jack Gasko, of Webber Avenue, addressed the Mayor and the Board, again, and asked about Jose Quinoy's hearing, stating that if the Board: "couldn't defend the charges in an open forum, then you shouldn't bring them up". He also stated that: "everyone is entitled to a fair process and you all should be ashamed". Trustee Schroedel responded that they had to have a discussion in closed session because the Board was presented with new information by Jose Quinoy's attorney at the last minute. Trustee Wompa also responded and stated that all Trustees spend many hours on all Village issues each week and, Mr. Gasko's comment left her speechless.
