Present: Mayor Kenneth G. Wray Deputy Mayor Karin Wompa Bruce Campbell Jennifer Lobato-Church Susan MacFarlane Evelyn Stupel, Trustees Absent: Barbara Carr, Trustee Also Present: Anthony P. Giaccio, Village Administrator Paula A. McCarthy, Village Clerk Janet Gandolfo, Village Counsel Richard Gross, Village General Foreman Gregory Camp, Police Chief At 7:15 p.m. Mayor Wray called the meeting to order with a pledge to the flag. Public Hearing; Code Revision Mayor Wray opened the public hearing and evoked the 5 minute rule. The Clerk read the notice aloud for the record (see attached) There were no public comments at this time. There was a brief discussion amongst the Board of Trustees regarding restaurants setting up tables on the sidewalks. Village Attorney suggested this may be a separate discussion in the future. Mayor Wray adjourned the Public Hearing at this time. Approval of Warrants: Trustee Campbell moved, seconded by Deputy Mayor Wompa to approve the warrant as submitted, and authorize the Treasurer to pay the bills in the total of $27, 400.26 Vote: 5-0 Approval of Minutes: Deputy Mayor Wompa moved, seconded by Trustee Lobato-Church to approve the minutes of 8/14/2012. Vote: 5-0 �Mavor Announcements: Mayor Wray reminded everyone there will be no meeting next week. Mayor congratulated and thanked Richard Gross and Doug DiCairano for 30 years of service and Ms. Filomena Falaccaro for 59 years of service to the Village. Trustee Reports: Trustee MacFarlane - reported that the second Park to Park days was a big success. There were more people this time and a lot of light house tours; it was a nice day. The last day is scheduled for September 9th. No incidents were reported. The water is back at Kingsland Park, and will be opening up the bathhouse and looking to line up a pop up cafe-restaurant so people can enjoy refreshments. There is a pop-up cafe already scheduled at the bathhouse for September 15th. In response to a previous request from a resident to install a permanent restroom at Sykes Park; the parks and recreation committee did a feasibility study, obtained public comments and got an estimate of the cost. The cost estimates were between $150,000. and $250,000. The committee discussed this and did not recommend it this time. There wasn't that much interest from the public in that area; it's a small park and the committee cannot justify the expenditure. There is a portable toilet in that park. Trustee Campbell -The Communications committee met with Jim Santo of NetSoft Solutions to discuss new designs and streamlining our website to be easier to access information. An electronic community board outside of Village Hall was suggested and three different proposals will be discussed and presented to the board in the future. Halloween is around the corner and we're looking for sponsorships. Deputy Mavor Worn pa - reported that she had a conversation with a local landscapers about doing tree wells work on Beekman Avenue. The Downtown Revitalization Corp will be speaking to Sara about capital budget funding for sidewalk improvements. The employee handbook discussion has been put on hold until after Labor Day. Grants are still available for business owners wanted to do fagade improvements. Trustee Stupel - Court resumes this Thursday, August 23rd. The water sprinklers at the parks will be turned off in mid September but the bathrooms remain opened. Sidewalk repairs are being done in front of the VanTassell building and in front of St. Teresa's Church. There will be a master plan in the next few weeks for sidewalk repairs and tree replacements in the Village. There will be no garbage pick up on Labor Day, September 3rd. The entire Village will be picked up on the 4th. Trustee Jennifer Lobato-Church - Had nothing to report at this time. Administrator's Report - See attached �Public Comments: Mayor opened the meeting and evoked the 5 minute rule. Carlos Mueller of 95 Beekman Avenue addressed the Mayor and the Board of Trustees and expressed much concern about the behavior of two bull dogs residing at 39 Elm Street. He expressed concern that the owners of these dogs are irresponsible and the dogs are often unleashed, there is no gate to corral the dogs and there have been two attacks by these dogs. He stated that the dogs are a nuisance, and he asked that serious measures be taken. Mayor Wray stated this is a serious issue and asked that Mr. Giaccio, Ms. Gandolfo and Chief Camp to address this concern immediately. A brief discussion ensued. There were no further comments at this time. Resolutions: (see attached) Old Business: Trustee MacFarlane asked about an oil leak on the Hudson River that was previously discussed. Mr. Giaccio said that the DEC and the County were contacted. The County states that the oil leak is coming from an old asphalt plant. Mr. Giaccio disagrees with this because the leak is very consistent and believes the leak is coming from an underwater pipe. Mr. Giaccio sent photos to the DEC and still has not received their response. Trustee MacFarlane also asked about the Ichabods Landing bulk head problem and Mr.Giaccio responded. The Village received proposals for repair about 30 feet of the bulk head and to fix the sink hole. However, after meeting with Village staff it is believed that the entire bulk head is failing and these repairs may be only temporary. Mr. Giaccio recommends further studies and has asked Village engineer to send out an RFP for this purpose. Trustee MacFarlane is concerned about the capital budged and the winter time. Discussion ensued. New Business: Trustee MacFarlane discussed with the Recreation Committee and advised that Kingsland Point Park is in need of repair to the fields. Discussion ensued. Trustee Lobato-Church asked Mr. Giaccio to follow up on previous traffic issues. She also inquired about vendor contracts. Deputy Mayor Worn pa suggested that the contracts should be discussed in executive session. �At 8:11 pm on a motion by Trustee Campbell, seconded by Deputy Mayor Wompa the meeting was adjourned. McCarthy Village Clerk / �8 �VILLAGE OF SLEEPY HOLLOW NOTICE OF PUBLIC HEARING ON PROPOSED LOCAL LAW PLEASE TAKE NOTICE that, for the purpose of adopting a codification of the local laws, ordinances and certain resolutions of the Village of Sleepy Hollow, said codification to be known as the "Code of the Village of Sleepy Hollow," a continuation of the public hearing will be held by the Board of Trustees at Village Hall, 28 Beekman Avenue in the Village of Sleepy Hollow, on the 21th day of August 2012, at 7:00 p.m. or shortly thereafter, originally set for Tuesday, the m 10 day of July, 2012, at 7 p.m.; to consider the enactment of the proposed local law described and summarized below: PROPOSED LOCAL L A W NO. -2012 A LOCAL LAW TO PROVIDE FOR THE CODIFICATION OF THE LOCAL LAWS, ORDINANCES AND CERTAIN RESOLUTIONS OF THE VILLAGE OF SLEEPY HOLLOW INTO A MUNICIPAL CODE TO BE DESIGNATED THE "CODE OF THE VILLAGE OF SLEEPY HOLLOW" This local law: (1) States the legislative intent of the Board of Trustees in adopting the Code. (2) Provides for the designation of the local laws, ordinances and certain resolutions of the Village of Sleepy Hollow as the "Code of the Village of Sleepy Hollow." (3) Repeals local laws and ordinances of a general and permanent nature not included in the Code, except as provided. (4) Saves from repeal certain local laws and ordinances and designates certain matters not affected by repeal. (5) Retains the meaning and intent of previously adopted legislation. (6) Provides for the filing of a copy of the Code in the Village Clerk's office. (7) Provides for certain changes in or additions to the Code. (8) Prescribes the manner in which amendments and new legislation are to be incorporated into the Code. (9) Requires that Code books be kept up-to-date. (10) Provides for the sale of Code books by the village and the supplementation thereof. (11) Prohibits tampering with Code books, with offenses punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or both.
