                  <text>A regular meeting was held by the Architectural Review Board on
September 28, 1994 in Village Hall, 28 Beekman Avenue, North
Tarrytown, New York 10591

Mr. Nazemetz called the meeting to order at 8:00 PM.
IN THE MATTER OF CHRISTINE MANQIERI, 404 NORTH BROADWAY, NORTH
TARRYTOWN. NEW YORK 10591
Mr. Richard Greek, the Architect of the applicant showed the
Board photographs of the property to give the Board a better
understanding of the architectural problems involved.
A
certificate of occupancy has been granted for a legal three
family residence. At the present time there is an antique store
on the first floor plus another two stories. The proposed front
porch is usable and the sides have trees on either side.
Mr. Greek stated that this is an English Tudor style. There is a
flat roof above the store. The roof is in disrepair.
Mrs.
Mangeri would like to replace the roof so that the space could be
used as a storage attic.
THe intent is to use the space for
storage even though there are stairs coming from the apartment.
The design used would compliment the English Tudor style.
Mr. Falasca would like to propose a condition that the area would
only be used for storage.
Mr. Margotta stated that the way it is built it cannot be a
habitable room.

It was mentioned that the windows should match the rest of the
house. A rod iron railing and steel stairs are being used on the
side because they are hazardous and deteriorating.

�Supervision of the project will be done by a general contractor.
Mr. McCarthy made a motion to approve the plans as submitted with
the conditions that the area above the store be used for storage
only and that the awning windows would be double hung windows
seconded by Mrs. Aloia. Motion carried. Mr. Falasca abstained.
IN THE MATTER OF FRANK POALANTONIO. 18 6 WEBBER AVENUE, NORTH
TARRYTOWN, NEW YORK 10591
Sam Viera, architect for the applicant stated that this is a
modular home. Its a single family residence. The elevation is
drawn with slight modifications, for instance a bay window and
shutters have been added to dress up the home.
Mr. McCarthy asked who the contractor was.

Mr. Viera stated it

On the porch a 5/12 pitch was used because of the difficulty o of
the angle. The house sets back 45 feet. The house to the south
sets back 15 ft. and the house to the left sets back 35ft. Mr.
Viera stated that he does not want to create a flat roof.
Mr. Weeks of Webber Avenue asked the Board to be more careful
about conformity of the houses on Webber Avenue. Serious changes
could devalue the homeowners. Mr. Weeks asked the Board to take
the time to look at the neighborhood and see how it conforms.
Ms. Fina stated that she has reviewed the code and feels that
applicants should have photographs in the future.
Mr. McCarthy stated that maybe the column should be changed to a
cast iron column, this would make it conform with he rest of the
house. Mr. Viera stated that his client would like the columns
as is.
Mr. Collins of 146 Webber Avenue stated that the house should
remain as is. Discussion ensued.
Mr. Weeks of 174 Webber Avenue stated that the Board should see
if the house fits in and to look at the integrity of the
ne ighborhood.
Mrs. Petry of Webber Avenue stated that the Board should not set
these plans aside. Also, she did not know why the board would
not approve the plans.
Mr. Nazemetz stated that the Board is not here to dictate style
to someone's home, they are here to make sure its keeps up with
the quality of life in the neighborhood.

�Mr. McCarthy is looking for further investigation concerning the
entranceway. Mr. McCarthy stated that it was a fine house but
there was too much scattered detail.
Mr. Falasca made a motion to approve the plans as submitted,
seconded by Mr. Nazemetz.

IN THE MATTER OF JOHN AND MAUREEN PETRY, AMQ8 STREET. NORTH
TARRYTOWN. NEW YORK 10591
Mr. Petry stated that this is a one family colonial home and they
made the changes requested. There are white columns and rails.
The shape of the roof shed, left and right are hipped.
A suggestion was made to have two windows on the second floor on
the west side of Amos Street.
Mr. Weeks stated that his home is adjacent to the property. It
was agreed that the north side would not have windows to allow
privacy for each home.
At this time Mr. Weeks submitted a petition which describes
certain requests, (in official minutes)
Mr. Falasca stated that the houses in the area are similar in the
cul-de-sac.
Mr. McCarthy mentioned that a pre-cast foundation style should
match whatever is above ground.
Also, it was mentioned that the chimney would infringe on the
side yard. This is why it is in the rear of the house.
Ms. Ann Petry of 73 Sleepy Hollow Road stated that the
neighborhood is evolving and changing. The driveway has already
been approved by the Planning and Zoning Board and
does not
see any other problems.
Mr. Collins of Webber Avenue stated that he does not see a
problem with this application.
Mr. McCarthy made a motion to close the public hearing seconded
by Ms. Fina. Motion carried unanimously.

�A motion was made by mr. McCarthy to approve the application with
he following conditions. The front porch should have a hip roof
and the north side elevation should have two double hung windows
directly in line with each other. These should have shutters,
seconded by Mr. Falasca. Motion carried unanimously.
IN THE MATTER OF ADELE CURTAIN 275-279 NORTH BROADWAY. NORTH
TARRYTOWN. NEW YORK 10591
Mr. Tom Curtain stated that he and his wife own the Sushi Raku
Restaurant property.
At this time he would like to put up a
green vynal fence because trash is always thrown in front of the
store into the garden. Mr. Curtain stated that it is a lot of
hard work and money to keep it clean and he is trying to avoid
littering.
Discussion took place concerning how high the fence would be.
The code allows a height of 6ft, because it is commercial
property.
Mr. Curtain said that this will also indicate where the property
lines are. The fence will be on Mr. Curtain's property.
Mr. Fitzgerald stated that the property is in litigation. The
fence would interfere with all right of the property. A fence
would prevent an easement. Also, Mr. Fitzgerald does not this
that this a aestetically good.
Discussion ensued concerning building permits and easements.
Mr. Falasca made a motion to close the public hearing, seconded
by Ms. Aloia. Motion carried unanimously.
Ms. Aloia made a motion to oppose the fence existing on North
Broadway, seconded by Ms. Fina. Motion carried unanimously.

Mr. Fitzgerald, Esq., the representative for the applicant showed
the board sample materials that were going to be used for the
sign, he also showed the Board pictures of the property.
The sign would be just like the one in Philipsburg Manor.

Mr. Falasca made a motion to close the public hearing, seconded
by Ms. Aloia. Motion carried unanimously.
Ms. Fina likes the original positioning of the signs. She feels
it would look better. Mr. Fitzgerald state there is a concern
about the metal plating that already exists.

exists and to table the final signs for 60 days., seconded by Mr.
McCarthy. Motion carried unanimously.

Mr. Zaicek state that the fence was put up without a permit. The
fence was an existing fence, it was just deteriorating.
The
Fence would have been 5ft high and continue for approximately
40ft.
Mr. Fitzgerald stated that he was familiar with the property. He
had a picture from 1983 that shows that the fence was replaced
far beyond what was there.
Mr. Falasca made a motion to table this issue until next months
meeting, seconded by Ms. Fina. Motion carried unanimously.

Mr. Margotta distributed plans that were approved in May of 1993.
Mr. Collins stated that he was trying to stay within his budget
and had used stone instead of wood for the front steps.
Discussion ensued.
Mr. Falasca made a motion to approve the "as building drawings".
Mr. Nazemetz stated that it is larger and it should be hidden
with landscaping.
With this condition, motion was carried
unanimously.
Being no further business, the meeting was adjourned.
