Resolution of the Board of Trustees of the Village of Sleepy Hollow
Authorizing Storm Water Management Grant Application
Whereas, the Village of Sleepy Hollow has been the Lead Agency for three
previous Water Quality Improvement Project Grants from New York
State Department of Environmental Conservation, and
Whereas, those previous grants have been completed and benefitted up to 18
communities in the Sleepy Hollow Stormwater Consortium, and
Whereas, the Village of Sleepy Hollow is willing to continue as the Lead
Agency for Round 11 of Stormwater grants to communities working together as
the Sleepy Hollow Stormwater Consortium, and
Whereas, Dolph Rotfeld Engineering, PC is willing to continue as Project
Manager for the implementation of the grant,
NOW THEREFORE BE IT RESOLVED that the Village Board of the Village
of Sleepy Hollow does authorize Dolph Rotfeld Engineering, PC as Project
Manager to submit on behalf of the Sleepy Hollow Stormwater
Consortium an application for funding under the Water Quality
Improvement Project, Round 11, to continue funding for assistance to the
members of the consortium to meet the General Permit requirements issued
by the New York State Department of Environmental Conservation
covering the discharge of storm water by MS4s to waters of the United States.

RESOLUTION A D O P T I N G MISSION S T A T E M E N T A N D F O R M A L
POLICY FOR G A L G A N O SENIOR CENTER

Whereas, since the construction of the Galgano Senior Center (Center) the Village has received
many requests to use the Center; and
Whereas, the Board of Trustees (BOT) is desirous of setting forth a mission statement
regarding the use of the Center, including a formal written policy for the Center's use; and
Whereas, in order to define the mission statement for the Center and formulate a usage policy
the BOT has requested comments and input from the Recreation Department, the Sleepy
Hollow Senior Citizens Club, other Village employees and members of the public;
Now, therefore be it resolved the BOT adopts the following mission statement for the
Center: The primary mission of the Center is to serve all senior citizen residents of the Village.
Notwithstanding the aforesaid primary mission, the BOT is desirous of making the Center
available to be utilized by civic and community groups operating within the Village; and
Be it further resolved, the Center will be managed by the Recreation Supervisor who will be
responsible for scheduling all events and activities as well as the daily operations of the Center;
and
Be it further resolved, the following is the policy for usage of the Center:
1. The following organizations may reserve the Center for meetings and events of the
organization: Sleepy Hollow Senior Clubs/Organizations, BOT, SHPD, SHFD, SHVAC,
SHDPW, SH Recreation Department, SH Recreation Advisory Committee, and SH Police
Advisory Committee; and/or other official committees, commissions or Boards appointed
by the Village.
2. The following community groups may reserve the Center for meetings and events of the
group: Girl Scouts/Boy Scouts, Garden Clubs, Youth Sports Organizations (ie TNT,
AYSO, etc), Organized Political Parties, or independent candidates, Condominium
Associations, Renters' Associations, School Booster Organizations, PMIA, SHMA, Webber
Park Association, any other organized neighborhood association;
3. Be it further resolved, the aforementioned organizations and groups may reserve the
Center for activities, meetings, or events for the organizations and groups. The Center
is not available for private events by any member or members of the aforementioned
organizations and groups, or any other private individual or entity; and

�Be it further resolved, the following are the Rules of Use for the Center and shall be posted
at the Center in a conspicuous place and distributed to the authorized representative of any
group or organization reserving the Center for use:
1. Any group or organization not listed in the aforementioned paragraphs may apply for
use of the Center to the Village Board of Trustees.
2. Any group or organization reserving the Center must provide the name, address and
phone number of the person responsible for the use of the Center.
3. Applications to reserve the Center must be submitted to the SH Recreation Supervisor at
least one week in advance of the date of requested use.
4. A Village employee must be available to open and close the Center before and after all
meetings or events.
5. The Center shall be closed no later than 11:00 p.m. All users of the Center must be
vacated by that time.
6. All events and meetings must be supervised by a person at least 21 years of age.
7. The Center shall be left in the same or cleaner condition when the event or meeting
terminates.
If the kitchen is utilized it must be left in a clean condition and all items for kitchen use
must be replaced in the same location as found.
8. Any caterer hired for an event or meeting must be licensed and provide proof of
insurance to the Village at the time of application for use.
9. Smoking is not permitted anywhere inside the premises.
10. All trash must be deposited in the dumpster outside.
11. All furniture must be left in the same location as it was found prior to the event or
meeting.
12. No items provided by the Center may be taken off premises (eg. Utensils, chairs, tables,
kitchenware).
13. Electronic equipment may not be moved without approval of the Recreation Supervisor;
14. The Village reserves the right to impose a fee upon the sponsor of the event or meeting
if overtime, cleaning or other costs are incurred by the Village solely as a result of the
event or meeting; and
Be it further resolved, any violation of the aforementioned rules may result in the denial of
future use of the Center by the group or organization sponsoring the event.

Resolution of the Board of Trustees of the Village of Sleepy Hollow
Approving Agreement with Westchester County for Remote Public Viewing
Application System
WHEREAS, Westchester County has created an internet-based public viewing system
of land records entitled "Westchester County Land and Legal Records Public Viewing
Application" herein (L&amp;LR) and made it available at no cost to municipal governments;
and
WHEREAS, although the information will be available to the public, access to the L&amp;LR
system will be limited to staff from the Department of Architecture, Land Use
Development, Buildings and Building Compliance via user identification numbers and
passwords; and
WHEREAS, the L&amp;LR system streamlines the manual, labor-intensive, costly and time
consuming process currently utilized by the Westchester County Clerk's Office for the
preparation and dissemination of deeds, mortgages and other land records documents;
and
WHEREAS, the Village of Sleepy Hollow will benefit from this system as a result of this
increased efficiency; and
WHEREAS, the proposed Intermunicipal Agreement with the Village of Sleepy Hollow
would grant remote access to the L&amp;LR system for a one year period, commencing on
January 1, 2013 and ending December 31, 2014; and
WHEREAS, said agreement has been reviewed and approved as to form by the Village
Attorney.
NOW, THEREFORE, BE IT RESOLVED that the Mayor is herein authorized to execute
the attached Intermunicipal Agreement with Westchester County to provide for remote
access to the Westchester County Land and Legal Records Public Viewing Application
System.

corporation of the State of New York, having and office and place of business in the Michaelian
Office Building, 148 Martine Avenue, White Plains, New York, 10601 and

W H E R E A S , the County desires to provide a license for remote access to the County
Clerk's land records and legal files; and
W H E R E A S , the Licensee desires a license for the privilege of utilizing such remote
access to the County Clerk's record; and
N O W , T H E R E F O R E , the parties hereto agree upon the premises, terms and conditions
as follows:
Licensed Access: The County hereby grants to the Licensee a License at no cost for
the use of (
) assigned user ID's from the Westchester County Clerk's system that would
permit Licensee to connect computer terminal(s) for remote web access to the County Clerk's
land records and legal tiles. Licensee accepts the land records and legal tile information on an
"as is" basis and the County provides no warranty as to the accuracy of the information. To the
extent permitted by law, the County disclaims all liability for the information contained in the
files and records.

- Confidentiality: The Licensee agrees that, except in accordance with proper judicial
order or as otherwise provided by law, the Licensee and any person employed, or otherwise
engaged, by such Licensee who by virtue of such employment or engagement is given access to
the County Clerk's Office land and legal records pursuant to this License, shall not divulge or
make known in any manner any confidential information, such as social security numbers,
contained in such records.

- Conduct of Operations: The Licensee assumes all risk of operation and shall provide,
at its sole cost and expense, all equipment and hardware, as determined by the County, necessary
to gain access to the County Clerk's records. The County shall not be responsible as a bailee or
otherwise for any equipment or hardware or other personal property of the Licensee, or its
employees, used to gain remote access. The Licensee hereby waives any claim for loss or
damages sustained to any personal property, including, without limitation, theft or other casualty.
The Licensee further agrees;
(a) that except for the amount, if any, of damage contributed to, caused by or resulting
from the negligence of the County, the Licensee shall indemnify and hold harmless the County,
its officers, employees and agents from and against any all liability damage, claims, demands,
costs, judgments, fees, attorneys' fees, or loss arising directly or indirectly out of the acts or
omissions hereunder by the Licensee and third parties under the direction or control of the
Licensee; and
(b) to provide defense for and defend, at its sole expense, any and all claims, demands or
causes of action directly or indirectly arising out of this License and to bear all other costs and
expenses related thereto.

Term and Termination: The term of this License shall be for a period
commencing on
201_, and terminating on December 31, 2014, with the
County Clerk's option to extend the License for up to four additional one-year periods on the
same terms and conditions. This License shall be extended for an additional one year period
automatically upon Licensee's receipt of a letter notice from the County Clerk advising Licensee
of the County Clerk's decision to exercise its option and extend this License for an additional
one year period.
In addition, this License may be terminated by the County upon thirty (30) days
written notice to the Licensee when, in its sole discretion, the County deems it in its best interest
to do so. Licensee shall have the right to terminate this License upon thirty (30) days written
notice to the County when, it is sole discretion, Licensee deems it in its best interest to do so.

No Lease: It is expressly understood and agreed that no equipment or space is
leased to the Licensee. No exclusive rights for remote access (other than the licensed user ID's
granted herein) are granted by this License.

Notices: All notices of any nature referred to in this License shall be in writing
and either sent by regular mail or overnight courier, or sent by facsimile (with acknowledgement
received and a copy of the notice sent by overnight courier), to the respective addresses set forth

�below or to such other addresses as the respective parties hereto may designate in writing.
Notice shall be effective on the date of receipt, or in the case of notices sent by regular mail,
notice shall be effective three business days after the date of mailing.

Resolution of the Mayor and Board of Trustees of the Village of Sleepy Hollow
to Extend Inter-Municipal Agreement for Kingsland Point Park
Whereas, in 2003, the Village of Sleepy Hollow entered into an Inter-Municipal
Agreement with the County of Westchester to maintain and operate Kingsland Point
Park for five years; and
Whereas, in 2009 the Village Board extended this inter-municipal agreement an
additional five (5) years expiring on October 31, 2013 and,

WHEREAS, proceedings were commenced in New York State Supreme Court,
