                  <text>Minutes of the Board of Trustees
Village of Sleepy Hollow
A work session of the Board of Trustees of the Village of Sleepy Hollow was held on Tuesday,
December 3, 2013 at 7:00 P.M. at Village Hall, 28 Beekman Avenue, Sleepy Hollow, New York.

Mayor Wray called the work session to order at 7:00 p.m.
EXECUTIVE SESSION Motion was made by Trustee Rosenbloom, seconded by Deputy Mayor Lobato-Church and
carried unanimously to go into executive session to discuss personnel matters.

carried unanimously to go out of executive session.
MONITORING VILLAGE PROJECTS - Deputy Mayor Lobato-Church recommended
keeping a list of village projects that would be periodically updated. The list would be used to
track projects to make sure they are accomplished in a reasonable timeframe. Mayor Wray
recommended that the Board prioritize the list of projects to monitor. Discussion ensued.
CODE REVISIONS - The Board discussed code revisions being proposed by the Village
Architect, Sean McCarthy. Mr. McCarthy provided the Board with a list of proposed changes
(attached) and answered questions from the Board. Discussion ensued.
At 9:10 p.m. the meeting was adjourned.

�Miscellaneous parking requirements.
(1) Upon the establishment of a parking fund for the C-2 Zone by the Village Board of
Trustees, should the Planning Board or the Zoning Board of Appeals, depending upon
which of these two Village agencies is responsible for the review and approval of the
particular parking requirement, determine that such parking requirement cannot be
fulfilled because applicant does not have land on site available for parking or has land
on site that cannot be accessed from public rights-of-way, said Board may require that a
monetary contribution in the amount of $1,000 per parking space to a maximum of five
spaces, in lieu of such off-street parking, be paid into a parking fund established by the
Village. These procedures shall be limited to the off-street requirements within the C-2
Neighborhood Commercial Zone. The parking fund, when established, shall be used
exclusively for parking improvements within the C-2 Zone.
(2) In the C-2 Neighborhood Commercial Zone, if the Building Inspector finds that a change
of use or occupancy will not require an increase of more than five off-street parking or
loading spaces beyond that required for the previous use, or in the number of spaces
actually approved for construction to serve the use, and the applicant does not have
land available on-site for parking or has land on-site that cannot be accessed from
public rights-of-way, site plan approval requirements may be waived by the Building
Inspector. If the Building Inspector determines that site plan approval is not required, the
parking requirements under this chapter shall be deemed fulfilled.

�steep slopes.
§ 450-X. Steep slopes.
A. All lots or open lands, whether or not proposed for use, reuse, development or
redevelopment, shall be subject to review in accordance with the environmental
review procedures established in the Village of Sleepy Hollow and all matters
requiring Planning Board or other Village agency review pursuant to this chapter.
B. The Planning Board shall restrict new construction and/or vegetation removal in
such designated areas. The restrictions are designed to achieve the following
objectives:
(1) Minimizing erosion and sedimentation, including the loss of topsoil;
(2) Preventing habitat disturbance;
(3) Protecting against possible slope failure and landslides;
(4) Minimizing stormwater runoff and flooding;
(5) Providing safe and stable building sites;
(6) Protecting the quantity and quality of the Village's surface water and
groundwater resources;
(7) Protecting impprtant scenic vistas, slopes, rock outcroppings and mature
vegetation;
(8) Preserving the Village's attractive aesthetic character and property values;
and
(9) Otherwise protecting the public health, safety and general welfare of the
Village'of Sleepy Hollow and its residents.
C. The restrictions are intended to encourage preservation of the following areas:
(1) Steep slopes: a grade of 25% or more.
(2) High ground: 300 feet or more above sea level.
(3) Hilltops: In areas of high ground (at least 300 feet above sea level), a roughly
circular area defined by a radius of 100 horizontal feet from the highest point
of a hill. A hill shall be defined as a landform that rises at least 10 feet above
the average elevation for the circumference of the circular area with a radius
of 100 feet from that highest point.

�Zoning Board of Appeals.
§ 450-80. Zoning Board of Appeals.
The Board of Appeals heretofore established pursuant to the Village Law is hereby
continued with all powers and duties prescribed by law and by this chapter. Such
powers and duties are summarized and more particularly specified as follows, provided
that none of the following provisions shall be deemed to limit any power of the Board of
Appeals conferred by general law:
A. Interpretation. On appeal from an order, requirement, decision or determination
made by an administrative official, the Board of Appeals shall have the authority
to decide any question involving the interpretation of any provision of this
chapter, including the determination of the exact location of any district boundary
if uncertainty with respect thereto remains after exhausting the rules specified in
§ 450-X
B. Variances.
(1) Area variances.
(a) The Zoning Board of Appeals shall have the power, upon an appeal
from a decision or determination of an administrative official charged with the
enforcement of such local law, to grant area variances from the area or
dimensional requirements of such local law.
(b) In making its determination, the Zoning Board of Appeals shall take
into consideration the benefit to the applicant if the variance is granted, as
weighed against the detriment to the health, safety and welfare of the
neighborhood or community by such grant. In making such determination, the
Board shall also consider:
[1] Whether an undesirable change will be produced in the character of
the neighborhood or a detriment to nearby properties will be created by
the granting of the area variance;
[2] Whether the benefit sought by the applicant can be achieved by some
method, feasible for the applicant to pursue, other than an area variance;
[3] Whether the requested area variance is substantial;
[4] Whether the proposed variance will have an adverse effect or impact
on the physical or environmental conditions in the neighborhood or district;
and

�Solar heating devices.
Freestanding devices designed and constructed to capture and use the warmth of the
sun for heating and other purposes shall be considered accessory uses and shall
comply with all standards and requirements pertaining to accessory buildings and
structures in this chapter. Solar devices attached to buildings or structures shall not
exceed the height limitations of the district within which they are located. Each solar
device shall require a permit to erect or locate or establish the same.

Wind-energy devices.
Devices designed and constructed so as to capture and otherwise use wind energy
shall be considered permitted accessory uses in all residential districts and shall be
subject to the particular accessory use standards and provisions of the particular district
within which they are located, except that wind energy devices shall require and be
subject to site plan approval by the Planning Board prior to the issuance of a permit for
their installation or erection. In said site plan approval, the Planning Board shall pay
particular attention to the need for landscape buffer screening to reduce the visual
impact of the particular wind energy device upon adjacent neighbors and the public in
general.

�Impervious coverage.
§ 450-X. Impervious coverage.
It is the intent of the Village Board of Trustees to mandate maximum impervious surface
coverage limits on residential lots in order to ensure that said lots contain enough
pervious surfaces to permit natural runoff to percolate into the ground. The following
table regulates the maximum impervious surface coverage allowed for residence
districts:

NOTE: Impervious coverage is the sum of the area of coverage or footprint of all
buildings, structures, paved areas, patios or other improved surfaces on a lot
preventing natural runoff to percolate into the ground. Calculation of total
impetvious surface area on a site shall be based upon the gross lot area not the
net developable area on a site.
