Present: Mayor Kenneth G. Wray Deputy Mayor Jennifer Lobato-Church Bruce Campbell Susan MacFarlane Glenn Rosenbloom Evelyn Stupel Karin Wompa, Trustees Also Present: Anthony P. Giaccio, Village Administrator Paula A. McCarthy Tompkins, Village Clerk Sara A. DiGiacomo, Village Treasurer Janet Gandolfo, Village Counsel Sean E. McCarthy, Village Building Inspector Gregory Camp, Village Police Chief At 7:02 p.m. Mayor Wray called the meeting to order with a pledge to the flag and a moment of silence for John Lacaruba, longtime resident of Tarrytown and Sleepy Hollow. Public Hearing; Hours of Operations for Barber Shops and other similar Establishments in the Village: Mayor Wray opened the meeting to the public and evoked the 5 minute rule. The Village clerk read the notice aloud for the record. Village Attorney, Janet Gandolfo, gave a synopsis of the problem regarding late hours of operation for these establishments. She stated there have been 36 police complaints at a specific location in the Village. Police Chief Camp addressed the Mayor and the Board of Trustees and stated that there have been numerous complaints in front of 85-87 Cortlandt St., which is a Baber Shop that stays open late, daily. Chief Camp suggested limiting the hours of these establishments, due to the volume of police calls and complaints. Lieutnant Bueti, addressed the Mayor and the Board of Trustees and stated that in reviewing blotter complains, it shows that 66% of calls are after 12:00 am. He suggested limiting the hours of operation to these establishments due to the high volume these complaints calls. Officer Yancey, addressed the Mayor and the Board of Trustees and stated that in numerous occasions she has responded to complaint calls in front of 85-87 Corltandt St, some were fights, others were noise and illegal activities, such as drinking and drugging on the sidewalk. She also stated that there are quite a few underage individuals hanging out in that area. �The Village Clerk read four letters of correspondence received regarding this issue. (See attached) Don Cateano of Lawrence Avenue addressed the Mayor and the Board and stated that the Village should not get involved in the operation of private businesses. Edna Belanich of North Washington Street addressed the Mayor and the Board and stated that an ordinance for hours of operation should be enforced. Justin Walters, addressed the Mayor and the Board of Trustees and stated that it is convenient for him to get a haircut at 2:00 am. He also stated that Yana, the barber shop owner, is trying to make an honest living and other establishments are just as crowded during the night. Yana Fernandez, of Cortlandt Street, addressed the Mayor and the Board of Trustees and through a Spanish translator in the audience, stated that he owns the barber shop business at 85-87 Cortlandt St. He stated that the Police Dept has been harassing him for over 10 years, and they often park outside his shop. He stated that his business was closed for 8 months after the Building Inspector sited him for doing bathroom work without a permit. He stated that during the time he was closed, the loitering remained the same and he should not be to blame for it. David Hodgson of North Washington Street addressed the Mayor and the Board of Trustees and stated that he is in favor of an ordinance that the Police Dept. can enforce to avoid crowds. Ana Lopez of Tarrytown addressed the Mayor and the Board of Trustees and stated that she works in the area and knows that there have been problems at that location. She is in favor of an ordinance that would enforce stricter hours of operations. Carlos Figueiredo of Depeyster Street addressed the Mayor and the Board of Trustees and stated that although everyone is trying to make a living, one shouldn't be getting a haircut at 1:00 am. He is in favor of an ordinance to enforce hours of operations from 7:00 am to 10:00 p.m. Mario Belanich of North Washington Street addressed the Mayor and the Board of Trustees and stated that all residents work and should be entitled to peace and quiet at night time. He is in favor of enforcing an ordinance that will do away with disturbance at night. Josephine Galgano of Gory Brook Rd, addressed the Mayor and the Board of Trustees and stated that the Village has a responsibility to the residents that live near the Barbershop and she is in favor of an ordinance for more stricter hours. Don Cateano of Lawrence Avenue addressed the Mayor and the Board of Trustees again, and stated that laws were made to be broken. �Edna Belanich of North Washington Street addressed the Mayor and the Board of Trustees, again, and stated that she gets her hair done between 10:00 am and 4:00p.m.; she also stated that this is not the time to discuss politics. Yana Fernandez, addressed the Mayor and the Board of Trustees, again, and stated that he is not the problem; he has pictures to prove it. He stated, once again, that the Police Dept. follows him around and they are harassing him. He also stated that if he was to file a lawsuit against the Police Dept. he would then have to move. Don Cateano, stated that the Board is trying to stop the business from operating. Ana Lopez stated that the Village is trying to protect the residents and make it safer by enforcing an ordinance. There were no further comments at this time. Mayor Wray adjourned the public hearing meeting for the following week. Public Hearing; Permit Parking in Specific Streets Mayor Wray opened the meeting to the public and evoked the 5 minute rule. The Village clerk read the notice aloud for the record. Jim Hart of Kendall Avenue addressed the Mayor and the Board of Trustees and agrees with permit parking to protect parking for the local residents. I^ario Belanich of North Washington Street addressed the Mayor and the Board of Trustees and asked what the permit parking's function was. Mayor Wray explained that it is to preserve parking for the local residents. David Hodgson of North Washington Street addressed the Mayor and the Board of Trustees and stated that he supports the said proposal and metered parking should be considered as well. There were no further comments from the public at this time. On a motion by Trustee Wompa, seconded by Deputy Mayor Lobato-Church the Public Hearing was closed. Mayor Wray asked for a motion to go into executive session to discuss a personnel matter. At 8:30 p.m., on a motion by Trustee Campbell, seconded by Trustee Wompa, the Board went into Executive Session. At 8:58 p.m., Trustee Campbell moved and Deputy Mayor Lobato-Church seconded to come out of executive session. �Approval of Warrant: Deputy Mayor Lobato-Church moved, seconded by Truste Wompa to approve the warrant as submitted and authorize the Village Treasurer to pay the bills in the total of $507,317.74 Approval of Minutes: Trustee Wompa moved, seconded by Trustee Rosenbloom to approve the minutes of January 7, 2014 as submitted, subject to minor typographical errors changes. It was unanimous. Trustee Campbell moved, seconded by Deputy Mayor Lobato-Church to approve the minutes of January 14, 2014, as submitted, subject to minor typographical errors changes. It was unanimous. Mayor's Announcements: Mayor Wray reminded Board Members that Village Tax Grievance Day is February 18^, 2014 and a Quorum is needed. Fred Gross, Village Assessor will make his recommendations on March 11^ 2014. Mayor Wray announced that the US Air Force will be conducting an exercise over the Hudson River in preparation for the Super Bowl. Residents should not be alarmed. Mayor Wray stated that the recent power outage in the Webber Park and surrounding areas was handled in a timely fashion. Trustee Reports: Trustee Rosenbloom - reported for Parks and Recreation and stated that the TNT baseball/softball sign-up will be this Saturday at the WI school from 10:00 a.m. to 12 noon, and grades K through will be accepted. Trustee Rosenbloom also reported that next Wednesday a meeting will take place with Trustee Campbell, Anthony Giaccio and the Village of Tarrytown, to discuss enhancing recreation programs for all residents. Trustee MacFarlane - reported that the new website will go live this Friday and having the Department Heads mind it will save the Village significant money. The email list is up to 750. Trustee MacFarlane thanked Christopher Scelza for his involvement and hard work with the new website success. Trustee Campbell - reported that there's an upcoming meeting with the Village of Tarrytown to emerge both Recreation Depts.', and will report back to the BOT as soon as there's something concrete to address. �Trustee Wompa - reported that discussion regarding fees is still being worked on with Department Heads for the upcoming budget. The Downtown Revitalization Comm is making headway and will meet again soon. There will be a meeting this week to discuss a more favorable IMA regarding Kingsland Point Park. Trustee Stupel - reported on Safe Housing and Public Works: the next court date is January 2 3 ' , and inspections of residential and commercial properties are ongoing. Brush pick up is on Mondays; leaves must be bagged. Public Works will be closed on Presidents day, February and garbage pickup for all routes will be Tuesday. Trustee Stupel reminded residents to check the Village's website for announcements regarding schedules changes and snow storms. Deputy Mayor Lobato-Church - reported that the Fire Department needs everyone's assistance to shovel out fire hydrants. An EMS consultant will be meeting with the Village's Emergency Services on 2/28/2014.
