BE IT RESOLVED tliat tlie Board of Trustees does Inereby call for a Public Hearing on
Tuesday, October 14"^ 2014 at 7:00 p.m. or soon thereafter, to exempt from Village
taxes, which are controlled by the said Village Trustees, pursuant to the provisions of
Real Property Tax Law Section 467.1 para (b) para (1), to the extent of 50% of its
assessed value at its sliding scale, properties owned by persons 65 years of age or over
who comply with provisions of Section 467 of the Real Property Tax Law as to
occupancy, income, length of ownership or othenwise.

COMMUNITY

WHEREAS, the Village of Sleepy Hollow (hereinafter "local government") believes that climate
change poses a real and increasing threat to our local and global environments which is
primarily due to the burning of fossil fuels; and
WHEREAS, the effects of climate change will endanger our infrastructure, economy and
livelihoods; harm our farms, orchards, ecological communities, including native fish and wildlife
populations; spread invasive species and exotic diseases; reduce drinking water supplies and
recreational opportunities; and pose health threats to our citizens; and
WHEREAS, we believe that our response to climate change provides us with an unprecedented
opportunity to save money, and to build livable, energy-independent and secure communities,
vibrant innovation economies, healthy and safe schools, and resilient infrastructures; and
WHEREAS, we believe the scale of greenhouse gas (GHG) emissions reductions required for
climate stabilization will require sustained and substantial efforts; and
WHEREAS, we believe that even if emissions were dramatically reduced today, communities
would still be required to adapt to the effects of climate change for decades to come,
IT IS HEREBY RESOLVED that Village of Sleepy Hollow, in order to reduce greenhouse gas
emissions and adapt to a changing climate will:
1) Pledge to be a Climate Smart Community
2) Set Goals, Inventory Emissions, Plan for Climate Action
3) Decrease Community Energy Use
4) Increase Community Use of Renewable Energy
5) Realize Benefits of Recycling and Other Climate Smart Solid Waste Management

RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF SLEEPY HOLLOW TO
ADOPT LOCAL LAW NUMBER 11 OF 2014
WHEREAS, the Board of Trustees of the Village of Sleepy Hollow (BOT) has reviewed the traffic
flow and parking restrictions on Old Broadway; and
WHEREAS, a duly noticed public hearing was held on September 9, 2014 to hear and consider
comments from the public regarding issues concerning parking, traffic flow and other concerns
regarding vehicular traffic on Old Broadway; and
WHEREAS, the BOT has reviewed a short EAF form submitted by Village Counsel which
evaluated the potential impacts associated with the Proposed Action and has determined that
the Proposed Action is an Unlisted Action as defined by SEQRA and will not have an adverse
impact on the environment,
NOW, THEREFORE, BE IT RESOLVED, that the BOT, after review of the materials submitted,
public comments and staff recommendations has determined that the proposed action is an
Unlisted Action and makes a determination of non-significance of environmental impact; and
BE IT FURTHER RESOLVED, that the following sections of the Code of the Village of Sleepy
Hollow are hereby amended to add the italicized language:

RESOLUTION TO AMEND THE ZONING TEXT AND OFFICIAL TAX MAP OF THE
VILLAGE OF SLEEPY HOLLOW REGARDING THE R-2 ZONING DISTRICT
(Local Law#12, 2014)
WHEREAS, the Sleepy Hollow Board of Trustees (BOX) Is desirous of amending the
zoning text and official tax map of the Village of Sleepy Hollow (VSH) to redraw the
existing western boundary line of the R-2 district; and
WHEREAS, the VSH (then North Tarrytown) approved a subdivision and special permit
application that allowed for the creation of a separate lot for the Center at the site of
the former Philipse Manor Train Station (a site listed on the National and State Registers
of Historic Places) to be used by the Hudson Valley Writers Center (HVWC); and
WHEREAS, the lot (approximately 0.14 acres) listed as Tax ID Number 01/115.6-1-2
was never designated in a zoning district typically associated with properties In the
Village; and
WHEREAS, the BOX is the only governmental body with the authority to approve the
proposed zoning text and tax map amendment; and
WHEREAS, a duly noticed public hearing was held on the proposed zoning text and tax
map amendment on September 23, 2014; and
WHEREAS, Village Counsel referred the application for the proposed zoning text and
tax map amendment to the Planning Board on September 19, 2014 for referral and
recommendation at which time the Planning Board reviewed and discussed the
proposed application and unanimously voted to provide a positive recommendation to
the BOT; and
WHEREAS, the BOT did review a short Environmental Assessment Form (EAF) and the
Coastal Assessment Form (CAF) submitted by the Village Planner which evaluated the
potential impacts associated with the Proposed Action and has determined that the
Proposed Action is an Unlisted Action as defined by SEQRA and will not have an adverse
impact on the environment,
NOW, THEREFORE, BE IT RESOLVED, that the BOT, after review of the materials
submitted, public comments, staff recommendations, the EAF and CAF, has determined
that the proposed action is an Unlisted Action and makes a determination of nonsignificance of environmental impact; and

�BE IT FURTHER RESOLVED, that the BOT approves the amendment to the Official
Zoning Map to redraw the western line of the R-2 District to include the aforementioned

nonprofit charitable, educational, eleemosynary or philanthropic organization, with a
minimum acreage of 10 acres" with a footnote that reads 'This provision shall be
applicable to the R-2 District only. For existing facilities present at the adoption of this
amendment, the existing site conditions shall constitute the zoning setback and parking
requirements for such facility. Any change in use is subject to site plan review,
pursuant to Section 450-66 of Chapter 450, Zoning."

Be It enacted the Sleepy Hollow Board of Trustees hereby adopts the following Local
Law Number 10 of 2014
Amending Chapter 450 of the Code and the official Zoning Map of the
Village of Sleepy Hollow
Be it enacted by the Village Board of the Village of Sleepy Hollow:
Section 1; Legislative Findings and Intent
The Village of Sleepy Hollow has an established Official Zoning Map which classifies most properties
within the Village by specific zoning districts. There are, however, certain lands within the Village which
have not been assigned a zoning classification, most notably the right-of-way and other related lands
associated with the Metro-North Railroad. It is the Intent of the Village to redraw the western boundary
of the R-2 District on the Official Zoning Map to include the improved lot associated with the MetroNorth Railroad that is currently not zoned but was approved for subdivision in February, 1995 by the
Village Planning Board.
Based on the foregoing, the Village Board hereby finds that the rezoning of the subject property known
as tax parcel number 14-25M-0001, from an undesignated zone within the Metro-North right-of-way to
R-2 and the related zoning text amendments will be consistent with good land use planning practice.
Section 2: Zoning Map Amendment.
The Official Zoning Map of the Village of Sleepy Hollow as established in Section 450-5 and 450-6 Is
amended by Including tax parcel number 14-25M-00001 as part of the adjacent R-2 One Family
Residence Low Density District.
Section 3: Zoning Text Amendment
Section 450 Attachment 1 Schedule of Regulations is amended by adding the following:
Under R-2, One-Family Residence Permitted Principal Uses

National, state or local historic landmarks or sites open to public visitation or other educational or
philanthropic uses under the auspices of a nonprofit charitable, educational, eleemosynary or
philanthropic organization, with a minimum acreage of 1.0 acres'"
