As provided for in Section 62-5.1.0 of the Village Code, this Special Permit will expire one year from the date of the adoption of this Resolution; provided, however, if the Project Site is restored to fully taxable state, or deemed to be so restored pursuant to Paragraph 1 of this Resolution, within such year, then this Special Permit shall not expire until one year from the issuance of Site Plan approval (as evidenced by the signature of the Chairman of the Planning Board on the approved Site Plan) for Phase 1 Site Development if a building permit is not applied for from the Village of Sleepy Hollow, with a 3 month extension for good cause available from the Building Inspector. And that The times set forth herein shall be tolled during the pendency of any litigation by a party other than the Applicant or any entity acting on behalf of the Applicant or of any moratorium affecting the Project adopted by any legislative body having jurisdiction over it. And WHEREAS, the litigation regarding the Project commenced by the Village of Tarrytown concluded on September 3, 2013; and WHEREAS, Lighthouse Landing Venture LLC took title to the Project Site on December 22, 2014, and the Project Site was restored to fully taxable state on that date; and WHEREAS, Lighthouse Landing Venture LLC has applied to the Village Planning Board for Site Plan approval for Phase 1 Site Development and that application is undergoing Planning Board review; NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees finds that (i) the Project Site was restored to fully taxable state while the Special Permit under the June 2011 Special Permit Resolution was in effect and (ii) Site Plan approval (as evidenced by the signature of theChairman of the Planning Board on the approved Site Plan) for Phase 1 Site Development has not been issued; and BE IT FURTHER RESOLVED, that the Board of Trustees confirms that June 11 Special Permit remains in full force and effect and that as set forth in the June 11 Special Permit, the June 11 Special Permit shall not expire until one year from the issuance of Site Plan approval (as evidenced by the signature of the-Chairman of the Planning Board on the approved Site Plan) �for Phase 1 Site Development if a building permit is not applied for from the Village of Sleepy Hollow, with a 3 month extension for good cause available from the Building Inspector; and BE IT FURTHER RESOLVED, that capitalized terms that are used but not defined in this resolution but are defined in the June 2011 Special Permit have the same meaning in this Resolution as they are given in the June 2011 Special Permit. KOELMEL Chairman Executive Summary New York Power Authority (NYPA) solicited proposals from Westchester municipalities for the self-installation of Electric Vehicle Supply Equipment (EVSE) at preferred locations within their respective territories. The Village of Sleepy Hallow (the Village) submitted a proposal for the installation of EVSEs at their Village Municipal Lot. Upon careful consideration, NYPA deemed the site adequate for the project and propose to award the Village of Sleepy Hollow two (2) EVSEs. This installation is part of Governor Andrew Cuomo's Charge New York Program. The goal of the program is to install 3,000 EVSEs throughout the State of New York. NYPA's Electric Transportation Program goal is to promote the development and demonstration of electricdrive vehicles that are of benefit to NYPA customers and other public entities around the state. To date, the program assisted in the placement of over 1,200 electric-drive vehicles. These vehicles have traveled over 11 million miles and have saved approximately 35,000 barrels of oil and avoided release of 4,000 tons of C02. The estimated value of the equipment which NYPA will award the Village is $12,225. The equipment value includes the EVSE unit and cable management system as well as four (4) years' worth of network fees and operation and maintenance service of which EV Connect will provide (EV Connect is NYPA's winning bidder for the implementation of this project). The Village is responsible for performing the installation of the equipment in accordance with all codes and regulations. NYPA expects the Village to adhere to the latest codes and standards governing electric vehicle charging, ensuring that the design, construction and installation of the equipment is safe. The Village will install the EVSEs under the supervision of a licensed electrician. The Village is to install the equipment at a location and with the intention of promoting the adoption of electric vehicle by its constituents. The units are to be installed within ninety (90) days of receipt with EV Connect providing oversight of the installation and commissioning. The Village, in return, shall provide NYPA access to the usage data for the first four (4) years of operation from date of commissioning.
