                  <text>REGULAR MEETING

NORTH TARRYTOWN, NEW YORK
NOVEMBER 20th ,1995

A regular meeting of the North Tarrytown Architectural Review
Board was held on November 20th, 1995 at 8:00 P.M. in the Village Hall,
28 Beekman Avenue, North Tarrytown, New York.

Chairman Nazemetz called the meeting to order at 8 P.M.
1.

Helen Stafford, 400 North Broadway, Stockade Fence.

Mrs. Stafford's Agent presented pictures of the property
and outlined the proposed fencing and stated that steps had been built
on the north side of the property and they were in litigation with the
neighbors regarding the fencing and the steps.
Mr. McCarthy moved, seconded by Ms. Fina to open the meeting
for public comments. Carried.
Georgina Mangieri representing the owners of property on the
north side stated that the matter was in litigation but her attorney
could not be present tonight. She asked that the matter be postponed
to a later date. She stated that the two properties have been in the
families for over fifty-five years and the alley between the two houses
has been accessible to both parties.
Discussion followed regarding steps that were installed in 1995,
and pictures were presented showing the steps.
Chairman Nazemetz stated that this was a legal matter that the
Board could not be involved in and they could only approve or disapprove
the fence.
Mr. McCarthy moved, seconded by Mr. Barstow that the meeting
be closed to the public. Carried.
Discussion followed regarding the height of the proposed fencing,
the type and stain to be used, and the front and sideyard setbacks.
Ms. Reilly moved, seconded by Mr. McCarthy that approval be
granted for a five foot high, stained fencing to the front of the house
and a three foot high fence in front of the house, fencing to be eight
foot sections. Fencing to be on the north side of the property. Carried.

Rodrigues Enterprises, 76 Chestnut Street &amp; 83 Depeyster StreetApproval of retaining wall.
Mr. Rodrigues presented "model" of proposed project.

Mr. Turnquist, Architect for the project stated they were asking
approvel of the approximately fourteen foot high wall so that they could
begin the project before the end of the year.
Mr. Turnquist presented affidavits of service to the Attorney.
Mr. McCarthy moved, seconded by Ms. Reilly that the meeting be
opened for public comments. Carried.
There being no comments, Mr. McCarthy moved, seconded by Mr.
Barstow that the meeting be closed to the public. Carried.
Discussion followed regarding various options available rather
than a fourteen foot high wall.
Chairman Nazemetz stated that the wall would be approximately
148 feet long, two feet above grade rising gradually from four feet
to fourteen feet high, thirty inches in width at the highest point.
Mr. Turnquisit stated there will be a black chain link fence
on top of wall from the beginnin to the end on the side yard and on the
front yard the fence will be three feet high.
Ms. Aloia stated she was opposed to the wall as the project
was in the center of the village and the wall would be an eyesore.
She stated she would like to see another plan.
Ms. Fina stated she favored a type of planting that would be
green all year round in order to cover the wall.
Discussion followed regarding the wall and if it had been
approved by the Planning Board.
Chairman Nazemetz moved, seconded by Mr. McCarthy that the
wall be a crib type retaining wall with four foot high chain link
black fence and that planting be honeysuckle or planting recommended
by Village's Planning Consultant.
Chairman Nazemetz polled the Board as follows:

Joseph Barron-28 Pine Street-One Family to Two Family
Mr. Barstow stated he would abstain from discussion in the

matter.
Mr. Turnquist, Architect for the project stated it was totally
redesigned since the last meeting and outlined the new plan. He stated
that the house was a one story ranch and they would like to raise the
roof and add a second floor.
Discussion followed regarding the various changes to be made,
type of construction and type of shingles to be used.
Ms. Fina moved, seconded by Mr. Nazemetz that the plans be
approved as submitted. Carried. Mr. Barstow abstained.

Jose Rivera, (Columbus Cargo Express)188 Cortlandt Street-Neon Sign.

Mr. Rivera failed to appear
the next meeting in December.

Omar Rivera, 15 Elm Street-Revision of roof, soffit, roof line
and windows.
Mr. Rivera presented affidavits of service to Attorney.

Mr. Barstow stated that approval for the project was obtained
in March, 1995 and he was asking approval for revised plans to the
roof, soffit and roof line and windows.
Mr. McCarthy moved, seconded by Ms. Reilly that the meeting be
open to the Public for comments. Carried.
There being no public comments, Mr. McCarthy moved, seconded by
Ms. Find to close the public meeting. Carried.
Discussion followed regarding the various changes and request
for approval.
Ms. Reilly moved, seconded by Ms. Fina that the application be
approved as submitted. Carried. Mr. Barstow abstained.
6.

Colabella Contracting-Tappan Avenue-Fence-Split Rail.
Applicant presented affidavit of service to Attorney.

Applicant presented pictures of fence to be installed along
the property line.
Chairman Nazemetz stated he had received a letter from Mr. &amp; Mrs.
Luigi Tucci, 45 Dell Street stating they object to the fence and would
like a retaining wall built with a chain link fence on top.
Mr. McCarthy moved seconded by Ms. Reilly that the meeting be
opened to the public for comments.

There being no public comments, Mr. Barstow moved, seconded
by Ms. Fina that the meeting be closed for public comments. Carried.
After a discussion Mr. Nazemetz moved, seconded by Ms. Fina
that approval be granted for a four foot high fence beginning twenty
feet from the front property line. Carried.
7.

Anna Ciampa, 286 No. Washington Street-Discussion. Fence.

Discussion followed regarding fence and condition of fence
at 286 North Washington Street.
Discussion followed regarding addition to Kitchen and garage
at 65 Howard Street.
Attorney stated that the applicant must resubmit
as the motion was denied.
Chairman Nazemetz stated that the December meeting will be held
on December 2 7th.
Minutes- Mr. McCarthy moved, seconded by Mr. Barstow that the minutes
of the meeting held on October 25, 1995 be approved as submitted.
Carried.
Chairman Nazemetz stated he had visited the site on 286
North Washington Street ans inspected the fence and feels that the
fence can be repaired and that the fence can be cut down to five
feet and refinished.
There being no further business to come before the Board,
Mr. McCarthy moved, seconded by Ms. Reilly that the same be duly
adjourned. Carried.
