https://sleepyhollow.localarchives.org/files/original/b759e0222e7ae9be7cb320b49633ba39.pdf 4d5a2114619a872efb475836525d2d41 PDF Text Text Resolution of the Board of Trustees of the Village of Sleepy Hollow on Settlement of Claim on Sanitation Charges WHEREAS, Ronald Yarrobino ("Claimant") has made claim against the Village of Sleepy Hollow for $10,945.00 principal due for sanitation charges mistakenly billed and paid with respect to the premises commonly known as 225 North Washington Street, Sleepy Hollow, New York f Premises"), for the period covered by Village statements from January 2011 until April 2016 fClaim"); and WHEREAS, Village personnel have confirmed amounts billed to and paid by Claimant and identified $10,926.67 sanitation charges mistakenly billed and paid with respect to the Premises for the period covered by Village statements from January 2011 until April 2016; and WHEREAS, Claimant is willing to accept refund of sanitation charges mistakenly billed and paid with respect to the Premises for the period covered by Village statements from January 2011 until April 2016 by a credit against future water, sewer, and sanitation charges billed by the Village with respect to the Premises; and WHEREAS, the Board of Trustees has considered the sanitation charges billed to and paid by Claimant, the "Voluntary Payment Doctrine" to the extent recognized In New York, and Claimant's willingness to accept refund by a credit against future charges; and WHEREAS, the Board of Trustees has found that resolution of the Claim by refund of $10,926.67 to Claimant will avoid potential cost, time, and risks of litigation; NOW, THEREFORE, be it RESOLVED, that the Board of Trustees approves and authorizes refund of $10,926.67 to Ronald Yarrobino on account of sanitation charges mistakenly billed and paid with respect to the premises commonly known as 225 North Washington Street, Sleepy Hollow, New York, for the period covered by Village statements from January 2011 until April 2016; and be It further RESOLVED, that such refund shall be implemented by crediting the premises commonly known as 225 North Washington Street, Sleepy Hollow, New York, with payment of $10,926.67 to be applied to future water, sewer, and sanitation charges billed by the Village with respect to the premises until exhausted; and be it further RESOLVED, that the Village Administrator and Village Attorney are directed to negotiate and the Village Administrator is authorized to sign or accept any document to �evidence satisfaction of tlie Claim so long as no provision of the docunfient is material and adverse to the Village's interests and so long as the document Is approved by Village Attorney as to form and substance. Now, Therefore, Be It resolved that the Mayor and the Board of Trustees of the Village of Sleepy Hollow approve the posting of such position for full-time Laborer(s) for ten consecutive days effective August 24, 2016. Moved: Trustee Leavy Seconded: Trustee Scaglione Vote: Unanimous �Resolution of the Board of Trustees of the Village of Sleepy Hollow Accepting Resignation of Public Works Deparment Employee Whereas, John Arena, by the attached letter dated August 1, 2016, and effective August 14, 2016 submitted his resignation letter from the Sleepy Hollow Public Works & Water Department, where he has worked as the Water Treatment Plant Operator Type II-B since 1998, and Whereas, said resignation letter must be formally accepted by the Village of Sleepy Hollow Board of Trustees, and Whereas, the Village, by resolution number 07/138/03 dated July 15, 2003, adopted a policy for employee termination and rehire, and Now, Therefore, Be it Resolved, that the Village accepts the resignation of John Arena by the attached letter dated August 1, 2016 and effective August 14, 2016, and finds that the termination/rehire policy of July 15, 2003 applies, and Be it Further Resolved, that a copy of the policy is forwarded to and a copy be placed in his personnel record with proof of service, and Be it further Resolved, we thank Mr. Arena for his 18 years of service and wish him well. Moved: Trustee Scaglione Seconded: Trustee Gebler Vote: Unanimous �Resolution of the Board of Trustees of the Village of Sleepy Hollow Approving Conference BE IT RESOLVED that the Mayor and Board of Trustees of the Village of Sleepy Hollow authorize the Court Clerk, Larry Cassidy, to attend the New York State Association of Magistrates Court Clerks 2016 Annual Conference from September 24, 2016 to September 28, 2016, and BE IT FUTHER RESOLVED that the fee to attend this conference is $642.00 Moved: Trustee Gebler Seconded: Trustee Scaglione Carried: Unanimous �Resolution Calling Public Hearing on a Local Law Amending Chapter 400 of the Code of the Village of Sleepy Hollow Entitled ''Vehicles and Traffic" to Grant the Board of Trustees and Police Chief Authority to Temporarily Suspend and Impose Parking Restrictions BE IT RESOLVED that the Board of Trustees hereby schedules a public hearing to be held on Tuesday, September 13, 2016, at 7:00 PM, or shortly thereafter, at Village Hall, 28 Beekman Avenue, Sleepy Hollow, New York, to hear and consider comments from members of the public on the proposed Local Law entitled: "A Local Law Amending Chapter 400 of the Code of the Village of Sleepy Hollow Entitled "Vehicles and Traffic" to Grant the Board of Trustees and Police Chief Authority to Temporarily Suspend and Impose Parking Restrictions;" and be it further RESOLVED, that the Village Clerk shall give due notice of this public hearing in accordance with the Village Code and the provisions of the Municipal Home Rule Law of the State of New York.
