SEQRA FINDINGS STATEMENT FOR
EAST PARCEL REDEVELOPMENT
SLEEPY HOLLOW, NEW YORK
WHEREAS, this document is a Findings Statement prepared pursuant to the New York
State Environmental Quality Review Act, Article 8 of the Environmental Conservation Law,
6N.Y.C.R.R. Part 617 (collectively referred to as "SEQRA") concerning the proposed
redevelopment of a portion of the former General Motors ("GM") automotive assembly plant,
known locally as the East Parcel, located at 60 Continental Street, Sleepy Hollow, New York,
and which consists of two parcels: Section 115.10 Block 1 Lot 2 and Section 115.11 Block 1 Lot
85, totaling approximately 28 acres (the "Project Site"); and
WHEREAS, the Village of Sleepy Hollow (the "Village") conducted an extensive
SEQRA review, and has approved various applications submitted by Lighthouse Landing
Ventures, LLC and its predecessors in interest in the former General Motors North Tarrytown
Assembly Plant property (the "GM Property"), for redevelopment of the GM Property which
consisted of a 64± acre parcel known as the West Parcel, a 1.67± acre parcel known as the South
Parcel and the aforementioned East Parcel; and
WHEREAS, the Village, as part of the SEQRA review for redevelopment of the GM
Property, considered at a conceptual level redevelopment of the East Parcel for certain
community related uses such as a new Department of Public Works ("DPW") facility; bus repair
garage; overpass connecting the East Parcel and West Parcel; recreational facilities; and parking
resources; and
WHEREAS in 2003, the East Parcel was entered into a Voluntary Cleanup Agreement
for the Project Site with the NYS Department of Environmental Conservation ("NYSDEC"), and
subsequently, in 2005, entered into a Brownfield Cleanup Agreement ("BCA"); and
WHEREAS, the East Parcel is subject to a Site Management Plan prepared as an element
of the remedial program for the GM Property under the New York State Brownfield Cleanup
Program ("BCP") as administered by NYSDEC dated December 2013 ("SMP"); and
WHEREAS, as part of the application processes and previous decisions and agreements
between the Village, Lighthouse Landing Ventures, LLC and its predecessors in interest, the East
Parcel (Section 115.11 Block 1 Lot 2 and Sect. 115.11 Block 1 Lot 85, generally the terminus of
Continental Street) was to be conveyed to the Village, or its designee; and
WHEREAS, the Village established the Sleepy Hollow Local Development Corporation
(the "LDC") as a not-for-profit local development corporation with purposes and powers that
include constructing, acquiring, rehabilitating for use by others, and assist financially with the

�WHEREAS, the Project as initially submitted called for a new DPW facility; a bus repair
garage, an overpass connecting the East Parcel with other GM Property known as the West
Parcel (now known as Edge-on-Hudson); recreational facilities; and parking resources; and
WHEREAS, on October 26, 2015, the LDC adopted a resolution declaring their intent to
act as Lead Agency and coordinate the environmental review of the Project under SEQRA and
caused to be circulated a notice of intent to act as Lead Agency to a list of potential involved
agencies and interested agencies, and provided the agencies with an opportunity to respond; and
WHEREAS, the LDC received correspondence from the New York State Department of
Transportation (the "NYSDOT"), the NYS Office of Parks Recreation and Historic Preservation
(the "OPRHP"), and the Village of Tarrytown, none of which objected to the LDC acting as
Lead Agency for purposes of the SEQRA review of the Project, and no other agencies
responded; and
WHEREAS, the Village Board is an Livolved Agency under SEQRA due to their
authority to grant a special permit and approval of a Concept Plan as authorized under the
Village of Sleepy Hollow Zoning Code; and
WHEREAS, the LDC briefed the Village Board on the Project in November and
December of 2015, and the Village Board concurred in the LDC's declaration of Lead Agency;
and
WHEREAS, on or about December 7, 2015, the LDC, as a "local authority" as defmed
within Section 2 of the Public Authorities Law, and an "Agency" as defmed pursuant to 6
NYCRR Part 617.2 (c) and (v), declared itself Lead Agency for the SEQRA review relating to
the Project; and
WHEREAS, the LDC circulated a preliminary Scoping Outline on the Project for
distribution along with a conceptual level plan of the Project, to all interested and involved
agencies for their review and input; published the notice of the scoping session in the
Environmental Notice Bulletin and held a public scoping session on the Project (the "Scoping
Session") on December 21, 2015 at 7:00 PM at Village Hall, 28 Beekman Avenue, Sleepy
Hollow, New York 10591, where all members of the public were provided an opportunity to be
heard; and
WHEREAS, the LDC closed the Scoping Session on December 21, 2015, but allowed for
additional time so that written comments could be submitted through and until January 4, 2016;
and
WHEREAS, on or about January 4, 2016, the LDC revised the proposed Scoping Outline
to reflect the substantive comments submitted, and adopted an amended Scoping Outline; and
WHEREAS, the LDC received copies of a preliminary DEIS on July 8, 2016 and
initiated a SEQRA completeness review; and

�•

The proposed regulation size baseball diamond was replaced by a full size multipurpose recreation field which was relocated from the southern portion of the
Project Site;

•

Proposed managed parking field was reduced from 500± spaces to approximately
400 spaces;

•

The proposed community center was expanded from a 10,000 square foot
footprint to a 21,000 square foot footprint and relocated;
An area was created for various court sports and an approximately 7,500 s.f. skate
park;

•

A passive open space "Great Lawn" was relocated from the northern portion of
the Project Site to the southern; and,

•

An at-grade roadway was proposed connecting to Beekman Avenue.

WHEREAS, copies of the preliminary FEIS were circulated to the Village Board, given
their role as an approving authority and comments on the FEIS were provided to the LDC; and
WHEREAS, the LDC and the Village Board both provided written comments on the
FEIS with respect to its adequacy and accuracy and caused revisions to be made to the FEIS; and
WHEREAS, on March 27, 2017 the LDC found that the FEIS was accurate and adequate
with respect to its scope and content, and accepted the FEIS as complete pursuant to 6
N.Y.C.R.R § 617.9 of the SEQRA regulations; and
WHEREAS, the LDC directed that a copy of the accepted FEIS be placed on the LDC's
website; a notice of completion of the FEIS shall be filed with the NYSDEC Environmental
Notice Bulletin; copies of the FEIS provided to the Mayor of the Village of Sleepy Hollow, all
involved and interested agencies, and NYSDEC's Division of Environmental Permits; and a
copy of the FEIS and Concept Plan submitted to the Village Clerk as part of the formal
submission for the required special permit and Concept Plan approval from the Village Board;
and
WHEREAS, the LDC also directed that a copy of the completed FEIS and Concept Plan
shall be placed on file at the public library, made available on the Village's publicly-accessible
Website, and that all involved and interested agencies and the public be provided ten (10)
calendar days in which to consider the FEIS before the LDC issues it written findings statement
pursuant to 6 N.Y.C.R.R. § 617.11; and
WHEREAS, on March 29, 2017, a representative of the LDC appeared before the Village
Waterfront Advisory Committee ("WAC") for a final consistency review with respect to the
goals and policies detailed in the Village's LWRP; and

�WHEREAS, the Village Board met on August 15, 2017 to review all correspondence
submitted on the FEIS, special permit public hearing and referral document from the Planning
Board and WAC; and
NOW THEREFORE BE IT RESOLVED that the Village Board determined that the
informational and procedural requirements of SEQR applicable to the Concept Plan as presented
in the DEIS and FEIS have been met, as evidenced by the recitals above, enabling the Village
Board to take a hard look at the potential adverse environmental impacts of the Project described
in the revised Concept Plan; and be it further
RESOLVED that having reviewed the DEIS, the FEIS, comments received from the
public, interested and involved agencies, Village staff and consultants, and upon the entire record
of the Project, the Village Board makes the following findings and determinations pursuant to
SEQRA and 6 N.Y.CR.R. § 617.11:
Evaluation of Potential Impacts
Consistent with the categories outlined in the LDC Findings, the Village Board has evaluated the
proposed Concept Plan and makes the following findings:
•

Land Use and Zoning - no change in the potential environmental impacts
addressed in the LDC Findings;

•

Visual Impacts - no change in the potential environmental impacts addressed in
the LDC Findings;

•

Stormwater management - no change in the potential environmental impacts
addressed in the LDC Findings;

•

Traffic and Transportation - no change in the potential environmental impacts
addressed in the LDC Findings with the exception that the LDC now controls the
former UAW property located along Beekman Avenue which allows for the
ability to create an at-grade secondary access to the East Parcel from Beekman
Avenue;

•

Cultural Resources - no change in the potential environmental impacts addressed
in the LDC Findings;

•

Construction - no change in the potential environmental impacts addressed in the
LDC Findings;

•

Utilities - no change in the potential environmental impacts addressed in the LDC
Findings;

•

Alternatives - no change in the potential environmental impacts addressed in the
LDC Findings;

�a.

Comprehensive Design
The Project includes a comprehensive development plan for the Project Site with
land use elements that complement each other, are compatible with the
surrounding area and which will create a public amenity and revitalize an
underutilized brownfield site.

b.

Relationship to Uses on Surrounding Public Property
The proposed Concept Plan creates or enhances pedestrian connections to the
surrounding community. The Concept Plan includes the creation of a multipurpose trail system that connects to DeVries Park to the north and Bamhart Park
in the south. Mitigation proposed as part of the improvements to Continental
Street include creating new sidewalks where none existed before enhancing
access to the neighboring Continental Street neighborhood.
The existing
Horseman's Trail currently leads to an entrance to the HHV property, which is
closed to the public when the facility is closed or when it is holding events. The
new multi-purpose path system now also connects the Horseman's Trail to the
proposed sidewalk system in Continental Street enhancing access for the public.
The revised Concept Plan has expanded the buffer are in the northern portion of
the East Parcel adjacent to DeVries Park and the Pocantico River shoreline to
approximately 2.7 acres.

c.

Provision of View Corridors:
The Village's LWRP identifies locally important scenic views/viewsheds
including those from DeVries Park and Barnhart Park. Given the difference in
elevation from the lower levels of the East Parcel to the surrounding
neighborhood and as illustrated in the FEIS, views of the Hudson River will be
maintained. The conceptual landscape plan prepared as part of the FEIS
introduces opportunities to visually connect and buffer surrounding uses including
DeVries Park and the HHV facility. In addition, the East Parcel will be improved
with new buildings and structures that will not impair views from the adjacent
properties to the east of the East Parcel.

d.

Architectural Design Standards
The LDC has prepared a series of precedent examples of the type of architectural
treatment that could be incorporated as part of the final design of the new DPW
facility. This includes a design treatment that is not utilitarian in concept but
respects Sleepy Hollow's rich history such that the main garage takes on more of

�proposed overpass will include a sidewalk for pedestrian use. The proposed
improvements to Continental Street will include the in-fill of sidewalks along the
entire length of the street and the proposed at-grade connection to Beekman
Avenue will include a sidewalk. The right-of-ways and pedestrian walkways have
been designed to accommodate their projected usage and promote safety and
efficiency of movement. The Project also introduces walkways and bicycle paths
throughout the open space, allowing for continuous access from adjacent open
spaces (DeVries Park and Barnhart Park) and throughout the Project Site.

j.

Public Access
The Project provides pedestrian access to all points north, south, east and west to
integrate the East Parcel with the surrounding neighborhoods and the Village as a
whole. The open space has also been designed with connections to surrounding
open spaces such as DeVries Park and Barnhart Park. An extension of the
Horseman's Trail will enhance circulation during those times that access to HHV
is prohibited. The Project also provides for expanded recreational uses, parking
on the East Parcel to support Village events and overflow events for HHV
activities.

k,

Off-Street Parking and Loading
The Project includes sufficient parking to accommodate day-to-day uses in atgrade and below building locations totaling 237± spaces. Of that total, 73 spaces
are proposed to be used as parking to support the multi-purpose field use, skate
park and court sports and would be designed to utilize a grass-crete type paver
system which provides for a pervious treatment. The managed parking field area
will consist of a permeable structurally reinforced grass treatment over a gravel
reservoir with an underdrain system so that it can be temporarily used as overflow
parking but maintain a high permeability with respect to stormwater runoff. The
provision of the managed parking field helps to support HHV's mission with
respect to the events that they can hold within the community.

I,

On-site Utilities and Services
All new utilities within the Project will be located underground. As described
below, the Project will be served by public water and sewer systems, which will
have adequate capacity to serve the new uses. The Project also incorporates a
comprehensive stormwater management system that will provide water quality
treatment of surface runoff from buildings and pavement areas prior to discharge
to the Pocantico River.

�the uses (multi-purpose field/community center/great lawn), a reduction in the number of spaces
in the managed parking field and the inclusion of new uses (skate park) at the request of the
public during the DEIS public comment period. The Project meets all of the RF district
dimensional and general development requirements and satisfies the general design standards of
the RF district. The Project is also consistent with the various local and regional public policy
and planning documents in terms of density, types of uses, recreational and open space linkages,
reinforcement of existing centers of development, and economic revitalization.
Findings
The Project will transform the Project Site from a vacant, almost entirely impervious surface
consisting of an asphalt parking lot, into a vibrant center for recreational and communal public
uses. The LDC finds that the types of uses proposed are commonly found in a village-type
setting and are compatible with surrounding development patterns. The types of buildings to be
developed are also representative of architectural elements found in other historic Hudson River
communities.
The LDC finds that with implementation of the mitigation measures and the reconfigurations
noted above, the Project is consistent with the applicable requirements of Village zoning, the
LWRP, the objectives and regulations of the RF Riverfront District, and with public policy as
reflected by the various land use and planning studies discussed above.
B.

Visual Resources

Potential Impacts
1.

In total, the Concept Plan presented in the FEIS includes approximately 24 acres that
would be devoted for open space or public uses. In response to comments on the DEIS,
the Concept Plan presented in the FEIS includes an expanded buffer area totaling
approximately 2.7 acres in the northern portion of the Project Site adjacent to DeVries
Park. The neighborhood to the east and south of the East Parcel is located at a
topographically higher elevation (approximately elevation 65 compared to the proposed
elevation of the East Parcel (approximately 19 with fill for the DPW). Even with the
incorporation of the fill necessary for the DPW site and the proposed building elevations,
the viewshed towards the Hudson River from the neighborhood to the East will not be
impeded.

2.

The most prominent component of the Project would be the proposed Continental Street
Overpass, which is anticipated to rise to an elevation of approximately 25 feet, which is
roughly consistent with the existing pedestrian overpass, which at one time connected the
East and West Parcels.

�that occurred throughout the 1900's. This included the Village's use of a portion of the
East Parcel as a municipal landfill and finally as GM converted the East Parcel into a
parking lot for workers at the plant and for rail sidings as part of the GM distribution
system.
Potential Impacts
2.

The Project will substantially reduce the overall amount of impervious area from
approximately 21 acres to approximately 9 acres (a 58% reduction), significantly
reducing peak stormwater runoff rates and stormwater pollutant loadings. With the
addition of pervious areas more stormwater should drain vertically through the soil,
thereby significantly reducing the overall volume of stormwater draining off the Project
Site compared to when the Project Site was mostly paved. In addition, a comprehensive
conceptual storm sewer system has been designed to collect and transport storm flows
off- site to the Pocantico River.

3.

The Project is designed to comply with the Village's Flood Damage Prevention Law.
Grading on the East Parcel has been designed to permit building first floor elevations to
be set at a minimum of six feet above the revised 100-year flood elevation and based on
proper engineering designs will sufficiently protect the structures. The earthwork on the
East Parcel required to satisfy the requirements of the SMP and advance the proposed
East Parcel Concept Plan, will maintain the existing flood storage capacity of the East
Parcel and not impact off-site properties.

4.

On-site wetlands are limited to a series of man-made drainage ditches within the East
Parcel located between the existing railroad tracks and sidings and the asphalt parking
areas. Based upon the documentation contained in the DEIS and FEIS, these wetlands
are of low ecological function and quality. The Project will remove these ditches and
replace the function of the ditches through the creation of interconnected water quality
swales that would collect and treat stormwater from the DPW site, the proposed paved
parking areas, recreation facilities, roadways and fields on the East Parcel. Through the
planting of native plant species, new higher quality wetlands would be created in the
proposed swale located in the western portion of the Project Site. Section 418-13 of the
Village Code requires that losses to wetlands be mitigated by replacement, enhancement
or restoration of existing wetlands by a ratio of 2:1. As indicated in the FEIS, the
Concept Plan includes an area of at least 0.84 acres of new wetland vegetation along the
bottom of the swales, representing a marked increase from the existing 0.23 acres of
ditched wetland to be filled, and meeting the replacement standard of the Village Code.

5.

The limited flooding that presently occurs on the East Parcel results from upstream flows
during large storm events overtopping the river banks onto the Project Site. By
introducing pervious surface and fill to the East Parcel, the existing flood storage capacity

The reduction in impervious surface area by approximately 58 percent over existing
conditions reduces stormwater volume leaving the Project Site during storm events and
reduces the heat island effect during warm weather events on nearby receiving bodies of
water.

D.

Traffic and Transportation

The traffic to be generated by the Project includes residents, employees, and visitors to the
recreation facilities, community center and DPW.
1.

The DEIS Traffic Study analyzed the following intersections:
•

US Route 9 (Broadway) and Pocantico Street/Old Broadway/Philipsburg Manor
driveway
Pocantico Street and Continental Street

•

Continental Street and Pleasant Street

•

Continental Street and Kendall Avenue

2.

Existing traffic volumes were recorded at each of the preceding intersections to determine
peak AM, peak PM and peak weekend (Saturday) volumes. Automatic traffic recorder
("ATR") 24-hour counts were also conducted on Continental Street near the Pocantico
Street intersection during the same period as the manual counts. The ATR counts
collected traffic volumes and travel speed measurements. The traffic counts were
supplemented by information from NYSDOT and a separate traffic study conducted on
behalf of the Village. Based on a review of specific field conditions and existing traffic
volumes, existing capacity analysis for each intersection was determined.

3.

In order to evaluate future conditions without the Project an annually compounded
growth rate (2.5%) was added to the existing traffic volumes through to the design year
build out. Development activity associated with the Edge on Hudson development and
activity in the Village of Tarrytown were added as part of the vicinity development traffic
volumes.

4.

The number of vehicles to be generated by the project was then estimated based on
Institute of Transportation Engineers standards and assigned to the local road network
and from input provided by HHV for those selected times when there would be large
events requiring overflow parking.

Potential Impacts
5.

The trip generation estimates were prepared for the project based on traffic counts
conducted for the existing DPW facility, input from HHV on their proposed facility use
and trip generation data published by the Institute of Transportation Engineers in the Trip

�Findings
12.

The LDC shall support the implementation of the mitigation measures at the specific
intersection described above.

13.

The LDC finds that the measures described above will mitigate the potential traffic
impacts from the Project to the maximum extent practicable.

14.

The proposed at-grade connection to Beekman Avenue will further enhance traffic
circulation and access to the southern portion of the Village. The connection would also
include a sidewalk.

15.

The parking has generally been designed in coordination with the proposed uses, street
system and open space network.

E.

Natural Resources

Project Site History and Investigations
1.

GM purchased the East Parcel in 1960 after it had been filled. GM then added additional
fill and paved this area. The Village had used approximately ten acres of the East Parcel
as a landfill for municipal refuse and ash during the 1920s and 1930s. Additional urban
fill was added to the East Parcel through the 1950s, prior to GM ownership, for public
development of a football field, track, baseball field and other athletic facilities.

2.

In 2003, GM and Roseland entered into a Voluntary Cleanup Agreement with the
NYSDEC for the Project Site under that agency's Voluntary Cleanup Program.
Subsequently, in 2005, GM and Roseland entered into two BCAs with NYSDEC under
the State's BCP. One BCA is for the West Parcel (which includes the South Parcel for
this purpose) and the other BCA is for the East Parcel. NYSDEC is responsible for
administration of the BCP and the New York State Department of Health ("NYSDOH")
plays an advisory role in consultation with NYSDEC in regard to health-related matters.

3.

NYSDOH has guidance for evaluating potential soil vapor intrusion into closed
buildings; however, the guidance does not apply to concentrations of compounds in
subsurface vapors {i.e., soil gas). NYSDEC does have guidance for concentrations in
indoor air for certain constituents.

4.

The soil gas investigation revealed the presence of methane on the East Parcel from the
former Village landfill. The methane is trapped under the asphalt of the East Parcel.
Although not a significant health risk, methane can be flammable and explosive if
allowed to build up in enclosed spaces and can be considered a greenhouse gas.

Mitigation

�Site Management Plan: The SMP, approved by NYSDEC, includes a complete
description of the engineering controls {e.g., the cap and demarcation barrier) and
institutional controls {e.g., the prohibition on the use of groundwater) that will
need to be maintained under the Environmental Easement. It will also include the
following elements that will apply during the remediation, construction and/or
post-construction stages of the redevelopment:
Health and Safety Plan ("HASP"): The HASP will contain procedures that
govern remedial activities and assure compliance with the applicable
provisions of the Occupational Safety and Health Act and State
requirements. The HASP applies to remediation and construction workers
only. The HASP will require monitoring during remedial activities and
during construction activities that might disturb historic fill.
Community Air Monitoring Plan ("CAMP"): The CAMP will be
implemented consistent with NYSDOH and other applicable guidance for
such monitoring. The CAMP will provide for monitoring at construction
area perimeters and the Project Site perimeter for volatiles and particulate
matter, using real-time monitoring equipment, and will require the
suspension of activities until any exceedances are addressed.
The CAMP will ensure that members of the public are not exposed to
levels of dust or vapors above applicable guidelines or standards during
remediation and construction.
-

Dust and Vapor Suppression Measures: These measures will include
spraying water mist on accessways and equipment during excavation and
loading activities, and transporting waste loads in properly covered
containers.

-

Decontamination: The SMP will describe procedures to decontaminate
construction vehicles, typically by washing them down before they leave
the Project Site.

-

New Contamination: The SMP will describe procedures to follow if
additional contamination is discovered during either the remedial or
construction process. These would include protocols for notification of
the appropriate agency, sampling of any newly suspected unknown
contamination, stockpiling such material and offsite disposal, if required.
New Utilities: The SMP will require that trenches for new utilities will be
over- excavated (by approximately one to two feet on all sides) and
backfilled with clean fill.

�slopes will include the use of erosion control fabric and diversion of upland stormwater
runoff away from the slope until soil stabilization has occurred.
9.

The LDC notes that the SMP administered by NYSDEC addressed the underlying
environmental conditions and remediation necessary for the Project and will protect the
public health and the environment.

10.

The LDC finds that due to the primarily asphalt capped existing condition of the Project
Site, the potential impact on natural resources due to disturbance will be minimal, and
that the proposed mitigation will be adequate to mitigate any potential significant adverse
impacts to the maximum extent practicable. The Project further proposes significant tree
plantings throughout the Project Site and landscaping along street right-of-ways, within
the buffer area, plazas and open space areas. This introduction of substantial quantities of
new vegetation is also expected to enhance the quality of the Project Site's ecological
resources.

F.

Cultural Resources

Potential Impacts
1.

As part of the DEIS for Lighthouse Landing, a Stage lA Literature Review and
Sensitivity Analysis was prepared. The report reviewed site files from the NYSOPRHP,
and the NYS Museum, mapping dating back as far as 1725, and historical texts and
studies dating from 1900. The analysis concluded that if the southeastern portion of the
West Parcel and the South Parcel were undisturbed they would have a high potential to
yield prehistoric cultural resources. However, both of these areas have been profoundly
disturbed by prior industrial development. With the exception of these two areas, the rest
of the Project Site is man-made and therefore, based on the available documentation,
lacks potential for prehistoric resources. The southern portion of the land north of
Beekman Avenue, as well as the land to the south have both been impacted by past
development activities. Given these factors, the analysis concluded that the Project Site
lacks the potential to yield prehistoric cultural resources.

2.

Unlike the West Parcel, the East Parcel historically contained no structures, and until
construction of the railroad in the mid-19th century, was part of an embayment of the
Hudson River. After construction of the railroad cut off the area from the Hudson River,
the area was gradually filled with silt from the Pocantico River (with the result that the
Pocantico River became channelized upstream of the culvert under the railroad tracks
through which it flowed), and in the mid-20th century this area was filled to create the
General Motors parking lot. Prior to establishment of the parking lot, a portion of the
East Parcel was also used for a municipal land fill and Village athletic fields. Given
these factors, the analysis concludes that the East Parcel as a whole lacks the potential to
yield historic resources.

�sequence and number of construction workers required. The fill plan requires the import
of approximately 100,000 to 120,000 cubic yards of fill material to raise the Project Site
to the proposed grade and complete construction. The LDC has previously applied for
and received a fill permit from the Planning Board which has certain mitigation measures
that the LDC and its contractors must follow.
3,

The construction of the Project would also likely result in an increase in short-term
employment opportunities and increased patronization of existing retail and service
establishments with the Village.

4,

The Project could potentially increase noise levels in the short-term through construction
activity such as import of fill and the use of construction equipment as part of Project Site
development.

5,

Noise generated during construction comes primarily from the diesel engines that power
the construction equipment. The actual sound levels experienced by surrounding
residential uses will be a function of distance. Since the Project Site covers a large area,
as construction progresses no one existing use will be exposed to the same sound levels
over an extended period of time.

Mitigation
6.

Construction operations will be undertaken in accordance with all applicable Village
regulations. The construction work force typically has offset early arrival and departure
times which vary from the local peak commuter periods and will reduce traffic related
impacts to the local roadway network. All material storage, and construction staging and
employee parking will be provided on-site. The phased construction and provision of
adequate staging and material stockpile areas will; coordinated use of construction crews
and equipment; and the reduction of material deliveries.

7.

Typical measures proposed to be employed during project construction to ensure that dust
suspension is minimized include:
•

Keeping on-site construction vehicle speed low (under 10 mph);

•

Covering trucks carrying soils and other dry materials;

•

Covering exposed stockpiles of soil and gravel, or minimizing the height of these
piles;

•

Periodic washing of paved surfaces during dry periods;

•

Applying water, as necessary, during concrete slab removal and crushing;

�Findings
4.

In addition to the mitigation described above, the Project shall utilize certified watersaving devices as mandated by the NYS Environmental Conservation Law. In order to
provide for efficient water service and encourage further conservation, all project
buildings shall have waters meter installed in accordance with New York State Building
Code and applicable Village regulations. The LDC finds therefore, that with the
mitigation and conditions described above, the Concept Plan will avoid and/or mitigate
potential adverse impacts on existing utilities to the maximum extent practicable.

Alternatives
The DEIS considered a range of alternative development scenarios, including those established
in the Scoping Document. These alternatives are discussed below:
A.

No Action
The No Action alternative would leave the Project Site in its current condition,
predominantly paved and used for selected DPW operations and temporary parking and
storage. This is inconsistent and incompatible with the uses envisioned in the LWRP and
implemented as outlined in the RF-Riverfront Development district. This would not meet
the objectives of the LDC to return the Project Site to beneficial use and make the open
space resource available to the public. This alternative would permit continued untreated
stormwater runoff into the Pocantico River.

B.

Alternative Layouts
During the course of preparing the initial Concept Plan presented in the DEIS, the LDC's
design team prepared two alternatives which generally included less parking for the
public and different configurations of field layouts. These alternatives kept the overall
concept of providing for a DPW facility. Continental Street Overpass and recreation
fields but arranges the location and extent of the facilities in different configurations. It is
noted that the proposed parking configurations of these alternatives does address the
parking needs as expressed by Historic Hudson Valley relative to shared use for larger
events at the Philipsburg Manor Restoration facility.

C.

Alternative Uses
As part of the Alternative Layout design process described in B. above, the LDC's design
team evaluated the opportunity to incorporate different uses on the East Parcel, including
an indoor recreation facility with community space, an outdoor amphitheater, and artist
work space to support proposed activities on the West Parcel and active recreation
facilities (playground/tennis courts/basketball courts). The LDC has incorporated some
of these elements into the proposed Concept Plan presented in the FEIS and will provide
opportunity for additional public input as to prospective recreation and community uses.

�577 Village Code- compliant parking spaces. As before, the Project Site layout
continues to show a primary vehicular access to the shared parking areas off the
proposed Continental Street extension, but now also depicts potential internal
vehicular and pedestrian linkages between the shared parking areas on the East
Parcel and the overflow parking lot on the adjacent Philipsburg Manor site (which
would likely result in the loss of a few parking spaces if those linkages are made).
The existing driveway access to the Philipsburg Manor overflow parking lot near
the existing terminus of Continental Street would continue to function and would
be regularly used to provide access to the overflow parking lot at times when
HHV does not need to use the shared parking areas on the East Parcel.
Maintaining ease of access to the overflow parking lot directly from Continental
Street on a regular basis is also important because that parking lot is a primary
drop-off location for visitors to the Philipsburg Manor site and is also one of the
locations where handicapped accessible parking is provided.

F.

•

MLB regulation baseball field
The alternative Project Site layout continues to accommodate a regulation size
baseball field in the same general location as identified on the most recently
examined conceptual plan for this portion of the East Parcel, with ample area
provided for spectators to gather behind home plate and the first and third base
lines.

•

Supplementary parking for baseball field
The alternative Project Site layout includes a new conveniently located parking
area with 27 spaces and a vehicular turnaround area immediately to the west of
the baseball field near DeVries Park.

•

Flexible event/ park space
The alternative Project Site layout continues to include an area that would have a
grassed surface and could be used for multiple purposes, but the area available for
those purposes would be much larger.

Alternative Access
An alternative access being considered by the LDC includes a new at-grade roadway
leading to Beekman Avenue. Existing access to Beekman Avenue is provided by a
combination of at-grade and an elevated steel viaduct structure. Given the condition of
the existing elevated viaduct structure, extensive renovations would need to be made
bring it up to a standard where it could be used for vehicular traffic, although based on
existing reports it would still not be able to support the heaviest of the DPW vehicles.
The LDC is in the process of contracting for the removal of the viaduct. Alternative
access being considered would include an at-grade roadway leading from the East Parcel
to Beekman Avenue. It is noted that portions of this at-grade alignment run across

�Irreversible and Irretrievable Commitment of Resources
Construction of the proposed plan for the East Parcel as shown on the Riverfront Development
Concept Plan would result in the consumption of gasoline, oil and electricity used in the
operation and maintenance of construction equipment typical for municipal projects in the New
York metropolitan area. Once completed the new facilities would need energy for heating,
cooling and lighting. Project Site generated vehicular traffic would result in the consumption of
fossil fuels. This consumption is anticipated to be typical of similar recreational and municipal
uses developments in Westchester County.
As part of the initial stage of the project planning, energy efficiency and GHG reductions can be
addressed primarily through design targets. Energy efficiency strategies that result in a minimum
of 5% energy cost reduction compared to the New York State Energy Construction Conservation
Code will be the target. These could include an improved building envelope, efficient lighting,
efficient central heating and cooling equipment, efficient parking lot lighting, and use of Energy
Star appliances.
Once completed the new facilities would need energy for heating, cooling and lighting. Site
generated vehicular traffic would result in the consumption of fossil fuels. This consumption is
anticipated to be typical of similar developments in Westchester County.

Growth Inducing Impacts
The East Parcel SEQRA process evaluated, at a conceptual level, the redevelopment of the
existing DPW property along with other adjacent Village-owned or controlled properties. A
conceptual level analysis was prepared for potential build out scenarios of the approximately
1.93 acres of Village owned/controlled lands which ranged from 38 to 84 residential units. The
analysis included projected impacts associated with population, school age children, water and
sewer usage, peak hour vehicle trips and projected fiscal implications. It was noted that any
subsequent development of those properties would require a separate environmental and
waterfront consistency review.
BE IT FURTHER RESOLVED, that having considered the Environmental Record for the
proposed East Parcel Redevelopment Project, and having considered the preceding relevant
environmental impacts, facts and conclusions relied upon to meet the requirements of 6
N.Y.C.R.R. § 617.11, and having weighed and balanced the relevant impacts with social,
economic and other considerations, this Statement of Findings certifies that:

The requirements of 6 N.Y.C.R.R. Part 617 have been met; and

2.

Consistent with social, economic and other essential considerations from among the
reasonable alternatives available, the Project is one which avoids or minimizes adverse
