VILLAGE OF SLEEPY HOLLOW
MAYOR AND BOARD OF TRUSTEES
RESOLUTION GRANTING SPECIAL PERMIT AND APPROVING
THE RIVERFRONT DEVELOPMENT CONCEPT PLAN FOR THE
EAST PARCEL DEVELOPMENT
WHEREAS, an application to grant a Special Permit (the "Spccial Permit") and approve a
Riverfront Development Concept Plan (the "Concept Plan") for the construction of a Department of
Public Works facility, active and passive recreation uses including but not limited to an outdoor
amphitheater with great lawn, a multipurpose sports field, skate park and sports courts, a community
facility, parking, roadway improvements including but not limited to a vehicular and pedestrian
overpass from Continental Street to cross over adjacent Metro-North train tracks, and at the Village's
discretion, a proposed school district bus repair garage or other Village related use(s) (collectively, the
"Proposed Project") was made by the Sleepy Hollow Local Development Corporation (the "LDC" or
"Applicant") to the Mayor and Board of Trustees (the "Village Board") of the Village of Sleepy Hollow
(the "Village"); and
WHEREAS, the Proposed Project is proposed to be located on a portion of the fonner General
Motors automotive assembly plant property known as the East Parcel located at 60 Continental Street,
Sleepy Hollow, New York, and which consists of two parcels: Section 115.10 Block 1 Lot 2 and Section
115.11 Block I Lot 85, totaling approximately 28 acres (the "Project Site"); and
WHEREAS, the LDC acted as Lead Agency for the environmental review of the Proposed
Project conducted under the State Environmental Quality Review Act ("SEQRA") and prepared both a
Draft Environmental Impact Statement and Final Environmental Impact Statement, the latter of which
was formally submitted to the Village Board on or about March 27, 2017 in fulfillment of the
requirements for a special permit and Concept Plan approval; and
WHEREAS, the LDC determined in its Lead Agency Environmental Findings Statement
adopted April 24, 2017 (the "LDC Findings Statement"), that the Proposed Project, with the mitigation
measures identified therein, would minimize or avoid potential significant adverse environmental
impacts to the maximum extent practicable; and
WHEREAS, on June 20, 2017, the Village Board did entertain a presentation from WSP, the
Proposed Project engineers that reviewed the proposed application for special permit and RDCP
approval which included a detailed presentation of the proposed development program including the
initial phase of development which contemplates public infrastructure and public improvements
including public open space, including, but not limited to sewage, water, drainage, roads, sediment

WHEREAS, the record of the Proposed Project's approval process is fully described in the
Draft Environmental Impact Statement (accepted as complete on July 25, 2016 ("DEIS")), the Final
Environmental Impact Statement (accepted as complete on iVIarch 27, 2017 ("FEIS")), the Findings
Statement, the Village Board Findings Statement (adopted on September 12, 2017), and the
application materials referenced above; and
WHEREAS, the Village Board has reviewed the application for the Proposed Project in
accordance with Chapter 450-15.E.(2){a-c)and (3)(a-g) of the Zoning Code; and
NOW, THEREFORE, BE IT RESOLVED, that pursuant to Chapter 450-15.E.(2)(a-c) and
(3)(a-g) of the Zoning Code, the Village Board determines that the Proposed Project, as described
above and modified by the conditions enumerated in this Resolution of Special Permit and
Riverfront Development Concept Plan Approval, meets the following standards:

1.

Conformance of the Conccpt Plan with the Requirements of the Riverfront Development
District-§450-15.E(2)(a-c)
a.

[The Concept Plan] will substantiallyjulfiH all of the purposes of the Riverfront Development
Zoning District.
The overall purpose of the Riverfront Zoning District is to promote the policies and
purposes of the LWRP, including positive development and revitalization of the
waterfront area, while ensuring such revitalization is sensitive to the Village's coastal
and community resources. The proposed Concept Plan is intended to revitalize a
significant unused portion of the Village and replace an existing incompatible land
use, consisting almost entirely of impervious

asphalt parking

lot, with a

contemporarily designed DPW facility, active and passive recreation uses.

�complementary to the permitted uses in the Riverfront Development District; and are
compatible with surrounding development patterns and land uses.
The Proposed Project provides for a total of approximately 24 acres (approximately 85%
of the Project Site area) for open space, public interest, or public use (e.g., roads,
sidewalks and utility access). The open space includes an approximately 2.7 acre buffer
area in the northern portion of the Projcct Site, and 12± acres for active and passive
recreation uses.
c.

[The Concept Plan] will be consisteni with the policies andpurposes of the Village's
Local Waterfront Revitalizalion Program.
The Proposed Project has been reviewed by the Village's WAC for consistency with the
goals and objectives outlined in the LWRP. On August II, 2017, the WAC issued a
consistency recommendation that the Proposed Project was consistent with the LWRP
goals and objectives. The Village Board, as required under Chapter 414 of the Village
Code, has completed its own consistency determination and has found that the Proposed
Project, meets the specific requirements for promoting water compatible/water-enhanced
uses and is consistent with the goals and policies of the LWRP.

II. Conformance of the Projcct with the Conditions and Standards for Issuance of a
Special Permit - §450-15.E(3)
a.

The [ProposedProject] will fulfill all ofthe purposes of the Riverfront Development
Zoning District.
The overall purpose of the Riverfront Zoning District is to promote the policies and
purposes of the LWRP including positive development and revitalizalion of the waterfront
area, while ensuring such revitalization is sensitive to the Village's coastal and community
resources. For the reasons stated above, the Proposed Project fulfills this purpose. The
Village Board, after due consideration of the record, including the WAC's consistency
recommendation, fiirther finds the Proposed Project to be consistent with the goals and
objectives of the LWRP.

b.

The [Proposed Project] meets the riverjront development design standards set forth in §-ISOIS, to the extent applicable at the special permit stage.

�DPW facility will incorporate landscaping and screening which will mitigate operations
from the view of the surrounding neighborhood.
The Proposed Project is located in a low-lying area of the Village well below identified
view corridors (i.e.. Elm Street looking west and Bamhart Park looking north). Despite
raising the proposed land area associated with the future DPW site, the view corridors will
be maintained. The Proposed Project design also includes a continuous 2.7± acre open
space buffer along the Proposed Project's northern boundary with DeVries Park. Views
from the proposed amphitheater would be directed towards the Hudson River and would
include views of the new Mario Cuomo Bridge.
The environmental review process for the East Parcel development contemplated the
redevelopment of the existing DPW with preliminary fiscal projections of new ta.x
revenue. The economic stimulus of new residents and lax revenue would help support the
core area of the Village. The Proposed Project also includes a stormwater management
system and will result in a substantial reduction in impervious surfaces as compared to the
existing remnants of the former industrial use, which is anticipated to improve the quality
of water being discharged to the Pocantico River and eventually to the Hudson River. The
Proposed Project design therefore appropriately appreciates and addresses the Site's
important relationship to the Hudson River.

8.

Relationship to uses on Surrounding Property
As noted above, the East Parcel is adjacent to two major Village parks DeVries Park to
the north and Bamhart Park to the south.

The Concept Plan includes physical

comieciions to both through a series of multi-use trails suitable for pedestrian and
bicyclists. In addition, improvements are contemplated that would: create an at-grade
vehicular connection to Beekman Avenue which would also include a sidewalk,
expanding access to the East Parcel for residents that live in the southern portion ofthe
Village; enhance the pedestrian sidewalk system along Continental Street that would
enhance access out to Route 9 and would become part ofthe Horseman's Trail, which
currently runs through the HHV's Philipsburg Manor Restoration and is not otherwise
always accessible lo the public; and create a pedestrian connection via sidewalk as pan
of the proposed Continental Street overpass to the West Parcel and the Edge on

Energy Conservation and Efficiency
The DEIS outlined the energy use from the Proposed Project. At this stage of the
project planning, energy efficiency and greenhouse gas (GHG) reductions can be
addressed primarily through design targets. Energy efficiency strategies that result in a
minimum of 5% energy cost reduction compared to the New York State Energy
Construction Conservation Code will be targeted. These could include an improved
building envelope, efficient lighting, efficient cenU-al heating and cooling equipment,
efficient parking lot lighting, and Energy Star appliances.

G.

Landscaping, screening and buffering (1-3)
The Proposed Project includes a comprehensive landscape planting plan that
incorporates native species as the planting element throughout the Proposed Project
Site. The landscaping will be designed to complement the project architecture and the
different project elements including the proposed buffer area in the northern portion of
the East Parcel, the area adjoining HHV, along the multi-purpose trail system and
within the proposed "Great Lawn". Shade trees will be planted along the new streets,
generally thirty to forty feet on center. A final detailed landscaping plan will be
prepared as part of the site plan application to the Planning Board.

H.

Lighting
The Proposed Project shall include a conceptual lighting plan that uses decorative
fixtures for the roadways, individual building lighting, pathway lighting, and open
space lighting all of which will be reviewed and approved by the Planning Board
during the site plan review process.

I.

Signage
Signage for the Proposed Project will be designed to complement the character of the
architecture and will be prepared for Planning Board review and approval as part of
the site plan review process.

All signage shall be in accordance with a

comprehensive signage plan and sized and scaled appropriately for its purpose.
J.

Vehicular circulation system and traffic access
The Proposed Project includes several opportunities for enhancing vehicular

On-site utilities and services (1-6)
The Proposed Project will be served by public water and sewer systems, which will
have adequate capacity to serve the new uses. All new utilities serving the Proposed
Project will be located underground.

The Proposed Project also incorporates a

comprehensive stormwater management system that will provide water quality
treatment of surface runoff from buildings and paved areas prior to discharge to the
Pocantico River.
N.

Floodplain Management
The Proposed Project has been designed to comply with the Villagers Flood Damage
Prevention Law and with the anticipated effects of climate changc and sea level rise.
The lowest habitable building floor on the East Parcel is at a minimum elevation of
approximately 19 to 20 feet, which is well above the 100-year flood elevation of
approximately 13.6 feet.

c.

Project]
will be in harmony with the appropriate and orderly
development of the Village's waterfront area.
The Proposed Project is the third Riverfront Development project to be constructed
within the Riverfront Zoning District. The area surrounding the Site is characterized
by a mix of retail and commercial uses, a number of residential areas, historic
properties, and public uses (e.g., DeVries Park, Bamhart Park). The Proposed Project
would transform the Project Site from an almost entirely asphalt parking lot into a mix
of public uses that include new DPW facilities, active and passive recreations uses,
community centcr and parking resources that would support both Village functions
and those sponsored by neighboring HHV.

These types of uses proposed are

commonly found in a mixed-use setting, are consistent with the permitted uses in the
Riverfront Zoning district, and are compatible with surrounding development patterns
and land uses. The Proposed Project also provides for a total of approximately 24
acres (approximately 85% of the Site area) to be utilized for open space, public
interest, or public use, including the approximately 2.7 acres of buffer area proposed

�and provides for meaningful permanent public open space and recreation
opportunities.

The Proposed Project allows for the Village to eventually

decommission and relocate its existing DPW facility and put that site to a higher and
better use. The Proposed Project also designates approximately 84% of the Project
Site for open space or other public uses and provides for a circulation network for
both vehicular and non-vehicular modes of transportation that significantly
strengthens the linkages and helps to better knit together the Village's various
neighborhoods. All of these items have significant value to the Village and help
advance the public interest.

NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Mayor and Board of
Trustees hereby approves the issuance of a Special Permit for the Proposed Project, and this
Resolution shall be such Special Permit, and hereby grants Riverfront Development Concept
Plan Approval for the c o n s t r u c t i o n of the Proposed Project conditioned upon, and
subject to the flill compliance with the following:
1.

This Special Permit is issued and the Riverfront Development Concept Plan Approval is
granted to the Applicant on the conditions set forth in this Resolution. The preparation of
any specific site plans and the pursuit of the resulting development program shall only comc
af^er specific approval by the Mayor and Board of Trustees for the LDC to prepare the Site
Plan application for submission to the Village of Sleepy Hollow Planning Board.

2.

The Proposed Projcct shall be constructed as described and detailed in the Riverfront
Development Concept Plan, by the Findings Statement, and by this Resolution.

3.

Prior to the issuance of any building permits a performance bond shall be submitted by
the LDC in an appropriate sum determined by the Village's Consulting Engineer and
Building Inspector in consultation with the LDC which shall be fiimished to and
accepted by the Village, to guarantee the satisfactory and complete insUllation of all
Phase I Site Development public infrastructure and public improvements for open space,
sewage, water, drainage, roads, and sediment and erosion control measures.

The

performance bond shall be approved as to form to the satisfaction of the Village
Attorney. A separate bond shall also be flimished in an appropriate sum determined by
the Building Inspector, the Village's Consulting Engineer and Administrator in

�shall constitute obligations that are binding upon the heirs, successors and assigns of the LDC,
respectively, and shall be enforceable by the Village Board or its designated representative; and be
it further
RESOLVED, that a certified copy of this Resolution be transmitted to the Village of Sleepy
Hollow Planning Board.
