Moved: Trustee Spiro Seconded: Trustee Scaglione Absent: Trustees Gebler and Gonzalez Vote: Unanimous �Local Law No. 1 of 2018 A LOCAL LAW AMENDING ARTICLE III OF CHAPTER 370 OF THE CODE OF THE VILLAGE OF SLEEPY HOLLOW ENTITLED ""TAX ABATEMENT FOR RENT CONTROLLED AND RENT REGULATED PROPERTIES OCCUPIED BY SENIOR CITIZENS OR DISABLED INDIVIDUALS" AND "TAXATION" REGARDING THE MAXIMUM INCOME LIMITS Be It Enacted by the Board of Trustees of the Village of Sleepy Hollow, New York, as follows: Section 1. Chapter 370, Article III, of the Code of the Village Sleepy Hollow entitled "Taxation" and "Tax Abatement for Rent-Controlled Properties Occupied by Senior Citizens" is amended at its title to read "Tax Abatement for Rent Controlled and Rent Regulated Properties Occupied by Senior Citizens or Disabled Individuals." Section 2. Chapter 370, Article III, of the Code of the Village Sleepy Hollow entitled "Taxation" and "Tax Abatement for Rent Controlled and Rent Regulated Properties Occupied by Senior Citizens or Disabled Individuals" is amended at Section 370-18.A to read as follows: § 370-18. Income limits; procedure for determination. A. No tax abatement shall be granted If the combined income of all members of the household for the income tax year immediately preceding the date of making application exceeds $40,000, provided that when the head of the household retires before the commencement of such year and the date of filing the application, the income for such year may be adjusted by excluding salary or earnings and projecting his retirement income over the entire period of such year. Section 3. The invalidity of any word, section, clause, paragraph sentence, part, or provision of this local law shall not affect the validity of any part of this local law which can be given effect without such invalid part or parts. Section 4. This Local Law shall take effect immediately upon filing in the Office of the Secretary of State. INTERAGENCY AGREEMENT This agreement made on the {1st.) day of (January), (2018), by and between North East Westchester Special Recreation Inc., a NFPC organized pursuant to laws of State of New York and the Town of Mount Pleasant, a municipal corporation of the State of New York, the Town of New Castle, a municipal corporation of the State of New York, the Town of Bedford, a municipal corporation of the State of New York, the Town of Somers, a municipal corporation of the State of New York, the Town of Lewisboro, a municipal corporation of the State of New York, the Town of North Castle, a municipal corporation of the State of New York, the Village-Town of Mount Kisco, a municipal corporation of the State of New York, the Village of Sleepy Hollow, a municipal corporation of the State of New York, the Village of Pleasantville, a municipal Corporation of the State of New York, The Town of North Salem, a municipal corporation of the State of New York, The Town of Pound Ridge, a municipal corporation of the State of New York, The Village of Briarcliff Manor, a municipal Corporation of the State of New York; shall enable said municipalities the opportunity to provide a collective program of Therapeutic Recreation services for individuals with disabilities through participation in (North East Westchester Special Recreation Inc.) Now, therefore, the parties hereto agree as follows: FIRST: The parties shall jointly operate a therapeutic recreation program for individuals with disabilities r e s i ^ g or domiciled within the corporation limits of their respective municipalities irrespective of age or degree of the disabling condition. SECOND: The program shall be funded through each municipality in accordance with a schedule of fees attached hereto and made part hereof establishing respective local shares which shall be in addition to any third party sources of funding. Additionally, the parties agree to help with fund raising events in support of North East Westchester Special Recreation Inc. Said local share shall be paid to North East Westchester Special Recreation in two installments; the first before the last day of February, and the second on the last day of July in any calendar year in which this agreement shall be operative. �THIRD: The substantive program policy shall be the joint responsibility of all the parties; but shalt be carried out administratively by North East Westchester Special Recreation, Inc.; in the manner as any other programs for which said municipality would othenA/lse individually be responsible. Administrative services include, but are not limited to, accounting, payroll, legal, personnel, insurance, and risk management. In addition, the agency on behalf of the program may apply and receive grants and other third party sources of revenue and may further enter into agreements on behalf of the program with other governmental agencies and non-profit organizations providing full or partial support of any program or activity to be provided hereunder. FOURTH: The Board of Directors, consisting of the Recreation Department Chief Administrator from each of the parties shall have policy making power for the program and which shall further have the power to adopt rules, regulations and procedures for the governing of the program affairs in a manner consistent herewith. FIFTH: North East Westchester Special Recreation shall procure and maintain liability insurance at its own cost and expense relating to all activities sponsored by and perfomned by the program, which insurance shall protect the interest of the parties hereto as named insured. Members of the North East Board of Directors shall be indemnified should suit be brought against them. A copy of the insurance coverage is submitted herewith naming North East Westchester Special Recreation, Inc. as the insured party to the benefit of the individual municipality. SIXTH: The chief fiscal officer of North East Westchester Special Recreation shall be the Treasurer. SEVENTH: Programs shall be held throughout the participating municipalities, utilizing existing community facilities. EIGHTH: North East Westchester Special Recreation shall provide sen/ices for residents of participating communities and will accommodate nonresident participants in accordance with agency guidelines currently enforced. �NINTH: TENTH: This agreement shall be effective for the calendar year and upon further agreement of the parties, may be amended and/or extended from year to year thereafter. This Agreement may be executed by the separate signatures of the parties hereto on any number of counterpart copies hereof, and each of said executed copies shall become effective when so executed by North East Westchester Special Recreation, Inc. and each particular municipality, and only after all of the municipalities to this Interagency Agreement have been signed, which would then bind all parties thereto. Each counterpart signed copy shall be deemed an original, but all of which together shall constitute one instrument. Ballard as Superintendent of Public Works from Westchester County Civil Service eligible list # 63-782, where he placed within top three scores, with the following terms and conditions of employment: 1. Waces: Mr. Ballard's base salary will be $130,000.00 prorated for any partial year of service. 2. Work Hours: With the prior approval of the Village Administrator, Mr. Ballard may flex his work hours within his defined workweek. 3. Vacation: Mr. Ballard will receive 20 vacation days each year, prorate for any partial years of service. 4. Villaae Vehicle: Mr. Ballard will be reimbursed for all mileage used in his personal vehicle for work related business or he Village may provide Mr. Ballard with a vehicle to be used for work-related travel in accordance with the Village's personnel manual. This vehicle may not be used for commutation purposes. 5. All other terms and conditions of employment will be as per the Village's then-current personnel manual and other policies and procedures, unless and until subsequently altered by Board resolution. BE IT FURTHER RESOLVED that said appointment is subject to a probationary period of twelve 12-52 weeks and the approval of the Westchester County Department of Human Resources. Moved: Trustee Spiro Seconded: Trustee Leavy Absent: Trustees Gonzalez & Gebler Vote: Unanimous �Resolution of the Board of Trustees of the Village of Sleepy Hollow Appointing Assistant Building Inspector Whereas, Robert Bischof is currently employed part-time as Assistant Building Inspector, by the Village of Sleepy Hollow's Building Department and performs in an exemplary manner and has the experience and knowledge needed for this position; Whereas, Robert Bischof has taken the required Assistant Building Inspector exam and placed first on the Westchester County's Assistant Building Inspector Local Eligible List #65-015. Now, therefore, be it resolved, the Board of Trustees hereby confirms the Mayor's appointment and the Building Inspector's recommendation of Robert Bischof to the full-time position of Assistant Building Inspector, effective January 2018, at an annual salary of $85,000.00 prorated for any partial year of service, and all other terms and conditions of employment should apply. Be it further resolved said appointment is subject to the approval of the Westchester County Department of Human Resources and a probationary period of twelve to fifty two weeks.
