                  <text>REGULAR MEETING

SLEEPY HOLLOW, NEW YORK
MAY 28th, 1997

A regular meeting of the Sleepy Hollow Architectural Review
Board was held on May 28th, 1997 at 8:00 P.M. in the Village Hall, Sleepy
Hollow, New York.
PRESENT:

James Nazemetz, Chairman

Rosaria Piomelli
Robert Barstow
Elvira Aloia
Barbara Fina
Louis Falasca

ALSO PRESENT:

Janet Gandolfo, Attorney
James Margotta, Building Inspector

Chairman Nazemetz called the meeting to order at 8:00 P.M.
1.

Augustin Triana, 128 Cortlandt Street-Renovations
Mr. Turnquist, Architect for the applicant stated that the project
was now in Phase II and presented plans and pictures for the Board to review.
Mr. Turnquist stated that it was decided to do the second and
third floors with a stucco finish and they have modified the lower level and
deleted the glass blocks, coloring will be tan with a neutral color around
the windows, the doors will be dark brown with brass hardware and the awning
will be burgandy with white lettering. Mr. Tuwnquist requested approval of
the changes.
Mr. Falasca moved, seconded by Mr. McCarthy to open the meeting
for public comments. Carried.
There being no public comments, Mr. Falasca moved, seconded by
Mr. McCarthy to close the meeting for public comments. Carried.
Discussion followed regarding windows and sills on the upper floors,
type of roofing, changes to cornice and proposed steps on the outside lower
level.
Mr. Falasca moved, seconded by Ms. Piomelli to approve the plans
as submitted with changes that supercede previous approval of October, 1996.
Carried.

2.

Rodrigues Enterprises, 106 Depeyster Street-Rehab building damaged by firs.

Mr. Turnquist, Architect presented plans and drawings to rehabilitate
the fire damaged building at the corner of Depeyster Street and Cortlandt Street.
Mr. Turnquist stated that the building had originally been a six
family dwelling apartment house and had been converted into a rooming house

�-2and it was now the intention of the owner to reconvert the building into a
six family apartment house. Mr. Turnquist stated that the windows had
been knocked out during the fire and will be replaced, the brick work is
damaged and will be cleaned and restored. He stated that the existing sills
and lintels are granite and will be restored, the windows will be white with
green trim and shutters will be added. There will be a canopy over the front
door with side lights. Mr. Turnquist stated that the fire-escape will be
repaired and repainted.
Mr. Falasca moved, seconded by Mr. McCarthy to open the meeting
for public comments. Carried.
There being no public comments Mr. McCarthy moved, seconded by
Ms. Fina to close the meeting for public comments. Carried.
Discussion followed regarding the front entrance and size of
transom over front door existing air conditioners and fire escape.
There being no further comments, Mr. Falasca moved, seconded
by Mr. McCarthy that the plans be approved as submitted with the exception
of the front entrance, and that the applicant submit a revised plans for
review at the next meeting to be held on June 25th. Carried.
Applicant presented proof of mailings to Building Inspector.
3.

Chris &amp; Staci Skelly, 130 New Broadway-Relocate deck stairs.
Architect presented proof of mailings to Clerk.

Architect presented pictures and plans of constructed deck and
stated that the applicant would like to relocate the stairs due to the
slope of the property and asked that the Board approve the change. He also
stated that previously the Board had recommended the change.
Mr. McCarthy moved to open the meeting for public comments,
seconded by Mr. Falasca. Carried.
There being no public comments, Mr. McCarthy moved to close the
meeting for public comments. Carried.
Discussion following regarding the relocating of the stairway
from the front of the deck to the side of the deck, the location of shrubbery
which would cover the stairway.
There being no further discussion, Mr. Falasca moved, seconded by
Ms. Piomelli that the plans be approved as requested and as suggested by the
Board at a previous meeting. Carried.
4.

Fanelli, Reddy, Minerva, 107, 109, 111 Bedford Road-Fence.

Applicants stated there was a retaining wall at the rear of the
three properties approximately four feet high and it was there intention to
install a fence on top of the wall for the safety of their young children.
They stated the fence would be approximately five feet in height and would be
a stockade fence installed on the rear and side yards.

�-3Mr. Falasca moved, seconded by Mr. Barstow that the meeting be
opened for public comments. Carried.
There being no public comments, Mr. Falasca moved, seconded by
Mr. McCarthy to close the meeting for public comments. Carried.
Applicants presented proof of mailings to the Clerk.
Discussion followed regarding landscaping on the wall and the
planting of ivy to cover the wall.
There being no further comments, Ms. Piomelli moved, seconded by
Mr. Falasca that the application for a five foot high stockade fence be
approved as requested. Carried. Ms. Aloia abstained.
5.

Alfredo DiPietro, Tappan Avenue-2-Family dwelling.
Mr. DiPietro presented proof of mailings to the Clerk.

Mr. DiPietro presented plans and pictures and outlined the
proposed plans for a two family dwelling.
Mr. Falasca moved, seconded by Mr. McCarthy to open the meeting
for public comments. Carried.
Mr. Margotta, Building Inspector presented copies of letter to
the Board regarding the concerns of neighbors at 45 Dell Street (copy in
official minutes).
There being no further public comments, Mr. Falasca moved, seconded
by Mr. McCarthy to close the meeting for public comments. Carried.
Discussion followed regarding the comments mentioned in the letter
regarding whether the lot was buildable.
Attorney Gandolfo stated that the Building Inspector can determine
whether the lot is buildable.
Mr. DiPietro stated that several years ago the property was subdivided and stated that the lot is 70 feet wide, and the Building Inspector
has stated the lot is buildable as 40 feet wide constitutes a building lot.
Discussion followed regarding front entry, front stairs, landscaping,
flues and chimney, garage and back windows.
Mr. Falasca moved, seconded by Mr. Barstow to approve the plans as
submitted with the exception of the front entry and front stairs, and basement
windows, and that a sketch be submitted by the next meeting outlining the
front stairway and landing as discussed and agreed to, and that the basement
windowsmatch and that planting be shown to cover the stairway% and that the
chimney and flue be revised as discussed. Carried.

Maria Graca, 139 New Broadway-Two family dwelling.

Ms. Piomelli excused herself from participating as a member of
the Board as she is the Architect for the applicant.
Ms. Graca presented proof of mailings to the Clerk.
Ms. Piomelli presented plans for a proposed two family prefab
dwelling, which conforms to the Zoning Code and stated that a entry porch
will be added which will be non-conforming and stated that all the houses
in the area are less than the required twenty feet from the front property
line.
Mr. McCarthy moved, seconded by Ms. Aloia that the meeting be
opened for public comments. Carried.
There being no public comments Mr. Nazemetz moved, seconded by
Mr. Falasca to close the meeting for public comments. Carried.
Discussion followed regarding the application and it was felt that
the applicant should appear before the Zoning Board before the Board approves
the application.
Discussion was had regarding the driveway and the garage
to be underneath the rear of the house. Also discussed was the type of
construction and the fire rating. Type of roof, soffit and cornice, front
yard and front porch, materials to be used were discussed.
Chairman Nazemetz stated that there were too many items that had
to be agreed upon and it was the consensus that the plans were too vague.
Mr. Falasca moved, seconded by Mr. Nazemetz that the matter be
adjourned and the applicant resubmit the plans for review after they have
appeared before the Zoning Board's next meeting to be held in June. Carried.
7.

Maria Graca, 143 New Broadway-Alteration

Ms. Piomelli presented plans for the alteration and conversion
of a one family dwelling into a two family dwelling and enclosing the front
porch.
Mr. Barstow stated the matter should be approved by the Zoning
Board before it is presented to the A.R.B.
Ms. Fina moved, seconded by Mr. McCarthy that the matter be adjourned
and that the applicant resubmit after they have appeared before the Zoning Board
Carried.
8.

James &amp; Patricia Nazemetz, 134 Hunter Avenue-Fence.

Mr. Nazemetz excused himself from participating as a member of
the Board as he is the applicant. Mr. McCarthy will act as Chairman.
Mr. Nazemetz presented proof of mailings to the Clerk.
Mr. Nazemetz presented pictures of his property and outlined where
the proposed three foot high chain link fence would be installed. He stated
his neighbors garbage cans were always rolling into his property and the fence
would prevent this.

Ms. Aloia moved, seconded by Mr. McCarthy to open the meeting for
public comments. Carried.
Mrs. Shafer, 124 Hunter Avenue stated she was the neighbor and she
objected to the fence being installed, and that part of the cement base had
heen taken up and pre-drilled holes where the fence was and she stated it
was a dangerous condition and people would be tripping over them. She also
questioned the placement of the fence stating she thought part of it would be
on her property.
Mr. Nazemetz stated that according to his survey the fence would
be entirely on his property.
Mr. McCarthy stated it was not up to the Board to determine the
placement of a fence.
Attorney Gandolfo stated that the Building Inspector would determine
the placement of the fence when he issues the building permit.
There being no further comments Mr. Falasca moved, seconded by Ms.
Fina to close the meeting for public comments. Carried.
After discussion, Ms. Fina moved, seconded by Mr. Falasca to approve
the application for the installation of fencing as submitted. Carried.
MINUTES
Mr. McCarthy moved, seconded by Mr. Barstow that the minutes of the
meeting held on April 23rd, 1997 be approved as submitted. Ms. Aloia and Mr.
Falasca abstained as they were not present. Carried.
OLD BUSINESS
Discussion was had on the Rodrigues Building on North Broadway
and Ms. Gandolfo stated that Mr. Rodrigues was appearing before the next
meeting of the Zoning Board for approval of the second floor.
There being no further business to come before the Board, Mr. McCarthy
moved, seconded by Mr. Falasca that the same be duly adjourned. Carried.
