                  <text>REGULAR MEETING

APRIL 22nd, 1998

A regular meeting of the Sleepy Hollow Architectural Review
Board was held on Wednesday, April 22nd, 1998 at 8:00 P.M. in the
Village Hall, 28 Beekman Avenue, Sleepy Hollow, N.Y. 10591.

Chariman Nazemetz called the meeting to order at 8 P.M.
L07 Devries Avenue Corp.-Installation of Fence.
Mr. Dermis Fitzgerald, Attorney presented Affidavit of Service
to Clerk.
1.

Mr. Fitzgerald stated that the owners were requesting permission
to install a fence, which conforms to all Village codes, and outlined the
type of fence, height of fence, removal of trees in order to install fence.
Mr. Nazemetz moved, seconded by Mr. McCarthy to open the meeting
tor public comments. Carried.
Mr. Frank Bateman stated he was a neighbor and was very disturbed
as how the matter was handled. Mr. Bateman stated that no permits were
issued for the removal of the beautiful trees and stated that the fence was
put directly on the property line and was ugly. He stated he was there when
the trees were being cut down and expressed his concern to the owners but
they paid no attention to him. He also stated that the fence was supposed
to stop the dog from roaming but the dog jumps over the fence.
There being no further comments, Mr. Nazemetz moved, seconded by
Mr. McCarthy to close the meeting for public comments. Carried.
Discussion followed regarding the size of the trees that were cut
down and whether a permit had been issued for the removal of the trees,
Ms. Fina stated she was very concerned that the residents are not
following the rules and regulations imposed by the Village and constantly
Jo things without permission and felt it was wasting the time of the members
to consider a matter after the fact.
Mr. McCarthy stated the Board should only act on the application
for the installation of a fence.
Ms. Piomelli moved,seconded by Ms. Fina that the application be
denied and that that trees be replaced.

Mr. Falasca moved, seconded by Mr. Nazemetz to table the matter
the next meeting in order to receive further information.

�-2Mr. Falasca stated that the removal of the trees without a permit
was an illegal action and should be referred to the Tree Commission for
review and await their recommendation before the Board takes any action.
Attorney Gandolfo stated that the Board has the authority to take
action on the matter of the fence and that the applicant may resubmit the
application after information is received from the Tree Corrmission. Ms.
Gandolfo stated that the Board should negotiate with the property owners
and not deny the permit.
Chairman Nazemetz asked Mr. Fitzgeral if the owner would be willing
to provide some planting in order to cover up the fence.
Mr. Fitzgerald stated that the issue was the fence and not the
replacement of the removed trees but he would discuss the matter with his
clients.
Mr. Barstow stated he felt the Board should move on the application
and that the matter of the replacement of the trees be referred to the Tree
Commission for action.
Mr. Falasca moved, seconded by Mr. Nazemetz that the matter be tabled
until the next meeting, that the matter be referred to the Tree Commission
for their recommendations, that the Attorney confer with his client regarding
trie replacement of planting to cover the fencing, and if the applicant does
not appear at the next meeting, the application will be denied and he be
directed tp remove the fence in question. CARRIED.
2.

Paul A. Nybo 199 Webber Avenue-Installation of Fence.

Mr. Nybo stated he was applying for permission to install a fence
around his property as he has a seventeen month old child. He stated part
of the property is already fenced in and he would be installed a five foot
high fence made of white pickets.
Mr. Nazemetz moved, seconded by Mr. McCarthy to open the meeting
for public comments. Carried.
There being no public comments Mr. McCarthy moved, seconded by
Mr. Falasca to close the meeting for public comments. Carried.
Discussion followed regarding existing fence, type of fencing to
be installed and height of fence.
Mr. McCarthy moved, seconded by Mr. Falasca to approve the application
to install a five foot high fence. Carried.
3.

Peter Castro-Amoco Station-335 North Broadway-Framed Sign.
Mi". Castro presented proof of mailings to Clerk.

Mr. Castro presented picture of type of portable sign to be placed
on the front of his property, said sign to be placed in the morning and to be
removed at night when the gas station closed.

for public comments. Carried.

Discussion followed regarding Village plans for the beautification
of Route 9from Pocantico Street to Beekman Avenue regarding plantings of tree
and shubbery.
Mr. Falasca moved, seconded by Mr. McCarthy to approve the application
as submitted.
Ms Fina stated the sign was toco large and is not nice to look at.
Ms. Piomelli stated she was

4.

Henry &amp; Sonya Lee-Chung-12 Webb Road - One story addition, second story
addition over garage.

Mr. Sam Vieira, Architect for Applicant presented affidavit of
service to Clerk.
Mr. Vieira presented pictures and drawings and outlined the
project stating that the addition would be approximately 16 x 16 and would
be in the rear of the house. He stated that had appeared before the Zoning
Board and several variances had been granted, and that setbacks, height
and coverage requirements are being met. Mr. Vieira stated that windows,
grills, and siding will all match the present building.
Mr. Nazemetz moved, seconded by Mr. Falasca to open the meeting
for public comments. Carried.
There being no public comments Mr. McCarthy moved, seconded by Mr.
Falasca to close the meeting for public comments. Carried.
Discussion followed regarding type of construction and size of
addition.
Mr. Falasca moved, seconded by Ms. Fina to approve the application
as submitted. Carried.

Romeo Forchetti, Tappan Avenue-Approval of Revised Plans-Two Family Res.
Mr. Forchetti presented Affidavit of Service to Clerk.

Mi". Forchetti stated that the approved plans called for cedar
and the completed house was done in brick and he would like the Board to
approve the change.
Ms. Piomelli stated that several changes were made including the
elimination of a dormer and the entry door was changed.
Mi\ Nazemetz moved, seconded by Ms. Piomelli to open the meeting
for public comments. Carried.
There being no public comments Mr. McCarthy moved, seconded by
Mi". Falasca to close the meeting for public comments. Carried.
Discussion followed and Board members agreed that the changes
that were made regarding the brick, the elimination of a dormer and changes
to the entry way were changes for the better.
Ms. Piomelli moved, seconded bv Mr. McCarthy that the approval
vf the revised plans be approved as requested. Carried.
Mr. Barstow stated that the changes that were made after approvel
of the plans were in violation and felt that approval should be asked for
before they proceed with the changes.

Donate DiFalco, 61 Sleepy Hollow Road-New One-Family Residence.

Mr. DiFalco presented plans and outlined the project stating that
the house would be a one family residence having a red brick front and siding
or stucco on the remaining building.
Mr. Nazemetz moved, seconded by Mr. Falasca to open the meeting
for public comments. Carried.
There being no public comments Mr. Nazemetz moved, seconded by
Mr. Falasca to close the meeting for public comments. Carried.
Discussion followed regarding elevations and the need for a wall

Mr. Nazemetz moved, seconded by Ms. Fina to table the matter until
the next meeting to be held May 27th and that the Architect appear and supply
mire information. Carried. Mr. McCarthy abstained.

�-57.Antonio Rodrigues, North Broadway-Preliminary Hearing.
Architect for the project which is the fire damaged building on
North Broadway stated that construction on the project was halted several
months ago and we are now applying for approval of a revised plan.
He stated
that the previous plans showed the building out to the front property line
and the revised plan set the building back ten feet from the front property
line and prsented a "Model" of the proposed building. Architect stated
that building would be stucco, double hung windows on the second floor, metal
roof to look weathered copper and color to be earth tone. He stated that the
sidewalk would be restored in keeping with the village standards. A dumpster
would be placed at the rear and would be screened.
Discussion followed regarding removal of steel framing and applicant
was directed to submit plans and documentation and return at the next meeting
to be held on May 27th, 1998.
Mr. Rodrigues stated he would like to start construction as soon
as possible and stated that the building would be completed within six months.
MINUTES
Ms. Piomelli moved, seconded by Mr. Falasca that the Minutes of the
meeting held on March 25th, 1998 be approved as submitted. Carried.
There being no further business to come before the meeting, Mr.
falasca moved, seconded by Ms. Aloia that the same be duly adjourned.

Re: Fence, Devries Avenue
Dear Board Members;
We are happy that the ARB is reviewing this backyard fence and disappointed that we
cannot attend the meeting this evening. We do not mind a fence in general but this particular one
has two problems:
1. It is ugly. It looks like a fort.
2. Although it is very tall, it cannot contain the American Pit Bull Dog who belongs to one
of the three unrelated tenants who rent the house. This dog is able to jump over this fence at will,
and has on many occasions come to my back door despite the fence. Since this large fence is not
tall enough to contain the dog, his owner currently ties up the dog when he is left outside. This
can be done with or without a fence.
We would be glad to work with the current owners on a more attractive fence design.
