Present: Mayor Kenneth G. Wray Deputy Mayor Glenn Rosenbloom Rachelle Gebler Sam Gonzalez John Leavy Sandra Spiro, Trustees Absent: Denise Scaglione, Trustee Also Present: Anthony P. Giaccio, Village Administrator Paula A. McCarthy Tompkins, Village Clerk Anthony Bueti, Police Chief Sean McCarthy, Building Inspector Clinton Smith, Village Counsel At 7:03 p.m. Mayor Wray called the meeting to order with a pledge to the flag and a moment of silence for Segundo Llavay, 46 years old of Sleepy Hollow, George Paiva, 82 years old of Florida and beloved father of a Village employee, Joseph Paiva, Judith Passariello, 72 year old and Alfonso Passariello, 91 years old, both longtime residents of North Tarrytown and Sleepy Hollow, and beloved parents of Village employee, Jerry Navin. Our thoughts are with their family and friends. Public Hearings: Sidewalk Cafe Permits and Floating Zones The Village Clerk read both Public Hearing announcements aloud for the record. Mayor Wray opened the Public Hearings and invoked the 5 minute rule. Michael Savitsky of River Street, addressed the Mayor and the Board of Trustees and stated he is opposed to any changes to code 362. He believes it is unfair to make new changes to the village code in a mixed use building for the sidewalk cafe permit. Daniel Convissor of Maple Avenue addressed the Mayor and the Board of Trustees and was supportive of the sidewalk cafe permit proposal. Mr. Convissor is generally in favor of the floating zones but had a few comments regarding slight changes to the proposal to encourage even more development. He also suggested that more affordable housing should be included in the proposal. There were no further comments at this time. On a motion by Trustee Gebler, seconded by Trustee Scaglione the public hearing regarding the sidewall cafes permit was closed. Motion carried. �On a motion by Trustee Gonzalez, seconded by Trustee Scaglione, the public hearing regarding the Floating Zones was adjourned until December 17th, 2019. Mayor Wray stated that it is important for all inputs/suggestions into the Comprehensive Plan should be submitted in writing to the Clerk's Office. Approval of Warrants: On a motion by Trustee Scaglione, seconded by Trustee Leavy, the warrant of $1,934,214.54 was approved and the Treasurer was authorized to process bills in this amount. Motion carried. Approval of Minutes: On a motion by Trustee Gebler, seconded by Trustee Leavy the minutes of October 15, 2019 were approved. Motion carried. Trustee Scaglione abstained. Approval of Minutes: On a motion by Trustee Gonzalez, seconded by Deputy Mayor Rosenbloom the minutes of November 12, 2019 were approved. Motion carried. Trustee Scaglione and Trustee Spiro abstained. Approval of Minutes: On a motion by Trustee Scaglione, seconded by Trustee Gonzalez the minutes of November 26, 2019 were approved. Motion carried. Deputy Mayor Rosenbloom abstained. Mayor's Announcements: Mayor Wray stated that the next Board meeting in December will be the 17th 2019. Mayor Wray stated that he recently met with the Department of Transportation (DOT) regarding the intersection of Route 9, Pierson and Gordon Avenues. Mayor Wray stated that a Christmas, musical pageant will take place at St. Teresa's Church on December 23rd. Administrator's Report: See attached Mayor Wray stated that progress is being made at the East Parcel. The wick drains contract will soon be awarded and the clean fill continues to come in. Public Comments: Mayor Wray opened the meeting to the public and invoked the 3 minute rule. Judy Knispel of River Street addressed the Mayor and the Board of Trustees and stated that the bulk head holes have expanded and its repairs should be a priority. There were no further comments at this time. �Mayor Wray stated that it is important for all inputs into the Comprehensive Plan be submitted in writing. Resolutions: (see attached) R1 - Bagged Parking Meters for the Holidays R2 - Approve Part-Time Hire - Recreation Dept. Communications: The Village Clerk sated that the 2020 calendar in now available on the Village's website. Hard copies will be out in the mail in a couple of weeks. New Business: Mayor Wray stated that he recently met with the Department of Transportation (DOT) and Senator Harckham regarding the intersection of Route 9, Pierson and Gordon Avenues, regarding pedestrian safety. Mayor Wray stated the DOT has agreed to allow a temporary bump out for safety reasons, and also agreed to place a walk light for pedestrians by the springtime. Public Comments: Mayor Wray opened the meeting to the public and invoked the 3 minute rule. Dan Convissor of Maple Avenue addressed the Mayor and the Board of Trustees and thanked the Mayor for meeting with the DOT. He thanked the Board of Trustees for everythinq thev do for the Village. There were no further comments at this time. At 7:30 pm, Mayor Wray asked for a motion to go into executive session to discuss a personnel matter. On motion by Trustee Gebler, seconded by Trustee Leavy, the Board went into Executive session to discuss a personnel matter. Opposition to Amending Village Code 362 Mayor Wray and Trustees, I live at 11 River Street which is a mixed use condominium. The one commercial unit within this condominium is a restaurant offering seasonal outdoor seating. I can only speak for my mixed use building AND I can tell you that outdoor seating DEFINATELY disrupts the quiet enjoyment of the condominium resident. Six months of disruption of our quiet enjoyment should entitle us to six months of quiet enjoyment. To amend the current code extending the time seasonal outdoor seating is allowed would be unjust to any condominium owner in a mixed use building that had purchased their unit based on the existing codes. I did my diligence before purchasing at 11 River Street and the codes allowing seasonal outdoor seating were very clear. If the Village Trustees believe there is a real need to extend the time period allowing seasonal outdoor seating within a mixed use buildings then any such amendment to the code should apply ONLY to NEW construction. Amending the code for new construction at this time would at the very least allow our future Village neighbors to base their purchase decision armed with all of the facts. To change a code that impacts one's quality of life after the fact is unreasonable and unfair.
