The meeting was broadcast live, but was closed to the public due to the Covid-19 pandemic. Members of the Village Board participated by video. Present: Mayor Kenneth G. Wray Sam Gonzalez (By Video) John Leavy (By Video) Denise Scaglione (By Video) Sandra Spiro (By Video) Rachelle Gebler (By Video) Deputy Mayor Glenn Rosen bloom (By Video) Trustees Also Present: Anthony Giaccio, Village Administrator Clinton Smith, Village Attorney (By Video) David Smith, Planner (By Video) Sara DiGiacomo, Treasurer (By Video) George Latimer, County Executive (By Phone) At 7:00 p.m. Mayor Wray called the meeting to order and explained that the meeting was being done entirely by video. Members of the public were not able to attend the meeting in person due to the Covid-19 pandemic. There was a pledge to the flag and a moment of silence for the passing of Dr. Aida Cruz-Soto, Annette Camilleri, Charlotte Schienberg and Mark Minardi. County Executive COVID-19 Update: County Executive, George Latimer addressed by Board by phone to give a report on the COVID-19 pandemic - There have been 9,967 positive cases in Westchester with 42 cases being in Sleepy Hollow. 35,623 people in Westchester have been tested. 25 Westchester residents have passed away from the virus. - The County is increasing test sites and more testing is being done. The County Center will be set up as a temporary hospital. - Hospitalization has been down which is good. The County Center will be set ud as a temporary hospital - Bee Line Buses are running on a Saturday schedule with no charge. - Town's distribute Personal Protection Equipment (PPE) not the County. - The County's first responder policy assumes that all calls are COVID-19 calls. �- The State Health Department has set a new isolation release recommendation that the County has adopted as a policy. - County Parks are open for hiking and biking. - Economic Development has been studying the stimulus package to see how it will affect local businesses. - The County Help Line is still operating. - The County Board of Legislature is discussing extending the deadline for taxes to July 15 for hardship cases only. Trustee Leavy thanked the County for all the emergency equipment that they helped to provide. Mayor Wray thanked the County Executive for the update. Warrant: Motion was made by Trustee Scaglione, seconded by Trustee Gebler to approve warrant 20MAR31 in the amount of $947,383.73. Motion passed 7-0. Mayor's Announcements: Mayor Wray gave an update on the COVID-19 pandemic - The number of residents that have tested positive for COVID-19 is increasing. Mayor Wray encouraged residents to continue to practice social distancing to help minimize the number of new cases. - Village Hall is closed to the public, but residents can call 914-366-5100 for assistance. - Bulk pick-up has been suspended. - Alternate side of the street parking is suspended. - Playgrounds are closed, but parks are open for walk through only. - Village Board meetings will be conducted electronically, but will allow for public comments. Residents are also encouraged to make comments in writing. - A public hearing will be held on the Mayor's budget. The budget is available on the Village website. �Resolutions: Motion was made by Trustee Gonzalez, seconded by Trustee Gebler to approve an Inter-Municipal Agreement with Westchester County to support emergency communication services. Motion Passed 7-0. Motion was made by Trustee Gebler, seconded by Trustee Gonzalez to approve the 2018/2019 snow and ice agreement with New York State. Motion passed 7-0. Motion was made by Deputy Mayor Rosenbloom, seconded by Trustee Leavy to set a public hearing on April 14, 2020 to override the tax cap. Motion passed 7-0. Motion was made by Deputy Mayor Rosenbloom, seconded by Trustee Gebler to terminate a Village Employee. Motion passed 7-0. Motion was made by Trustee Gebler, seconded by Trustee Scaglione to approve a retainer agreement with the Fire Department Secretary. Motion passed 7-0. Motion was made by Trustee Scaglione, seconded by Trustee Gebler to accept a floating zone status request from the Sleepy Hollow Local Development Corporation for 193 Beekman Avenue and to refer the matter to the Sleepy Hollow Planning Board and Westchester County Planning Board and to set a public hearing on matter for April 21 2020. J , , — y c -dministrator �Meeting Date: 03/31/2020 Resolution #: 03/35/2020 Resolution of the Board of Trustees of the Village of Sleepy Hollow Authorizing Execution of an IMA between the Village of Sleepy Hollow and the County of Westchester for Emergency Communication Services WHEREAS, the Village Board is desirous of entering into an inter-municipal agreement with the Westchester County's Department of Emergency Services; and NOW# THEREFORE, BE IT RESOLVED that the Mayor is herein authorized to execute the attached IMA with the County of Westchester to support emergency communication services. Moved: Trustee Scaglione Seconded: Trustee Gebler Vote: Unanimous �Meeting Date: 03/31/2020 Resolution #: 03/36/2020 Resolution of the Board of Trustees of the Village of Sleepy Hollow Authorizing the 2018/2019 Snow and Ice Agreement WHEREAS, the Village of Sleepy Hollow has provided Snow and Ice control services on a continuous basis since 1997 for 9.1 lane miles of roadway located in the Village of Sleepy Hollow and owned by the State of New York; and WHEREAS, the Village Administrator is hereby authorized to execute the 2018/2019 indexed sum of the 2018-2019 Snow and Ice Agreement with the New York State total reimbursement to the Village estimated to be $18,675.02. NOW, THEREFORE, BE IT RESOLVED that the Village Board herein authorizes the Village Administrator to execute the attached 2018-2019 Snow and Ice Agreement and to take other such steps as are necessary to effectuate the intent of this resolution. Moved: Trustee Gebler Seconded: Trustee Gonzalez Vote: Unanimous �MEETING DATE: 3/31/2020 RESOLUTION #: 3/37/2020 RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF SLEEPY HOLLOW TO SET PUBLIC HEARING AUTHORIZING TAX CAP OVERRIDE BE IT RESOLVED that the Board of Trustees hereby schedules a public hearing to be held on Tuesday, April, 14th, 2020 at 7:00 p.m. or shortly thereafter, at Village Hall, to hear and consider comments from members of the public on the proposed Local Law authorizing a property tax levy in excess of the limit established in general Municipal Law §3-C. BE IT FURTHER RESOLVED, that the Village Clerk shall give due notice of this public hearing in accordance with the Village Code and the provisions of the Municipal Home Rule Law of the State of New York. Legislative Intent It is the intent of this local law to allow the Village of Sleepy Hollow to adopt a budget for the fiscal year commencing June 1, 2020 that requires a real property tax levy in excess of the "tax levy limit" as defined by General Municipal Law § 3-c. Section 2. Authority This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes a local government's governing body to override the tax levy limit for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of said governing body. Section 3. Tax Levy Limit Override The Board of Trustees of the Village of Sleepy Hollow, County of Westchester is hereby authorized to adopt a budget for the fiscal year commencing June 1sf, 2020 that requires a real property tax levy in excess of the tax levy limit otherwise prescribed in General Municipal Law §3-c. Section 4. Severability If a court determines that any clause, sentence, paragraph, subdivision, or part of this loca law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court's order or judgment shall not affect impair or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered. Section 5. Effective date This local law shall take effect immediately upon filing with the Secretary of State. Moved: Trustee Spiro {00701808.DOC.} Seconded: Trustee Gonzalez Vote: Unanimous �Meeting Date: 03/31/2020 Resolution #: 03/39/2020 Resolution of the Board of Trustees of the Village of Sleepy Hollow Authorizing Retainer Agreement Whereas, the Fire Chief has requested the Board of Trustees hire personnel to maintain and administer reports required by the State and other governing and/or regulatory entities; and Whereas, the Fire Chief has also requested assistance with processing invoices, purchasing of supplies, correspondence and maintaining the Fire Departments'website and red alert. Whereas, the Fire Chief has recommended Dana Tavano, for these Administrative tasks position. Now, Therefore, Be it Resolved, the Board of Trustees hereby authorizes the Mayor to enter into a consulting retainer with Dana Tavano to perform the aforementioned tasks; and Be it Further Resolved, that Dana Tavano be paid the sum of $500.00 per month pursuant to a retainer agreement to be drafted by Village Counsel effective upon mutual execution of the retainer; and Be it further resolved, that Dana Tavano shall be an independent consultant effective February 1, 2020. Whereas, Chief Mike Tavano of SHFD has recommended the Contractor and has represented that she is qualified to provide the aforementioned services to the Village. The Contractor shall not subcontract any part of its work or duties under this Agreement without written consent of the Village. 5. Compliance with the Law In executing their respective responsibilities under this Agreement, the Village and the Contractor shall comply with all applicable Federal, State and Local Laws, rules and regulations. 6.
