REGULAR SESSION
A regular meeting of the Sleepy Hollow Architectural Review Board was called to
order at 8:00 p.m. in the Village Hall, 28 Beekman Avenue, Sleepy Hollow, New York
10591.
PRESENT:

James Nazemetz, Chairman
Rosaria Piomelli
Elvira Aloia
Louis Falasca

ALSO PRESENT:

Janet Gandolfo, Village Attorney
James Margotta, Building Inspector

1. Beekman Realty Corp. - Sign Application
Frank Zambrano appeared on behalf of the owner of the premises which is now
called "Maria's." Mr. Zambrano explained to the Board that they took down the old sign
and repainted it with the new owner's name on it. There were no other changes. Mr.
Margotta explained that the sign was a two faced sign and it is back-lit. Mr. Margotta
explained that the sign code prohibits back-lit signs. A discussion followed as to whether
the board should allow 2 signs at the location. The sign is 4 x 6.
The Chairman opened the public hearing. There were no public comments and
the public hearing was closed.
Board member Piomelli questioned whether the sign could be lit from the side or
from overhead. Mr. Margotta stated that it would look better if it was back-lit. Member
Falasca stated that he had no objection to the sign being back-lit. Member Aloia
questioned the dimensions of the building but Mr. Zambrand could not provide that
information. The board members discussed various requirements of the code. Ms. Aloia •
stated that there were too many questions about the size and dimensions of the building
fc r the board to consider granting a variance to the owner. The Board directed the owner
to return with the dimensions of the building.

Mr. Falasca moved to table the application. Seconded by Chairman Nazemetz.
Motior carried unanimously.
2. .'" -f 'ess Horseman Entities application. The applicant did not appear.

�3. John Volpacchio application. The applicant did not appear.
4. Cad Development Corp. application.
Architect John Woodruff appeared for the applicant and explained that the
proposal was for a singe family home on Hunter Avenue. The architect explained the
details of the design.
The public hearing was opened and after no one appeared to speak on the
application the public hearing was closed.
The Board members held a discussion on the plans. Chairman Nazemetz felt the
design was too broken up. After further discussion the applicant agreed to eliminate the
top 2 coins in the center and add coins on the left front edge of the building. The
applicant also agreed to make the rest of the garage in brick and leave the siding behind
as vinyl. In addition, the applicant agreed to wrap the brick around the coin and apply
coins to northern corner. The applicant would also place shutters above the garage and
remove the lA circle.
The applicant will send Vi dozen elevations to the board. The board agreed to
permit the building inspector to issue a building permit. The applicant will make the
suggested changes on paper and resubmit to the board. Ms. Piomelli moved to approve
the application with the suggested changes. Seconded by Mr. Falasca. Motion carried
unanimously.
5. E. Lee Kennedy, 107 Harwood Avenue.
Mr. Kennedy explained that he is the architect/owner of the property. Mr.
Kennedy explained what he was trying to do with the property. He will be painting the
facade; cleaning and/or replacing the tile roof; do landscaping, etc. However, the only
issue before the board was the approval of the front porch enclosure. After discussion
and a public hearing Mr. Falasca moved to approve the application for the enclosure of
the front porch as submitted. Chairman Nazemetz seconded. Motion carried
unanimously.
The Board adjourned to Executive Session to discuss litigation involving 107
Devries Avenue, Sleepy Hollow, New York. No votes were taken during executive
session.
6. 107 Devries Avenue - continuation of fence application.
Attorney Dennis Fitzgerald appeared on behalf of the applicant. Mr. Fitzgerald
presented photos of plants the applicant would be willing to plant in front of the fence in
order to obscure the fence. He suggested mountain laurels. The public hearing was
opened. Mr. Chris Atkinson, the contract vendee, spoke to the board and stated that he

�liked the plants and would plant them in the spring if the board approved the fence. Mr.
Bateman, Bellwood Avenue, voiced his objection to the fence and stated the fence still
has a jagged top. Mr. Falasca suggested to Mr. Bateman that he do some planting on his
property to hide the fence. Mr. Bateman criticized the ARB for continuing with the
application when the applicant put the fence up prior to receiving a building permit.
Mr. Nazemetz made the following motion, seconded by Mr. Falasca: The
application for the fence "as-built" is approved with the condition that the applicant be
responsible for the planting of at least 5 plants (larger than 1 gallon size) at the earliest
possible planting time in the late winter/early spring. The plantings should cover the
fence.
The board unanimously approved the minutes from the October 28, 1998 meeting.
There being no further business the board adjourned.
