July 28, 1999

A regular meeting of the Sleepy Hollow Architectural Review Board
was held on Wednesday, July 28, 1999 at 8:00 P.M. in the Village Hall,

Chairman McCarthy called the meeting to order at 8:05 P.M.
1. Maria L. Graca. 139-143 New Broadway
Maria Graca presented her application for approval to build a unilock retaining
wall about 8 ft. high, 40 ft. long and 30 ft. return and a 42 in. high
galvanized high chain link fence.
Mr. McCarthy asks Ms. Graca to present the certified mailings. The
applicant did not have certified mailings with her.
Chairman McCarthy indicates that the Board has the plans from Ms. Graca's
engineer which shows where the wall is proposed and Mr. McCarthy asks if
the plans have been approved by the Village Engineer. Ms. Graca responds
that she has been to the Planning Board. The Architectural Board has
concerns about the aesthetics of the wall and how high it will be and asks
about the color of the wall. Ms. Graca indicates the wall will be beige and
presents the board pictures of the wall.
Mr. Falasca moved to open the meeting for public comments, seconded by
Mr. Barstow. Motion carried.
At this time a resident who's property abuts Ms. Graca's property asks
several questions regarding drainage considerations and the slope of
property.

The adjacent property owner does not feel an 8 ft. high wall will suffice and
understands a fence will be built on top of the wall but has concerns about
the drainage. She asks about the statute of limitations on building this
retaining wall and feels the project is taking too long.
Ms. Graca states she was advised to build a retaining wall which will provide
better accessibility to the building and emphasizes there is adequate
drainage.
Chairman McCarthy asks Ms. Graca that after she gets approval from the
Architectural Review Board and applies for a building permit how soon after
will she be prepared to build the wall.
Ms. Graca intents to build the wall as soon as possible, citing that the
building permit expires after one year.
Mr. McCarthy advises the neighboring property owner to inform the building
department if this becomes a dangerous hazard to her property and her
neighbors.
There was some discussion about the soil that has not been removed.
Mario DeFelice, Board of Trustees informs the Board a note, "to stop all
work" was left at the site of applicant's property.
Ms. Graca indicates to Mr. McCarthy that she has a contractor for this
project.
There is some discussion on the height of the wall. Mr. McCarthy indicates
that according to the drawings the wall will be higher than 8 ft. The
topograhy map shows an 80.6 elevation at the southern most point and at
the top of wall will be 89.5.
There was still concern from the public regarding drainage and the time span
for this project. Mr. McCarthy also indicates concern with the danger of an
unsafe site.
There was some discussion on the discrepancy with the height of the wall
between 7 ft. maximum and 8.6 ft. The public expressed their approval of
an 8 ft. wall.
Attorney Lammers indicates the Architectural Review Board determines

the aesthetics of the property and suggests any decision made by the
Architectural Board would be subject to a decision by the Mayor and Board
of Trustees. The drainage concerns will be addressed with the Village
Engineer.
The applicant indicates that at this time she does not have a building permit
which is a concern to the public.
After comment from the public regarding the absence of the certified
mailings by the applicant, Attorney Lammers indicates any decision by the
Architectural Review Board will rest on the submission of the proper certified
mailings by the applicant. If proper mailings were not sent, the Board will
not authorize the Building Inspector to issue a building permit
There being no further public comments, Mr. Falasca moves to close the
meeting to public comments, seconded by Mrs. Fiina. Motion carried.
Motion by Mr. Falasca to adjourn until Ms. Graca returns with certified
mailings, seconded by Ms. Fina. Motion carried.

2. Julio Zhingri. 290 N. Washington St.
Application for the construction of a 5 ft. high stockade type fence.
Chairman McCarthy asks applicant for certified mailings. Mr. Zhingri did not
send certified mailings.
There is some discussion by the Board and the applicant on the proper
procedure for certified mailings.
Motion by Mr. Falasca to table this application until the September meeting,
seconded by Mr. Barstow. Motion carried.

3. Harold &amp; Jane Tucker. 260 Millard Avenue
Application for an addition.
Mailings presented to Mr. Lammers.
Mr. Tucker presented application for approval to raise and construct a new
roof with dormers on front and back to accomodate more space, new siding

throughout, new windows and shutters with window boxes and move
existing side entrance.
Mr. Tucker presents drawings to Board with some discussion.
Mr. Falasca moved to open meeting to the public, seconded by Ms. Fina.
Motion carried.
There being no comments from the public, Mr. McCarthy moved to close
meeting to the public, seconded by Mr. Barstow. Motion carried.
Some discussion by the Board and the contractor Barry Newman regarding
the 24" from the ridge line of the cupola and the submission of new plans to
scale.
Mr. Falasca motions for approval to build the house as submitted with the
exception of the cupola and to return and submit a new plan to scale of the
portion of the house with the cupola. Motion seconded by Ms. Fina. Motion
carried.
4. Anthony &amp; Kimberly Zuzzolo. 6 Fremont Road. Sleepy Hollow Manor
(continued)
Application for the construction of a new module house.
Mr. McCarthy reports that the application is a continuation of last month's
meeting. The applicant had to return with some details on the porch,
windows, and garage doors.
Mr. Zuzzolo indicates that the house will be white and the shutters black.
The windows will be trimmed with 4 in. trim board on the bottom and sides,
6 in. on top with solid crown molding. Mr. Zuzzolo will return the ends of
the crown. Garage doors will be changed to the side of house with two
windows in front. The front windows will be revised with a picture window
without shutters. Applicant has submitted details on the portico. The front
door will be standard size. Looking at the plans the Board has some
discussion regarding the front door trim. Mr. Zuzzolo indicates to Mr.
McCarthy that these are all the revisions.
Mr. Falasca motions to open meeting for public comments, seconded by Ms.
Fina. Motion carried.

There being no public comments, Mr. Falasca moves to close meeting to
public comments, seconded by Ms. Fina. Motion carried.
Ms. Fina makes a recommendation that the second story window should
have some sort of decoration. Mr. Zuzzolo responds that he did not like the
appearance of a vent and has contemplated different sizes and shapes. To
the homeowners personal opinion it did not fit. Mr. Zuzzolo did not like the
prefabricated sunburst but possibily would make one from the siding. Many
of these sunbursts are smooth grain but with wood siding will stand out.
The grain on the siding and the grain on the prefabricated sunburst is a
noticeable difference. The picture window will be one piece and arched. Mr.
Falasca wants a scale of the windows.
Mr. McCarthy motions to approve the resubmission of 6 Fremont Road
including a revised entrance portico subject to a revised front portico
window. Seconded by Mr. Falasca. Motion carried.

5 Shippy Realty (Miguel Jiminez). 196 Cortlandt St. (continued)
Mr. Jiminez, at a previous meeting, presented an application to renovate
building by removing existing clapboard (vinyl) siding and stucco walls with
new shutters, lights and awnings, (drawing prepared by Turuquist
Architects, 95 Beekman Ave., Sleepy Hollow).
Mr. Jiminez states that at the previous meeting the Board is concerned about
what is under the siding and the windows. (At this point Mr. Jiminez shows
the Board some photos of the building) The applicant's intention is to take
the siding off and stucco the building and add shutters. The colors would be
light green stucco with dark green on the corners of the building.
Ms. Fina has concern about the contrast of the green stucco of the building
and the trim and asks about the surrounding buildings. Mr. Jiminez says that
several surrrounding buildings are stucco.
Mr. McCarthy asks Mr. Jiminez if he investigated what was the building's
original siding. The Board feels the building was originally shingle and did not
want another stucco building. Mr. McCarthy wants the character of the
building restored as part of the waterfront redevelopment. Mr. Jiminez
states that in the past the building has never been repaired.

�Mr. Falasca asks about the two different fire escapes and Mr. McCarthy did
not want the cornice to be covered up like the Castle Restaurant.
Mr. McCarthy referred, in part, to the Revitalized Plan; "When rehabiliting
commerical buildings the integity of the original design should be respected
and whenever possible the original materials should be used".
Ms. Fina asks Mr. Jiminez what is the differential between stucco and
clapboard in which Mr. Jiminez indicates a 75% increase. The applicant
would take off the old stucco and add new stucco on the building. Architect
Ron Turuquist indicates that this building could not be built today because of
the type of construction. The applicant is ready to go with the energy
efficient insulation and the stucco.
Mr. Jiminez adds that the building has renovated hallways, fire proof sheet
rock and has the sprinkler system set up.
Ms. Fina moves to open the meeting for public comments, seconded by Mr.
Falasca. Motion carried.
Mr. McCarthy asks what color would be used for the building. Ms. Fina
comments that the color is important and does not want every building in
town to look the same. The architect indicates there isn't much that can be
done with the building besides stucco or aluminum/vinyl siding. Mr. Jiminez
can not afford cedar shakes. Ms. Fina again expresses her concern with the
color green and at this point Mr. Jiminez says another color would be
agreeable to him.
Mr. Falasca moves to close the meeting to public comments, seconded by
Ms. Fina. Motion carried.
Mr. Falasca asks about the present condition of the stucco. Mr. Jiminez
indicates that the stucco is too heavy, cracked and very dirty. The Board
feels in several years the replaced stucco will crack and get dirty because of
the building's busy location. Mr. Falasca feels that because the applicant
will use synthetic stucco it will not withstand the abuse. Mr. Jiminez states
the base is a mix of glue and cement which will make it more durable. The
windows will not be replaced this year, only painted.
Mr. Barstow asks Mr. Jiminez what he will do with the detail on the top of
the building. Mr. Jiminez responds that he will paint it. The Board has some
discussion on the original material underneath the aluminum siding and
requests that it be researched. Mr. Barstow likes the original photo but

because of code concerns does not think it is practical. He agrees with the
stucco but not the color green and has concern regarding the details on the
top of the building.
Mr. Falasca will not vote for a green building. Ms. Fina will favor a stucco
building but not the color green. She prefers colonial colors in keeping with
the historical theme of the town.
The Board is told by the architect that Mr. Jiminez must finish the stucco
work and negotiate the awnings and spend the money for the awnings by
September 14th.
Mr. Falasco feels the building should be white with a blue, maroon or green
trim. Ms. Fina feels white will be hard to keep clean.
Mr. Barstow indicates that half of the lineation of the sketch is not spelled
out. The Board asks several questions about signage on the awnings.
At the previous meeting the Board requested Mr. Jiminez to return with
photos showing the condition of the material underneath the aluminum. Mr.
McCarthy feels the aluminum siding should be removed to investigate the
material underneath. Replacing the structure with colonial vinyl siding or
original cedar siding will cost less or as much as stucco. Using these
materials will restore the village back to its historical character. At this point
a lengthy discussion incurred between the applicant and the Board regarding
the multi colors used in the village and the hispanic heritage now living in
Sleepy Hollow.
Ms. Fina makes a motion to approve this application with the following
notations, seconded by Mr. Falasca. Motion carried.

Mr. McCarthy moved to reopen the meeting, seconded by Mr. Falasca.

Ms. Fina indicates wall will be unilock pizza two, 8 feet high. The color will
be greyish.
Ms. Fina motions for approval, seconded by Mr. Falasca. Motion carried.
6. Rodrigues Enterprises, 76 Chestnut St. (cont.)
Continued application for construction of new multiple dwelling.
Applicant presents Board with photos of 76 Chestnut St. Mr. McCarthy
indicates several years ago applicant received approval for retaining wall
which has been done and now applicant needs approval for building. The
original application was for a gable roof but applicant now seeks approval for
a flat roof.
Turuquist Architects, 95, Beekman Avenue, Sleepy Hollow presents to the
Board details of the application. The building was originally commercial but
has been changed. Will be 1 2 units with entrances on each end of the
stairwells with an entrance to the lower level. Floor plans for each floor have
been prepared. Garage will be in front. The windows are white vinyl, double
hung windows. Construction is concrete block with stucco finish, columns
for detail and globe lighting. An extra story will be added. The adjacent
building will be demolished for a parking lot.There was some discussion with
