Approving Temporary Agency Employee for Finance Department
WHEREAS, the Village Treasurer, Sara DiGiacomo has recommended hiring a
temporary agency employee to assist in the Finance Department due to recent
resignations, and
WHEARAS, resolution#10/137/2021, of 10/12/2021, approving Temp Solutions
Agency is rescinded.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Board of Trustees of the
Village of Sleepy Hollow hereby approve Treasurer DiGiacomo's request for a temporary
agency employee from Robert Half - Talent Solutions Agency at an hourly rate up to
$31.00 effective October 18, 2021 until such position is filled.

Resolution of the Board of Trustees of the Village of Sleepy Hollow
Approving the
Garage Entrance and Exit for Building H of Edge on Hudson

WHEREAS, the Village of Sleepy Hollow ("Village") is a municipal corporation with offices at
28 Beekman Avenue, Sleepy Hollow, New York; and
WHEREAS, the Village Planning Board has approved a Site Plan for Building H at the Edge on
Hudson project which shows a garage entrance and exit on to Westward Dive ("Westward Garage
Entrance"); and
WHEREAS, The Village Planning Board is considering an application for an amended Site Plan
for Building H which shows the Westward Garage Entrance; and
WHEREAS, both of the Environmental Assessment Narrative submitted on behalf of General
Motors LLC on or about December 14,2010, and the Resolution on Environmental Determination
and Findings Revised Riverfront Development Concept Plan Pursuant to Section 62-5.1 of the
Sleepy Hollow Code for the Lighthouse Landing Riverfront Development adopted by the Village
Board of Trustees on January 6,2011, state that "Building H has been reconfigured to remove
the driveway opposite the Village Green;'" and
WHEREAS, the Village Board of Trustees has reviewed and considered the matter and would like to
darify any confusion relatedtothe quoted statement;
NOW THEREFORE BE IT RESOLVED, that the "driveway" removed by the Environmental
Assessment Narrative and the 2011 Findings was a street level connection to what is now
Westward Drive, and the garage entrance and exit shown on the current Site Plan slopes
downwardtoWestward Drive. The garage entrance and exit is not precluded by the removal of
the driveway; and
BE IT FURTHER RESOLVED, that because of concerns with headlights of vehicles leaving the
garage, however, the Applicant has agreed to provide a planting mitigation program acceptable to
the Village's Department of Architecture, Land Use Development Buildings and Building Compliance;
and
BE IT FURTHER RESOLVED, that pursuanttoVillage Code Sec. 45G-15.G, thisrevisiondoes not
require any further consideration, environmental analysis, or further project review and/or public
hearing."

RESOLUTION APPROVING SETTLEMENT OF ACTION
FOR PROPERTY LOCATED AT
175 VALLEY STREET AND 76 CHESTNUT STREET, SLEEPY HOLLOW, NY
WHEREAS, proceedings were commenced In New York State Supreme Court,
Westchester County, to challenge the tax assessments for property located at
175 Valley Street and 76 Chestnut Street, by owner George Samaras d/b/a 175 Valley
Street, LLC and 76 Chestnut Street, LLC; and
WHEREAS, the Village and the property owner's attorney have reached a mutually
agreeable resolution for the aforementioned pending proceedings filed under Index
Nos. 9811/11, 56717/12, 56794/13, 56917/14, 57368/15, 55670/16, 56358/17,
56247/18, and 56634/19; and
WHEREAS, it has been recommended to the Board of Trustees by its Assessor and
Attorney to resolve this litigation;
NOW, THEREFORE, BE IT RESOLVED the Board of Trustees authorizes the Village
Attorney to execute a Consent Judgment in substantially the form as attached to these
Resolutions settling the claims in all respects with assessed values for the 2011, 2012,
2013, 2014, 2015, 2016, 2017, 2018, and 2019 tax years as set forth in the "Assessed
Value Reduced To" column on the schedule at the end of these Resolutions; and be it
further
RESOLVED, that refunds for the 2011, 2012, 2013, 2014, 2015, 2016, 2017, 2018, and
2019 tax years are authorized in the amounts set forth in the "Anticipated Refund"
column on the schedule at the end of these Resolutions, subject to adjustment by an
increase of not more than 5% or a reduction in any amount upon final calculation after
entry of a Consent Judgment implementing the settlement;

custody of the assessment rolls upon which the above-mentioned assessments and any taxes
levied thereon are entered shall correct the said entries in conformity with this order, and shall
note upon the margin of said rolls, opposite of said entries, that the same have been corrected
by the authority of this order, and it is further
ORDERED AND DIRECTED that there shall be audited and paid by the
VILLAGE OF SLEEPY HOLLOW, respectively, to the Petitioners, the amounts, if any, paid
by the said Petitioners, their representatives or agents as Village taxes against the said
erroneous assessments in excess of what the Village taxes should have been if the said
assessments had been as herein ordered and determined with interest, except in the event that
the refund of taxes is paid within 60 days of service of a certified copy of this Court Order with
Notice of Entry, then interest is waived, and it is further

�ORDERED AND DIRECTED that all tax refunds hereinabove directed to be
made by Respondent, VILLAGE OF SLEEPY HOLLOW, and/or any of the various taxing
authorities, be made by check or draft payable to the order of JOSEPH E. ST. ONGE, ESQ.,
as attorney and agent for the Petitioners, who is to hold the proceeds as trust funds for
appropriate distribution, and who is to remain subject to the further jurisdiction of this Court
in regard to his attorney's lien, pursuant to Judiciary Law Section 475, and it is further
ORDERED, that this Order hereby constitutes and represents full settlement
of the tax review proceedings herein, and there are no costs or disbursements awarded to, by
or against any of the parties, and that upon compliance with the terms of this Order, the aboveentitled proceedings be and the same are settled and discontinued.
