RESOLUTION:

SITE PLAN APPROVAL

WHEREAS, the Planning Board of the Village of Sleepy Hollow (the Planning Board) has reviewed
an application for site plan approval (the Application) pursuant to the Village Zoning Ordinance, Article X,
Site Plan review, and to applicable laws and regulations considered pertinent to the Application, which is
for the construction of an approximately 2,917± s.f. two-family residence and related stormwater
management improvements (the "Proposed Project"), submitted on behalf of Eugeno Thercaj (the
"Applicant" or the "Owner") and located at 14 Clinton Street (the Subject Site); and
WHEREAS, the Planning Board has reviewed the following materials:
1.

Site Plan application, 2/21/21 signed by the Applicant;

2.

Site plan set for the Subject Site, undated but submitted on or about 3/12/21, last revised
11/8/21 signed by Yahaira M. Voquez Colombo; and, engineering plans prepared by
Dominick Pilla Architecture - Engineering, P.C., P.E., P.C dated last revised 1/4/22;

3.

Short Environmental Assessment Form, dated 2/24/21signed by the Applicant;

4.

Stormwater Management Plan dated 9/10/21 prepared by DRPilla Consulting Engineers.

5.

Property Survey prepared by Big Apple Land Surveying signed by Vincent Teutonico, LLS,
dated 8/30/21;

6.

Sprinkler Plan, stamped by William R. McShane, P.E. of Joselow &amp; Associates;

7.

Building renderings (five), prepared by Yahaira M. Voquez Colombo, undated but
submitted on or about 7/11/21, 9/27/21 and 10/10/21;

8.

Correspondence dated 10/19/21 from DR Pilla Consulting Engineers responding to
comments from the Village Engineer;

9.

Correspondence with review comments dated 3/16/21 from Planning &amp; Development
Advisors Village planning consultant;

10.

Review memoranda from Dolph Rotfeld Engineering an Al Engineers Company the
Village's consulting engineer, dated 3/15/21, 7/16/21, 9/28/21,12/10/21 and 1/17/22.

�WHEREAS, the Planning Board discussed the Application at its 3/14/21, 4/22/21, 7/22/21, and
9/23/21 regularly scheduled meetings and a public hearing was held on 10/21/21 in which all members
of the public were invited to be heard and said public hearing was closed on 1/20/22; and
WHEREAS, as part of the site plan review process, the Applicant did appear before the Village of
Sleepy Hollow Zoning Board of Appeals (ZBA) and a public hearing was held on 12/15/21 on proposed
variances from the Village of Sleepy Hollow Zoning Code related to minimum required lot area, minimum
required lot width, minimum required one-side yard setback, and minimum required combined side yard
setbacks;
WHEREAS, in the course of its review and pursuant to Part 617 of the Implementing Regulations
pertaining to Article 8 of the Environmental Conservation Law, the Planning Board has made the following
findings and caused, noted or conducted the following activities:

Received an application fee;
Requested, received and considered comments from the Village Attorney, Village
Engineer, Village Planner and Building Inspector about the proposed project;

Requested, received and reviewed a Short Environmental Assessment Form;
Held a duly noticed public hearing; and
Considered the factors set forth in Village Code Sec. 450-67.A.

NOW, THEREFORE, BE IT RESOLVED, that Planning Board, after review of the materials submitted,
public comments and recommendations and the EAF has determined that the proposed action is a Type
II Action and makes a determination of non-significance of environmental impact; and, be it further
RESOLVED, that the Planning Board has reviewed the plans and specimen building materials, the
uniformity, dissimilarity, inappropriateness, and quality of design and approves the architectural design
of the Proposed Project; and, be it further
RESOLVED, that the said Application for site plan approval relative to construction of a two-family
home and other related improvements as shown on the site plan dated last revisedll/8/21 and 1/4/22
and as may be subsequently revised, is hereby granted approval and the Applicant may obtain the
endorsed approval of the Planning Board Chair on a copy of the resolution and upon the site plan
drawings, as and when revised as necessary to show compliance with the following conditions, which
endorsement shall permit filing in the Sleepy Hollow Department of Architecture, Land Development,
Buildings &amp; Building Compliance (the Building Department) for purposes of obtaining a building permit in
accordance with this resolution and all building code requirements, provided however, that this approval
shall expire one (1) year after the date of this resolution if the following modifications and conditions have
not been completed to the satisfaction of the Planning Board and the Village Building Department, and,
the Applicant has not obtained the required building permit or permits for construction in accordance
with the approved plan(s):

The Applicant shall pay the Village of Sleepy Hollow all application and review fees as
required by the Village Code prior to a building permit being issued;
Documentation, sufficient in form and substance for the Village Engineer that the list of
items outlined in the Village Engineers 1/17/22 correspondence have been incorporated
onto the Site Plan drawings;

As required of other applicants in the Village of Sleepy Hollow, a landscape maintenance
bond shall be posted to remain in effect for two years to ensure landscape plantings are
established and maintained in a healthy and vigorous growing condition. The extent of
the bonds to be determined by the Village Building Inspector and Village Administrator
in consultation with the Applicant and in a form satisfactory to the Village Attorney;

Prior to the issuance of a Certificate of Occupancy, an as built survey shall be provided to
the Village Building Department, any material change to the site plan from that approved
by the Planning Board will require the Applicant to present the revised plan to the
Planning Board for a site plan amendment.
