WHEREAS, the Hudson Valley Writers Center (the "Applicant") had previously been granted
subdivision approval on 2/16/95 for an approximately 0.1458 parcel associated with the former Philipse
Manor Train Station now home to the Hudson Valley Writers Center from the Planning Board of the Village
of Sleepy Hollow (the "Planning Board"); and
WHEREAS, the original subdivision approval was not filed properly with the Westchester County
Clerk's office and the approval has subsequently lapsed; and
WHEREAS, the Planning Board has reviewed the following materials:
1.

Cover letter from Kristin Pelatti on behalf of the Applicant dated 12/2/20;

2.

Planning Board Application dated 11/24/20 signed by Donald Stever, Chairman of the
Board of Directors of the Hudson Valley Writers Center, Inc.

3.

Property Survey prepared by Ward Carpenter Engineers Inc dated 8/20/20;

4.

Short Environmental Assessment Form, dated 11/24/20 signed by Donald Stever;

5.

Coastal Assessment Form, undated and unsigned;

6.

Review memo from Planning &amp; Development Advisors dated 12/14/20;

7.

Correspondence from Kristin Pelatti submitted on behalf of the Applicant dated 12/16/20
and 1/20/21; and

8.

Subdivision Plat completed prepared by Ward Carpenter Engineers, Inc dated 1/6/21.

WHEREAS, the Applicant as required by Section 425-7.C(l) has officially submitted the Final
Subdivision Plat at the Planning Board's 1/21/21 regular meeting; and
WHEREAS, the Applicant described as part of their 12/16/20 correspondence and at the
12/17/20 regularly scheduled Planning Board meeting that the Final Subdivision Plat had very minor
adjustments compared to the Preliminary Subdivision Plat; and
WHEREAS, in the course of its review and acting as Lead Agency pursuant to Part 617 of the
Implementing Regulations pertaining to Article 8 of the Environmental Conservation Law, the Planning
Board has made the following findings and caused, noted or conducted the following activities:

Received an application fee;
Requested, received and considered comments from the Village Engineer, Village Planner
and Building Inspector about the proposed project;

3.

Requested, received and reviewed a Short Environmental Assessment Form.

NOW, THEREFORE, BE IT RESOLVED, that Planning Board, after review of the materials submitted,
public comments and recommendations and the EAF has determined that the proposed action is a Type
II Action and makes a determination of non-significance of environmental impact; and be it further
RESOLVED, that the said Application for a final subdivision as shown on the Subdivision Plat
prepared for the Hudson Valley Writers Center dated 1/6/21 is hereby granted approval and the Applicant
may obtain the endorsed approval of the Planning Board Chairperson on a copy of the resolution and the
appropriate subdivision plan, which endorsement shall permit the filing of the Final Plat, provided
however, that this approval shall expire one (1) year after the date of this resolution if the following
modifications and conditions have not been completed to the satisfaction of the Planning Board and the
Village Building Department, in accordance with the approved plan(s):

for an easement for pedestrian circulation over the northerly portion of the lot identified
as "Macadam Pavement" on the Final Plat. A note shall be included on the Final Plat
which states that if such easement is not in place within two years, then the Applicant
will declare that portion of the Macadam Pavement running from the head of the
stairway to the opposite border with that parcel identified as "Riverside Drive" on the
Final Plat as an easement for the benefit of the public for so long as the area at the base
of the stairs is fit for mass transportation of the public..
