WHEREAS, the Planning Board of the Village of Sleepy Hollow (the Planning Board) has reviewed
an application for site plan approval (the Application) pursuant to the Village Zoning Ordinance, Article X,
Site Plan review, and to applicable laws and regulations considered pertinent to the Application, which is
for the construction of one five unit townhouse building and one four unit townhouse building, related
stormwater management improvements and utility improvements serving the site (the Proposed Project),
submitted on behalf of Frank Cenquiera (the Applicant); and
WHEREAS, by way of background, an Application for site plan approval was initially submitted to
the Planning Board in 2016 which included a total of 12 townhouse units but with a different applicant.
The Application was subsequently revised but due to inactivity in the application process and lack of
response to specific Planning Board comments and Requests for additional information the Application
was terminated by the Planning Board; and
WHEREAS, as noted above the Applicant has prepared updated plans and responded to principal
comments raised; and
WHEREAS, the Planning Board has reviewed the following materials:

WHEREAS, the proposal was discussed by the Planning Board at public meetings on 5/21/20, and
6/18/20 at which time the Planning Board scheduled a public hearing; and
WHEREAS, the Planning Board held a public hearing on 7/16/20 in which all members of the
public were invited to be heard and said public hearing was carried over and subsequently closed on
11/19/20; and
WHEREAS, during the course of the site plan review process, various members of the Planning
Board visited the site to acquaint themselves with the site; and
WHEREAS, in the course of its review and pursuant to Part 617 of the Implementing Regulations
pertaining to Article 8 of the Environmental Conservation Law, the Planning Board has made the following
findings and caused, noted or conducted the following activities:

�1. Received an application fee;
2. Requested, received and considered comments from the Village Engineer, Village Planner
and Building Inspector about the proposed project;
3. Requested, received and reviewed a Short Environmental Assessment Form;
4. Held a duly noticed public hearing; and
5. Considered the factors set forth in Village Code Sec. 450-67.A.
NOW, THEREFORE, BE IT RESOLVED, that Planning Board, after review of the materials submitted,
public comments and recommendations and the EAF including parts 2 and 3, has determined that the
proposed action is an Unlisted Action and has been determined not to have a significant impact on the
environment or is otherwise precluded from environmental review under Article 8 of the Environmental
Conservation Law; and, be it further
RESOLVED, that the Applicant shall continue to work with the Village Architect to refine the final
architecture with the following goals: incorporating existing neighborhood precedent house designs;
lower the overall roofline; emphasize the individuality of the townhouse units with vertical breaks; and
use of a variety of fa?ade materials and colors; and, be it further
RESOLVED, that prior to the issuance of a foundation permit from the Building Department, the
Applicant shall submit to the Planning Board final architectural plans for review and approval; and, be it
further
RESOLVED, that the said Application for site plan approval relative to construction of one five unit
townhouse building and one four unit townhouse building and other related improvements as shown.on
the site plan dated last revised 6/30/20 and as may be subsequently revised with the approval of the
Village Architect, is hereby granted approval and the Applicant may obtain the endorsed approval of the
Planning Board Chair on a copy of this resolution and upon the site plan drawings, as and when revised as
necessary to show compliance with the following conditions, which endorsement shall permit filing in the
Sleepy Hollow Department of Architecture, Land Development, Buildings &amp; Building Compliance (the
Building Department) for purposes of obtaining a building permit in accordance with this resolution and
all building code requirements, provided however, that this approval shall expire one (1) year after the
date of this resolution if the following modifications and conditions have not been completed to the
satisfaction of the Planning Board and the Village Building Department, and, the Applicant has not
obtained the required building permit or permits for construction in accordance with the approved
plan(s):
1. The Applicant shall pay the Village of Sleepy Hollow all application and review fees as
required by the Village Code prior to a building permit being issued;
2. The last revised dates on all site plan drawings shall be updated, provided there are no
changes to the drawings, prior to the issuance of a building permit;
3. Documentation, sufficient in form and substance for the Village Engineer that the list of
items outlined in the Village Engineer's 10/21/20 correspondence have been
incorporated onto the Site Plan drawings or otherwise addressed;
4. Documentation, sufficient in form and substance for the Village Architect that the list of
items outlined in the Village Architect's 9/15/20 correspondence have been incorporated
onto the Site Plan drawings or otherwise addressed;

�5. Documentation, sufficient in form and substance to the Village Attorney, for the
establishment of an easement between the subject site and the adjacent Village of Sleepy
Hollow parking lot.
6. Prior to issuance of a Building Permit, the Applicant must provide to the Building
Department an "Approval of Plans for a Water Main Extension" and an "Approval of Plans
for a Sanitary Sewer Main Extension" from Westchester County Department of Health
with respect to the proposed water and sanitary sewer mains shown on the site plan.
7. Prior to the issuance of a building permit the Applicant shall submit, sufficient in form
and substance to the Village Attorney, proposed homeowner association language.
8. Prior to the issuance of a building permit that Applicant shall pay the required Recreation
Fund fee in accordance with Chapter 200-5 of the Village Code.
9. Prior to the issuance of a Certificate of Occupancy, an as built survey shall be provided to
the Village Building Department, and any material change to the site plan from that
approved by the Planning Board will require the Applicant to present the revised plan to
the Planning Board for a site plan amendment.
